I The Board of Supervisors of Roanoke County met this day at the Salem-Roanoke Valley Civic Center in Salem, Virginia, being the fourth Tuesday and the second regular meeting of the month. Members Present: Chairman Richard C. Flora, Vice-Chairman John G. Seibel C. Lawrence Dodson and May Winn Johnson. Absent: R. E. Hilton, Jr. Chairman Flora called the meeting to order at 7:00 p.m. and recognized IReverend D. N. McGrady, West Salem Baptist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Flora. On the motion of Supervisor Seibel and the unanimous voice vote of the Imembers present, the minutes of the regular meeting of March 11, 1975 were approved as spread. W. Spradlin for a special exception to park a mobile home on a 1.006-acre tract located on the north side of Route 658 (Rutrough Road) about one mile west of the I Roanoke City limits be approved subject to the provisions of the County Zoning Ordinance as it pertains to Mobile Homes and a variance granted by the Board of Zoning Appeals with the stipulation that the mobile home be placed at a location that would not be visible from the roadway and that the variance be good for a period of two years. The motion was adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Hilton Mrs. Spradlin was present at the hearing. IN RE: ADOPTION OF ORDINANCE NO. 1216 AMENDING CHAPTER 14, REFUSE AND GARBAGE, OF THE ROANOKE COUNTY CODE AND ENTITLED RATES FOR DISPOSAL OF TIRES I WHEREAS, the Board of Supervisors deems certain amendments to the Roanoke County Code to be necessary in the best interests of the health, safety and general welfare of the citizens of Roanoke County; and WHEREAS, a Notice of Intention to amend the Roanoke County Code as proposed, and public hearing thereon, have been advertised and posted in accordanc with law. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, that the Roanoke County Code be amended as follows: Chapter 14. Refuse and Garbage, be amended by the addition of a new Section numbered 14-8.1 and entitled Rates for disposal of tires. Sect. 14-8.1. Rates for disposal of tires. The following rates shall apply for disposal of tires at the County landfill: I Any tire up to and including the 18 inch wheel size Any tire with wheel size between 19 and 22 inches, inclusive $ .50 per tire 1.00 per tire 1 I The motion was adopted by the unanimous voice vote of the members presentJ I I I I ! i I I I I I I I ~ At 8:10 p.m., the Supervisors returned to the Civic Center and the Board I reconvened in open session. I The Board took no action on the mobile home permit granted to Ms. Richard1. IAccording to the opinion of the County Attorney, the permit is valid until June 22, i 1975, at which time the mobile home must be moved or the permit will be null and II void. IN RE: BUDGET REQUEST - ROANOKE VALLEY BICENTENNIAL COMMISSION On the motion of Supervisor Johnson and the unanimous voice vote of the members present, the budget request of the Roanoke Valley Bicentennial Commission was referred to Budget Study Committee. I IN RE: BINGO PERMIT RENEWAL - VINTON LODGE 1121, LOYAL ORDER OF MOOSE Supervisor Seibel moved that the application of Vinton Lodge 1121, Loyal Order of Moose for renewal of their Bingo Permit be approved effective this date for a period of one year. IN RE: MOBILE HOME PERMIT - DEBRA KAY RICHARDS Mr. C. Richard Cranwell, Attorney, appeared before the Board regarding the conditions of the mobile home permit granted to Ms. Debra Kay Richards. S. and Frances J. Ferguson for vacation of a portion of the Plat of Homeland Hills, of record in Plat Book 8, Page 60, Clerk's Office of the Circuit Court for Roanoke County, said portion being a cul de sac on Ferguson Drive. I Petition of Ronald D. and Belva S. Forbes for rezoning approximately three acres located at 2602 Cannady Road, N. E., from R-l to A-l in order to construct and operate a greenhouse for the purpose of raising plants. Map of Cherry Hill Subdivision, Section 3 Status of Tanglewood Road IN RE: 1975/76 BUDGET Supervisor Seibel moved that the Board receive the 1975/76 Budget as presented by the County Administrator. The motion was adopted by the unanimous voice vote of the members present. The first Budget Study meeting of the Board was set for Wednesday, April 2, 1975 at 4:00 p.m. in the County Administrator's office. I IN RE: COMPREHENSIVE PLAN Mr. Donald J. Balzer, Planning Consultant, appeared before the Board and presented for the Board's preliminary consideration certain interim plans for anticipated growth within designated areas of the County over the next five to eight years. Supervisor Dodson moved that the Board receive the interim plans as I submitted by Mr. Balzer and that they be referred to the Planning Commission for its consideration and recommendation back to the Board. The motion was adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Flora NAYS: None ABSTAINING: Mr. Seibel I ABSENT: Mr. Hilton 3-25-75 JlIIIIiIt" ~ 20:5 IN RE: RESOLUTION NO. 1217 AUTHORIZING THE PURCHASE OF VEHICLES TO BE USED IN THE SHERIFF'S DEPARTMENT WHEREAS, the Sheriff of Roanoke County has heretofore appeared before the Board of Supervisors and requested that the County purchase seventeen vehicles for I use by his department, which request was referred to the County Administrator in I order that he seek bids for the acquisition of said vehicles; and - WHEREAS, bids were received and opened on Tuesday, March 18, 1975, in thel office of the County Administrator of Roanoke County for seventeen police cars, I funds for said vehicles to be appropriated in the current year's budget; and I WHEREAS, the County Administrator has recommended that the County purchast the vehicles from the bidder hereinafter specified, said bid being the lowest bid received fully complying with the County's specifications for said vehicles. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the bid of Beach Brothers Motors, Inc. for seventeen Dodge Monaco police pursuit vehicles in the amount of $73,662.75, said bid being the lowest and best bid fully complying with the County's specifications, be, and the same is I execute vote: AYES: INAYS: IABSENT: ! On motion of Supervisor Johnson and adopted by the following recorded Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora None i Mr. Hilton I I AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1218 i I On motion of Supervisor Seibel, the General Appropriation Ordinance of I l I Roanoke County, Virginia, adopted June 25, 1974, be, and the same is hereby amendedi as follows to become effective March 25, 1975: EXPENDITURES 4500 - Parks and Playground Facilities Fund 601b - Improvements to Catawba Center: An additional appropriation of $2,500 is hereby made from the Parks and Playground Facilities Fund for the period ending June 30, 1975 for the function and purpose hereinabove indicated. I AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora Adopted by the following recorded vote: NAYS: None ABSENT: Mr. Hilton - 3-25-75 IN RE: RESOLUTION NO. 1219 AUTHORIZING THE RENTAL OF CERTAIN PROPERTY OF THE BOARD OF SUPERVISORS WHEREAS, the Board of Supervisors has recently purchased approximately thirty-nine acres of property situate in the north County area for development of a park site, on which property are situate two houses which are presently leased to tenants; and I WHEREAS, the Board of Supervisors is desirous of entering into lease agreements with said tenants and has heretofore, by Resolution No. 1173, adopted January 14, 1975, authorized the execution of said leases; and WHEREAS, the Board of Supervisors is of opinion that the rentals hereto- fore paid by said tenants should be reduced to the figures hereinafter set out due to the fact that the heating systems in said houses are very inadequate. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby authorizes the reduction of the rentals to the tenant of the property heretofore purchased by Roanoke County for development of a north County park, said rentals to be as follows: a. The property leased to Alexander Hennesy and Ruth Hennesy to be leased for the sum of $50 per month. b. The property leased to Tina Batson to be leased for the sum of $85 per month. BE IT FURTHER RESOLVED that all other terms and provisions of said lease I agreement to be in a form approved by the County Attorney. On motion of Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Hilton IN RE: NOTICE OF INTENTION TO AMEND CHAPTER 7, BUILDINGS, OF THE ROANOKE COUNTY CODE, ENTITLED CERTAIN UNSAFE BUILDINGS BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that a public hearing be held on April 22, 1975 at 7:00 p.m. at a regular meeting of the Board of Supervisors of Roanoke County, held at the Salem-Roanoke Valley I Civic Center, at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 7. Buildings, amended by the addition of a new section, Section 7-7. Certain unsafe buildings. 3-25-75 . 2(~~ This amendment to take effect on April 22, 1975. The Clerk of this Board is directed to publish the proposed amendment and notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the 1950 Code of Virginia, as amended, once a week for two consecutive weeks, in I the Roanoke World News, a newspaper having a general circulation in Roanoke County. Said proposed amendment and notice of hearing thereon shall be published and posted at the front door of the Roanoke County Courthouse. I ~ 3-25-75 08 IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1220 On motion of Supervisor Dodson, the General Appropriation Ordinance of Roanoke County, Virginia, adopted June 25, 1974, be, and the same is hereby amended as follows to become effective April 1,1975: EXPENDITURES I 305c - Commonwealth1s Attorney 100 - Salaries: An additional appropriation of $1,800 is hereby made from the General Operating fund for the period ending June 30, 1975, for the function and purpose hereinabove indicated. On the motion of Supervisor Dodson and the unanimous voice vote of the members present, the statement of travel expenses incurred by the Sheriff's Department for the month of January, 1975, was this date received and filed. I IN RE: HIGHWAY SAFETY GRANTS On the motion of Supervisor Seibel and the unanimous voice vote of the members present, the following Highway Safety Grants were approved for filing: 315 - Police Traffic 311 - Emergency Medical Services 310 - Traffic Records IN RE: SCHOOL BUDGET - FISCAL YEAR 1975-76 Mr. Arnold R. Burton, Superintendent, Roanoke County Public Schools, and other representatives appeared before the Board and presented the School Budget for fiscal year 1975-76. On the motion of Supervisor Seibel and the unanimous voice vote of the members present, the School Budget for fiscal year 1975-76 was this date received by the Board for consideration during Budget Study. I '.' 3-25-75 IN RE: RESOLUTION NO. 1221 CANCELING THE SECOND MEETING OF THE BOARD OF SUPERVISORS IN JUNE AND THE FIRST MEETING OF THE BOARD OF SUPERVISORS IN JULY WHEREAS, the Board of Supervisors is required to meet no less than one time each month in regular session; and I WHEREAS, the Board of Supervisors desires to cancel their regular meeting scheduled for June 24, 1975 and July 8, 1975. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the regularly scheduled meetings of said Board set for June 24, 1975 and July 8, 1975 be, and they are hereby canceled. BE IT FURTHER RESOLVED that any business set for the aforesaid meetings be continued until the next regularly scheduled meeting of the Board of Supervisors BE IT FINALLY RESOLVED that the Clerk of the Board be, and he hereby is directed to publish this resolution once a week for two weeks in the Roanoke World News, a newspaper having general circulation in Roanoke County. Said resolution shall also be published and posted at the front door of the Roanoke County Courthouse. Nelson be reappointed to serve as the Master Plumber on the Roanoke County Plumbers Examining Board for a term of five years, ending on March 25, 1980. Sink be appointed to serve as the Journeyman Plumber on the Roanoke County Plumbers Examining Board for a term of five years, ending on March 25, 1980. The motion was adopted by the unanimous voice vote of the members I present. IN RE: APPOINTMENT - PLUMBERS EXAMINING BOARD Supervisor Johnson moved that Mr. W. W. McGuire, Roanoke County Plumbing Inspector, be reappointed to the Roanoke County Plumbers Examining Board for a term of five years, ending on March 25, 1980. The motion was adopted by the unanimous voice vote of the members present. IN RE: CONFIRMATION OF APPOINTMENT - ROANOKE VALLEY BICENTENNIAL COMMISSION Supervisor Johnson moved to confirm the appointment of Mr. James P. Woods, Jr. as one of the three County representatives on the Roanoke Valley Bicentennial Commission. I The motion was adopted by the unanimous voice vote of the members present. IN RE: APPOINTMENT - ROANOKE VALLEY BICENTENNIAL COMMISSION Supervisor Johnson moved that Mr. Marvin H. Boley be appointed to serve as one of the County's three representatives on the Roanoke Valley Bicentennial Commission. The motion was adopted by the unanimous voice vote of the members present. IN RE: APPOINTMENT - ROANOKE VALLEY BICENTENNIAL COMMISSION Supervisor Johnson moved that Mr. William K. Craft be appointed to serve Commission. I as one of the County's three representatives on the Roanoke Valley Bicentennial The motion was adopted by the unanimous voice vote of the members present. 3-25-75 .- 2.1 1 IN RE: MASON CREEK Mrs. Glenn Collins, resident of the Mason Cove area, appeared before the Board regarding the water problem at Mason Creek. On the motion of Supervisor Johnson and the unanimous voice vote of the I members present, the County Administrator was directed to contact the Marine and Navy reserves regarding the water problem at Mason Creek. Mr. Donald Pugh appeared before the Board regarding a situation whereby approximately ten school children do not have access to a school bus at Virginia and Ohio Avenue. On the motion of Supervisor Seibel and the unanimous voice vote of the members present, the matter regarding Virginia and Ohio Avenue was referred to the County Administrator and County Engineer for their recommendation and report back to the Board. IN RE: RESOLUTION NO. 1222 SETTING A PUBLIC HEARING ON THE SETTING OF A LEVY ON REAL ESTATE AND TANGIBLE PERSONAL PROPERTY I BE IT RESOLVED by the Board of Supervisors of Roanoke County that a public hearing be held at an adjourned meeting of the Board of Supervisors of Roanoke County at the Salem-Roanoke Valley Civic Center Community Room on April 15, 1975, at 7:00 p.m., at which time there will be considered the setting of a levy for the calendar year beginning January 1, 1975 and ending December 31, 1975, of a tax not to exceed $2.95 per One Hundred Dolllars of assessed valuation on all real estate situate in Roanoke County and on all taxable tangible personal property, excluding all those classes of household goods and personal effects as are defined in Section 58-829.1 of the 1950 Code of Virginia, as amended to date, but including the property separately classified by Sections 58-829; 58-829.3; 58-831.1; and 58-831.2 in the Code of Virginia, 1950, as amended to date, located in this County on January 1, 1975, and tangible personal property, including the property I separately classified by Sections 58-829; 58-829.3; 58-831; 58-831.1; and 58-831.2 in the Code of Virginia, 1950, as amended to date, of public service corporations based upon the assessment thereof fixed by the State Corporation Commission and duly certified. ~'~'- 3-25-75 Such taxes, when and if appropriated by the Board of Supervisors of this County, shall be used to defray the County charges and expenses and all necessary charges incident to or arising from the execution of the lawful authority of the Board of Supervisors of this County. The Clerk of this Board is directed to publish the notice of the proposed I levy in the World News, a newspaper having general circulation in Roanoke County. Said proposed resolution and notice of hearing thereon shall be published and posted at the front door of the Roanoke County Courthouse. A copy of the proposed resolution is on file in the County Administrator' Office at 306-A East Main Street, Salem, Virginia. On motion of Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Hilton Following adoption of the above resolution, it was discovered that the Civic Center was unavailable for said public hearing and all Board members, by telephone, approved rescheduling of the public hearing to April 16, 1975, at 7:00 p.m. at Northside High School, which time and place was advertised in accordance with this resolution. I IN RE: RESOLUTION NO. 1223 AUTHORIZING A STUDY BY CONSULTANTS ON A COURTHOUSE, JAIL AND ADMINISTRATION FACILITY WHEREAS, the Board of Supervisors of Roanoke County is aware of the urgent need for the construction of a jail, courthouse, and administration facilityl i i for Roanoke County; and I I WHEREAS, the Board of Supervisors of Roanoke County on February 25, 1975 I I appointed a Jail Study Committee to discuss with the City of Salem, the development of a County courthouse and jail facility; said County Committee having met with the City of Salem and discussed the possibility of such a project; and WHEREAS, the Board of Supervisors is of opinion that consultants should be retained to make a. feasibility study on certain aspects of construction of a courthouse, jail and administration facility; and I WHEREAS, the Board of Supervisors is of opinion that the firm of Smithey & Boynton, a partnership, is well qualified to prepare such a study and that an agreement should be entered into with Smithey & Boynton, a partnership, J providing for said firm's preparation of such feasibility study. .,t, .....~ r)- f 3-25-75 214 NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Chairman be, and he is hereby authorized and directed to enter into an agreement with Smithey & Boynton, a partnership, whereby said consultants agree to prepare a feasibility study on certain aspects of construction of a courthouse, jail and administration facility; said agreement to provide, among its other provisions, that the consultants shall be compensated by Roanoke County at a total cost not to exceed Nine Thousand Five Hundred Dollars, ($9,500), without approval I of the Board of Supervisors; as set out in said proposal, said study to be com- pleted within six weeks of receipt of all necessary information from the County; said agreement to otherwise be in such form as is approved by the County Attorney. On motion of Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Hilton IN RE: RESOLUTION NO. 1224 OFFERING TO PURCHASE CERTAIN PROPERTY OWNED BY SALEM-WEST CORPORATION I WHEREAS, the Board of Supervisors of Roanoke County did on the 11th day of September, 1974, enter into an Option for Purchase Agreement with Salem-West Corporation granting to the County the option to purchase eighty acres (80) of real estate owned by said corporation in the western portion of the County; and WHEREAS, said option expired on March 11, 1975, but has been extended by letter until April 1, 1975, and the Board of Supervisors of Roanoke County desires to make an offer for the purchase of said land pursuant to the provisions of said Purchase Option Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby offers to purchase the approximate eighty acres (80) of real estate described in the Option for Purchase dated the 11th day of September, 1974, between Salem-West Corporation and the County of Roanoke for the sum of One Hundred Eighty-five Thousand Five Hundred Dollars ($185,500).
