The Board of County Supervisors of Roanoke County, Virginia
met this day in open session at the Roanoke County School Board
Conference Room in Salem, Virginia, this being the second regular
meeting of the month, which by Resolution duly adopted by the

Board had been rescheduled from December 26 to December 28 due to
the holiday season.
Members Present: Chairman R. Wayne Compton, Vice-Chairman
Robert E. Myers, Supervisors May W. Johnson, Edward C. Park, Jr.,
and Lawrence E. Terry.
Chairman Compton called the meeting to order at 7:00 p.m.
and recognized Supervisor ,Robert E. Myers, who offered the
invocation. The pledge of allegiance to the flag was given in
unison.
IN RE:
APPROVAL OF MINUTES
Supervisor Terry mo~ed that the minutes of the regular
meeting held November 28, 1978 be approved as presented, which
motion was adopted unanimously.

ORDINANCE NO. 2205 AMENDING SECTION 19 OF THE ROANOKE
COUNTY CODE IN REGARD TO BIENNIAL GENERAL REASSESSMENTS
OF REAL ESTATE
1;.JHEREAS, the Board ol County Supervisors of Roanoke
County deems certain amendments to the Roanoke County Code to be
necessary in the best interests of the health, safety, and
general welfare of the citizens of Roanoke County; and
WHEREAS, a Notice of Intention to amend the Roanoke County
Code as proposed and the public hearing thereon have been
advertised and posted in accordance with law.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Supervisors of Roanoke County that Chapter 19 of the Roanoke
County Code be amended by the addition of the following:
Section 19-10. Biennial general reassessment of real estate.
In lieu of the general ~eassessment requirements of Chapter
58 of the Code of Virginia of 1950, as amended, the Board of
County Supervisors hereby provides for the biennial general
reassessment, assessment and equalization of real estate for the
purpose of taxation beginn~ng with the biennial general
reassessment to become effective January 1, 1981. All taxes for
each even year on such real estate shall be extended on the basis
of the last general or biennial general reassessment made prior
to such year, except for changes that have been lawfully made.
The reassessment shall be made by the County's assessor, who
shall be certified by the Tax Commissioner of Virginia. The
reassessment may be completed during an entire two-year period
by employing the same standards of value for all appraisals made
during that period as provided by Section 58-778.1 and made in

accordance with all other applicable provlsions of Chapter
58 of the Code of Virginia of 1950, as amended.
This amendment to take effect on January 1, 1979.
The County's Director of Finance John M. Chambliss, Jr.
was spokesman for the proposed amendment. Mr. Chambliss briefly
explained the ordinance and its advantages to County citizens..
No one appeared in opposition. ,
This concluded the public hearing, and the foregoing
ordinance was adopted on motion of Supervisor Johnson and the
following recorded vote:

PETITION OF SOUTHERN STATES COOPERATIVE, INC. FOR
VACATION AND ABANDONMENT OF A PORTION OF STATE
SECONDARY ROUTE 858 (ON THE SOUTH SIDE OF U. S.
ROUTE 11), 0.75 MILE EAST OF SALEM, JUST EAST
OF STATE POLICE HEADQUARTERS IN THE CATAWBA
DISTRICT
This petition was presented to the Supervisors by Attorney
Carr L. Kinder, Jr., who advised that the Planning Commission
held a public hearing on the request and reco0m.ends approval
of same. It was also noted that the notice of the proposed
abandonment had been given in accordance with State Code and
that thirty days have elapsed since the posting of the aforesaid
notice and no landowner has petitioned for a public hearing in
this matter.

FINAL ORDER
WHEREAS, at its meeting on November 14, 1978, the County
Board of Supervisors adopted a Resolution setting forth its
intent to approve said petition and resolved that notice be
given in accordance with the applicable provisions or the 19S0
Code of Virginia, as amended, of its intent to vacate, close,
discontinue and abandon the hereinafter described portion or
State Route 858; and
WHEREAS, notice of said intention (1) was posted at the
front door or the Roanoke County Courthouse, Salem, Virginia;
(2) was posted at three places along the affected portion of
State Route 858; (3) was duly and legally advertised for two
weeks in the Roanoke Times ~ World News; and (4) was mailed to
the COImnissioner of the State Highway and Transportation
Department; and
v;HEREAS, thirty days have elapsed since the posting of the
aforesaid notice and no landowner has petitioned for a public
hearing in this matter.
NOW, THEREFORE, BE IT ORDERED by the Board of County
Supervisors of Roanoke County that the following described
portion of State Route 858 be, and the same hereby is, vacated,

closed, discontinued and abandoned:
That portion of State Route 858, situate in the Catawba
Magisterial District, and more particularly described as
follows:
Extending easterly and southerly for an approximate
distance of 440 fee~ from a point 600 feet South of
U. S. Routes 11 and 460, West of Salem to the right-
of-way of the Norfol!k and Western Railway Company.
Supervisor Myers moved that the Board concur with the
the recommendation of the Planning Conunission and approve the

Supervisor Johnson moved that the application of Cave

Spring First Aid and Rescue Squad, Inc. for renewal of their bin 0
permit be approved for th~ period January 1, 1979 through
December 31, 1979, which motion was adopted unanimously.
IN RE: BINGO PERMIT-FORT, LEWIS RESCUE SQUAD LADIES AUXILIARY
Supervisor Myers moved that the application of Fort Lewis
Rescue Squad Ladies Auxiliary for renewal of their bingo permit
be approved for the period January 1, 1979 through December 31,
1979, which motion was adopted unanimously.

PURCHASE OF PROPERTY-HOLLINS AREA

Mr. G. Steven Agee, Roanoke County citizen and an attorney,
appeared before the Board in regard to the recent acquisition
of property in the Hollins area. Mr. Agee expressed concern
over the (1) circumstance of the purchase and (2) the future
use of the property. Mr. Agee further questioned why the County
bought this property or a~y property, expressed concern over
the size of the tract and the fact that no public notice was
given whereby citizens could express their feelings. Hr. Agee
again questioned the purpose of the purchase and stated that
taxpayers question the need for such expansion after loss of
land due to annexation.
In response to Mr. Agee's remarks, Board Chairman Compton
advised that a firehouse in the Hollins area, which will be
designed to hold a new ladder truck will be the first but not
the only building on the site. Mr. Compton further advised
that other buildings to b~ constructed will be determined by a
feasibility study. Mr. Compton then raised questions on several
of Mr. Agee's comments. Mr. Agee advised that some of his
comments were rumors and were part of the reason he appeared
before the Board--to clarify any misgivings he or citizens may
have Supervisor Myers ~larified that the fire station is just
one building that will go on the site--other possibilities
would be County administration offices and possibly the Public

Service Authority offices. Supervisor Terry advised Mr. Agee
that the Board has been looking for land for quite some time.
There being no further comments, this concluded the
discussion.

IN RE: RESOLUTION NO. 2206 CONCURRING IN THE USE OF
SCHNABEL ENGINEERING ASSOCIATES FOR GEOTECHNICAL
ENGINEERING SERVICES DURING CONSTRUCTION OF THE
NEW JAIL
WHEREAS, Roanoke County is in receipt of a recommendation
from the VVKR Partnership that the firm of Schnabel Engineeri~g
Associates be engaged for geotechnical engineering services in
connection with the jail construction project; and
WHEREAS, said firm is the logical choice to perform on-site
inspections and tests for such things as compaction of fill
material and other observations and tests as they were employed
by the County to provide technical engineering services in
connection with foundation designs, core borings, etc.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that said Board concurs in the use
of Schnabel Engineering Associates for geotechnical engineering
services during construction of the jail.
BE IT FURTEER RESOLVED that the County Executive be, and
he is hereby, authorized to execute the necessary contracts for
this purpose.

IN RE: REFERRALS TO PLANNING COMMISSION
In a report to the Board, the County Executive advised
that the following petition for rezoning had been referred to
the County Planning Cornmission since the Supervisors' meeting
on November 14, 1978:
Petition of John M. Oakey, Inc. requesting rezoning frOTIi
B-1 to E-2 of 6.7726 acres presently m,med by F. L. Bowman
and located on the west side of Route 221, about 800 feet
south from its intersection with Route 1663 (Old Cave
~pring Road) and extending back from Route 221 in a
westerly direction about 750 feet to Route 1663 so that
a funeral chapel :r.1ay be constructed and operatec thereon.
In the same report, the County Executive attached cop; of
a letter dated November 14, 1975, addressed to the County
Planner from the attorney for John M. Oakey, Inc. requesting

that Oakey's be allowed to withdraw their petition filed on
October 27, 1978, which requested rezoning 14.32 acres on the
south side of Route 419 for a funeral chapel.
IN RE: RESOLUTION NO. 2207 DESIGNATING PERSONS AUTHORIZED
TO ACT ON BEHALF OF THE COUNTY OF ROANOKE TO ACCEPT
CONVEYANCES OF REAL ESTATE.
IT RESOLVED by the Board of County Supervisors of Roanoke
County that the persons serving as Chairman of said Board or
the Vice Chairman of said Board, either of whom may act, be,
and they are hereby, designated as persons authorized to act
on behalf of the County of Roanoke to execute acceptances on
deeds to real estate conveyed to the County pursuant to Section
15.1-286 of the Code of Virginia, as amended.
On motion of Supervisor Park and adopted by a unanimous
voice vote of the Board.

REQUEST TO ADD STREET IN BRIAR RIDGE SUBDIVISION,
SECTION 2, TO THE HIGHWAY SYSTEM
On motion of Supervisor Johnson and a unanimous voice
vote, the Virginia Department of Highways and Transportation
was this date requested to accept the following street in
Briar Ridge Subdivision, Section 2, into the State Secondary
System of Highways in Roanoke County:
Adrienne Circle from State Route 688 (Cotton Hill Road)
to end, a distance of 0.32 mile.
IN RE: RESOLUTION NO.2208 ACCEPTING CERTAIN GRANTS FROM
THE VIRGINIA DIVISION OF JUSTICE AND CRIME PREVENTION
AND THE VIRGINIA SUPREME COURT FOR THE CIRCUIT COURT
IN RE:

WHEREAS, the Virginia Division of Justice and Crime
Prevention and the Virginia Supreme Court have awarded to the
Roanoke County Circuit Court funds to participate in projects
to improve the safety and efficient operation of the Circuit
Court; and
WHEREAS, the Director of Finance has, in a report to the
Board dated December 28, 1978, recommended that the acts
hereinafter set out be accepted; and
WHEREAS, matching funds for these grants are included
in the 1978-79 Budget;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that the Grant #79-A4944 from the
Division of Justice and Crime Prevention for the improvement
of prosecution and court activities funded by the Division
of Justice and Crime Prevention and Grant #77-A4380 for a
telephone answering system from the Virginia Supreme Court,
a magnetometer, an opaque projector, and video equipment
funded through the Virginia Supreme Court be accepted by the
County of Roanoke.
BE IT FURTHER RESOLVED that the County Executive be
auth0rized 'to sign the appropriate acceptance forms and procure

the equipment outlined in the grant applications.

IN RE: RESOLUTION NO. 2210 ACCEPTING A BID FOR THE PURCFASE
OF MOBILE RADIOS FOR VARIOUS DEPARTMENTS OF ROANOKE
COUNTY
WHEREAS, on December 15, 1978 at 10:00 a.m. bids were
received and opened in the Department of Finance, Purchasing
Division, for the purchase of mobile radios for various
departments in the County; and
w~EREAS, the Purchasing Supervisor has, in report to the
Board dated December 28, 1978, recommended that the acts
hereinafter set out be accepted; and
WHEREAS, the funds for said mobile radios hereinafter
accepted are included in the 1978-79 Budget;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that the bid for said mobile
radios of the RCA Corporation in the amount of $18,905 be

accepted and said mobile radios to be used by the various
departments of Roanoke County; and the County Executive is
hereby directed to notify said bidder of the acceptance of
their bid and is authorized to execute the necessary contracts
for this purchase.

IN RE:
RESOLUTION NO. 2211 WAIVING THE REQUIREMENTS
OF THE ROANOKE COUNTY WATER ORDINANCE IN REGARD
TO CERTAIN PROPERTY
WHEREAS, Truck Enterprises has approached the Board of
County Supervisors of Roanoke County and requested that the
Water Ordinance heretofore adopted by said Board be waived in
certain respects in order to provide that water service to
said property may be provided by means other than Roanoke
County, by being allowed to drill a well to serve their facility
and
WHEREAS, the Board is of opinion that in this particular
instance, because of the hardships created, that certain
provisions of the Water Ordinance should be waived on the
condition that the well that is to be built meet the State
Health Department, Division of Engineering, approval and that
the well serve only the Truck Enterprise facility.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that said Board hereby waives the
requirements of the Roanoke County Water Ordinance contained in
Section 20.1-5 of the Roanoke County Code in regard to the
following described property only, said waiver being based upon
a demonstration by the property owner that strict compliance
with the provisions of the above section of the Water Ordinance
would impose an undue hardship and burden upon said property

owner;

BE IT FURTHER RESOLVED that this Board shall authorize
no further waiver unless and until it has been demonstrated to

RESOLUTION NO. 2212 AUTHORIZING WILLIAM C. OVERMAN
ASSOCIATES TO DESIGN CERTAIN WATER SYSTEM IMPROVE-
MENTS
WHEREAS, Roanoke County has heretofore commenced upon the
development of a County-wide water system; and
WHEREAS, in conjunction with said County-wide
certain water system improvements including storage
in some sections of the County have heretofore been authorized
water system,
facilities

and/or contructed; and
WHEREAS, at a meeting of the Roanoke County Public Service
Authority held on December 19, 1978, it was adopted to recommend
that additional storage facilities in the eastern portion of
Roanoke County and water transmission facilities in the south-
western portion of the County be implemented as further improve-
ments of the system; and
WHEREAS, the Board of County Supervisors of Roanoke County
does agree with the need for such improvements.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that said Board does hereby
authorize William C. Overman Associates to design the new tank
and related improvements in the eastern portion of the County
and the water main improvements on Route 419 for interconnection
of the Hidden Valley and Penn Forest systems.
BE IT FURTHER RESOLVED that bond money heretofore
authorized for water system improvements be utilized for these
two projects.

RESOLUTION NO. 12214 ACCEPTING A BID FOR THE
CONSTRUCTION OF A WATER STORAGE TANK IN ALGOMA
PARK
WHEREAS, the Board qf County Supervisors of Roanoke
County has heretofore undertaken the establishment of a
County-wide water system in order to provide water service
to the citizens of the County; and
WHEREAS, on November 28, 1978, bids were received and
opened at the Roanoke County Public Service Authority for the
construction of a water storage tank to be constructed in

Algoma Park; and
WHEREAS, by Letter Ballot dated December 22, 1978, the
Authority Board did approve to recommend to the Board of County
Supervisors that the construction of the Algoma Park water
storage tank be awarded to Southwest Construction, Inc.
NOW, THEREFORE, BE IT RESOLVED by the Board of County

Supervisors of Roanoke County that the bid for said
construction of the Algoma Park water storage tank by Southwest
Construction, Inc., in the amount of $97,480 be accepted, and
the County Executive is hereby authorized and directed to
notify said bidder of the acceptance of their said bid and is
authorized to execute the necessary contracts for this purpose.

RESOLUTION NO. 2215 AUTHORIZING THE ACQUISITION
OF THE WELL 'SITE ON WILLIAM BYRD HIGH SCHOOL
PROPERTY
WHEREAS, the Board of County Supervisors of Roanoke

County has heretofore undertaken the establishment of a
County-wide water system in order to provide water service to
the citizens of the County; and
WHEREAS, the Roanoke County School Board and the Roanoke
County Public Service Authority staff have met with respresent-
atives of the Board of Co,unty Supervisors and aeveloped an
arrangement whereby the County could possibly acquire the
School Board well site at the William Byrd School property in
Roanoke County; and
WHEREAS, the well, s,i te and chemical analys is have been
approved by the State Health Department; and

WHEREAS, in a report to the Board of County Supervisors
dated December 28, 1978, the Roanoke County Public Service
Authority advised that by Letter Ballot of the Authority dated
December 21, 1978, the acts hereinafter set out were approved;
and
I
WHEREAS, the Board of County Supervisors is of the opinion

that said acts are in the best interests of the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that action as necessary be taken
to request that the well site, including well and 100' x 100'
rectangular lot with minimum 50' radius around well casing, be
deeded to the County for development of a public water supply.
BE IT FURTHER RESOLVED that the proposed agreement be
approved by the respective Boards involved in order to cOwDlete
the transfer in accordance with agreement; and that the County
Executive is hereby authorized to execute the necessary document~
on behalf of the County for this purpose.

IN RE: RESOLUTION NO. 2216 ACCEPTING CERTAIN GRANTS FROM
THE VIRGINIA DEPARTMENT OF TRANSPORTATION SAFETY
FOR THE ROANOKE COUNTY SHERIFF'S DEPARTMENT
w~EREAS, by Resolution #2103 adopted on July 25, 1978,
the Board of County Supervisors approved the submission of
certain grant applications for highway safety funds; and
WHEREAS, the Virginia Highway Safety Council and the
Virginia Department of Transportation Safety has awarded to the
Roanoke County Sheriff's Department funds to participate in
three projects designed to improve the safety of citizens and
visitors using the Roanoke County streets and highways; and
WHEREAS, the Roanoke County Sheriff's Department has, in
a report to the Board dated December 28, 1978, recommended that
the acts hereinafter set out be accepted; and
WHEREAS, matching funds for these grants are included
in the 1978-79 budget.
NOvJ, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that the grant for Project No.
AL79-l6l-005-l designed to alleviate the problem of the use of
alcohol and drugs by motor vehicle operators in Roanoke County,
and the grant for Project No. PT79-l6l-08l-l providing for the
establishment of a special police traffic officer I'osition,
including a fully equipped police patrol vehicle and modern
radar detection devices and for the operation of this vehicle
during the project period, and the grant for Project No.
PT79-l6l-033-l providing for the establishment of special
selective enforcement patrols during those periods throughout
the year in which statistics show an increase in traffic crashe~
and involvement of drivers with intoxicating chemicals, and
for officers to work on an overtime basis to augment the
regular patrol complement of Roanoke County officers and for
their vehicle operation cost be accepted.

BE IT FURTHER RESOLVED that the Roanoke County Sheriff be,
and he is hereby, authorized to begin implementation of the
projects within the project application guidelines.
BE IT FURTHER RESOLVED that the Roanoke County Sheriff's
Department be, and the same is hereby, authorized to hire an
additional County Police Officer.
BE IT FINALLY RESOLVED that the County Executive be and he
is hereby,authorized to procure a police patrol vehicle and the
necessary radio and other police equipment for the vehicle and
to procure the radar units authorized, along with the necessary
camera and specialized communications equipment called for under

INTERIM APPOINTMENT OF ROBERT H. LOGAN AS ACTING
COUNTY ZONING ADMINISTP~TOR AND COUNTY PLANNER
Due to the resignation of Robert W. Hooper as County
Planner effective December 31, Supervisor Park moved that
Robert H. Logan, III, Planning Technician, be appointed to
act as County Zoning Administrator and as County Planner on an
interim basis, until a new Planner is hired. The motion was
adopted unanimously.

Chairman Compton advised the Supervisors that David A.
Updike has submitted his resignation as the Hollins District
representative on the Roanoke County Planning COlnmission
effective December 31, 1978. Hr. Compton further advised that
Mr. Updike is resigning since he is no longer a resident of the
Hollins District.
Mr. Compton then nominated Harvey L. Hales, Jr., 148
Plymouth Drive, N.W. to fill the unexpired term of Mr. Updike
on the Planning Commission, which term expires January 12, 1980.
Mr. Hales was appointed to serve in the above-mentioned
capacity by the following recorded vote:

IN RE: RESOLUTION NO. 2218 COMMENDING THE ROANOKE COUNTY/
SALEM CITY SCHOOL SYSTEM ON THEIR EXCELLENT
PERFORMANCE IN THE VIRGINIA GRADUATION COMPETENCY
TESTS
vJHEREAS, a testing system known as the Virginia Graduation
Competency Tests has been developed to determine students'
instructional needs related to the graduation competencies; and
WHEREAS, said tests have been given to Roanoke County/
Salem City tenth graders and their performance has been
reported; and
WHEREAS, 94 percent of the Roanoke County/Salem City
School students passed the Reading Test of the Virginia Graduatior
Competency Tests; and
WHEREAS, 95 percent of the Roanoke County/Salem City
School students passed the Mathematics Test of the Virginia
Graduation Competency Tests; and
WHEREAS, the Board of County Supervisors of Roanoke
County recognizes the merits of our school system and pledges
its continued cooperation and support of this program fully.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that said Board hereby conmlends
and congratulates the Roanoke County School Board, the school
administration teachers and students on their fine performance.
On motion of Supervisor Edward C. Park, Jr. and adopted

IN RE: NOTICE OF INTENTION TO AMEND ORDINANCE NO. 1178
REGARDING A CA~V SYSTEM IN ROANOKE COUNTY BY THE
ADDITION OF SECTION 3.1, TERRITORIAL AREA EXCLUDED
BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that a public hearing be held on January 23, 1979
at 7:00 p.m., at a regular meeting of the said Board at the
Salem-Roanoke County Civ{c Center, at which time it will be
moved that Ordinance No. 1178 be amended by the addition of
Section 3.1 as follows:
Section 3.1 Territorial Area Excluded
a. a portion of Sedtion 2 and the entirety of Section 3
of Fairway Forest lying south and west of the City of
Salem corporate 'limits and immediately south of the
Hidden Valley Country Club in the County of Roanoke.

This amendment to take effect on January 23, 1979.
This Clerk of this Board is directed to publish the
proposed amendment and notice of hearing thereon as required
by law, pursuant to Section 15.1-504 of the 1950 Code of

Virginia, as amended, once a week for two consecutive weeks
in the Roanoke Times and World News, a newspaper having a
general circulation in Rqanoke County.
Said proposed amendment and notice of hearing thereon
shall be published and posted at the front door of the Roanoke
County Courthouse.

Office of the Circuit Court of Roanoke and at the County
