HomeMy WebLinkAbout10/24/1978 - Regular 10-24-78 53"4 ,- Salem-Roanoke County Civic Center Salem, Virginia October 24, 1978 7:00 p.m. I The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the second Tuesday and the first regular meeting of the month. Members Present: Chairman R. Wayne Compton, Vice-Chairman Robert E. Hyers, and Supervisors Hay W. Johnson, Edward C. Park, Jr. and Lmlrence E. Terry. Chairman Compton called the meeting to order at 7:00 p.m. and recognized Mr. William F. Clark, who offered the invocation. The Pledge of Allegiance to the Flag was given in unison. IN RE: APPROVAL OF MINUTES I Supervisor Myers moved that the minutes of the regular meeting of October 10, 1978, be approved as submitted, which motion was adopted unanim- ously. IN RE: REQUEST OF RONAD G. ARTHUR FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 7.l07-ACRE TRACT ON THE EAST SIDE OF ROUTE 958, 0.1 MILE EAST OF ITS INTERSECTION WITH ROUTE 220 IN THE CAVE SPRING DISTRICT. This request was presented to the Supervisors by Mr. Arthur. No one appeared in opposition. This concluded the public hearing and Supervisor Johnson moved that the request be approved subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously I IN RE: REQUEST OF WILLIAM E. AND SHIRLEY F. MILLNER FOR A RENEWAL OF THEIR SPECIAL EXCEPTION TO PARK A NOBILE HOME ON A 58.2-ACRE TRACT ON A PRIVATE DRIVE OFF ROUTE 852, 800 FEET NORTH OF ROUTE 613 IN THE tmIGHT SECTION, CAVE SPRING DISTRICT. This request was presented to the Supervisors by Mr. Millner. No one appeared in opposition. This concluded the public hearing and Supervisor Johnson moved that the renewal request be approved beginning June 30, 1978, subject to the 10-24-78 5- ~_::&.~ ,. provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: REQUEST OF ROGER ROBERTS FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 5-ACRE TRACT AT THE END OF STATE MAINTENANCE ON ROUTE 941 IN THE BENNETT SPRINGS SECTION OF THE CATAWBA DISTRICT. This request was presented to the Supervisors by Mr. Roberts. No one appeared in opposition. This concluded the public hearing and Supervisor Myers moved that the request be approved subject to the provisions of the County Zoning Ordinanc as it pertains to mobile homes, which motion was adopted unanimously. IN RE: REQUEST OF JIMMY JOE AND NONA BROOKS ARTHUR FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 1.086-ACRE TRACT ON THE WEST SIDE OF A PRIVATE ROAD RUNNING NORTH OFF LOCH HAVEN DRIVE AND ADJACENT TO 5848 LOCH HAVEN DRIVE, CATAWBA DISTRICT. This request was presented to the Supervisors by Mr. Arthur who advised that he will be required to move his mobile home from its present site by January 31. Mr. Arthur also advised the Supervisors that he plans to build a home in the future. At this point, Chairman Compton opened the floor for public comments. Mr. M. C. Peters, who advised that he resides on Loch Haven Drive, approximatel two blocks from the proposed location of the mobile horne, appeared in oppositio . Mr. Peters expressed concern that if this request was granted, it might set a precedent for other mobile homes in the area. Catawba District Supervisor Myer reaffirmed Mr. Arthur's intention to build a home and also noted that all speci 1 exceptions granted by the Supervisors to park a mobile home on a private property are for a two-year period only and must be renewed if the applicant continues to make such use of his property. This concluded the public hearing and Supervisor Myers moved that the request be approved subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: REQUEST OF ROSIE L. DAVIS FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A I-ACRE TRACT AT THE END OF KELLY STREET, SOUTH OFF ROUTE 910 IN THE DIXIE CAVERNS SECTION OF THE CATAWBA DISTRICT. This request was presented to the Supervisors by Mrs. Davis. Mr. 10-24-78 5 3':. ~'6" ,> .,( .... ~. t W. K. Light, previous property owner was also present at the hearing. ~lr. Light advised that Mrs. Davis had recently purchased the property in question from him and further advised that there were other mobile homes in the area. Mr. Light then submitted photographs of the property. Mr. E. S. Conner, Route 3, Box 198, appeared in opposition to the request stating that a mobile home will devalue his property. This concluded the public hearing and Supervisor Myers moved that th request of Rosie L. Davis be approved subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: ORDINANCE NO. 2160 AMENDING SECTION 9.l-l2(b) OF THE ROM~OKE COUNTY CODE IN REGARD TO BUSINESS LICENSE TP~ES WHEREAS, the Board of County Supervisors of Roanoke County deeTI1S certain amendments to the Roanoke County Code to be necessary in the best interests of the health, safety and general welfare of the citizens of Roanoke County; and \ffiEREAS, a Notice of Intention to amend the Roanoke County Code as proposed, and public hearing thereon have been advertised and posted in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of Roanoke County that Section 9.l-12(b) of the Roanoke County Code be amended as follows: (b) If any person, firm or corporation shall continue a business, employment or profession after the expiration of a license previously issued without renewing such license, such person, firm or corporation shall, if such failure to renew such license be continued for one month or if an initial or seasonal license is not purchased prior to the commencement or resumption of a seasonal business or employment, be subject to a penalty of ten percent of the amount of the license tax which was due and payable at the beginning of such time, in addition to the license tax imposed by this chapter; but such penalty shall in no case be less than five dollars. Such penalty shall be assessed and paid along with the license tax and shall become a part of the license tax. This amendment to take effect on January 1, 1979. Chambliss, Director of Finance, presented this proposed amendment to the Supervisors advising that the purpose of the ordinance was to have the County Code be in compliance with the State Code. Chairman Compton opened the floor for public comments. No one appeared in opposition to the proposed amendment. IN RE: BRUSH AND LEAF COLLECTION ORDINANCE A public hearing was this date conducted concerning an amendment to Chapter 14 of the Roanoke County Code for the purpose of adding a new article entitled "Brush and Leaf Collection." County Engineer Guepe presented the amendment to the Supervisors and briefly highlighted the proposed ordinance. Supervisor Myers stated that he thought the ordinance was proposed would be so restrictive that the people will not be served. Mr. Myers raised a question on the requirement of plastic bags for leaves and the requirement that tree limbs be bundled, with each bundle being no more than four(4) feet in length. Mr. Claude C. Thompson, resident of the Hollins District, also raised the same questions as Mr. Myers and asked that some alterations be made to the proposed ordinance for the benefit of the citizens. IN RE: REQUEST TO CUT TREES ON THE RIGHT OF lJAY OF THE UNIMPROVED SECTION OF ANTIETAM DRIVE (MOUNT VERNON HEIGHTS SUBDIVISION) Supervisor Johnson moved that the request of Eugene P. Donahue (3601 Antietam Drive, S. W.) for permission to cut trees on the right of way of the unimproved section of Antietam Drive (Mount Vernon Heights Subdivision) be continued to the November 14, 1978, Board meeting so that she may investigate the matter further since the property is in the Cave Spring District. The motion was adopted by the unanimous voice vote of the Board. IN RE: PROCLAMATION - AMERICAN EDUCATION WEEK Supervisor Johnson moved that Chairman Compton be authorized to proclaim November 12, - November 18, 1978, to be "American Education Week." A full copy of the proclamation is filed with the minutes of this meeting. The motion was adopted ~nanimously. IN RE: RESOLUTION NO. 2161 ACCEPTING BIDS FOR THE PURCHASE OF MOTOR VEHICLES FOR SEVERAL DEPARTMENTS THROUGHOUT THE COUNTY. WHEREAS, on October 10, 1978, at 10:00 a.m., bids were received and opened in the Department of Finance, Purchasing Division, for the purchase of motor vehicles for several departments throughout the County; and 'iVdEREAS, the Purchasing Supervisor has, in report to the Board dated October 24, 1978, recommended that the acts hereinafter set out be accepted, in which report the Director of Finance concurs; and WHEREAS, the funds for said motor vehicles hereinafter accepted are included in the 1978-79 budget, as sho~m in the attached appropriation resolution. I WHEREAS~ on October 10~ 1978~ at 2:00 p.m.~ bids were received and opened in the Department of Finance~ Purchasing Division for the installation of lights on the tennis courts in Mount Pleasant Park and at Northside High School; and WHEREAS~ the Purchasing Supervisor has~ in a report to the Board dated October 24~ 1978~ recommended that the acts hereinafter set out be accepted~ in which report the Director of Finance concurs; and 1978-79 budget. IN RE: RESOLTUION NO. 2164 ACCEPTING A GRill~T FROM THE COUNCIL ON CRIMINAL JUSTICE FOR TWO MEMBERS OF THE ROANOKE COUNTl COURT SERVICE UNIT TO ATTEND THE SIXTH NATIONAL COUNCIL OF JUVENILE AND FAMILY COURT JUDGES. WHEREAS, the Roanoke County Juvenile and Domestic Relations District Court has, in a report to the Board dated October 24, 1978, informed said Board that the grant proposal of the Roanoke County Court service Unit for two members of the Roanoke County Court Service Unit to attend the Sixth National Council of Juvenile and Family Court Judges for the purpose of training has been adopted and approved by the Fifth Planning District and the Council on Criminal Justice; and w~EREAS, this same report recownended this grant be accepted by the Board of County Supervisors; and WHEREAS, the Board of County Supervisors of Roanoke County is of the opinion that this grant should be accepted with Roanoke County matching $62.00 of the funding for 'this grant; and WHEREAS, the funds for said grant hereinafter accepted are included in th 1978-79 budget, as shown in the attached appropriation resolution. WHEREAS, the Roanoke County Sheriff's Department has, in a report to the Board dated October 24, 1978, stated that said department is in need of three motor vehicles meeting certain specifications in order to meet the responsibilities of the Youth and Family Services Bureau of the Roanoke County Sheriff's Department; and WHEREAS, the Roanoke County Sheriff's Department has, in said report, recommended that the acts hereinafter set out be accepted; and WHEREAS, the funds for said motor vehicles hereinafter accepted are included in the 1978-79 budget. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of I Roanoke County that the County Executive be, and he is hereby authorized to issue a purchase order to the Hertz Company for the procurement of three motor vehicles meeting the specifications previously set out by the Roanoke County Sheriff's Department, at a cost not to exceed $4,700.00 per unit; said motor vehilces to be used by the Youth and Family Services Bureau of the Roanoke County Sheriff's Department. On motion of Supervisor Johnson and adopted by a unanimous voice vote. - I I 10-24-78 5_".4 3 . , , IN RE: APPOINTMENT - BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS Supervisor Johnson moved that Mr. Alan L. Sibley from the Cave Spring District be appointed to serve as a member of the Roanoke County Building Code Board of Adjustments and Appeals for a term of four years ending on October 24, 1982, which motion was adopted unanimously. I IN RE: RESOLUTION NO. 2168 ADOPTING THE MOTOROLA MINITOR AS THE STANDARD RADIO ALERTING DEVICE FOR ROANOKE COUNTY EMERGENCY USE. WHEREAS the citizens of Roanoke County are highly dependeflt upon volunteer fire fighting rescue forces to make quick response to alarms in order to minimize hazard to lives and property; and WHEREAS there does presently exist within the ranks of these volunteer firemen and rescue squadsmen a variety of radio alerting equipment with which they are made aware of the need for their services; and WHEREAS, at a meeting of the Roanoke County Volunteer Fire Chiefs and other fire company representatives held on September 28, 1978, there was unanimously approved a resolution requesting the Board of County Supervisors I to adopt a certain alerting monitor as a standard for Roanoke County in order to insure adequate emergency notification to the volunteers; and WHEREAS, in a memorandum to the County Executive dated 4 October 1978, Robert N. Monroe, Coordinator of Fire and Emergency Services for Roanoke County, did support the request of the volunteers and explain how tests have been conducted on various alerting equiment which resulted in conclusions that a certain receiver called Motorola Minitor best met the County's needs; an WHEREAS, in a memorandum to the County Purchasing Supervisor dated October 3, 1978, Captain Michael F. Kavanaugh, County Communications Officer, did also support the request of the volunteers for standardized alerting equipment; NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of I Roanoke County that said Board does adopt the Motorola Minitor as the standard radio alerting device for Roanoke County Emergency use, which is considered to be the best euipment presently available for the purpose of alerting volunteer firemen and rescue squadsmen in the event of an emergency; and BE IT FURTHER RESOLVED that the County Purchasing Agent is hereby authoriz d and directed to obtain Motorola Minitor units when acquiring radio alert 10-24-78 54,4 I I I monitors 'with funds budgeted for same as long as said equipment remains reasonable priced in comparison with other alerting devices; and BE IT FINALLY RESOLVED that volunteer firemen and rescue squadsnen are hereby urged to obtain the Motor>;)la Hinitor ...hen acqui.ring radio alert monitors with their own funds in order the County's emergency dispatching system can become fully standardized. AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None IN RE: SCHOOL SYTffi1 FIN~~CES As a result of a meeting the Supervisors held on October 16 wit~ the School Board, some discussion took place among the Supervisors on the School Board's previous request for the Supervisors' reconsideration of approval of the School budget by categories. Supervisor Terry stated that he did want to go on record that the Supervisors authori.zed the School to solicit proposals for school buses and to bring back their recommendations for the Board's consideration. County Executive Clark advised the Supervisors that he was meeting with representatives of the School Administration on Friday, October 27, in an attempt to reach an agreement administratively on such financial procedures IN RE: EXECUTIVE SESSION At 9:50 p.m. Supervisor Terry moved that the Board go into Executive Session to discuss personnel, real estate and legal matters, which motion was adopted by the following recorded vote: AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None At 11:16 p.m. the Supervisors returned to the meeting room on the motion of Supervisor Johnson and a unanimous voice vote, the Board reconvened in open session. IN RE: EMPLOYMENT OF DODSON, PENCE, VIAR, YOUNG & WOODRUM Supervisor Terry moved that the law firm of Dodson, Pence, Viar, ! ! 10-24-78 545 .. Young and Woodrum be and it hereby is authorized to institute legal proceedings against such parties as it deems necessary to prevent continued violation of this County's subdivision ordinance and other provisions of the Roanoke County Code and the Code of Virginia, which mo.tion was adopted by the following I recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None IN RE: ADJOURNMENT This concluded the business before the Board at this time, and on the motion of Supervisor Terry and a unanimous voice vote, the meeting was adjourned at 11:17 p.m. CHAIRMAN I I
