The Board of Supervisors of Roanoke County met this day at the Salem- I Roanoke Valley Civic Center in Salem, Virginia, being the second Tuesday and the first regular meeting of the month. Members Present: Chairman Richard C. Flora, Vice-Chairman John G. Seibel and R. E. Hilton, Jr. Absent: C. Lawrence Dodson and May Winn Johnson. Chairman Flora called the meeting to order at 7:04 p.m. and recognized Reverend Hugh E. Nichols, Central Methodist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Flora. On the motion of Supervisor Hilton and the unanimous voice vote of the members present, the minutes of the regular meeting of March 25, 1975, were approved as spread. IN RE: APPLICATION OF ALFRED O. KING FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A NINE ACRE TRACT LOCATED ABOUT 1.3 MILES WEST OF ROUTE 221 ON ROUTE 688 NEAR ROUTE 854 A P PRO V E D I Supervisor Seibel moved that the application of Alfred O. King for a special exception to park a mobile home on a nine-acre tract located about 1.3 miles west of Route 221 on Route 688 near Route 854 be approved subject to the provisions of the County Zoning Ordinance as it pertains to Mobile Homes and a variance granted by the Board of Zoning Appeals with the stipulation that the mobile home be placed at a location that would not be visible from the roadway. The motion was adopted by the following recorded vote: AYES: Mr. Hilton, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Dodson, Mrs. Johnson Mr. Alfred King was present at the public hearing. SMITH TO PERMANENTLY VACATE, DIS- ) CONTINUE AND CLOSE THAT PORTION OF COLONY ) FIN A LOR 0 E R LAND IN GREEN VALLEYS SUBDIVISION NEAR ) FAIRBURN DRIVE AND ROUTE 419 ) I WHEREAS, James B. Sink, Carroll L. and Vivian W. Smith have heretofore lfiled a petition requesting, pursuant to Section 14.1-482(b) of the 1950 Code of Virginia, as amended, that a portion of Colony Lane shown on the plat of Green Valleys Subdivision, Section 1, which has never been improved, opened or used and 4-8-75 218 I lis what is commonly referred to as a "paper street," be permanently vacated, dis- continued and closed; said portion of said Colony Lane being described in said petition and also shown on a plat attached to said petition showing in red the portion to be closed; and WHEREAS, this Board at its meeting on September 10, 1974, referred the I matter to the Planning Commission for its report and recommendation; and WHEREAS, the Planning Commission at a regular meeting held on September 17, 1974, after due and proper advertisement and notice to all property owners fully considered the said petition and reported to the Board by resolution, recommending that the portion of Colony Lane in question, including that portion of the platted street hereinabove mentioned and shown thereon, be permanently vacated, discontinued and closed, reserving, however, for the use of the general public a 10 foot drainage easement, the center line of said portion of said Colony Lane to be the center line of said 10 foot drainage easement, the said easement being located 5 feet on each side thereof, which said easement shall not be obstructed hereafter, and extending from Virginia Route 419 to Colony Lane and Fairburn Drive intersection; and WHEREAS, on this day a public hearing was held by the Board after I advertisement as required by law and a full opportunity was accorded all interested parties to express their views concerning the petition and the closing of said portion of said Colony Lane; and WHEREAS, at the conclusion of said public hearing and after full con- sideration of the matter, this Board is of the opinion that a vacation of that portion of Colony Lane, shown on the plat in question, is proper and would promote the public interest, prosperity and welfare of the citizens of Roanoke County; and WHEREAS, all requirements of law have been complied with. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Board of Supervisors of Roanoke County that, pursuant to Section 15.1-482(b) of the 1950 Code of Vir- ginia, as amended, the portion of Green Valleys hereafter described and that portion of Colony Lane contained within the following description be permanently I vacated, discontinued and closed: .:........ . ~i,;-$f~x... 4-8-75 I BEING all that unopened, unused portion of Colony Lane lying westerly of the point of curve on the easterly boundary line of Lot 1, Block 5, and point of curve on the easterly line of Lot 9, Block 4, as shown on the Map of Green Valleys, Plat Book 3, Page 153, and extending in a southwesterly direction to the northerly boundary line of Virginia State Route 419, said portion to be closed being shown in red on the plat showing portion of Colony Lane to be vacated and closed, made by David Dick and Associates, Engineers and Surveyors, dated August 14, 1974, a copy thereof being attached to the petition and which said plat is to be recorded with the recordation of this order, reserving, however, for the use of the general public a 10 foot drainage easement, the center line of said portion of said Colony Lane to be the center line of said 10 foot drainage easement and the easement being located 5 feet on each side thereof, which said easement shall not be obstructed hereafter and which said easement may at all times be used for the benefit of the public for any purpose or use that may be deemed appropriate hereafter for drainage purposes. IN RE: REGIONAL LANDFILL AGREEMENT Supervisor Seibel moved that the communication from the Town of Vinton requesting Roanoke County to execute the Regional Landfill Agreement be received and that the Board study further the proposed Regional Landfill Agreement. I The motion was adopted by the unanimous voice vote of the members present. ~?....~ '. '('~ 4-8-75 2 20~, IN RE: RESOLUTION NO. 1225 WITHDRAWING AS A MEMBER OF THE FIFTH PLANNING DISTRICT WHEREAS, Roanoke County has, since the organization of the Fifth Planning District Commission, been a member of said organization and has contributed its share of funds to the operation of said organization; and WHEREAS, the Board of Supervisors is of opinion that the Fifth Planning I District Commission provides no beneficial services to Roanoke County which Roanoke County cannot receive elsewhere other than to review applications for State and Federal aid; and WHEREAS, members of the Board of Supervisors are greatly concerned with the lack of organization and guidelines for the performance of the functions of said Planning District Commission, which lack of organization and guidelines result in no uniform set of standards for the operation of said Commission so as to treat all member jurisdictions equally; and WHEREAS, members of the Board of Supervisors are concerned about indiscriminate spending of Federal, State and Local funds by said Commission on projects which have not fully been evaluated in order to determine the necessity NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke I of said projects. County that said Board, for the reasons herein stated and for other reasons associated therewith, withdraws and resigns its membership in the Fifth Planning District Commission, said withdrawal and resignation to be effective June 30, 1975. Mr. C. Darrell Shell, Past President, League of Older Americans, Inc. appeared before the Board and submitted a budget request in the amount of $10,781. Supervisor Seibel moved that 50 percent of the budget request submitted by the League of Older Americans, Inc. be considered in the proposed 75-76 County I Budget. AYES: NAYS: ABSENT: The motion was adopted by the following recorded vote: Mr. Seibel, Mr. Flora Mr. Hil ton Mr. Dodson, Mrs. Johnson 4-8-75 IN RE: JAIL FACILITIES Supervisor Hilton moved that the County Administrator be directed to express the County.s interest in knowing more of the details concerning the County's possible use of proposed new jail facilities to be constructed by the I City of Roanoke and that the City be requested to submit an estimate of the probabl per diem cost and the length of contract which would be offered to the County; and ! further, that this information be provided to the County by May 8, 1975. The motion was adopted by the unanimous voice vote of the members present I I I I I i I I I ! ! i , , IN RE: TRANSPORTATION DISTRICT, REGIONAL On the motion of Supervisor Hilton and the unanimous voice vote of the members present, copy of a Resolution advising that the Greater Roanoke Transit Company intends to become a Regional Transportation District and has adopted the name "Valley Metro" was this date received and filed. I heretofore made available to Roanoke County the use of the facilities of the New I River Valley Juvenile Detention Home on a space available basis without the benefit I I I On the motion of Supervisor Hilton and the unanimous voice vote of the members present, the following item was this date received, filed and referred the Planning Commission for its recommendation: Petition of Billy Hooker Harbour for rezoning a tract of land containing approximately .41 acre located on the north side of Route 220, about 350 feet south of the City of Roanoke, south corporate line, known as Patricia's Family Restaurant (3505 Franklin Road, S.W.) from B-2 to B-3 in order to construct a 50-foot extension to the present building on said property. I IN RE: I RESOLUTION NO. 1226 AUTHORIZING AND DIRECTING THE EXECUTION OF AN AGREEMENT FOR THE USE OF THE NEW RIVER VALLEY JUVENILE DETENTION HOME WHEREAS, the New River Valley Juvenile Detention Home Commission has of any formal written agreement between the parties; and I WHEREAS, said Commission has requested that the Board of Supervisors the execution of an agreement providing for the use of the New River :authori ze I IValley Juvenile Detention Home day for each juvenile detained I ! facilities by Roanoke County at a cost of $10.43 per I at said home; and WHEREAS, the County Administrator has recommended that the Board enter I into an agreement with the New River Valley Juvenile Detention Home Commission, saidl agreement to provide for the payment of $10.43 per day per juvenile, said rate to be ..~.. ,,~~...,; ~, 4-8-75 ,'~25 reviewes and adjusted at such times as the State Board of Corrections approves revisions to said rate, in which recommendation the Board concurs. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Chairman and Clerk be, and they are hereby authorized and directed to execute on behalf of the County an agreement with the New River Valley Juvenile I Detention Home Commission whereby said Commission shall make available to Roanoke County the use of facilities of the New River Valley Juvenile Detention Home at the rate of $10.43 per day per juvenile; said rate to be adjusted at such times as the State Board of Corrections approves adjustments in said costs, said agreement to otherwise be in such form as is approved by the County Attorney. On motion of Supervisor Seibel and adopted by the following recorded vote: AYES: Mr. Hilton, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Dodson, Mrs. Johnson IN RE: RESOLUTION NO. 1227 AUTHORIZING THE EXECUTION OF A CONTRACT FOR THE CONSTRUCTION OF THE CLEARBROOK PUBLIC SAFETY BUILDING I WHEREAS, the Board of Supervisors has recently purchased a parcel of land in the Clearbrook section of Roanoke County as the site for the construction of a new Clearbrook Public Safety Building; and WHEREAS, bids were received and opened on Tuesday, March 25, 1975, at the Salem-Roanoke Valley Civic Center for the proposed Clearbrook Public Safety Buildinc, a portion of the funds for the construction of said building having been heretofore appropriated and the remaining funds contemporaneously herewith; and WHEREAS, the County Administrator has recommended that the County award the contract for the construction of said building to Frye Building Company, the bid of said company being the lowest and best bid received fully complying with the County.s specifications for the construction of said building. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke I County that the bid of Frye Building Company for the construction of the Clearbrook Public Safety Building in the amount of $211,000, for building Type 2 as set out in said bid proposal, said bid being the lowest and best bid fully complying with the County's specifications, be, and the same is hereby accepted; the County Administra tor being authorized and directed to execute on behalf of Roanoke County a contract with said company in such form as is approved by the County Attorney. 4-8-75 ,:~ 2- 2.. On motion of Supervisor Hilton and adopted by the following recorded vote AYES: Mr. Hilton, Mr. Seibel, Mr. Flora NAYS: None ABSENT: Mr. Dodson, Mrs. Johnson I IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1228 On motion of Supervisor Hilton, the General Appropriation Ordinance of Roanoke County, Virginia, adopted June 25, 1974, be, and the same is hereby, amended as follows to become effective April 8, 1975: EXPENDITURES 1400 - Federal Revenue Sharing Fund None Clearbrook Public Safety Building: An additional appropriation of $167,285 is hereby made from the Federal Revenue Sharing Fund for the! period ending June 30, 1975 for the function and purpose hereinabove I indicated. IN RE: i RESOLUTION NO. 1229 AUTHORIZING PAVING IMPROVEMENTS AT CERTAIN PARK AND PUBLIC SAFETY FACILITIES IN ROANOKE COUNTY WHEREAS, funds are available out of the present County budget for several projects involving the placing of bituminous paving improvements at certain park and public safety facilities in Roanoke County; and I WHEREAS, bids were received and opened on Friday, March 28, 1975, in the office of the County Administrator of Roanoke County for said paving improvements; land i WHEREAS, the County Administrator has recommended that the bid of Adams I Construction Company for said work be accepted, said bid being the lowest and best bid fully meeting the County's specifications. Mr. T. T. Moore, President, Roanoke Valley Regional Health Services Planning Council, Inc., appeared before the Board requesting Board's reconsidera- tion of the Agency's budget request. Mr. Moore also presented to the Board a Supervisor Seibel moved that the Board reconsider the budget request of I summary report of the Health Services Planning Council. the Roanoke Valley Regional Health Services Planning Council, Inc. for the 1975-76 proposed County budget. The motion was defeated by the following recorded vote: AYES: Mr. Seibel NAYS: Mr. Hilton, Mr. Flora ABSENT: Mr. Dodson, Mrs. Johnson At 8:10 p.m., on the motion of Supervisor Hilton and the unanimous voice vote of the members present, the Board went into Executive Session to discuss legal, real estate and personnel matters. At 9:05 p.m., the Supervisors returned to the Civic Center and on the I motion of Supervisor Hilton and the unanimous voice vote of the members present, the Board reconvened in open session.
