I The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke Valley Civic Center in Salem, Virginia, this being the second Tuesday and the first regular meeting of the month. Members Present: Chairman May W. Johnson, Vice-Chairman E. Deal Tompkins, R. Wayne Compton, and Robert E. Myers, Absent: C. Lawrence Dodson. Chairman Johnson called the meeting to order at 7:00 p.m. and recognized Reverend John H. Roark, Covenant Presbyterian Church, who offered the invocation. IN RE: APPROVAL OF MINUTES On the motion of Supervisor Myers and the unanimous voice vote of the members present, the minutes of the regular meeting of September 14, 1976 and the I regular meeting of September 28, 1976 were approved as amended. IN RE: APPLICATION OF M. A. WALKER FOR A SPECIAL : EXCEPTION TO PARK A MOBILE HOME ON A I-ACRE : PORTION OF A 3. 75-ACRE TRACT OWNED BY A. The motion was adopted by the following recorded vote: AYES: Mr. Compton, Mr. Myers, Mr. Tompkins, Mrs. Johnson NAYS: None ABSENT: Mr. Dodson IN RE: VACATION OF A PORTION OF CERTAIN STREETS AND PARK, AS SHOWN ON THE PLAT OF BYDAWYLE ) ) ) FINAL ORDER WHEREAS, this Board, after giving careful consideration to said petition and to said recommendation, and after hearing evidence touching on the merits of said proposed vacation of the park and certain streets as shown on the plat of Bydawyle, being of the opinion that said park and streets should be vacated. I NOW, THEREFORE, BE IT RESOLVED and ORDERED that at this meeting of the Board of Supervisors of Roanoke County, Virginia, held on the 12th day of October, 1976, the park and following streets as shown on the plat of Bydawyle dated March 21, 1925, recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia in Deed Book 1029, page 822, be permanently vacated, discontinued and closed: 1. Belle Air Road - from its intersection with Hill Crest Road to its termination in Section 2. 2. Hill Crest Road - from its intersection with River Side Road to the northwest corner of Lot 58, Section 4. 3. Hill Crest Road - from a point opposite the line of Lots 4 and 5, Section 3 to its termination at Park Road. 4. River Side Road - from its intersection with Hill Crest Road to its termination in Section 4. I 5. Mountain View Road - from its intersection with Sleepy Hollow Road to its intersection with the unnamed connector between Mountain View Road and Hill Crest Road. 6. Bydawyle Road - from its intersection with Park Road to its termina- tion at the northeasterly corner of Lot 16, Section 5. 8. The park which lies between Sections 3, 4, 5, and 9. 10-12-76 3'2.(. I The force and effect of the recordation of the plat of Bydawyle is hereby destroyed as to the above stated park and streets hereby vacated, and the fee simple title to the vacated park and streets is vested in the owners of the abutting lots free and clear of any rights of the public or other owners of lots shown on the plat, but subject to the right of the owners of any public utility installations which have been previously erected therein; and be it further ORDERED that an attested copy of this Order be placed of record in the current deed book of the Clerk's Office of the Circuit Court for the County of Roanoke at the cost of the petitioners indexing the same on the General Index in the name of the County of Roanoke, as grantor, and the petitioners, as grantee; and be it further ORDERED that the Clerk is directed to comply with the provisions of Section 15.1-485 of the Code of Virginia of 1950, as amended, and write in plain, legible letters across that portion of the plat of Bydawyle affected the work "VACATED", and also make a reference on the plat to the volume and page in which this instrument of vacation is recorded. I BE IT FURTHER RESOLVED and ORDERED that the Clerk of this Board shall forthwith certify a copy of this resolution and order to the Secretary of the Planning Commission of Roanoke County, Virginia, and a copy to Smeltzer & Hart, attorneys for petitioners. The foregoing resolution was adopted on motion of Supervisor Myers, and on the recorded vote, the Supervisors voted as follows, to-wit: AYES: NAYS: ABSENT: Mr. Compton, Mr. Myers, Mr. Tompkins, Mrs. Johnson None Mr. Dodson IN RE: TAMARACK TRAIL Mr. Durward M. Stanley appeared before the Board regarding storm drain at the intersection of Tamarack Trail and Lofton Road, S.W. in Spring Valley Highlands I Subdivision. Mr. Stainley also advised the Supervisors of the poor condition of Tamarack Trail. Mr. William H. Worth, resident of Tamarack Trail, was also present at the meeting. Mr. Worth stated his main concern was the safety of children bycycling along the road in its present poor condition. Mr. Stanley requested the Board to give consideration to alocating funds to bring such roads up to State standards. Chairman Johnson advised that consideration would be given to the County allocating funds for the purpose of bringing certain subdivision streets up to State standards during the Board's budget study for next fiscal year. 10-12-76 830 IN RE: CONCURRENCE IN DEBT SCHEDULE BY ROANOKE CITY On the motion of Supervisor Tompkins and the unanimous voice vote of the members present, Resolution No. 23258 adopted by Roanoke City Council concurring in a certain debt schedule approved by the Board for payment by the City as a result of certain annexations of County territory to the City of Roanoke was this I date received and filed. IN RE: REQUEST OF TEMPO HOMES, INC. FOR A USE PERMIT On the motion of Supervisor Myers and the unanimous voice vote of the members present, the request of Tempo Homes, Inc. for a conditional use permit to conduct a construction-waste fill operation in a ravine between Section 10 of North Lakes and Section 1 of Meadow Wood was this date referred to the Planning Commission for review and recommendation. IN RE: SELECTION OF COUNTY SCHOOL BOARD MfllBERS Mr. Ralph W. Hart, President of the Roanoke County Council of P.T.A. 's, appeared before the Board and discussed the selection process of the Roanoke Count' School Board members. Mr. Hart requested the Board to defer any decision on adopt I ing a policy for selecting County School Board members until such time as a pro- posed resolution being considered by the County Council of P.T.A. 's has been given ample time to be circulated among P.T.A. units for approval or disapproval. Mr. Hart stated that the procedure set out in the proposed resolution provides for a more uniform method of selecting School Board members. Supervisor Myers moved that the Board continue indefinitely the matter regarding the selection process of County School Board members. The motion was adopted by the unanimous voice vote of the members presen . Kirk for rezoning from A-I to M-l of a 1 acre portion of an l8,8-acre tract located on the south side of State Route 624, approximately 4.5 miles west of Route 311 so that an automobile body shop may be operated thereon. 10-12-76 331 IN RE: FIREWORKS DISPLAY PERMIT - GLENVAR HIGH SCHOOL Supervisor Myers moved that the Board approve the request of Mr. Wilbur E. Grant, Band Director, Glenvar High School, to hold a fireworks disply on the premises of the stadium at Glenvar High School on Friday evening, October 15, 1976. I The motion was adopted by the unanimous voice vote of the members present IN RE: ALLOCATION OF FUNDS TO VOLUNTEER FIRE DEPARTMENTS Supervisor Compton moved that the Board concur in the report of the County Executive establishing a new policy for distribution of financial support to the County's volunteer fire companies, which report is filed with the minutes of this meeting. The motion was adopted by the unanimous voice vote of the members present IN RE: RESOLUTION NO. 1635 AUTHORIZING THE CONTINUATION OF A PAPER RECYCLING PROGRAM AND THE EXECUTION OF A CONTRACT THEREFOR WHEREAS, the Board of County Supervisors has heretofore authorized a 6-month experimental program in which the Roanoke Jaycees undertook a waste paper I and metal recycling program; and WHEREAS, the waste paper portion of said program was extremely successful and the Board of County Supervisors is of opinion that said program should be con- tinued for an additional 6-months; and WHEREAS, a contract with the Roanoke Jaycees, Incorporated, Cycle Systems Inc. and the respective governing bodies has been forwarded to the Board and has been approved by the County Attorney; and WHEREAS, the Board is of opinion that said contract should be approved and executed by the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby authorizes and approves the continuation of a waste paper recycling project in conjunction with the Roanoke Jaycees, Incorporated I and Cycle Systems, Inc. for an additional period of six months from the date of June 30, 1976, upon the terms and conditions set forth in the agreement forwarded to the County Executive by letter of September 29, 1976. BE IT FURTHER RESOLVED that the County Executive be and he is authorized and directed to execute said contract on behalf of the County as such contract has been approved by the County Attorney. On motion of Supervisor Tompkins and adopted by the following recorded vote: AYES: NAYS: ABSENT: Mr. Comtpon, Mr. Myers, Mr. Tompkins, Mrs. Johnson None Mr~ Dodson 10-12-76 3 IN RE: NOTICE OF INTENTION TO AJ1END THE ROANOKE COUNTY CODE BY THE ADOPTION OF A NEW SECTION NUMBERED 8.2-1. BE IT RESOLVED by the Board of County Supervisors of Roanoke County that a public hearing be held on November 9, 1976 at 7:00 p.m. at a regular meeting of the said Board at the Salem-Roanoke Valley Civic Center, at which time it will be Chapter 8.2 I moved that the Roanoke County Code be amended as follows: Fire Protection Section 8.2-1. Regulating the burning of woods, brush, etc.; penalties.- (a) It shall be unlawful for any owner or lessee of land to set fire to, or to procure another to set fire to, any woods, brush, logs, leaves, grass, debris, or other inflammable material upon such land unless he previously shall have taken all reasonable care and precaution, by having cut and piled the same or carefully cleared around the same, to prevent the spread of such fire to lands other than those owned or leased by him. It shall also be unlawful for any employee of any such owner or lessee of land to set fire to or to procure another to set fire to any woods, brush, logs, leaves, grass, debris, or other inflammable material, upon such land unless he shall have taken similar precautions to prevent the spread of such fire to any other land. (b) During the period beginning March first and ending May fifteenth of each year, even though the precautions required by the foregoing paragraph shall have been taken, it shall be unlawful, for any person to set fire to, or to procure another to set fire to, any brush, leaves, grass, debris or field containing dry grass or other inflammable material capable of spreading fire, located in or within three hundred feet of any woodland or brushland, except between the hours of four o'clock post meridian and twelve o'clock midnight. (c) The provisions of subsection (b) of this section shall not apply to any fires which may be set on rights of way of railroad companies by their duly authorized employees. I (d) Any person violating any prov~s~ons of this section shall, upon con- viction be fined not less than ten or more than one hundred dollars for each separate offense. If any forest fire shall originate as a result of the violations of any person of any provision of this section, such person shall, in addition to the above penalty, be liable to the State and to the county for the full amount of all expenses incurred by the State and the county respectively in suppressing such fire, such amounts to be recoverable by action brought by the State Forester in the name of the Commonwealth on behalf of the Commonwealth and by the board of supervisors on behalf of the county. This amendment to take effect on November 9, 1976. The Clerk of this Board is directed to publish the proposed amendment and notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the Code of Virginia, as amended, once a week for two consecutive weeks in the World News, a newspaper having a general circulation in Roanoke County. I IN RE: RESOLUTION NO. 1636 AUTHORIZING THE ACQUISITION OF THE BROOKWOOD WATER COMPANY WHEREAS, the Board of County Supervisors of Roanoke County has hereto- fore acquired the assets of the water system of Roanoke County Public Service Authority and has taken further steps to develop a Countywide water system; and 10-12-76 338 I WHEREAS, the staff of the County has nogotiated a contract with the owners of the Brookwood Water System providing the terms and conditions under which the County would acquire said water system; and WHEREAS, the Board desires the purchase said water system pursuant to the temrs and conditions of said agreement and incorporate said system into the County water system. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby authorizes and directs the Chairman and the Clerk to execute on behalf of said Board an agreement dated October 12, 1976, providing for the acquisition of the water system serving the Brookwood Subdivision, which system consists of certain real estate and other improvements together with certain personal property, the acquisition price of said system to be $7,500.00 which sum is deemed to be a fair and equitable consideration. BE IT FURTHER RESOLVED that, pursuant to the provisions of Section 15.1- 285 of the Code of Virginia as amended, that the Judge of the Circuit Court of Roanoke County be requested to appoint a discreet and competent attorney at law to examine title to said real estate and further that under the provisions of Section 15.1-286 of said Code that the County Attorney be required to approve the deed to said real estate when the same is prepared and that William F. Clark, County Execu tive, be and he is hereby authorized and directed to accept said deed on behalf of the County when title to said property has been examined and the Deed for the same has been approved by the County Attorney. BE IT FINALLY RESOLVED that the County Attorney be and he is hereby directed to forthwith deliver a copy of this resolution to the Judge of the Circui Court of Roanoke County. The foregoing resolution was adopted on motion of Supervisor Myers and the following recorded vote: I I AYES: NAYS: ABSENT: Mr. Compton, Mr. Myers, Mr. Tompkins, Mrs. Johnson None Mr. Dodson The computer print out for the previous month's expenditures was for information of the Supervisors and is filed in the office of the County Director of Finance. 334 10-12-76 IN RE: NOTICE OF INTENTION TO AMEND THE ROANOKE COUNTY CODE BY THE ADDITION OF A NEW SECTION NO. 19.5.2 ENTITLED FILING DATE FOR TANGIBLE PERSONAL PROPERTY TAX RETURN; PENALTY FOR FAILURE TO FILE BE IT RESOLVED by the Board of County Supervisors of Roanoke County that a public hearing be held on November 9, 1976 at 7:00 p.m. at a regular meeting of the said Board at the Salem-Roanoke Valley Civic Center, at which time it will be I moved that the Roanoke County Code be amended as follows: Chapter 19. Taxation Section 19-5.2. Filing date for tangible personal property tax return; penalty for failure to file. Returns for tangible personal property shall be filed with the Director of Finance on or before May 1 of the year for which the tax is to be assessed. An person who shall fail to file such return prior to May 1 of the year for which the tax is to be assessed shall, in addition to the tax to be paid, be assessed a penalty of 10% of the tax due for such tangible personal property or the sum of $10.00, whichever is greater. This amendment to take effect on November 9, 1976. I the State Secondary System of Highways in Roanoke County: IN RE: DISPOSITION OF STRAY DOGS Chairman Johnson directed the County Executive to contact Mrs. Lela Spitz, Chairman of a committee appointed by the Board to study disposition of stray dogs, and request Mrs. Spitz to submit a formal report to the Board on the subject by its October 28, 1976 meeting. The following items were for information of the Supervisors and are filec with the minutes of this meeting: Jail Report for the month of September, 1976. Statement of travel expenses incurred by the Sheriff's Department for the month of August, 1976. I Vice-Chairman Tompkins directed the County Executive to study the effect on Roanoke County should the Town of Vinton surrender its charter and report back to the Board his findings. IN RE: PAYROLL TAX Supervisor Myers moved that the Board go on record opposing the proposed City of Roanoke's payroll tax since such a tax imposes a burden on persons working in but not residing in the City, and further that the County Executive be directed to notify area legislators of the Board's opposition to said tax. J. Andrew, President of the Peters Creek Civic League, to rename a portion of Green Ridge Road, be referred to staff and Planning Commission for report and recommendation back to the Board for its consideration. The motion was adopted by the unanimous voice vote of the members present. IN RE: APPOINTMENT - ROANOKE COUNTY GRIEVANCE PANEL On the motion of Supervisor Tompkins and the unanimous voice vote of the members present, Mr. J. T. Kesler, Sr. from the Cave Spring District was appointed to serve as an alternate member on the Roanoke County Grievance Panel for a term of two years, which term ends on October 12, 1978.
