The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday and the second regular meeting of the month. Members Present: Chairman R. Wayne Compton, Vice-Chairman Robert E. Myers, Supervisors May W. Johnson, Edward C. Park, Jr., and Lawrence E. Terry. Chairman Compton called the meeting to order at 7:07 p.m.and recognized Reverend D. N. McGrady, West Salem Baptist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison. IN RE: APPROVAL OF MINUTES Supervisor Johnson moved that the minutes of the regular meeting of March 14, 1978, be corrected to include appointment of Mr. Edwin M. Savage, Cave Spring District representative on the Service Center Study Committee, and appointment of Mrs. Martha Lee Rhodes, Cave Spring District representative on the Clean Valley Committee, which motion was adopted unanimously. Supervisor Johnson moved that the minutes of the regular meeting of March 14, 1978, be approved as corrected. The motion was adopted unanimously. NOTE: The minutes of the March 14 meeting have been corrected accordingly. IN RE: RENEWAL APPLICATION OF ALBERT T. KELLEY FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 2.558-ACRE TRACT LOCATED 0.3 MILE EAST OF THE END OF STATE ROUTE 921 IN THE RED HILL AREA Mr. Kelley, applicant, was present at the hearing. No one spoke in opposition to the request. Supervisor Johnson moved that the renewal application of Albert T. Kelley be approved beginning February 11, 1978, subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A ONE-ACRE TRACT LOCATED ON A PRIVATE ROAD ON THE NORTH SIDE OF STATE ROUTE 658 (RUTROUGH ROAD), ONE MILE SOUTHEAST OF ROANOKE CITY LIMITS Mrs. Spradlin was present at the hearing. No one spoke in opposition to the request. I Supervisor Park moved that the application of W. W. Spradlin, Sr. be approved subject to the provisions of the County Zoning Ordinance pertaining to mobile homes, which motion was adopted unanimously. IN RE: APPLICATION OF HARRIET PREECE FOR A SPECIAL EXCEPTION * TO PARK A MOBILE HOME ON A 19.5-ACRE TRACT LOCATED ON * THE SOUTH SIDE OF STATE ROUTE 1404, 2.5 MILES FROM ITS * CONTINUED INTERSECTION WITH STATE ROUTE 863, ADJACENT TO THE LOCH * HAVEN COUNTRY CLUB TENNIS COURTS * Chairman Compton opened the floor for public comments on the above application for a mobile home permit and asked if the applicant, or someone representing the applicant, was present. There was no response. Mr. Edward A. Natt, Attorney representing certain persons in opposition to the request, was present at the hearing. I Supervisor Myers moved that the public hearing on the application of Harriet Preece be continued to April 25, 1978, and that the applicant be notified of this action, which motion was adopted unanimously. IN RE: RENEWAL APPLICATION OF ALBERT L. MAXEY FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A ONE-ACRE TRACT LOCATED ON THE EAST SIDE OF STATE ROUTE 643, 0.6 MILE NORTH OF ITS INTERSECTION WITH U.S. ROUTE 11-460, TO BE OCCUPIED BY BENJAMIN COY DAUGHERTY Mr. Daugherty, trailer occupant, was present at the hearing. No one spoke in opposition to the request. Supervisor Myers moved that the renewal application of Albert L. Maxey be approved beginning November 12, 1977, subject to the provisions of the County Zoning Ordinance pertaining to mobile homes, which motion was adopted unanimously. I I I I 3-28-78 311' . BLACKWELL FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A TWO-ACRE TRACT LOCATED ON A PRIVATE ROAD OFF THE WEST SIDE OF STATE ROUTE 774, 0.25 MILE SOUTH OF STATE ROUTE 638 IN THE GREEN HILL AREA Mr. Blackwell, applicant was present at the hearing. No one spoke in opposition to the request. Supervisor Myers moved that the application of Gerald D. Blackwell be approved subject to the provisions of the County Zoning Ordinance pertainin to mobile homes, which motion was adopted unanimously. IN RE: RENEWAL APPLICATION OF GEORGE W. DIVERS FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 0.57-ACRE TRACT LOCATED ON THE EAST SIDE OF STATE ROUTE 613, 1.5 MILES SOUTH OF STARKEY. Mr. Divers, applicant, was present at the hearing. No one spoke in opposition to the request. Supervisor Johnson moved that the renewal application of George W. Divers be approved beginning April 13, 1978, subject to the provisions of the County Zoning Ordinance pertaining to mobile homes, which motion was adopted unanimously. IN RE: PETITION OF RONALD L. AND BRENDA C. WILLARD AND LEO H. AND BETTY W. ROBINSON FOR REZONING FROM M-l TO B-1 OF A 0.54-ACRE PORTION OF A 1.33-ACRE TRACT LOCATED ON THE SOUTHEAST SIDE OF ROUTE 419 (155 FEET OFF RIGHT OF WAY), 125 FEET EAST OF ITS INTERSECTION WITH OGDEN ROAD TO PERMIT CONSTRUC- TION OF A BUSINESS AND/OR PROFESSIONAL OFFICE BUILDING. * * * * * * * * APPROVED In relation to the above request for rezoning, Mr. Sam Garrison, Attorney, appeared on behalf of the petitioners. Chairman Compton opened the floor for public comments. No one appeared in opposition to the proposed rezoning. FINAL ORDER it is accordingly ORDERED that the Petitioners be, and hereby are, granted rezoning of the following described parcel of land from Industrial M-l to Office and Residential District B-1 so that a business and/or professional office building may be constructed and operated thereon pursuant to Section 21-61, et seq., of the Roanoke County Code: BEGINNING at an iron pin at the southwesterly corner of the property of Exxon Corporation (formerly Humble Oil & Refining Co., Deed Book 949, page 117) and the northeasterly corner of the property of T. R. Leslie & Branch Associates, Inc. I This concluded the public hearing and Supervisor Johnson moved that tl rezoning be approved, which motion was adopted by the following recorded vote. AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None IN RE: ORDINANCE NO. 2018 AMENDING SECTION 10-39 OF THE ROANOKE COUNTY CODE RELATING TO ACCIDENT REPORTS. I WHEREAS, the Board of County Supervisors of Roanoke County deems certain amendments to the Roanoke County Code to be necessary in the best interests of the health, safety and general welfare of the citizens of Roanoke County; and WHEREAS, a Notice of Intention to amend the Roanoke County Code as proposed, and Public Hearing thereon, have been advertised and posted in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of Roanoke County that Section 10-39 of the Roanoke County Code be amended by the addition of Section 10-39.1, as follows: Sec. 10-39.1. Accident reports made under certain sections open to inspecition by certain persons; copies. But any report of an accident made pursuant to Sections 10-32 through 10-34, 10-37 and 10-38, and filed with the Sheriff's Department, shall be open to the inspection by any person involved or injured in the accident or his attorney or any authorized representative of any insurance carrier reasonably anticipating exposure to civil liability as a consequence of the accident; and provided, further, that such person, attorney or authorized representative shall be furnished a copy of such report upon written request therefor and payment of a $3.00 fee to the Sheriff's Department. I This amendment to take effect on March 28, 1978. - 'I I I I 3-28-78 The foregoing ordinance was adopted on motion of Supervisor Terry and the following recorded vote: AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None A public hearing was this date held on the proposed ordinance relat- ing to accident reports. County Attorney Dean Foster briefly explained and outlined the proposed amendment. No one appeared in opposition. Supervisor Johnson raised a question on the $3.00 feet, asking how that certain amount was decided upon. Sheriff O. S. Foster was also present at the hearing and advised Mrs. Johnson that the $3.00 fee for copying such a report is identical to the amount charged by the Division of Motor Vehicles. This concluded the public hearing. IN RE: REQUEST FOR WAIVER OF WATER ORDINANCE--FORT LEWIS VILLAGE Pursuant to the request of the applicant, Supervisor Park moved that the request of T. A. Carter for the Board to reconsider waiving the County Water Ordinance for Fort Lewis Village be continued to the April 11, 1978 Board meeting, which motion was adopted unanimously. IN RE: CETA Mr. Donald Schumacher appeared on behalf of the Roanoke Consortium for Manpower Services to discuss and answer any questions the Supervisors might have on the CETA program (Comprehensive Employment and Training Act). A brief question and answer session took place among the Supervisors and Mr. Schumacher, after which the Board thanked Mr. Schumacher for his presentation. IN RE: DECALS FOR DISABLED VETERANS Mr. Roy E. Spicer, National Service Supervisor, appeared before the Board regarding exemption of County vehicle decal fees for certain disabled veterans. Mr. Spicer explained that he had previously appeared before the Board in April, 1977, requesting the Supervisors to consider adopting an ordinance exempting these veterans from the fee and the matter was tabled indefinitely. Mr. Spicer again urged the Board to take affirmative action. Supervisor Myers moved that the County Attorney be directed to pre- pare the necessary papers for public hearing to be held on April 25, 1978, at a regularly scheduled meeting of the Board, which motion was adopted by 3-28-78 f€)' ..4 Q}l.. the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None NOTE: The County Attorney has subsequently advised the Board that this matter will be covered by State law beginning July 1, without the County taking action, and the Board therefore decided not to proceed with the public hearing. See minutes of April 11, 1978. IN RE: PUBLIC HEARING ON PETITION OF A. T. WILLIAMS Supervisor Johnson moved that a public hearing be scheduled for Tuesd April 25, 1978, at 7:00 p.m. at the Salem-Roanoke County Civic Center on the petition of A. T. Williams Oil Company, Inc. for rezoning from B-2 to B-3 of part of Lots 7, 8, and 9, Section 2 of Richard Heights Subdivision (Plat Book 1 Page 328) located at 3144 Brambleton Avenue so that a service station for the retail sale of petroleum products (no repair work would be done) may be constructed and operated thereon. The motion was adopted unanimously. IN RE: 1978-79 LANDFILL BUDGET On motion of Supervisor Johnson and the unanimous voice vote of the members, the 1978-79 budget for the Roanoke Valley Regional Landfill as sub- mitted by the Roanoke Valley Regional Solid Waste Management Board was this date received and filed. IN BE: BINGO PERMIT--WILLIAM BYRD ATHLETIC BOOSTER CLUB Supervisor Park moved that the application of William Byrd Athletic Booster Club for a bingo permit be approved effective this date for a period of one year, which motion was adopted unanimously. IN RE: BINGO PERMIT RENEWAL - CLEARBROOK FIRST AID AND RESCUE SQUAD, INC. Supervisor Johnson moved that the application of Clearbrook First Aid and Rescue Squad, Inc. for renewal of their bingo permit be approved effec- tive this date for a one year period, which motion was adopted unanimously. IN RE: BINGO PERHIT--OPTIMIST CLUB OF CAVE SPRING Supervisor Johnson moved that the application of the Optimist Club of Cave Spring for a bingo permit be approved effective this date for a period of one year, which motion was adopted unanimously. IN RE: RAFFLE PERMIT - MASON COVE CIVIC CLUB Supervisor Myers moved that the application of Mason Cove Civic Club for a raffle permit be approved effective this date for a period of one year, which motion was adopted unanimously. IN RE: RESOLUTION NO. 2019 AUTHORIZING THE RENEWAL OF A LEASE AGREEMENT FOR CERTAIN SPACE IN A BUILDING SITUATE IN THE CITY OF SALEM. WHEREAS, the County has heretofore entered into a lease agreement wi h the owners of property situate in a building at the rear of 306 Calhoun Street, in the City of Salem for the purpose of storage of certain equipment and for a base of operations for the County Communications System; and WHEREAS, the County Executive has, in a report dated March 28, 1978, advised the Board that the lease agreement hereinabove mentioned expired on March 1, 1978; and WHEREAS, in the abovementioned report to the Board the County Executive has recommended the renewal of the lease agreement referred to above on a quarterly basis at the rate of $125.00 per month for an indefinite period of time, in which recommendation the Board concurs. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby approved the renewal on a quarterly basis at the rate of $125.00 per month for an indefinite period of time of that certain lease agreement dated March 8, 1977, by and between Dame Roofing Company and the Board of County Supervisors of Roanoke County. BE IT FURTHER RESOLVED that the County Executive be, and the same is hereby, authorized and directed to execute said lease renewal on behalf of the Board. On motion of Supervisor Johnson and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None IN RE: REPORT ON TURNOVER AUDIT On motion of Supervisor Terry and the unanimous voice vote of the members, the report on the turnover audit was this date received and filed. 3-28-78 816 IN RE: DEPARTMENTAL ACTIVITIES REPORTS - FEBRUARY, 1978 The departmental activities reports for the month of February, 1978, as submitted by the County Executive, were for information of the Supervisors and are filed with the minutes of this meeting. IN RE: RESOLUTION NO. 2020 REQUESTING STATE COMPENSATION BOARD APPROVAL FOR ADDITIONAL PERSONNEL IN THE ROANOKE COUNTY SHERIFF'S DEPARTMENT. WHEREAS, under recent guidelines established by the State Compensatio Board pursuant to the directive of the Governor relating to the employment of personnel in correctional offices, no personnel may be employed without the consent of the State Compensation Board; and WHEREAS, by letter dated March 23, 1978, the Sheriff of Roanoke County has requested the Board of County Supervisors of Roanoke County to request the State Compensation Board to approve the hiring of two (2) additiona Dispatchers and two (2) additional Correctional Officers effective July 1, 1978, in which request the Board concurs. NOW, THEREFORE, BE IT RESO~VED by the Board of County Supervisors of Roanoke County that said Board hereby respectfully requests the State Compensation Board to approve the hiring of two (2) additional Dispatchers and two (2) additional Correctional Officers in the Roanoke County Sheriff's Department, effective July 1, 1978. On motion of Supervisor Johnson and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None IN RE: RESOLUTION NO. 2021 REQUESTING THE CIRCUIT COURT FOR THE COUNTY OF ROANOKE TO APPROVE A CHANGE IN THE SCHOOL CONSTRUCTION PROGRAM HERETOFORE APPROVED BY THE VOTERS OF ROANOKE COUNTY. WHEREAS, the voters of Roanoke County did, in a bond referendum held on May 27, 1968, approve a $15.8 million bond issue by the Board of County Supervisors of Roanoke County to provide for school construction within Roanoke County; and WHEREAS, because of factors which have occurred since said bond I I I 3-28-78 3,1:7 referendum, including the recent annexation by the City of Roanoke and shifting population trends, the County School Board of Roanoke County is of opinion that the program as approved by the voters of Roanoke County should be I modified to allow for changes from the school construction program as approved by the voters; and WHEREAS, the County School Board of Roanoke County did, at its meeting on February 23, 1978, adopt a resolution approving the reallocation of the school construction program as hereinafter set out, contingent on approval by the Bonding Attorney and which approval has heretofore been given to the School Board at a special meeting on March 16, 1978, in which proposal the Board of County Supervisors of Roanoke County concurs. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby concurs that the following changes need to be made in the school construction program as approved by the voters on Hay 27, 1968: I That the $3.75 million on balance in the construction fund be reallocated as follows: (a) Capital improvements to various school buildings at an approximate cost of $1,277,800; (b) Construction of added classrooms to the Mount Pleasant Elementary School at an approximate cost of $172,500; (c) Construction of a student cafeteria to the Clearbrook Elementary 'School at an approximate cost of $89,700; (d) Construction of a new warehouse facility on existing School property at an approximate cost of $460,000; (e) The remaining $1.75 million on balance to be held on reserve against the future documented needs of the Roanoke County Schools. BE IT FURTHER RESOLVED that said Board respectfully requests the Circuit Court for the County of Roanoke, in accordance with the provisions of the Code of Virginia, to schedule a hearing on the above proposed changes and I to approve said changes so as to enable the School Board to proceed with the construction of facilities that are urgently needed in order to fulfill the educational requirements of the students in the Roanoke County School System. On motion of Supervisor Johnson and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None 3-28-78 3i~1,8 In relation to the above resolution, Mr. Arnold R. Burton and Dr. Alan K. Farley were present on behalf of the School Board. Considerable discussion took place on item Cd) listed above. Supervisor Terry, along with other Board members advised that a committee had recently been established for the purpose of studying the feasibility of a service center to be built to include the needs of Roanoke County and the PSA. Supervisor Park then asked Mr. Burton if it would be detrimental to the School to locate its warehouse facility elsewhere, instead of having it adjoin the existing warehouse. Mr. Burton said he did not think it would be and he would be willing to discuss it further and would have someone present from the School Administration at the Service Committee's meeting which is scheduled for Wednesday evening, March 29. IN RE: STUDY COMMITTEE - UPGRADING FINANCE DEPARTMENT Chairman Compton appointed the following persons to serve on a study committee to meet with Daniel A. Robinson and Associates, the County's independent auditors, and discuss with Mr. Robinson his ideas for the needs and continued development of the County's Department of Finance: Supervisors Myers and Park, County Executive Clark, Assistant Director of Finance Chambliss Harry Franks, Programmer Analyst, and Bayes Wilson, Director of Finance for the County School Board. Mr. Compton designated Supervisor Myers to serve as Chairman of this committee. IN RE: MEETING WITH S.P.C.A. The Supervisors scheduled a meeting at the Civic Center in Room C beginning at 7:00 p.m. on Wednesday, April 5, to discuss with representatives of the S.P.C.A. that organization's request for financial contributions. Salem City Council and Vinton Town Council were also invited. IN RE: RESOLUTION NO. 2022 COMMENDING CERTAIN STUDENTS OF WILLIM1 BYRD HIGH SCHOOL FOR OUTSTANDING PERFORMANCE IN ACADEMIC COMPETITION. WHEREAS, certain students of William Byrd High School were selected to represent their said school on "Klassroom Kwiz," a local television program in which area high school students compete in responding to questions of I I I I I I 3-28-78 3",19 general knowledge; and WHEREAS, said students retired as undefeated champions after seven (7) consecutive weeks of competition, a feat accomplished only once previously in five (5) years; and WHEREAS, the Board of County Supervisors of Roanoke County wishes to express its appreciation and recognition of the achievements of these students, their parents, the staff, faculty and the entire student body of William Byrd High School for producing this championship team. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby recognizes and commends Carolyn Jill Springer, Richard Christopher Dorval and Charles Michael Holloway for their outstanding performance in academic competition on "Klassroom Kwiz." BE IT FURTHER RESOLVED that appreciation is hereby expressed to the said student's parents, the staff, faculty and the entire student body of William Byrd High School for producing this championship team. BE IT FINALLY RESOLVED that a certified copy of this resolution be transmitted by the Clerk of this Board to Carolyn Jill Springer, Richard Christopher Dorval, Charles Michael Holloway and William Byrd High School. On motion of Supervisor Park and adopted by the unanimous voice vote of the Board. IN RE: CO~1ITTEE TO STUDY FORM FOR ACHIEVEMENT CERTIFICATE Chairman Compton appointed the following persons to serve on a study committee to investigate the feasibility of having a form certificate for special recognition printed up to be used by the County for special occasions: Supervisors Johnson and Park, and County Attorney Foster. Mr. Compton designated Supervisor Park to serve as Committee Chairman. IN RE: SICK LEAVE/WORK}~N'S COMPENSATION Supervisor Park moved that a Committee of Supervisors, Supervisor Compton, Park, and Johnson, meet with the County employees' committee on Wednesday afternoon, April 5, to discuss workman's compensation benefits for County Employees, which motion was adopted unanimously. IN RE: REQUEST OF MOUNT PLEASANT RECREATION CLUB FOR A CONDITIONAL USE PERMIT Supervisor Park moved that the Board hold a public hearing at 7:00 3-28-78 '8? 0 .. -:::- p.m. on TuesdaYt April 25t 1978t at the Salem-Roanoke County Civic Center on the request of the Board of County Supervisors on behalf of the Mount Pleasant Recreation Club for a conditional use permit to operate a landfill of construc- tion waste materials (no garbage) on a tract of land containing 9.13 acres, I adjacent to the Mount Pleasant Elementary School and located on the south side of State Route 617 (Pitzer Road), approximately 1,000 feet east of State Route 886 (Mount Pleasant Boulevard) for the purpose of leveling an area on which to develop a ballfield. The motion was adopted unanimously. IN RE: SWIM POOL AND RECREATIONAL CLUB OPERATIONS Approximately fifteen (15) residents of the Sugar Loaf area of south- west County were present at the meeting to discuss swim pool and recreational club operations in the County. Mr. Howard L. Butterworth was spokesman for the group. Mr. Butterworth submitted a proposed ordinance outlining procedures and conditions for the operation of swimming pools and recreational clubs I stating that the purpose of the proposed ordinance is to ensure public safety and minimize devaluation of surrounding property, and also to reduce potential vandalism. The matter was referred to the County Attorney and County Planner fo report back to the Board by the first regular meeting in May. IN RE: APPOINTMENT OF HOLLINS DISTRICT REPRESENTATIVE TO CLEAN VALLEY COMMITTEE Mr. Compton appointed Mrs. H. Wright Stover, Jr. to serve as the Hollins District representative on the Clean Valley Committee. IN RE: EXECUTIVE SESSION At 9:47 p.m.t on motion of Supervisor Terry and the unanimous voice I vote of the memberst the Board went into Executive Session to discuss a legal matter. At 10:28 p.m., the Supervisors returned to the meeting room and on the motion of Supervisor Terry and the unanimous voice vote of the memberst the Board reconvened in open session. - 3-28-78 321 IN RE: O. C. THOMAS WATER COMPANY I Supervisor Park moved that the County Executive be directed to study and report back to the Board within 90 days in regard to water service for the area of the County presently served by the former O. C. Thomas Water Company.
