The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem,
Virginia, this being the second Tuesday and the first regular meeting of
the month of June.

IN RE:
APPROVAL OF MINUTES
On motion of Supervisor Matthews and a unanimous voice vote, the
minutes of the meeting for May 27, 1980 were approved.
IN RE:
COUNTY BUDGET
I
Chairman Terry informed those in attendance that the County Budget
has not yet been adopted. He called for speakers who wish to comment on the
upcoming budget.
Mr. Claiborn Wilcox and Mrs. Marsha Cannon were present representing
the Red Cross of Roanoke Valley. Mr. Wilcox explained a new blood donation
program they would like to use in this area and requested as much funds as
may be available for this program.
Dr. Fred Roessel Jr., Director of Mental Health Services of Roanoke
Valley, was present to request that a modest increase be made to the tentativel
allocated $95,000 for this fiscal year's budget. No new programs are scheduled
for this year but the maintenance cost will be considerably more than last
fiscal year according to Dr. Roessel.

Cindy Trinkle, Director of Planned Parenthood of Roanoke Valley,
spoke regarding the birth control program for the Valley citizens. She cited
a need of $4,000 for operation expenses this fiscal year.
Mr. E. Cabell Brand, TAP Board of Directors, was present to request
that $33,600 be made available to TAP in this year's budget. He also stated
that out of a total of 250 employees, 52 are Roanoke County residents and
that TAP's total budget for this year was $4 million dollars. He informed
the Board of the various projects with which TAP is involved and of programs
which would be funded by TAP. Mr. Brand submitted an "Economic Impact State-
ment" which is filed with the minutes of this meeting.
Mr. John Dove and Mrs. Barbara Newbill were present requesting funds
stated that funds come from various sources, including United Way, to support

on behalf of the Child Abuse and Neglect program in the Roanoke area. They
this program.
Mr. Jack Hart, CASE representative, stated to the Board that, in
his opinion, if this proposed budget is adopted, it would be disastrous since
an increase in property taxes would be inevitable. He suggested that
Supervisors cut the budget now.

Mr. Natt informed the Board that owners propose to build a 40-unit
2 and 3 bedroom residences on this property. That units will be sold and
not rented. He submitted for review, a map of the proposed layout of units
and cited conditions which would be met by the developers.
After some discussion by the Board and residents of the area,
James Buchholtz, County Attorney, reminded the Board of Resolution

Supervisor Myers moved to deny this request.
No. 2571 adopted May 13, 1980, which states that the request for rezonings
be presented at one meeting and a decision be made at the next regular
meeting. But, if the Board so desired, they could rescind the policy and make
a decision at the first presentation of a request.
Supervisor Myers then moved to withdraw his motion and moved to

Tim Gubala, County Planner, stated he was familiar with the
type of mini-warehouses proposed for this property and that he felt this
rezoning would be in keeping with the area.
Edward Natt, Attorney, submitted a list of conditions with which
the developers will comply. He further submitted a petition of the residents
of the area who favor the rezoning.
Supervisor Myers moved to approve the request with conditions
submitted.
County Attorney James Buchholtz reminded Supervisor Myers of the
policy on rezonings.
Supervisor Myers then moved to withdraw his motion to approve

on her property.
Mr. Newman concurred with Mr. Hopkins regarding the debris along
the road and asked if something could be done to clean up. He then stated
his objection to the request of Mrs. Preece.

the City of Roanoke and Town of Vinton have adopted a similiar Ordinance

and that such an Ordinance in the County would be in keeping with those
jurisdictions.
ORDINANCE NO. 2593 PROVIDING FOR REGULATION OF
PERSONS WHO ARE DEALERS IN OR ARE IN THE BUSINESS
OF PURCHASING SECONDHAND OR USED SILVER, SILVER-
PLATED, GOLD, GOLD-PLATED OR PEWTER ITEMS, WATCHES
AND JEWELRY, GUNS AND COINS.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That there be and there hereby is established a Code for the
regulation of persons who are dealers in or are in the business of
purchasing secondhand or used silver, silver-plated, gold, gold-plated
or pewter items, watches and jewelry, guns and coins to read and provide
as follows:
DEALERS IN CERTAIN SECONDHAND MERCHANDISE
I
Section 1. Requirements of register for dealers in certain secondhand
merchandise.
Every person who is a dealer in or in the business of purchasing
secondhand or used silver, silver-plated~gold, gold-plated or pewter
flatware, tableware or other similar household items, watches and jewelry,
guns and coins shall keep at his place of business a register in which
he shall record with respect to each purchase of any of the foregoing
items the following information:

(a) a complete and accurate description of the goods,
articles or things purchased, including the number
of items;
(b) the time and date of receiving the same;
(c) the amount of money paid for the same; and
(d) the name and complete and accurate address of
the person selling the goods, articles or things
which information shall be taken from a valid driver's
license or special identification card issued by the
State Division of Motor Vehicles, together with a
particular description of such person.
Section 2. Access of law enforcement officers to register.
The register required to be maintained by Section 1 of this Code
shall be open to inspection by any federal, state or local law enforcement
officer during business hours.
Section 3. Examination of merchandise by law enforcement officers.
Every person who is a dealer in or in the business of purchasing
any of the items enumerated in Section 1 of this Code and every person
in the employ of such person shall admit to his premises during business
hours any federal, state or local law enforcement officer to examine any
item purchased and to search for and to take into possession any article
known by him to be missing or known or believed by him to have been
stolen.
Section 4. Purchases from minors prohibited.
No person who a dealer in or in the business of purchasing any
of the items enumerated in Section 1 of this Code shall purchase, buy or
receive, directly or indirectly, any such items from any person under
the age of eighteen (18) years of age.
Section 5. Penalties.
Violation of any provision of Section 1 through 4 of this Code shall
be a Class 2 misdemeanor punishable by a fine of not more than five hundred
dollars ($500.00) or by imprisonment in jail for not more than six (6) months
or by both such fine and imprisonment.
2. This Code shall be in full force and effect from and after the date
of its passage.

Major Meador, Sheriff's Dept. was present to represent Sheriff
Foster, he reminded the Board of a letter from Sheriff Foster (filed with the
minutes of this meeting) which states rules and regulations which would be

desirous if said Ordinance is approved. Major Meador spoke in favor of the
Ordinance if rules and regulations are followed. Major Meador further
informed the Board of insurance coverage for law enforcement officers which

covers their actions in the line of duty.
The Vice-President of the Virginia Security Association was present
to speak in opposition to this request. Other members of the Association
were also present. He cited incidents whereby off-duty officers had abused
their position and of several lawsuits involving these officers. He further
stated that, in his opinion, the County should not supply uniforms, ga~, and
cars at the taxpayers expense in order that officers be employed for private
gain.
After some discussion Supervisor Matthews moved to refer this matteI
to the County Attorney for further investigation of this matter; adopted by
unanimous voice vote.

At 9:45 p. m. Chairman Terry called the meeting to order and

REQUEST OF HILLS DEPARTMENT STORE FOR A "FIREWORKS *
DISPLAY PERMIT" TO SET OFF FIREWORKS JULY 4TH AT *
THE STORE LOCATED AT CAVE SPRING CORNERS AND * DENIED

Allen Kiger, Assistant Manager, Hills Department Store, presented
to the Board copies of insurance covering the New York Protechnic Product
Company who would be responsible for setting off fireworks. He stated
there would be no tangible debris or excessive noise from the fireworks.

Supervisor Terry stated that last year there was a traffic jam on
Route 419 and problems arose for the Sheriff's Department and that,in his
opinion, this should not be approved. Supervisor Terry moved to deny this
request which was adopted by unanimous voice vote.

REPORTS OF DEPARTMENTS, OFFICERS & COMMITTEES
County Administrator
Lease of County Property--Dixie Caverns
Administrator Clark informed the Board that the County's former
I
Dixie Caverns landfill has been used for dumping recently and that efforts
to stop trespassers have been futile. Mr. L. D. Hill has requested to use
approximately one-acre of this property to store heavy equipment. He has
offered to install a gate and assist the County in preventing unauthorized
use of the property. Therefore, the following resolution was adopted.
RESOLUTION NO. 2594 AUTHORIZING THE COUNTY
ADMINISTRATOR TO ENTER INTO A CERTAIN LEASE
AGREEMENT ON BEHALF OF ROANOKE COUNTY UPON
CERTAIN TERMS AND CONDITIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the County Administrator be, and he hereby is authorized
and directed to enter into a certain lease agreement with Mr. L. D. Hill
to provide for the lease of approximately one acre of the County's

property located near Dixie Caverns and formerly used by the County as a
landfill site, the said Mr. Hill to provide for security to the said
landfill site, and the leased portion of said site to be used for storage
of used equipment from Mr. Hill's crushed stone business and for no
other purpose; and
2. That the County Administrator shall enter into written agreement
with the said Mr. Hill containing provision for termination thereof upon
thirty days notice by either party and to be otherwise upon form approved
by the County Attorney.

REFERRALS TO PLANNING COMMISSION
(a) Petition of Virginia Asphalt Paving Company, Inc.
requesting rezoning from A-l to M-2 of a 7-acre
tract adjoining the 16.91 acres already owned by
Virginia Asphalt Paving and located on the south
side of Route 679 (Buck Mountain Road) about
1,000 feet east from the Blue Ridge Parkway bridge
in Cave Spring District. Rezoning is requested to
permit construction of an office building and shop
facility.

(b) Petition of Barry M. Fitzgerald requesting rezoning from
M-2 to RE of a 4.l3-acre tract on the east side of Route
639 between the Norfolk and Western railroad tracks and
the former Virginian railroad tracks in the Wabun section
of Catawba District. Rezoning is requested to permit
construction of a residence.
(c) Petition of W. W. Sink requesting rezoning from R-l to
A-I of about 18 acres lying on both sides of Enon Drive and
including four lots fronting on Carvin Street in Walrond
Court in Hollins District. Rezoning is requested because
the petitioner is of the opinion the land is unsuitable
for residential use.
IN RE:
TRANSIT SERVICE--TANGLEWOOD MALL AREA
Supervisor Johnson stated that she had a petition from Starkey
area residents who wished to support the Pendleton Bus Lines for that area
regarding public transportation, but they were unaware at the time that Mr.
Pendleton would not be continuing service for that area. In view of Mr.
Pendleton's decision to discontinue service, Supervisor Johnson moved to
approve the resolution prepared favoring Valley Metro bus service for the
Tanglewood area with an increase of $.10 for fares.
RESOLUTION NO. 2595 AUTHORIZING AND DIRECTING THE
COUNTY ADMINISTRATOR TO ENTER INTO A CERTAIN AGREEMENT
ON BEHALF OF THE COUNTY OF ROANOKE WITH THE CITY OF
ROANOKE TO PROVIDE CERTAIN BUS SERVICE WITHIN THE
COUNTY UPON CERTAIN TERMS AND CONDITIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the County Administrator be, and he hereby is authorized and
directed to execute a certain agreement on behalf of the County of Roanoke
with the City of Roanoke upon form approved by the County Attorney to
provide bus transportation along U. S. Route 220 and Virginia Highway
419 in Roanoke County to the Tanglewood Mall Shopping Center pursuant
to authorization contained in Section 15.1-526.2 of the 1950 Code of
Virginia, as amended; and
2. That the extension of such service shall specifically contain
provision authorizing the Board of Supervisors to from time to time
establish the rate of charge for such service into the County of
Roanoke; which said rate of charge is at the present time established

Gene Robertson, County Engineer, requested that an extension of 0.10
mile for Route 827 be approved. Mr. Robertson submitted a report with facts

RESOLUTION NO. 2599 ESTABLISHING A NEW PUBLIC ROADWAY THE
SAME BEING AN EXTENSION OF SECONDARY ROUTE 827.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the County Engineer, having heretofore been appointed by

the Board to view an extension of State Secondary Route 827 for a distance
of 0.1 mile and to establish the location thereof and to report thereon,
the report of the said County Engineer is hereby received and filed; and
2. That the County Engineer's report as herein received and filed

Michael Turner, Purchasing Supervisor, submitted a report which
states that a service contract is now available to the County for service
on 220 Motorola minitors used by the Fire and Emergency Services Department,
at a total cost of $9,900.00 which realizes a savings of $29,700 for a 5-year
period now covered at a cost of $39,600.00 by Lucky's Communications.
RESOLUTION NO. 2600 AUTHORIZING THE COUNTY
ADMINISTRATOR TO ENTER INTO A CERTAIN CONTRACT
TO PROVIDE MAINTENANCE SERVICE FOR CERTAIN FIRE
AND EMERGENCY SERVICES RADIOS UPON CERTAIN TERMS
AND CONDITIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the County Administrator be, and he hereby is authorized
and directed to accept a certain agreement with Motorola Communications
and Electronics for the servicing of two hundred twenty Motorola Minitors
for the fire and emergency services department of the County for the full
sum of $9,900.00, being $45.00 per unit, to provide for said two hundred
twenty units for a period of five years; and
2. That said servicing agreement shall be executed on behalf of the
County of Roanoke by the County Administrator upon form approved by the
County Attorney.

VEHICLES PURCHASED FROM GENERAL FUND REVENUES OF THE
COUNTY.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That from and after the date hereof all fire and rescue vehicles
of the County of Roanoke hereafter replaced by fire and rescue vehicles
purchased from general fund revenues of the County shall be and remain
the property of Roanoke County; and
2. The disposal of such replaced vehicles shall be as directed
by the Board of Supervisors of Roanoke County from time to time and
funds realized from such disposal shall be paid into the general fund
of the County of Roanoke.

IN RE:
HEARING OF CITIZENS
Mr. Newman Via spoke in regard to the trash and debris along the
road in the Loch Haven area and asked the Board to look into the matter to
see if this problem can be alleviated. He also informed the Board of a house
which is an eyesore and questioned if something could be done about the house.
Rev. Carl Tinsley, Vice-President NAACP, spoke in opposition to
the reappointment of E. Cabell Brand to the TAP Board of Directors.
Mrs. Betty Despar, County resident and employee at TAP, spoke in
favor of Mr. Brand's reappointment.
Stephen Johnston,
Associate Director of TAP, stated that in his
opinion, it would be a mistake not to reappoint Mr. Brand to the Board of
Directors.
Theodore Edlich III, Executive Director TAP, stated his opinion
favoring the reappointment of Mr. Brand.

INQUIRIES OF BOARD MEMBERS
Supervisor Johnson asked Michael Turner, Purchasing Supervisor, to
write a letter to the Clear brook Rescue Squad stating that monitors for them
have been ordered.
