Civic Center - 521 ':' I I I I I I I I I I 1-2-76 Pursuant to the adjournment of the meeting of December 23, 1975, the I Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke Valley Civic Center in Salem, Virginia. Members Present: Mrs. May W. Johnson, Mr. E. Deal Tompkins, Mr. R. Wayne Compton, Reverend C. Lawrence Dodson and Mr. Robert E. Myers. Mr. William F. Clark, Clerk to the Board, called the meeting to order at 4:05 p.m. and introduced Reverend George Bowers, St. Mark1s Lutheran Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison. IN RE: CONSIDERATION OF TERMS FOR CHAIRMAN AND VICE CHAIRMAN On the motion of Supervisor Myers and the unanimous voice vote of the Board, the terms of office for Chairman and Vice Chairman were set for a period I of one year each. IN RE: ELECTION OF PERMANENT CHAIRMAN FOR THE CALENDAR YEAR 1976 The Clerk asked for nominations for permanent Chairman of the Board I for the calendar year 1976. Supervisor Tompkins nominated Supervisor Johnson to serve as permanent Chairman of the Board of County Supervisors for the calendar year 1976. There being no further nominations, the nominations were then closed. Mrs. May W. Johnson was elected to serve as permanent Chairman of the Board of County Supervisors for the calendar year 1976 by the following recorded vote: AYES: NAYS: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson None I Mrs. Johnson made a short speech of acceptance and requested to be called Chairman and addressed as Madam Chairman. IN RE: ELECTION OF PERMANENT VICE CHAIRMAN FOR THE CALENDAR YEAR 1976 Supervisor Myers nominated Supervisor Tompkins to serve as permanent ViCE Chairman of the Board of County Supervisors for the calendar year 1976. There being no further nominations, on the motion of Supervisor Dodson and the unanimous voice vote of the Board, the nominations were closed. Mr. E. Deal Tompkins was elected to serve as permanent Vice Chairman I of the Board of County Supervisors for the calendar year 1976 by the following recorded vote: AYES: NAYS: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson None Mr. Tompkins made a short speech of acceptance. IN RE: BOARD POll CY Chairman Johnson recognized Supervisor Myers who read a prepared statement of the Board's policy, which is filed with the official Board records. IN RE: ADOPTION OF RULES OF PROCEDURE Supervisor Tompkins moved that the Board operate under "Roberts Rules I of Order" as its rules of procedure, modified so as not to require a second to motions. The motion was adopted by the unanimous voice vote of the Board. IN RE: BOARD MEETINGS Supervisor Myers moved that the Board's regular meetings be held at 7:00 p.m. on the second and fourth Tuesdays of each month at the Salem-Roanoke Valley Civic Center. The motion was adopted by the unanimous voice vote of the Board. I 1-2-76 - 52. IN RE: PETITION OF OLLIE E. FRALIN, ET AL, FOR ) REZONING FROM B-2 TO B-3 OF A CERTAIN ) PARCEL OF LAND SITUATE ON THE EAST SIDE ) OF U. S. ROUTE 11, NORTH OF THE PROPERTY ) OF THE ROANOKE COCA-COLA BOTTLING CO.,INC. ) FI NAL ORDER WHEREAS, Ollie E. Fralin, et al, did petition the Board of Supervisors I to rezone certain property described in said petition, and to amend the Zoning Ordinance of Roanoke County so as to provide that certain property described in I I said petition be rezoned from Business District B-2 to Business District B-3, whichl I I I petition was filed at a regular meeting of this Board and referred to the Planning Commission of Roanoke County for recommendation; and WHEREAS, said Planning Commission by resolution adopted at a meeting held on the 16th day of December, 1975, after due advertisement and after hearing evidence touching on the merits of said Petition, recommended to this Board that said County Zoning Ordinance be amended so as to change the classification of the property described in said petition from Business District B-2 to Business District B-3; and WHEREAS, January 2, 1976, at 4:00 p.m., was set as the date and time I for public hearing on the aforesaid proposed amendment to the said County Zoning Ordinance after advertisement by notice duly published in accordance with law; and I WHEREAS, said public hearing was this day had on the said proposed lamendment; and WHEREAS, this Board after giving careful consideration to said petition, and to said recommendation of the Planning Commission, and hearing evidence touching on the merits of said proposed amendment, being of the opinion that said County Zoning Ordinance should be amended. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this meeting of the Board of Supervisors held on the 2nd day of January, 1976, the said Roanoke County Zoning Ordinance be, and the same is hereby amended so as to reclassify that certain parcel of land situate on the east side of U. S. Route 11, north of the I property of the Roanoke Coca-Cola Bottling Company, Inc. from Business District B-2 to Business District B-3. In relation to the above rezoning, Mr. W. H. Fralin, Attorney, appeared on behalf of the petitioners. There was no opposition. The foregoing resolution and order was adopted on motion of Supervisor Compton and the following recorded vote: AYES: NAYS: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson None ,...,,_., - 1-2-76 5'2.4 I IN RE: RESOLUTION NO. 1390 APPOINTING A COUNTY EXECUTIVE WHEREAS, Section 15.1-595 of the Code of Virginia requires the Board of County Supervisors to appoint a County Executive and to fix his compensation; and WHEREAS, the Board desires to designate the individual hereinafter named as County Executive at the salary hereinafter set out. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that I William F. Clark be, and he is hereby designated as County Executive, at an annual salary of $28,008 for the year 1976, said salary being subject to revision in up-coming budgets; the County Executive hereinabove named being required to fulfill all of the duties and responsibilities imposed upon him by the Code of Virginia. On motion of Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson NAYS: None IN RE: RESOLUTION NO. 1391 DESIGNATING THE COUNTY EXECUTIVE AS CLERK TO THE BOARD OF COUNTY SUPERVISORS WHEREAS, Section 15.1-610 of the Code of Virginia states that the I County Clerk shall be Clerk to the Board of County Supervisors unless the Board shall designate some other person for such purpose; and WHEREAS, the Board of County Supervisors desires to designate the County Executive to be Clerk to the Board of County Supervisors. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that the County Executive be, and he is hereby designated as Clerk to the said Board, it being the responsibility of said individual to execute all the powers conferred and perform all the duties imposed upon such Clerk by law. On motion of Supervisor Myers and adopted by the following recorded vote: AYES: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson NAYS: None I 1-2-76 - 5.2 IN RE: RESOLUTION NO. 1392 CREATING THE POSITION OF COUNTY ATTORNEY AND APPOINTING AN INDIVIDUAL TO FILL SAID POSITION WHEREAS, Section 15.1-608 of the Code of Virginia provides that under I the County Executive form of government the Board of County Supervisors may appoint a County Attorney who shall serve at an annual salary to be fixed by the Board of I County Supervisors; and WHEREAS, the Board of County Supervisors is of opinion that it is in the best interests of the County to create the position of County Attorney and to appoint said individual hereinafter named to fill said position at the salary hereinafter set out. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that the office of County Attorney be, and it is hereby created and that Edward A. Natt be, and he is hereby appointed to fill said position for the calendar year 1976, said individual to be hired at Grade 420 in the pay plan; it being the duty and responsibility of said County Attorney to fulfill all of the requirements imposed upon said office by statute. IN RE: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson None RESOLUTION NO. 1393 CREATING CERTAIN DEPARTMENTS WITHIN THE COUNTY GOVERNMENT WHEREAS, Section 15.1-604 of the Code of Virginia designates certain departments which must be created under the County Executive form and authorizes the establishment of certain additional departments; and WHEREAS, the Board of County Supervisors desires to create a Department of Extension and Continuing Education and a Department of Public Works in addition to the six required departments. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that I the following departments be, and they are hereby created: Department of Finance; Department of Public Welfare; Department of Law Enforcement; Department of Education; Department of Records; Department of Health; Department of Extension and Continuing Education and Department of Public Works. - 526 1-2-76 BE IT FURTHER RESOLVED that the organizational chart attached hereto be, and it is hereby adopted as the organizational set up for the administration of Roanoke County. On motion of Supervisor Myers and adopted by the unanimous voice vote of the Board. I On the motion of Supervisor Myers and the unanimous voice vote of the Board, the resolution reserving to the Board of Supervisors the appointment of various department heads and delegation of authority to appoint subordinates was deferred to the County Attorney for clarification and revision. Supervisor Compton suggested that the County Executive be advised of any and all new employees. APPOINTMENT - DIRECTOR OF FINANCE On the recommendation of the County Executive, Supervisor Myers moved that Mr. George F. Ferrell be appointed as Director of Finance for Roanoke County effective this date at an annual salary of $19,296. Clingenpeel be appointed as Supervisor of Assessments for Roanoke County effective this date at an annual salary of $15,216. L .. !)')~ 1-2-76 IN RE: RESOLUTION NO. 1394 DESIGNATING THE COUNTY EXECUTIVE AS ZONING ADMINISTRATOR WHEREAS, the requirements of the Code of Virginia require that an individual be designated as Zoning Administrator to perform all duties in connection with enforcement of the Zoning Ordinance of the County; and WHEREAS, the Board desires to designate the County Executive as Zoning I Administrator for Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the County Executive be, and he is hereby designated as Zoning Administrator for Roanoke County it being the responsibility of said Zoning Administrator to enforce all of the provisions of the Zoning Ordinance of Roanoke County. On motion of Supervisor Dodson and adopted by the unanimous voice vote of the Board. IN RE: RESOLUTION NO. 1395 ESTABLISHING CERTAIN FUNCTIONS OF THE COUNTY EXECUTIVE'S OFFICE WHEREAS, the County of Roanoke is presently involved in providing certain services which do not fall within the area of responsibility of any of the prescribed departments established under the County Executive form of I government; and WHEREAS, the Board of County Supervisors is of opinion that the p functions hereinafter identified should be established as functions of the County Executive's office. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the following be, and they are created as functions of the County Executive's office, the head of each such function to report directly to the County Executive: Library System Parks and Recreation Planning and Zoning On motion of Supervisor Tompkins and adopted by the unanimous voice I vote of the Board. 1-2-76 - 529 '.: IN RE: RESOLUTION NO. 1396 DESIGNATING THE MEMBERS OF THE ROANOKE COUNTY SCHOOL BOARD WHEREAS, Sections 15.1-609 and 15.1-609.1 provide that the Board of County Supervisors shall appoint the members of the County School Board and also provide for the method of appointment of the same. IN RE: RESOLUTION NO. 1397 CREATING THE COUNTY BOARD OF PUBLIC WELFARE I WHEREAS, Section 15.1-607 requires the appointment by the Board of County Supervisors of a County Board of Public Welfare in those counties having the County Executive form of government; and WHEREAS, the Board of County Supervisors desires to create said Board and to appoint the individuals hereinafter named to serve on said Board for the terms hereinafter set out. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that there is hereby created the County Board of Public Welfare and that the following individuals be and they are hereby appointed as members of the County Board of Public Welfare for the terms hereinafter set out: Mrs. C. Seibel has heretofore served as a member of the Roanoke County Public Service Authority and as liaison member of the Board of Supervisors to said Authority and in such capacity is extremely well versed in the affairs of said Authority; and I WHEREAS, the Board of County Supervisors is of opinion that his appoint- ment as an ex officio member of the Authority with the responsibility of keeping the Board of County Supervisors advised of the affairs of the Authority would be advantageous to said Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that John G. IN RE: APPOINTMENT - BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS Supervisor Compton moved that Mr. Norman Eugene Jarrett be appointed as the Hollins District representative on the Building Code Board of Adjustments and Appeals for a four-year term effective January 2, 1976 and ending January 2, 1980. IN RE: APPOINTMENT - INDUSTRIAL DEVELOPMENT AUTHORITY Supervisor Tompkins moved that Mr. Bill Triplett from the Vinton Districtl , i I I I be appointed to the Industrial Development Authority for a four-year term effective January 2, 1976 and ending January 2, 1980. The motion was adopted by the unanimous voice vote of the Board. IN RE: APPOINTMENT - MENTAL HEALTH SERVICES Supervisor Dodson moved that Mr. Billy K. Cruey be reappointed to serve as the County Representative on the Mental Health Services of the Roanoke Valley Board of Directors for a three-year term effective January 2, 1976 and ending January 2, 1979. The motion was adopted by the unanimous voice vote of the Board. I I .. 1-2-76 5~2 IN RE: CONFIRMATION OF AT-LARGE APPOINTEES - MENTAL HEALTH SERVICES BOARD Supervisor Tompkins moved that the Board confirm the following three persons to serve as at-large appointees on the Mental Health Services Board for three-year terms each commencing on January 1, 1976: Mrs. Dorothy L. Gibboney Mr. Glenn H. Simmers Mrs. Anna L. McClung The motion was adopted by the unanimous voice vote of the Board. I IN RE: HEALTH SERVICES PLANNING COUNCIL Supervisor Dodson moved that Supervisor E. Deal Tompkins be appointed to serve as a County representative on the Roanoke Valley Regional Health Services Planning Council, Inc. effective this date and ending January 28, 1978. The motion was adopted by the unanimous voice vote of the Board. IN RE: APPOINTMENT - CIVIC CENTER COMMISSION Supervisor Myers moved that R. Wayne Compton be appointed to serve as a County representative on the Salem-Roanoke Valley Civic Center Commission to fill the unexpired five-year term of Richard C. Flora, which term ends on I October 17, 1978. The motion was adopted by the unanimous voice vote of the Board. IN RE: APPOINTMENT - CIVIC CENTER COMMISSION Supervisor Myers moved that Mr. E. R. Bowery, Jr. be appointed to fill the unexpired three-year term of Mrs. Charles Glover as a County representative on the Salem-Roanoke Valley Civic Center Commission, which term ends on February 12, 1977. The motion was adopted by the unanimous voice vote of the Board. Prior to the adoption of the following resolution setting the salary for the Clerk of the Circuit Court, Supervisor Tompkins stated that according to State law the Board of Supervisors must set the salary for the Clerk of the Circuit Court and the Supervisors wish it clearly understood that the salar~ is I being set for the office not the individual. 1-2-76 - 533" IN RE: RESOLUTION NO. 1399 SETTING THE SALARY FOR THE CLERK OF THE CIRCUIT COURT WHEREAS, under the provisions of the County Executive form of government, it is the responsibility of the Board of County Supervisors to set the salary of the Clerk of the Circuit Court; and I WHEREAS, the Board of County Supervisors is of opinion that the salary hereinafter set out is an equitable salary for said position. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that the salary of the Clerk of the Circuit Court be, and the same is hereby set at $20,000, said salary to remain at such figure until changed by resolution of the Board of County Supervisors. On motion of Supervisor Tompkins and adopted by the following recorded vote: AYES: NAYS: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson None IN RE: RESOLUTION NO. 1400 INCORPORATING THE EMPLOYEES OF THE DEPARTMENT OF RECORDS INTO THE COUNTY'S CLASSIFICATION AND PAY PLAN I WHEREAS, the employees of the office of the Clerk of the Circuit Court of Roanoke County have heretofore not been included within the County's classifi- ,cation and pay plan; and WHEREAS, as a result of the transition to the County Executive Form of government the employees in said office become employees with the requirement that they come within the provisions of the County's classification and pay plan; and WHEREAS, the Board of County Supervisors desires to incorporate the hereinafter named individuals into the County.s classification and pay plan at the following grades and steps with the salaries as hereinafter set out. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the Library Board of Trustees heretofore created under the traditional form of county government be, and it is hereby abolished and further that pursuant to Section 42.1-36 of the Code, the Board of County Supervisors hereby places the I control of the library system under its jurisdiction and does not create a library board of trustees. On motion of Supervisor Compton and adopted by the unanimous voice vote of the Board. - 535 I In relation to the foregoing resolution abolishing the existing Library 1-2-76 Board of Trustees, Supervisor Dodson stated that during the construction of all County libraries the Library Board of Trustees gave sacrificial time. The only reason he voted for its abolishment is because of the change in the form of I government. IN RE: RESOLUTION NO. 1402 RECOGNIZING THE SERVICES OF THE FORMER LIBRARY BOARD OF TRUSTEES WHEREAS, the Board of Supervisors of Roanoke County did heretofore establish a Library Board of Trustees at a time when such a Board was necessary in order to improve library services to the citizens of Roanoke County; and WHEREAS, said Board accomplished the task charged to it and in the process thereof saw to the construction of new library facilities in various areas of the County, the result of which was that a majority of the citizens of the County had available to them excellent library facilities; and WHEREAS, the Board of County Supervisors desires to acknowledge the I work of the Library Board of Trustees of Roanoke County for a job well done in that said Board accomplished the task of providing excellent library facilities for a majority of the citizens of Roanoke County and together with said facilities I provided an extremely varied program for the citizens of the County. I NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board recognizes the accomplishments of the Library Board of Trustees in developing for the citizens of Roanoke County an outstanding library system comprised of excellent facilities and offering a wide variety of programs for the citizens of the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the County Board of Health be, and the same is hereby abolished pursuant to the authority contained in Section 15.1-611 of the Code of Virginia. IN RE: RESOLUTION NO. 1404 DELEGATING THE AUTHORITY TO SIGN CERTAIN CHECKS WHEREAS, the provisions of the County Executive form of government require that no money be disbursed or paid out by the County except upon checks signed by the Chairman, or some other designated person, and counter-signed by the Director of Finance; and WHEREAS, it is the opinion of the Board of County Supervisors that checks for the Department of Public Welfare and the Department of Education should I be signed by representatives of said departments rather than by the Chairman of the Board of County Supervisors. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that the Assistant Superintendent of Business and Finance of the Department of Education be, and he is hereby authorized and directed to sign check for the Department of Education and that the Superintendent of Public Welfare be, and she is hereby authorized and directed to sign checks for the Department of Public Welfare. Robinson and Associates has conducted a turn-over audit for Roanoke County effective December 31,1975; and WHEREAS, it is necessary for the Board of County Supervisors to authorize an individual to receive the assets of the County and to deposit and disburse them as required by law. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the Director of Finance be, and he is hereby authorized and directed to receive from Alfred C. Anderson, Former Treasurer, all of the assets of Roanoke County as of December 31, 1975. BE IT FURTHER RESOLVED that prior to receipt of the assets, the Director of Finance be bonded according to the provisions of the Code of Virginia. IN RE: RESOLUTION NO. 1408 WAIVING THE MANDATORY RETIREMENT AGE FOR CERTAIN EMPLOYEES AND RETAINING SAID EMPLOYEES AS EMPLOYEES OF THE COUNTY WHEREAS, Roanoke County has heretofore established personnel rules and regulations which include a mandatory retirement age of 65; and WHEREAS, it is the opinion of the Board of County Supervisors that said mandatory retirement age should be waived for the hereinafter named employees due to the fact that said employees are invaluable to the County on the basis of I experience and knowledge in their respective positions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that the following individuals be, and they are hereby authorized to be employed from the period from January 1, 1976 to January 1, 1977 and that the mandatory retire- ment age of 65 for said employees be, and it is hereby waived: Bi lly K. I 1-2-76 - 5 39 ~ IN RE: CONSIDERATION OF PARTICIPATION IN GREATER ROANOKE TRANSIT COMPANY I Supervisor Myers moved that the question of the County's participation in the Greater Roanoke Transit Company be tabled until further information is received. He stated that he cannot agree with the proposal submitted by the Greater Roanoke Transit Company Board of Directors as to what formula is proposed or how long the County would be participating. Supervisor Tompkins amended the motion by moving that a reply be sent to the Greater Roanoke Transit Company requesting further facts, as called for by Supervisor Myers, by the January 13, 1976 Board meeting. Chairman Johnson commented that the desired information would probably not be available by January 13. The County Executive advised that the County was being asked to participate on a mileage basis as outlined in the communication received from the Board of Directors of the Greater Roanoke Transit Company dated December 24, 1975. IN RE: RESOLUTION NO. 1409 RELATING TO THE TOWING OF VEHICLES AT THE REQUEST OF COUNTY DEPARTMENTS WHEREAS, on occasion it is necessary for various County departments to utilize the services of wreckers in order to tow vehicles to various locations; and WHEREAS, the Board of County Supervisors desires to establish a policy that, wherever possible, County departments utilize the services of wreckers owned I by individuals or companies having a Roanoke County or Town of Vinton business license. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that said Board hereby establishes a policy that departments of the County utilize the services of wreckers owned by individuals or companies having a Roanoke County or Town of Vinton business license except in situations where a wrecker capable of performing the required job is unavailable. ANDERSON AS TREASURER OF ROANOKE COUNTY WHEREAS, Alfred C. Anderson was, on November 2, 1971, elected to serve as Treasurer of Roanoke County for a term of four years; and WHEREAS, as the result of the transition to the County Executive form of government the position of Treasurer is no longer an elected position; and I WHEREAS, the Board of County Supervisors desires to recognize the services of Alfred C. Anderson as Treasurer of Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanoke County that said Board hereby expresses its appreciation for the services of Alfred C. Anderson as Treasurer of Roanoke County for four years; during which term Mr. Anderson performed the duties imposed upon him in an outstanding manner, serving both the County and the general public in making all attempts to collect the revenues due to Roanoke County and in all aspects of his job, serving his public in a most courteous manner. IN RE: RESOLUTION NO. 1411 RECOGNIZING THE SERVICES OF BILLY K. MUSE AS COMMISSIONER OF THE REVENUE FOR ROANOKE COUNTY WHEREAS, Billy K. Muse was appointed by the Judge of the Circuit Court of the County of Roanoke on January 2, 1968 to fill an unexpired term as Commissioner of Revenue and was elected on November 2, 1971 for a four-year term in said office; and WHEREAS, as the result of the transition to the County Executive form of government the position of Commissioner of the Revenue is no longer an elected positi on; and WHEREAS, the Board of County Supervisors desires to recognize the services of Mr. Muse as Commissioner of the Revenue for Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke I County that said Board hereby recognizes the extremely capable service rendered by Billy K. I IN RE: FIFTH PLANNING DISTRICT COMMISSION - 208 WASTE MANAGEMENT STUDY The request of the Fifth Planning District Commission for a meeting with the Board of Supervisors to discuss the 208 Waste Management Study was continued to the adjourned meeting of the Board to be held on January 5, 1976. IN RE: WESTERN VIRGINIA EMERGENCY MEDICAL SERVICES COUNCIL Supervisor Tompkins moved that the request from the Regional Health Services Planning Council for nominations of persons to serve on the Western Virginia Emergency Medical Services Council be tabled until the January 13, 1976 meeting of the Board. The motion was adopted by the unanimous voice vote of the Board. IN RE: BUDGET REQUESTS I The request of Planned Parenthood of Roanoke Valley, Inc. for funds in the 1976-77 County budget was before the Board. Supervisor Tompkins moved that this, and all such budget requests, be acknowledged administratively and referred to budget study. The motion was adopted by the unanimous voice vote of the Board. At this point, Chairman Johnson asked those present if anyone had business to bring before the Board. John Lancaster, Chief of the Bent Mountain Fire Department, identified himself and asked why Irvin L. Chilcoat, former Fire Coordinator for Roanoke County, had not been reappointed and further why the departments were not informed before it happened. Chairman Johnson advised Mr. Lancaster that under the County Executive form of government, the Board has I the right to appoint department heads and "this right we reserved by not reappointing Mr. Chilcoat." Mr. Lancaster said the fire departmentsfelt they have the right to know about what takes place in the fire service. Mrs. Johnson said the Board did not take office until January 1 and could not have informed anyone. She also repeated that portion of the statement of Board policy previously read by Supervisor Myers which pertained to fire departments. ,~ ..-. ~ .. - ,. At 5:30 p.m., on the motion of Supervisor Compton and the following recorded vote, the Board went into Executive Session to meet with the firemen present to discuss this personnel matter. AYES: Mr. Compton, Mr. Dodson, Mr. Myers, Mr. Tompkins, Mrs. Johnson NA YS: None I At 5:55 p.m., the Supervisors returned to the Civic Center and on the motion of Supervisor Tompkins and the unanimous voice vote of the members, the Board reconvened in open session. Supervisor Tompkins moved that in the light of what the Board heard in Executive Session that the Supervisors meet with the Volunteer Fire Chiefs' Board and with representatives of the volunteer organization in order to get more input into the decision on Mr. Chilcoat before the matter is completely closed. Mrs. Johnson said Mr. Chilcoat had already been notified that he was no longer a County employee. Mr. Tompkins suggested that Mr. Chilcoat be placed on leave of absence until the meeting or that he continue to be employed. Mr. Compton agreed that the Board should meet with the volunteer group and the Fire Chiefs. Board, but that the Board should stick to the decision it had previously made. I AYES: NAYS: Supervisor Tompkins moved that the Chilcoat matter be reopened and requested the Board to reconsider and further that Mr. Chilcoat continue to be employed by Roanoke County until such meeting had taken place. He also suggested that a representative of the paid County firefighters be invited to attend the projected meeting. Supervisor Tompkins suggested clarification of the proposed resolution pertaining to the hiring by department heads of their subordinates. Supervisor Myers moved that the present employees of the County remain employed and that the Board reserve the right to appoint the following individuals: Library Director, Parks and Recreation Director, Fire and Emergency Services Coordinator, Finance Director, Supervisor of Assessments, Superintendent of Public Welfare, County Health Officer, County Engineer, and County Planner. The motion was adopted by the unanimous voice vote of the Board.
