I The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the second Tuesday and the first regu1armeeting of the month. Members Present: Chairman R. Wayne Compton, Supervisors May W. Johnson, Edward C. Park, Jr., and Lawrence E. Terry. Absent: Vice-Chairman Robert E. Myers. Chairman Compton called the meeting to order at 7:30 p.m. and recognized Reverend Robert T. Copenhaver, St. Paul IS Episcopal Church of Salem, who offered this invocation. The Pledge of Allegiance to the flag was given in unison. IN RE: APPROVAL OF MINUTES On motion of Supervisor Johnson and the unanimous voice vote of the members present, the minutes of the adjourned meeting of January 9, 1978, regular meeting of January 10, 1978, special meeting of January 16, 1978, and the regular meeting of January 24, 1978, were this date approved as submitted. I IN RE: RENEWAL APPLICATION OF STEVE A. BOYD FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 2.25-ACRE TRACT LOCATED 300 YARDS WEST OF STATE ROUTE 845 (INDAIN GRAVE ROAD), SOUTH OF STATE ROUTE 676 IN THE BACK CREEK SECTION Supervisor Johnson moved that the renewal application of Steve A. Boyd be approved beginning November 15, 1977, subject to the provisions of the County Zonin Ordinance as it pertains to mobile homes, which motion was adopted by the unanimous voice vote of the members present. Mr. Boyd was present at the hearing. There was no opposition. IN RE: RENEWAL APPLICATION OF BUDDY R. CALDWELL FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 6-ACRE TRACT LOCATED ON THE WEST SIDE OF STATE ROUTE 624 (NEWPORT ROAD), 1.5 MILES SOUTH OF ITS INTERSECTION WITH ROUTE 311; SAID MOBILE HOME TO BE OCCUPIED BY JAMES L. AND ELLA M. CALDWELL Supervisor Park moved that the renewal application of Buddy R. Caldwell be approved beginning August 12, 1977, subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted by the unanimous voice vote of the members present. No one spoke in opposition to the request. I IN RE: APPLICATION OF DENNIS ODELL DREWERY FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 3-ACRE TRACT LOCATED ON THE EAST SIDE OF HUFF STREET OFF STATE ROUTE 618 (HIGHLAND ROAD) Supervisor Park moved that the application of Dennis Odell Drewery be approved subject to the provisions of the County Zoning Ordinance as it pertains tc mobile homes, which motion was adopted by the unanimous voice vote of the members present. FOR A * "USE NOT PROVIDED FOR" PERMIT UNDER SECTION 2]-7 OF THE", ROANOKE COUNTY CODE TO HOLD A COUNTRY/BLUE GRASS COMPE-* TITION FOR THE WEEKEND OF MAY 19, 20, AND 21, ]978, ON * PROPERTY OWNED BY PAUL D. HOLLYFIELD SITUATE IN THE * WINDSOR HILLS DISTRICT AND LOCATED ON BENT MOUNTAIN ON * THE WEST SIDE OF ROUTE 22] AND ON THE EAST SIDE OF * STATE ROUTE 889 JOINING BOTH ROADS AND CONTAINING * APPROXIMATELY ]30.71 ACRES * FINAL ORDER The above use permit is subject to the following terms and conditions con- sented to be petitioners: (a) The "Use Not Provided For" granted herein shall remain in force and effect for one, three-day weekend event to be conducted between May ]9, 1978, and May 21, ]978. (b) On the weekend of the event, the hours of operation wi]] be from 6:00 p.m. to ]2:00 Midnight on Friday, ]2:00 Noon to 12:00 Midnight on Saturday and from ]2:00 Noon to 6:00 p.m. on Sunday. (c) That police protection for the events be provided for at the expense of the petitioners by following the recommendations of and in close cooperation with the Sheirff of Roanoke County. (d) Petitioners wi]] provide one (]) privy for each ]00 persons present at the events, one sewage dump station to serve campers (trai ]ers), adequate dumpster and trash containers to contain trash pending removal and an approved water supply. (e) The property sha]] be used in accordance with the plat submitted by the peti- tioner. (f) A woven wire fence at least 54 inches in height with at least two strands of barbed wire wi]] surround the spectator area and four gates shall be installed for the entrance. (g) A sign shall be posted at each entrance gate depicting restrictions specified by the Sheriff of Roanoke County. (h) Additional lighting wi]] be added to the spectator area to insure that the grounds are sufficiently lighted. (i) White signs with black lettering shall be permanently displayed on the rest- rooms to enable spectators to know where they are located and permanent inside ] ighting shall be instal led in the said restrooms. In relation to the request of Bent Mountain Amusement Park, Inc., Mr. Paul Ho] ]yfie]d appeared on behalf of the petitioners. At this point, Chairman Compton opened the floor for public comments. No one appeared in opposition. Sheriff O. S. Foster was present at the hearing and requested the Supervisors to incorporate certain recommendations which he submitted to the Board to insure greater crowd control; the Sheriff's recommendations are incorporated in the Fina] Order. Sheriff Foster also expressed concern over the dust on the road to the site. Mr. Ho]]yfie]d advised that he has already been in contact with the Highway Department and they have agreed to put down fresh gravel on the road to help insure dust contro]. Mr. Ho]lyfie]d also stated that he has changed campground regulations requiring those attending the festival to be clothed at a]] times. At the Board's request, Mr. Hol]yfie]d further advised that he wi]l I I 2- ]Li-78 ? '7 ~) I have all site improvements ready a week before the festival is held to allow Sherif Foster to inspect them. He also invited the Sheriff to attend the meeting with representatives of the Highway Department concerning dust control. There being no further comments, this concluded the public hearing and Supervisor Terry moved that the "Use Not Provided For" permit be approved subject to the conditions enumerated above (a thru i) and contained within the Final Order with the stipulation that Mr. Hollyfield concurs with and abides by any and all recommendations of the County Sheriff. The motion was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Park, Mr. Terry, Mr. Compton NAYS: None ABSENT: Mr. Myers IN RE: RAFFLE PERMIT - NORTHSIDE RECREATION CLUB, INC. Mr. Charlie H. Wiseman, Jr., Present of Northside Recreation Club, Inc., wa present at the meeting. There being no opposition, Supervisor Johnson moved that the application of Northside Recreation Club, Inc. for a raffle permit be approved effective this date for a period of one year. The motion was adopted by the unani- mous voice vote of the members present. IN RE: "REGIONAL-URBAN DESIGN ASSISTANCE TEAM" (R/UDAT) I Mr. John P. Cone, Jr., President, Citizens's Environmental Council, and Mr. Curtis R. Jennings, Jr., President, Blue Ridge Chapter of the American Institut of Architects, appeared before the Board and requested the County's approval and contribution toward a new valley-wide cooperative planning program cal led "Regional Urban Design Assistance Team" (R/UDAT). After discussion and consideration thereof, Supervisor Johnson moved that the request be referred to the County1s Planning Commission for recommendation and report back to the Board, which motion was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Park, Mr. Terry, Mr. Compton NAYS: None ABSENT: Mr. Myers I IN RE: S.P.C.A. - REQUEST FOR CONTRIBUTION The Executive Director of the S.P.C.A., along with several other represen- tatives, appeared before the Board and requested a contribution from the County to help defray the agency's operating expenses. Following discussion, Supervisor Park moved that the matter be taken under advisement, which motion was adopted by the unanimous voice vote of the members present. The following items were for information of the Supervisors and are filed with the minutes of this meeting: Roanoke City Ordinance No. 24002, amending Ordinance No. 23974, providing that the authority of the Mayor and the City Clerk to execute the proposed Water and Sewer contract shall expire on midnight, January 31, 1978. A communication from Roanoke City Clerk advising that the County's addendum to the proposed Water and Sewer contract has been taken under advisement. Roanoke City Resolution No. 24011 expressing support for the Clean Valley Committee; authorizing the Committee to coordinate a 1 itter control program with Roanoke County and City of Salem; and authorizing the Committee to apply for a grant on behalf of the City. 280 2-14-78 IN RE: FIRE APPARATUS - REMOVAL FROM SERVICE On motion of Supervisor Johnson and the unanimous voice vote of the members present, the Board concurred with the recommendation of the County Executive and the Fire Coordinator for taking certain fire apparatus from service and returning title to said vehicles to the volunteer fire companies for their disposal. A full copy of the report is filed with the minutes of this meeting. IN RE: RESOLUTION NO. 1985 APPROVING AN AMENDMENT TO THE JANITORIAL SERVICES CONTRACT I WHEREAS, by Resolution No. 1861, Roanoke County did enter into a contract with Blue Ridge Janitorial Services for a twelve (12) month period commencing September 1, 1977, for the janitorial service of certain County property; and WHEREAS, by letter dated January 23, 1978, to the Board of County Supervi- sors of Roanoke County, Blue Ridge Janitorial Service has advised the Board that in order to continue service to the County the contract referred to above must be amended to reflect new Federal minimum wage rates which came into effect January 1, 1978; and AYES: NAYS: ABSENT: WHEREAS, such an adjustment is in accordance with the provisions contained in the bid proposals for said contract. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that an amendment to the Janitorial Services Contract with Blue Ridge Jani- torial Service entered into with the County be Resolution No. 1861 be, and the same is hereby, authorized and approved to increase the obligation owed Blue Ridge Jani- torial Service by the County in the amount of $280.00 per month from and including the month of January, 1978, to the end of the term of said contract. BE IT FURTHER RESOLVED that the County Executive be, and the same is hereby authorized to execute this amendment to the said contract on behalf of Roanoke Coun y. On motion of Supervisor Terry and adopted by the fol lowing recorded vote: Mrs. Johnson, Mr. Park, Mr. Terry Mr. Compton Mr. Myers I IN RE: RESOLUTION NO. 1986 ACCEPTING PROPOSAL FOR SUBSURFACE EXPLORATION FOR NEW JA I L S ITE WHEREAS, Roanoke County has previously entered into an agreement with VVKR Partnership, Architects and Consultants, for design of a new jail facil ity; and WHEREAS, after receipt of proposals for subsurface exploration for a new jail site, VVKR has recommended acceptance of a proposal as contained in a letter to Roanoke County dated January 24, 1978, by Schnabel Engineering Associates, Con- sulting Geotechnical Engineers, for subsurface exploration and other work on the new jail site in the amount of $6,135; and WHEREAS, the Board of County Supervisors of Roanoke County is of the opinio that said proposal is in the best interest of Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the proposal for subsurface exploration and other work for the new jail site in the amount of $6,135, as contained in a letter dated January 24, 1978, to Roanoke County by Schnabel Engineering Associates be, and the same is hereby, accep ed. I IN RE: RESOLUTION NO. 1987 ENDORSING HOUSE BILL 50 OF THE 1978 SESSION OF THE GENERAL ASSEMBLY OF VIRGINIA WHEREAS, there is proposed legislation before the 1978 Session of the Genera] Assembly of Virginia in the form of House Bi]] 50, which would amend Sectio~ ]4. ]-70 of the Code of Virginia to authorize support for County Deputy Sheriffs by the State Compensation Board to reflect impact of tourism in counties; and WHEREAS, the Board of County Supervisors of Roanoke County is of the opinio that passage of said proposed legislation is in the best interests of Roanoke Count NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that said Board hereby expresses itsapprova] of House Bi]] 50 of the ]978 Session of the Genera] Assembly of Virginia, and requests its representatives to the Genera] Assemb]y to support and work for passage of said bill. The foregoing resolution was adopted on motion of Supervisor Terry and the unanimous voice vote of the Board. IN RE: REFERRALS TO PLANNING COMMISSION I In a report to the Board, the County Executive advised that the following petitions for rezoning had been referred to the County Planning Commission since the Supervisors' meeting on December 27, ]977: (]) Petition of George Egerton t/a Young World Child Care Centers for rezoning from B-] to B-2 of parcels of land containing a total of ] .873 acres located on the west side of Route 221, 500 feet south of its intersection with Route 4]9 so that a child care center may be constructed thereon. (2) Petition of Dona]d J. and Charlotte H. Ridenhour for rezoning from B-2 to B-3 of 3.]9 acres fronting 6]8 feet along the north side of Peters Creek Road and extending back 225 feet (from Nationa] Pride Car Wash to property owned by Kenney's Franchise Corporation at private road leading to Ho]] ins fire house). Rezoning is requested so the land may be used for construction of a Pizza Inn and a Long John Si ]ver1s Restaurant. (3) Petition of Carlton Land Company for rezoning from B-3 to B-2 of 8,580 square feet at the rear of the 0.73-acre tract on which is located a Pizza Inn, 3944 Brambleton Avenue, SW. Rezoning is requested so the land may be used for con- struction of an office building. I IN RE: RESOLUTION NO. ]988 APPROVING VARIOUS IMPROVEMENTS TO STATE SECONDARY ROUTE 6]3 BY THE VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION WHEREAS, Secondary Route 6]3 from Route ]564 (Meadow]ark Road) to the Frank] in County line, a distance of 3.29 mi ]es, has been altered, and a new road has been constructed and approved by the State Highway Commissioner, which new road serves the same citizens as the road so altered; and WHEREAS, certain sections of this new road follow new locations, these being shown on the work sketch titled, "Changes in Secondary System Due to Relocation and Construction on Route 613. Project: 06]3-080-151, C50l, dated at Richmond, Virgini~, Janua ry 4, ] 977 . II NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanokle County that the portions of Secondary Route 613, i.e., Sections 8, 9, 10, 11, 12, and 13, as shown in red on the work sketch titled, "Changes in Secondary System Due to Relocation and Construction on Route 613, Project: 0613-080-]51, C50], dated at Richmond, Virginia, January 4, ]97r, a total distance of 0.86 miles be, and the same is hereby, added to the Secondary System of State Highways, pursuant to Section 33. ]-229 of the Code of Virginia of ]950, as amended. 2-14-78 BE IT FURTHER RESOLVED that the sections of old location, i.e., Sections 2 and 7a, shown in blue on the aforementioned work sketch, a total distance of 0.61 miles, be, and the same is hereby, abandoned as a publ ic road, pursuant to Section 33.1-155 of the Code of Virginia of 1950, as amended. BE IT FURTHER RESOLVED that the Virginia State Highway Commission be, and the same is hereby, requested to take the necessary action to discontinue the sec- tions of old location, i.e., a total distance of 0.27 miles, as a part of the Secon dary System of State Highways as provided in Section 33.1-150 of the Code of Virgin a of 1950, as amended. BE IT FINALLY RESOLVED that the sections of old location, i.e., Sections 1 and 7b, shown in green on the aforementioned work sketch, a total distance of 0.39 miles, be, and the same is hereby, retained as a public road in the Secondary Syste of State Highways. The foregoing resolution was adopted on motion of Supervisor Johnson and the unanimous voice vote of the members present. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the County Executive be, and the same is hereby, authorized to enter into a standard County water 1 ine reimbursement contract with Northland Developers I 2-14-78 28!l at a cost to the County of $7,222.85 for water main improvements along Route 628 to serve the Wi llow Creek Subdivision. The motion was adopted by the unanimous voice vote of the members present. Saunders, et ux, et al - Request for a new road extending from Pitzer Roal (Route 617) in a norhterly direction along the southeastern side of the Blue Ridge Parkway for a distance of 0.25 mile and then leaving the Parkway right-of-way and extending in a northerly direction 0.15 mile to end with a 40 foot right-of-way On application of Alfred E. Saunders, et ux, et al, who has filed a request for inclusion into the Secondary Highway System of Roanoke County, this Board of County Supervisors orders A. A. Guepe, County Engineer, to view the grounds and report to this Board the convenience and inconvenience that will result to indivi- duals as well as the publ ic if such road shall be opened to the public and especial y whether any yard, garden, orchard, or any part thereof wi 11 in such cases have to I be taken and that no road or landings sha 11 be established on or through the land of any cemetary or through the lands of any semi nary of learning wi thout the consen of the owners thereon, and the said County Engineer sha 11 also ascertain and report to this Board whether the said road wi 11 be of such mere private convenience as to make it proper that said road should be kept open and kept in order by the person or persons for whose convenience they are desired. He shall also assess and report what damages, if any, the landowners are entitled to and accompany his report with < plat or diagram of said road and, IT IS FURTHER ORDERED that the Clerk of this Board be, and hereby is, directed to notify the State Highway Commissioner of Virginia as to these road proceedings. Notification may be given to the Resident Engineer of the Virginia Department of Highways and Transportation of Virginia, having supervision of mainte nane and construction of highways in Roanoke County. The foregoing resolution was adopted on motion of Supervisor Park and the unanimous voice vote of the Board. I IN RE: RESOLUTION NO. 1993 ESTABLISHING A NEW PUBLIC ROADWAY ALONG THE SOUTHEASTER S I DE OF THE BLUE RIDGE PARK\.JAY I tl THE MOUNT PLEASANT AREA WHEREAS, the County Engineer heretofore appointed by this Board of County Supervisors to view the following road and the location thereof and to make a repor thereon: Request of Alfred E. Saunders, et ux, et al, beginning at a point on Pitzer Road (Route 617) and extending in a northerly direction along the southeast rn I 2-14-78 285 -:c- I side of the Blue Ridge Parkway for a distance of 0.25 mile and thence leaving th Parkway lands and extending in a norhterly direction 0.15 mile to end with a 40 foot right-of-way. NOW, THEREFORE, BE IT RESOLVED that the County Engineer's report is approved and it is hereby ordered that said road as described above be and hereb is establ ished as a publ ic road to become a part of the State Highway Secondary System in Roanoke County, the Board of County Supervisors guaranteeing the right of-way and right-of-drainage for that portion outside the right-of-way of the Blue Ridge Parkway. This Board of County Supervisors officially requests the Virginia Department of Highways and Transportation to make the proper applicatio to the Blue Ridge Parkway for that portion of the right-of-way on Parkway land requesting a Special Use Permit so that this road may be added to the State High way System and, IT IS FURTHER ORDERED that a ceritified copy of this resolution be fur- nished to the Resident Engineer of the Virginia Department of Highways and Trans porta ion having supervision and maintenance of State secondary roads in Roanoke County. IN RE: MENTAL HEALTH SERVICES OF THE ROANOKE VALLEY I Chairman Compton advised the Supervisor5 of a letter he had received fro Mr. Glenn H. Simmers submitting his resignation as a member at large of the Ment 1 Health Services of the Roanoke Val ley Board of Directors. On motion of Supervisor Johnson and the unanimous voice vote of the members present, the Mental Health Services Board was this date requested to submit a recommendation for Mr. Simmers' replacement. IN RE: PUBLIC SERVICE AUTHORITY - RESIGNATION OF L. S. WALDROP Chairman Compton advised the Board that he was in receipt of a letter from Mr. L. S. Waldrop submitting his resignation as Chairman and a member of the Roanoke County Public Service Authorit. Supervisor Park moved that the Chairman be directed to ask Mr. Waldrop if he would be willing to remain as Co-Chairman or just as a member of the Authority Board, even though he may not have the time. The motion was adopted b the unanimous voice vote of the members present. I IN RE: RESOLUTION NO. 1994 RECOGNIZING THE CLEAN VALLEY COMMITTEE OF ROANOKE VALLEY AND AUTHORIZING SAME TO APPLY FOR ANIT-LITTER PROGRAM GRANTS FOR ROANOKE COUNTY WHEREAS, the Board of County Supervisors of Roanoke County recognizes th existence of a 1 ittle problem within the boundaries of Roanoke County; and WHEREAS, the Virginia Litter Control Act of 1976 provides, through the Department of Conservation and Economic Development, Division of Litter Control, for the allocation of public funds in the form of grants for the purpose of promoting enforcement of anti-litter statutes and ordinances and for the purpose of enhancing local litter control programs; and 2-14-78 286 ~ WHEREAS, said Board has reviewed and considered the Regulations and the Appl ication covering administration and use of said funds. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board: Hereby endorses and supports such a program for the County of Raonoke, a d Hereby expresses the intent to combine with the City of Roanoke and the City of Salem in a mutually agreed uponand coordinated program, continge t on approval of the Application by the Department of Conservation and Economic Development, Division of Litter Control, and contingent on receipt of funds, and Hereby authorizes the Clean Valley Committee of Roanoke Valley to plan and budget for a coordinated anti-litter program, which shall represent said program for all localities named in this resolution, and Further authorizes the Clean Valley Committee of Roanoke Val ley to apply on behalf of all of the above-named local ities for a grant, and to be responsible for the administration, implementation, and completion of the program as it is described in the attached appl ication form LC-G-l, nd Further accepts responsibil ity jointly with the Clean Valley Committee 0 Roanoke Val ley and the City of Roanoke and the City of Salem for all phases of the program, and Further accepts liabi lity for its pro rata share of any funds not proper y used or accounted for pursuant to the Regulations and the Appl ication, a d that said funds, when received, will be transferred immediately to the Clean Valley Committee of Roanoke Valley to be used in said coordinated program to which we give our full support and endorsement, and Further provide that the financial records of the Clean Valley Committee of Roanoke Valley shall be subject to inspection and review by the Count Finance Director and such data shall be presented to allow proper report ng on a timely basis by the County, and Hereby requests the Department of Conservation and Economic Development, Division of Litter Control, to consider and approve the application and program being in accord with Regulations governing use and expenditures of said funds. Trout from the Windsor Hills District be appointed to serve as a member of Roanoke County1s Grievance Panel for a term of two years beginning February 10, 1978 and ending February 10, 1980 which motion was adopted by the unanimous voice vote of the members present. IN RE: APPOINTMENT - HIGHWAY SAFETY COMMISSION Supervisor Terry moved that Mr. Charles C. Manning, Jr. be appointed to fill the unexpired term of Mr. Kenneth W. Lussen as one of the two representc tives of the Windsor Hills District on the Roanoke County Highway Safety Commis sion, which term expires January 1, 1979. Humphrey be appointed to serve as one of the two representatives of the Windsor Hills District on the 2-14-78 28:7 Roanoke County Highway Safety Commission for a term of two years, which term expires January 1, 1980. I IN RE: APPOINTMENT - INDUSTRIAL DEVELOPMENT AUTHORITY Supervisor Terry moved that Mr. Albert Trompeter from the Windsor Hills District be appointed to fill the unexpired term of Mr. Kenneth W. Lussen as a member of the Roanoke County Industrial Development Authority, which term expire September 26, 1978. The motion was adopted by the unanimous voice vote of the members present. IN RE: STUDY COMMITTEE - SERVICE CENTER Supervisor Terry moved that a committee be established for the purpose of studying the feasibility of a service center to be built to include the needs of Roanoke County and the Public Service Authority, and that this committee repo t back to the Board its recommendations. The motion was adopted by the unanimous voice vote of the members present. This committee shall consist of the following: Board of County Super- visors, one person from each magisterial district with the County Executive and the Executive Director of the Publ ic Service Authority to serve as Ex Officio members.
