The Board of County Supervisors of Roanoke Cour:cty, Virgirlic, met this day in open session at the Salem,-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday a.D,d the Second regular meeting of the month. Members Present: Chairman R. Wayne Compton, Vice,-Cb,s"i:c::;an Robert E. Nyers, and Supervisors Hay H. Johnson, Edvlard C. Park, Jr., and Lawrence E. Terry. Chairman Compton called the meeting to order at 7;03 p.m. and recognized Reverend Edgar G. Petry, Oak Grove Church of the Brethren, who offered the invocation. The pledge of allegiance to the flag was given in unison. IN RE: APPROVAL OF MINUTES On motion of Supervisor Terry and the unanimous voice vote of the Board, the minutes of the regular meeting of October 24, 1972, and the special meeting of October 31, 1978, were approved as presented. IN RE: ORDINANCE NO. 2192 AMENDING SECTION 19 OF THE ROANOKE COUNTY CODE IN REGARD TO CLASSIFICATION OF PERSONAL PROPERTY FOR TAXATION WHEREAS, the Board of County Supervisors of Roanoke County deems certain amendments to the Roanoke County Code to be necessary in the best interests of the health, safety and general welfare of the citizens of Roanoke County; and WHEREAS, a Notice of Intention to amend the Roanoke County Code as proposed and the public hearing thereon have been advertised and posted in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of Roanoke County that Section 19 of the Roanoke County Code be amended by the addition of Section 19-2.1 as follows: Section 19-2.1 Classification of farm animals, certain grains, farm machinery, and farm implements exempt from taxation. The following farm animals, certain grains, farm macr.inery, aDcl farm implements are, pursuant to Section 58-829.1:1 of the COGe of Virginia, hereby exempt from taxation and shall not be assessed for that purpose: (1) Horses, mules and other kindred animals (2) Cattle (3) Sheep and goats (4) Hogs (5) Poultry (6) Grains and other feeds used for the nurture of farm animnls (7) All farm machinery and farm implements 11-28-78 5 7;.5~' ~. This amendment to take effect on November 28, 1978. A public hearing was this date held on the proposed amendment to the County Code in regard to classification of personal property for taxation. John M. Chambliss, Jr., Director of Finance, briefly explained the proposed ordinance and advised that the purpose of the ordinance is to eliminate taxation of certain classes of personal property. There were no citizen comments, either for or against the ordinance, but Supervisor Myers did advise that he had received support from certain farmers and said he felt that it would be a help to them. Following some discussion, this concluded the public hearing, and Supervisor Myers moved adoption of the foregoing ordinance, which motion was approved by the following recorded vote: I NAYS: IN RE: Mrs. Johnson, Mr. Myers, ~r, Park, Mr, Terry, Mr. Compton None AYES: EXECUTIVE SESSION At 7:12 p.m., Supervisor Park moved that the Board go into Executive Session to discuss personnel and legal matters, which motion was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None At 7:40 p.m., the Supervisors returned to the meeting room and on the motion of Supervisor Park and unanimous voice vote of the members, the Board recovened in open session. IN RE: VIRGINIA STATE FIREMENtS ASSOCIATION On motion of Supervisor Park and unanimous voice vote, the communication from the Virginia State Firemenls Association accepting the Supervisorsl\ invitation to host their 93rd annual convention in Roanoke County during the week of August 12-17, 1979, was this date received and filed. IN RE: JAIL FACILITY-LETTER FROM DJCP At the request of Supervisor Myers, the communication dated October 5, 1978, between the State Division of Justice and Crime Prevention and the National Clearinghouse for Criminal Justice Planning and Architecture concerning the County's new jail facility was before the Supervisors at this meeting. Mr. Myers advised that he wished to ask County Executive Clark several questions regarding the letter. Mr. Myers stated that he first knew such a letter existed when he read about it in the November 19th issue of the Roanoke Times and World News. Mr. Myers then asked Mr. Clark what effect this letter, in his opinion, would have in getting Federal funds. Mr. Clark did stress that he felt that the letter was a working document only, and that he had no intention of keeping the matter secret. He did emphasize that the letter was not addressed to Roanoke County (the County Executive and County Planner received copies). In conclusion, Hr. Clark stated that in his opinion the letter will not be the determining factor on whether or not Roanoke County receives a grant. Supervisor Myers thanked Mr. Clark for his comments with the request that he forward all future information involving money or tax dollars to the Supervisors. It was noted that County staff and law enforce~ep-t officials are schedl1led to meet with State representatives on December 6, 1978 at 1:30 p.m. at which time the County Executive was directed to schedule a follmv-up meeting with the Supervisors and these representatives to discuss the jail facility. IN RE: GREATER ROANOKE TRANSIT COMPA~N REQUEST TO EXPAND CPARTER SERVICE In regard to the letter from Noel C. Taylor, President, Valley Metro, Supervisor Johnson moved that the Board support the request of the Greater Roanoke Transit Company to expand its charter service area to include Roanoke. The motion was adopted unanimously. ANI~~L CONTROL ORDINANCE-APPOINTMENT OF STUDY COMMITTEE Mrs. Lela C. Spitz, Roanoke County resident, appeared before the Board regarding suggested amendments to the County'e Animal Control Ordinance, with particular reference to that section pertaining to vicious dogs. Mrs. Spitz then submitted to the Supervisors these changes for their consideration. Mr. William St. Clair, who advised the Board that he has recently had concern over vicious dogs, was also present. After discussion and consideration thereof, Chcirman Compton appointed the following persons to serve on a committee to stusly the County's Animal Control Ordinance and report back to the Supervisors their recommendations by the Janu,9.ry 23, 1979 Board meeting: Mrs. Lela C. Spitz, t-Tilliam St. Clair, Supervisor ~ay H. Johnson, County Executive vnlliam F. Clark, County Planner Robert W. Hooper, Chief Animal Control Officer Kenneth L. Hogan, and an attorney. Mr. Compton appointed Mrs. Suitz to serve as committee chairman. IN RE: IN RE: JOINT-USE SEWER INTERCEPTOR CONSTRUCTION PROJECTS On ITootion of Supervisor Hyers and a unanimous voice vote, the following resolutions adopted by Roanoke City Council were 11-28-78 :) '7 7 . . this date referred to the Public Service Authority for review and recommendation: Resolution No. 24412 allocating joint use capacity in certain interceptor sewer lines of the City of Roanoke. Resolution No. 24413 requesting the local governing bodies causing sewage to be delivered to the Cityts Sewage Treatment Plant for treatment to advise the City, as their interests may dictate, whether or not said localities wish to join the City in certain joint-use sewer intercepto construction projects. Resolution No. 24414 directing City Manager to reauest the County and/or PSA to reimburse the City for a proportionate part of the cost of construction of a certain joint-use sewer interceptor being constructed for the benefit of both the City and the County. IN RE: RESOLUTION NO. 2193 ABANDONING A PORTION OF RIGHT OF WAY OF STATE SECONDARY ROUTE 666 WHEREAS a portion of State Secondary Route 666, approximately one-half mile east of the intersection of Routes 666 and 667, has been altered and a new road has been constructed and approved by the State Highway Commissioner, which new road serves the same citizens as the road so altered; and WHEREAS a certain section of this new road, following a new location as shown in red on the attached plan sheet serves no public necessity and is not longer necessary for the uses of the secondary system of State highways; NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that the portion of the State Secondary Route 666, from left station 11 + 40 to left station 18 + 23 (as shown in red on attached plan sheet-Project 0666-080- 156, C50l) a distance of 683 feet be, and the same hereby is, abandoned as a public road pursuant to Section 33.1-155 of the Code of Virginia of 1950, as amended. On motion of Supervisor Park and adopted by the following recorded vote: AYES: Mrs. Johnson, Hr. Myers, Mr. Park, Mr. Terry, Mr. Compton NAYS: None IN RE: ANNUAL AUDIT-YEAR ENDED JUNE 30, 1978 Supervisor Park moved that the annual audit and turnover audit for the year ended June 30, 1978, be received and filed and that the condensed Statement of Cash Receipts and Disbursements by Funds for the Year Ended June 30, 1978, be published in accordance with statute. Both audit reports are filed with the minutes of this meeting. The motion was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Hr. Park, Mr. Terry, Hr. Compton NAYS: None At the request of Supervisor Myers, it was also confirmed by all Supervisors that $1 million had been provided from the County General Fund when contract was awarded for the new jail facilities. Fund S17000-31d $47,000 On motion of Supervisor Johnson and adopted by the following recorded vote: AYES: NAYS: IN RE: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None FIFTH PLANNING DISTRICT COMMISSION-PROPOSALS FOR CO}~ISSION REORGANIZATION Supervisor Ed Park, Chairman of an Ad Hoc Committee for the Fifth Planning District Commission, submitted proposals for Commission reorganization for the Supervisors' review and comment Mr. Park advised the Board that he recommended proposal #2 which I reads as follows: "Retain the Executive Cormnittee and the Full Commission, but join them together for monthly meetings. If a quorum is present, then the Full Commission would review and vote on matters. If there is no Full Commission quorum, then the Executive Committee would review and vote on matters; thus insuring a quorum of either committee." Following discussion, Supervisor Park moved that the Board recommend to the Fifth Planning District Commission their support for proposal #2, which motion was adopted unanimously. IN RE: INSURANCE COMMITTEE The following named persons were unanimously appointed by the Supervisors to serve as a committee of knowledgeable citizens to review the County's current employee hospitalization and medical insurance coverage and make any recommendations back to the Supervisors: Joe Morrow-Blue Cross/Blue Shield of Southwest Virginia J. IN RE: PUBLIC HEARINGS-DECEHBER 28,1978 Supervisor Terry moved that no requests for rezonings, special use permits, special exceptions or uses not provided for be scheduled for public hearings for the December 28, 1978, meeting of the Board due to the holiday season. The motion was adopted by a unanimous voice vote. IN RE: RAFFLE PERMIT-BENT MOUNTAIN FIRST AID & RESCUE CREW, INC. Supervisor Terry moved that the application of Bent Mountain First Aid & Rescue Crew, Inc. for a raffle permit be approved for the period January 1, 1979 through Decerr-ber 31, 197c, which motion was adopted unanimously. IN RE: WORK STUDY SESSION-BOARD OF COUNTY SUPERVISORS Supervisor Park moved that the Board have a work study session on December 7, 1978, at 2:00 p.m., which motion was adopted unanimously. IN RE: SOIL SURVEY Mr. Lowell M. Gobble, VPI & SU Extension Agent, appeared before the Board regarding the letter from Donald L. Wells, Soil Survey Coordinator, advising that the State Soil Survey Committee has completed an initial evaluation of all counties in Virginia without a comprehensive soil survey, of which Roanoke County is one. Mr. Gobble advised the Supervisors that two main factors must be considered (1) does Roanoke County need such a survey and (2) the cost involved. Mr. Dwight A. Towler, local representative for Botetourt, Roanoke and Craig Counties, was also present to help answer questions the Supervisors may have. Supervisor Myers asked how much this surve' will cost Roanoke County. Hr. Gobble advised that the County's share would be approximately 20 per cent of the total cost or $60,000. Chairman Compton asked the County Executive to coorespond with other counties in Virginia who have had such a soil survey for their feelings and information, etc. about the survey. Supervisor Myers advised that he was awaiting additional information pertaining to the survey and moved that the matter be continued to the January 23, 1979, meeting of the Board, which motion was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Hr. Terry, Mr. Compton NAYS: IN RE: None AUDIT AND JAIL FACILITY Mr. Tom Farrell, Roanoke County citizen,appeared before the Board and made brief comments and allegations regarding the Annual Audit for the County of Roanoke for the year ended June 30, 1978. Mr. Farrell also commented on the size of the County's new jail facility. Chairman Compton advised that the 11-28-78 5~1 Supervisors went by the information given them from knowledge- able persons such as the Sheriff and Judges. Mr. John N. Lampros, Commonwealth's Attorney for the County, said that he felt the County's figures were a very fair estimate of what the County will need in the next 50 years. Mr. Jack Hart, Roanoke County citizen and member of CASE (a citizens' group), said he felt the Supervisors have taken very lightly the fact that the letter from the DJCP dated October 5, 1978, had not been turned over to them. IN RE: EXECUTIVE SESSION On motion of Supervisor Terry and the following recorded vote, the Supervisors went into Executive Session at 8:40 p.m. to discuss personnel, real estate and legal matters. AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Comptol NAYS: None IN RE: ADJOURNMENT At 10:59 p.m. the Supervisors returned to the meeting room and on motion of Supervisor Johnson and a unanimous voice vote, the Board reconvened in open session and adjourned immediately thereafter.
