The Board of County Supervisors of Roanoke County, Virginia, met this

day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the second Tuesday and the first regular meeting of the month.
Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson, May W. Johnson, and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:0S p.m. and recognized
Reverend Hugh E. Nichols, Central United }lethodist Church of Salem, who offered
the invocation. The Pledge of Allegiance to the flag was given in unison.

IN RE:
ORDINANCE NO. 1742 AMENDING THE ROANOKE COUNTY CODE BY DELETING SECTIONS
4-3 AND 4-4 AND ADOPTING NEW SECTIONS IN THEIR PLACE
WHEREAS, the Board of County Supervisors of Roanoke County deems certain
amendments to the Roanoke County Code to be necessary in the best interests of the
health, safety and general welfare of the citizens of Roanoke County; and
WHEREAS, a Notice of Intention to amend the Roanoke County Code as pro-
posed, and Public Hearing thereon, have been advertised and posted in accordance
with law.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of
Roanoke County that the Roanoke County Code be amended as follows:
I
Section 4-3. Hours of Operation.
It shall be unlawful for any person to operate or conduct a public dance
hall in the County between the hours of 2:00 a.m. and 6:00 a.m. of any day.
Section 4-4.
It shall be unlawful for any person to operate a public dance hall until
such time as he has secured a permit from the County Executive. An application
for such permit shall be filed with the County Executive, together with a fee of
$25.00 for the processing thereof. The County Executive shall call such investi-
gation as he deems necessary to be made in order to insure that the public dance

hall shall be operated in accordance with the prOVlSlons of law, in which case he
shall issue the permit. The permit shall be revocable should the operation of said
public dance hall be found to violate any provision of law in the County Code or
in the Code of Virginia. In causing such investigation to be made, the County
Executive shall insure that the proper business license has been applied for and
paid and shall further insure that the persons who are operating said public dance
hall have not been convicted of any criminal offense other than traffic violations.
This amendment to take effect on Hay 1, 1977.

IN RE:
SOLICITATIONS ORDINANCE
County Attorney Edward A. Natt appeared before the Board of County
Supervisors regarding the public hearing on adoption of an amendment to the Roanoke
County Code by the addition of a new chapter 16.1 entitled "Solicitations." Mr.
Natt briefly explained the proposed amendment.
At this point, Board Chairman Myers opened the floor to public comments.
Several citizens spoke on the proposed ordinance, nearly all opposed the amendment
due to the stigma it attaches to legitimate companies and the burden the fee places

on non-profit organizations. It was also suggested that the companies involved
have an input and work with the County Attorney in drawing up an ordinance that
would satisfy the whole and bring such back to the Board for its consideration. A
more complete record of public comments is filed with the minutes of this meeting.
Supervisor Johnson moved that the proposed ordinance regarding solicita-
tions be referred back to the County Attorney and that the public hearing be con-
tinued indefinitely.

REQUEST OF MASONS COVE RECREATION CLUB
were no objections to this request. He stated that the Masons Cove area was in
need of a park and recreational facility and that he had requested the County
Executive to obtain an appraisal on a parcel of land in the Catawba District.
This being a real estate matter, the County Executive suggested that the Board go
into Executive Session for discussion.

RESOLUTION NO. 1743 }~KING AN OFFER TO ACQUIRE A PARCEL OF REAL ESTATE
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore determined the necessity for constructing and developing additional parks and

recreational facilities in Roanoke County; and
WHEREAS, the Board desires to make an offer on a parcel of real estate
situate in the Catawba Magisterial District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby makes an offer to T. J. Raykes to acquire a
parcel of land containing 10 acres situate approximately 0.5 miles east of State
Route 311, said property being on the south side of State Route 912 in the Catawba
Magisterial District for the sum of $19,000.00.
BE IT FURTHER RESOLVED that the County Executive notify said property
owner of said offer and advise the property owner that said offer shall remain in
force and effect for a period of 30 days from this date.

COUNTY-WIDE WATER SYSTEM
Supervisor Compton moved that the County Executive be authorized and
directed to make application to the United States Army Corps of Engineers and
the Virginia Department of Health for permits providing authority for Roanoke
County to withdraw water from the Roanoke River and from Back Creek. The motion
was adopted by the unanimous voice vote of the Board.

REFERRALS TO PLANNING COMMISSION
In a report to the Board, the County Executive advised that the following
petition was referred to the County Planning Commission since the previous Board
meeting:

Request from LaMonte B. McChesney for a two-year extension of a special
exception permit allowing the operation of a used car lot at 7430 Williarr-
son Road (northwest corner of Plantation and Williamson Roads). This
property is presently occupied by Morris Motors.

RESOLUTION NO. 1744 SETTING A PUBLIC HEARING ON THE SETTING OF A LEVY ON
REAL ESTATE AND TANGIBLE PERSONAL PROPERTY
BE IT RESOLVED by the Board of County Supervisors of Roanoke County that
a public hearing be held at a special meeting of the Board of County Supervisors of
Roanoke County at the Northside High School auditorium on Tuesday, May 3, 1977, at
7:30 p.m., at which time there will be considered the setting of a levy for the
calendar year beginning January 1, 1977, and ending December 31, 1977, of a tax not
to exceed $3.60 per One Hundred Dollars of assessed valuation on all real estate iL
Roanoke County and on all taxable tangible personal property, excluding all those
classes of household goods and personal effects as are defined in Section 58-829.1

of the 1950 Code of Virginia, as amended to date, but including the property sepa-
rately classified by Sections 58-829; 58-829.3; 58-831.1; and 58-831.2 in the Code
of Virginia, 1950, as amended to date, located in this County on January 1, 1977,
and tangible personal property, including the property separately classified by
Sections 58-829; 58-829.3; 58-831; 58-831.1; and 58-831.2 in the Code of Virginia,
1950, as amended to date, of public service corporations based upon the assessment
thereof fixed by the State Corporation Commission and duly certified.
Such taxes, when and if appropriated by the Board of County Supervisors
of this County, shall be used to defray the County charges and expenses and all
necessary charges incident to or arising from the execution of the lawful authorit
of the Board of Supervisors of this County.
The Clerk of this Board is directed to publish the notice of the propose(

levy in the World News, a newspaper having general circulation in Roanoke County.
Said proposed resolution and notice of hearing thereon shall be publishe(
and posted at the front door of the Roanoke County Courthouse.
A copy of the proposed resolution is on file in the County Executive's
office at 302 East Main Street, Salem, Virginia.

Line Termination System for use of the Communications Division; and
WHEREAS, bids were opened on March 4, 1977 at 10:00 a.m. for the purchasE
of Line Termination System from Altecom and ITT; and
WHEREAS, a recommendation has been made by the Purchasing Supervisor and
the Director of Finance that the County purchase said Line Termination System from

Roanoke County that the bid of Altecom of California, in the amount of $3,081.00
for a Line Termination System be, and the same is hereby accepted, the County
Executive to notify said bidder of the acceptance of said bid and to complete the

RESOLUTION NO. 1748 AWARDING A CONTRACT FOR THE CONSTRUCTION OF BARRENS
ROAD TRANSMISSION MAIN
WHEREAS, bids were received and opened on March 15, 1977, for Project
77-l-W Barrens Road Transmission Main providing for the construction of an 8-inch
water line from the proposed storage tank north of Interstate 81 to connect to the
existing Starmount/Dwight Hills Water System; and
WHEREAS, the staff of the Roanoke County Public Service Authority has
reviewed the bids and recommended the award of said contract to the bidder herein-

after specified, which recommendation was approved by the Roanoke County Public
Service Authority by letter ballot; and
\~EREAS, the Board of County Supervisors concurs in said recommendation
and desires to award the bid as hereinafter set out.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby accepts the bid of E. C. Pace and Company for
the construction of the Barrens Road Transmission Main, Project 77-l-W, said con-
struction to be accomplished with ductile iron pipe; the bid of said company being

the lowest and best bid received by the County for construction of said project witl
the use of such ductile iron pipe.
BE IT FURTHER RESOLVED that the County Executive be and he is hereby
authorized and directed to enter into and execute on behalf of the County all con-
tracts and agreements required to be executed to accomplish said work.

Mr. David K. Lisk appeared before the Board and stated that he representEd
eight community service organizations who desire to have bingo permits. Consider-

able discussion took place as to the merits of the premises for the proposed use
and the question as to whether some of the organizations were County organizations.
Supervisor Compton moved that the matter be continued to the next regular
meeting of the Board for further investigation.

Supervisor Tompkins moved that the Board approve issuance of the permits
submit to review and verification by the County Attorney that the organization com-

Following review and verification by the County Attorney on the day after
the meeting, the following organizations were issued bingo permits effective April

At 9:45 p.m., Supervisor Johnson moved that the Board go into Executive
Session to discuss legal matters.
The motion was adopted by the following recorded vote:

At 10:15 p.m., the Supervisors returned to the meeting room and on the
motion of Supervisor Tompkins and the unanimous voice vote of the members, the
