The Board of County Supervisors of Roanoke County, Virginia, met this I day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday and the second regular meeting of the month. Members Present: Chairman May W. Johnson, Vice-Chairman E. Deal Tompkins, R. Wayne Compton, C. Lawrence Dodson and Robert E. Myers. Chairman Johnson called the meeting to order at 7:00 p.m. and recognized Reverend Gordon L. Keller, Vinton Baptist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison. IN RE: RENEWAL APPLICATION OF LEWIS WOOLDRIDGE FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 6.9-ACRE TRACT LOCATED ON THE EAST SIDE OF STATE ROUTE 603, 1.2 MILE SOUTH OF U.S. ROUTE 11-460 IN THE COVE HOLLOW COMMUNITY CONTINUED I In relation to the above request, Mr. Wooldridge was present at the hearing. There was no opposition. Supervisor Myers asked Mr. Wooldridge if it was true that in addition to his mobile home there was the shell of a second mobilE home on his property. Mr. Wooldridge replied that there was; he had arranged for it to be moved but the mover was in the hospital. Supervisor Myers moved that the public hearing be continued to the January 11, 1977 meeting of the Board in order to allow Mr. Wooldridge time to have the shell moved. Mrs. Johnson asked why the shell was there. Mr. Wooldridge responded that it was the shell of a mobile home that had been burned out. Supervisor Tompkins suggested that the renewal be approved on the condition that the shell be moved. Supervisor Myers stated that the shell had been on the premises sometime and that the question of moving it had I been pending. Supervisor Myers repeated his motion to continue the public hearing to the next meeting. The motion was adopted by the unanimous voice vote of the Board. Board, Executive Vice President of the Chamber, was prese at the meeting and advised the additional contribution was being requested to help pay for promotional material prepared by the Chamber. Responding to a question from Mrs. Johnson, Mr. Board advised that next year's request for funds would be reducted by at least the $500 the Supervisors were presently considering allocating. IN RE: TOBACCO PRODUCTS On the motion of Supervisor Tompkins and the unanimous voice vote of the Board, Resolution No. 587, adopted by Vinton Town Council, requesting other Valley governing bodies to support the establishment of a Tobacco Tax Board for the purpos I of formulating and evaluating a taxing policy on the use and sale of tobacco pro- ducts in the Roanoke Valley was this date received and filed. IN RE: JAIL FACILITY On the motion of Supervisor Tompkins and the unanimous voice vote of the Board, the resolution adopted by the Roanoke Valley Chamber of Commerce urging the governing bodies of the City of Roanoke and the County of Roanoke to make every "last mile" effort in negotiations that could lead to a single jail facility was this date received and filed. IN RE: ITEMS REFERRED TO THE PLANNING COMMISSION On the motion of Supervisor Tompkins and the unanimous voice vote of the I Board, the following petition was this date received, filed, and referred to the Planning Commission for recommendation: Petition of Eugene B. Knighton for rezoning from B-2 to B-3 of Lots 1 and 2, Block 1, map of Yostland Heights, on Brambleton Avenue, and the issuance of a special exception so that the property may be used for an automobile car wash and used car lot. 12-28-76 395 IN RE: VEHICLE TITLE TRANSFER Supervisor Compton moved that the Board concur with the recommendation of the County Executive whereby title to the 1958 Dodge step van would be retained by the County Sheriff's department for use by communications personnel in exchange for I the Hollins Volunteer Fire Department and Rescue Aid No. 5 receiving title to a surplus jeep presently in use by the Sheriff's department. IN RE: SCHEDULING OF ANNUAL ORGANIZATIONAL MEETING The County Attorney reminded the Board that they should set the date and time for their organizational meeting for 1977 and suggested the early part of the I first week in January. Chairman Johnson suggested January 4, 1977, at 3:30 p.m. in the conference room adjoining the County Executive's office. This date and time met with the approval of the other Supervisors. WHEREAS, local funds for this grant have been approved in the current NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that a senior citizens grant in the amount of $41,522, to run from October 1, 1976 through September 30, 1977, be and the same is hereby accepted. The County Executive is hereby authorized to sign for said grant. BE IT FURTHER RESOLVED that a loan from the County of Roanoke's General Operating Fund in the amount of $4,266 until funds from the State are received is I hereby approved. R. Quick, developer of Spring Valley Highlands, Section 4, appeared before the Board and presented a map of said subdivision and urged the Supervisors to either grant waiver of the County Water Ordinance or reimburse him for extra costs involved in obtaining water service for his subdivision from the County instead of City of Roanoke. After discussion and consideration thereof, Supervisor Dodson moved that the Board concur with the recommendation of the Public Service Authority and deny waiver of the County Water Ordinance. The motion was adopted by the unanimous voice vote of the Board. IN RE: SCHOOL BOARD APPOINTMENT COMMITTEE REPORT Mr. Ralph Hart was present to speak on behalf of the committee which had prepared this Policy for Selection of County School Board members. He explained various preovisions of the Policy and urged the Supervisors to adopt it. Super- visor Tompkins did not agree with the provision which he felt would take away from individual Supervisors the power or prerogative to appoint a School Board member from his district. Supervisor Compton moved for approval of the policy. The Coun y I Attorney advised that if the policy recommended by the committee were to be made part of official County policy, a formal resolution should be prepared and adopted Supervisor Compton rescinded his original motion and moved that the County Attorne be directed to prepare a formal resolution, using the committee's recommendations as a guideline, for consideration at the next regular meeting of the Board. The motion was adopted by the unanimous voice vote of the Board. 12-28-76 ~Q(I - IN RE: REFUSE COLLECTION Supervisor Compton requested that the committee appointed to study the possibility of reduced refuse collection rate for the elderly and lower-income residents of the County schedule a meeting and make a recommendation on its finding I to the Board. IN RE: MASS TRANSIT The County Attorney was directed to prepare a resolution in opposition to the expenditure of funds for mass transit for the Board's consideration at its next regular meeting. Supervisor Compton stated that it had been brought to his attention that the developer of Meadewood Drive, map of Meadewood Subdivision, recorded in 1965, had shown on the subdivision map a 50-foot right of way for the street, but that since 1965 the developer had sold parcels of land in a manner which reduced the width of the right of way. He requested the County Engineer to investigate the mattpr. I IN RE: APPOINTMENT - ROANOKE COUNTY PLANNING COMMISSION Supervisor Dodson moved that Mrs. Sidney Smith be reappointed to serve as the Windsor Hills District representative on the Roanoke County Planning Commission for a term of four years beginning January 1, 1977 and ending January 1, 1981. BYERS AND BETTY IRENE BUTTERBAUGH BYERS WHEREAS, by deed of dedication dated June 15, 1968, duly executed and acknowledged by William A. Byers and Betty Irene Butterbaugh Byers, individually I and as husband and wife, which deed of dedication is of record in the Clerk's Offic3 of the Circuit Court of the County of Roanoke, Virginia, in Deed Book 855, at Page 786, the said William A. Byers and Betty Irene Butterbaugh Byers did give, grant and donate with Special Warranty of Title to the Public certain real property located in the County of Raonoke, Virginia, as described in said deed, a copy of which is attached hereto and incorporated herein and as further hereinafter des- cribed; and WHEREAS, the said deed of dedication to the Public was for use as a public street or roadway; and 12-28-76 WHEREAS, there has been no formal or informal acceptance of such dedica- tion by the County of Roanoke, which acceptance is necessary in order that title t the property in question may be vested together with the rights of use thereof in the Public; and WHEREAS, it is the desire of abutting property owners that the Board of I Supervisors of the County of Roanoke, Virginia, evidence acceptance of the dedica- tion of Parcels 2 and 3 as set forth in the deed aforesaid so that a public street or roadway may hereafter be established at the expense of private funds and not at the expense of the Public; and WHEREAS, it is recognized by the parties that the action of the Board of Supervisors in acceptance of the dedication is not sufficient to establish the real estate in question as a public road within the meaning and definition of the statutes of the Code of Virginia relating to the Virginia Department of Highways and Transportation but merely operates to accept dedication in the name of the Public and vest title of the real estate in question to the Public. Adopted on motion of Supervisor Compton, and the following recorded vote: AYES: Mr. Compton, Mr. Dodson, Mr. Myer~ Mr. Tompkins, Mrs. Johnson NAYS: None IN RE: JAIL FACILITY Mr. Crawford Calhoon, resident of the Windsor Hills District, appeared before the Board and stated that an informal survey of certain area residents had been conducted on the question of a regional jail facility. He said he believed the majority of all County citizens wanted one jail, regardless of the location. Chairman Johnson advised Mr. Calhoon that negotiations regarding a regional jail for the Valley or a jail to be jointly owned by two or more of the local jurisdic- I tions had been going on for approximately seven years. She stated that since the City of Salem had agreed to participate with the County in the construction of a jail, she felt their position had to be given consideration. Salem does not want a jail in the City of Roanoke, and the City of Roanoke refuses to consider the loca- tion of a jail anywhere except within the City of Roanoke. Mr. Calhoon said he had discussed the jail question with several of Roanoke City Councilmen and that it was his impression that they would be willing to compromise on the location. Superviso Dodson gave Mr. Calhoon a copy of the most recent letter from the Supervisors to thp City of Roanoke and told him that the County was still waiting for a response from the City. This concluded the business before the Board at this time, and on the I motion of Supervisor Tompkins and the unanimous voice vote of the members, the meeting was adjourned at 8:45 p.m. CHAIRMAN
