I The Board of Supervisors of Roanoke County met this day at the Courthouse in Salem, Virginia, in the County Courtroom being the fourth Tuesday, and the second regular meeting of the month. MEMBERS PRESENT: C. Lawrence Dodson, Chairman, John G. Seibel, Vice-Chairman, J. Thomas Engleby, III, Richard C. Flora and R. E. Hilton, Jr. Mr. William F. Clark, County Administrator, and Mr. Edward A. Natt, County Attorney, were also in attendance. Chairman Dodson called the meeting to order at 7:00 p.m., recognized The Reverend D. N. McGrady, Minister, West Salem Baptist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Dodson. On the motion of Supervisor Seibel and the unanimous voice vote of the Board, approval of the minutes of the regular meeting of I June 12 and the adjourned meeting of June 12, 1973 were continued to the July 10, 1973 meeting of the Board of Supervisors. IN RE: PETITION OF HARVEY S. LUTINS ) AND J. B. RAPPORT FOR REZONING) PROPERTY LOCATED AT SOUTHEAST ) CORNER OF HIGHWAY 221 AND ) FIN A L WESTMORELAND DRIVE FROM B-3 ) TO B-2. ) o R D E R This matter came on to be heard before the Roanoke County Board of Supervisors at its regular meeting held at the Courthouse in Salem, Virginia, and the same having previously been filed with the Board, referred to the Planning Commission and upon notice and public hearing before the Planning Commission and recommendation of the Planning Commission; and upon the appearance of the I Petitioners by counsel and upon the recommendation of the Planning Commission, that the Petitioners herein be issued a special use permit for the operation of self-service gasoline pumps and that the property herein sought to be rezoned from Business B-3 to Business B-2, and the Board having heard and weighed the evidence in the case and being of the opinion that the rezoning of the property in question would be in accord with the laws of the 4 6-26-73 Commonwealth of Virginia and consistent with the Zoning Ordinance of the County of Roanoke, Virginia, it is accordingly: ORDERED that the following described property presently classified Business B-3 on the zoning map of Roanoke County which is a part of the Zoning Ordinance of Roanoke County, and that the map be amended to reflect such change: BEGINNING at the southeast corner of (Cave Spring Road) New U. S. Highway Route 221, and Westmoreland Drive; thence with Route 221, S. 10 degrees 03' W. 100 feet to a point on same; thence a new line through Lot 1, S. 79 degrees 57' E. 200 feet to Lot 4; thence N. 10 degrees 03' E. 58.34 feet to Westmoreland Drive; thence with Westmoreland Drive N. 68 degrees 11' W. 204.03 feet to Route 221, the place of BEGINNING, and BEING the same property conveyed to the parties of the first part by Deed from J. Calvin Garnand, husband and wife, dated June 5, 1969, recorded in the Clerk's Office of the Circuit Court of Roanoke County in Deed Book 877, Page 349. The use of the property shall henceforth be in conform- ance with all uses allowed under the Zoning Ordinance of Roanoke County, Virginia, in the classification known as Business B-2. I I I 5 6-26-73 IN RE: CIVIC CENTER CONTRACT I Mrs. Marge Glover, Chairman of the Civic Center Commission, appeared before the Board and requested the Board to appropriate $25,000.00 for operating funds of the Salem- Roanoke Valley Civic Center. Mrs. Glover also requested the Board to appoint one member of the Board and the County Attor- ney to meet with Salem City Council member and their Attorney in regard to changes concerning the Civic Center Contract. Supervisor Flora moved that the Chairman be author- ized to appoint one member of the Board, the County Administrator and the County Attorney to meet with Salem City Council member and their Attorney, Mr. Kime, to discuss and finalize changes regarding the Civic Center Contract and report back those changes to the Board. The motion was adopted by the following recorded vote: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson I AYES: NAYS: None IN RE: TAP PROGRAM I Mr. Cabell Brand, President of Stuart McGuire Company, appeared before the Board and requested an appropriation of $12,000.00 for the TAP Program. Supervisor Engleby moved that $12,000.00 be appro- priated for the TAP Program for the period beginning November 1, 1973 and ending June 30, 1974. With said appropriation, any reduction in County programs would be in new enrollees and not old enrollees. It is further understood that if federal funding is received beyond November 1, 1973 that the Roanoke County funds will not be needed and would be refunded to the County if disbursed at all. SHOWALTER AND ) VALLEY BUILDERS, INC., TO PERMANENTLY) FINAL ORDER CLOSE AND VACATE A CERTAIN PORTION OF ) OLEVA STREET. ) AN ORDINANCE, permanently vacating, discontinuing, and closing that certain portion of Oleva Street, in the County of Roanoke, State of Virginia, between Lot 4, Block 6, Map of Hillendale, and the new location of Oleva Street. WHEREAS, Edwin D. Showlater and Valley Builders, Inc. have heretofore filed their petition before the Board of Supervisors in accordance with Section 15.1-364 of the Code of Virginia of 1950, requesting the Board to permanently vacate, discontinue and close the above described street; and WHEREAS, at its regular meeting on May 8, 1973, the Board referred the petition to the Planning Commission of the County of Roanoke, Virginia, for study and recommendation; and WHEREAS, the said Roanoke County Planning Commission held a public hearing on the matter at its regular meeting on June 19, 1973; and WHEREAS, a communication has been received from the said Roanoke County Planning Commission recommending the permanent closing of the aforesaid street; and WHEREAS, it further appears that the petitioners agree to bear all expenses of this proceeding; and WHEREAS, on the 26th day of June, 1973, a public hearing to consider the closing of said street was held before the Board of Supervisors, and no objection was heard from any citizen to the petition. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, that the portion of Oleva Street in the County of Roanoke, Virginia, between Lot 4, Block 6, Map of Hillendale and the new location of Oleva Street, all as herein- above described, be and it hereby is permanently vacated, dis- continued and clsoed and that all right, title and interest of the County of Roanoke and the public therein is hereby released insofar as the Board is so empowered to do, reserving, however, I I I I I I 6-26-73 7 unto the County of Roanoke, Virginia, any and all public utilities as may now be located across said property, together with the right of ingress and egress for the maintenance of such lines. BE IT FURTHER ORDAINED that the Secretary of this Board of Supervisors do forthwith certify to the Clerk of the Circuit Court of Roanoke County, Virginia, a copy of this ordinance for recordation in the deed books of her office and a like copy to the County Engineer so that he may show on all maps in his office the closing of said street. WILSON ) FOR VACATION OF A PORTION OF PLAT ) OF ETON HILL, SECTION 2. ) o R D E R This day came Vickie Hutson Powers and Charles Lewis Wilson and Carolyn Patterson Wilson, petitioners, and requested leave to file their petition relative to vacating a road described in said petition. WHEREFORE, BE IT RESOLVED AND ORDERED that the aforesaid petition be and the same is hereby filed. AND BE IT FURTHER RESOLVED AND ORDERED that the proposal to vacate a portion of Hammond Lane, SW, as requested in said petition be, and the same is hereby referred to the Planning Commission for a recommendation. 8 6-26-73 AND BE IT FURTHER RESOLVED AND ORDERED that when said Planning Commission shall report its recommendation to the Clerk of this Board, as required by the Code of Virginia, that upon receipt of same, the Clerk of this Board shall forthwith set the same down for public hearing at the next permissible regular or special meeting of this Board and that notice thereof be given by said Clerk by publication. AND BE IT FURTHER RESOLVED AND ORDERED that one certi- fied copy of this resolution and order be forthwith delivered to the Secretary of the Planning Commission of Roanoke County. BE IT RESOLVED AND ORDERED that said proposal to amend the Roanoke County Zoning Ordinance, be, and the same is hereby referred to the Planning Commission of Roanoke County for a recommendation, and when said Planning Commission shall have reported its recommendation to the Clerk of this Board, said Clerk shall forthwith set the same down for a public hearing at the next permissible regular or special meeting of this Board, notice of which meeting shall be given by the Clerk by publica- tion. BE IT FURTHER RESOLVED AND ORDERED that one certified copy of this resolution and order be delivered by said Clerk to the Secretary of the Planning Commission. Supervisor Engleby moved that the sum of $13, 875.00 be added to the budget for the Roanoke County Juvenile and Domestic Relations Court. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None IN RE: PRINTING OF 1973-74 BUDGET Supervisor Seibel moved that Mr. Clark be authorized to duplicate the final copy of the County budget and distribute said budget to those persons who desire or need to have this information. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None IN RE: PUBLIC SERVICE AUTHORITY'S REQUEST FOR RENTAL OF OFFICE SPACE - 306A MAIN STREET Supervisor Flora moved that the Roanoke County Public Service Authority's request for rental of office space at 306A Main Street, Salem, be granted and that the County Administrator, County Attorney and Public Service Authority be authorized to execute the lease agreement. The motion was adopted on the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None 10 6-26-73 IN RE: AIR POLLUTION CONTROL ORDINANCE Supervisor Engleby moved that the County Attorney be directed to prepare the necessary papers in regard to the Air Pollution Control Ordinance and report back at the next regular meeting of the Board. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None IN RE: CLASSIFICATION AND PAY PLAN- ROANOKE COUNTY EMPLOYEES Supervisor Engleby moved that whatever portion of the classification and pay plan provided by Yarger and Associates is adopted be retroactive to July 1, 1973. Supervisor Seibel offered a substitute motion that the Board of Supervisors study and review the Yarger Plan before any commitments are made and to make this study as soon as possible. The substitute motion was adopted by the following recorded vote: AYES: Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: Mr. Engleby IN RE: NOTICE OF INTENTION TO AMEND CHAPTER 19, TAXATION, SECTION 19-7, UTILITY SERVICE TAX BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that a public hearing be held on August 14, 1973, at 1:00 p.m., at a regular meeting of the Board of Supervisors, at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 19, Taxation, Section 19-7, Utility Service Tax. This amendment to take effect on August 14, 1973. I I I I I I 6-26-73 11 The Clerk of this Board is directed to publish the proposed amendment and Notice of Hearing thereon as required by law, pursuant to Section 15.1-504 of the 1950 Code of Virginia, as amended, once a week for two consecutive weeks in the Roanoke World News, a newspaper having a general circulation in Roanoke County. Said proposed amendment and Notice of Hearing thereon shall also be published and posted at the front door of the Roanoke County Courthouse. A copy of the proposed amendment is on file in the Clerk's Office of Roanoke County. IN RE: COUNTY PAYROLLS On the motion of Supervisor Flora and the following recorded vote, the County Payrolls (Semi-monthly 6/15/73), (Bi-weekly 6/20/73) and (Bi-weekly 6/6/73) were approved for payment in the gross amount of $97,948.15 from which the sum of $5,608.14 F.I.C.A., $11,540.18 F.I.T., $1,982.69 State Tax, $206.50 ACC, $3,130.00 Blue Cross, $3,173.57 Ret., $1,553.07 Misc., $30.68 U.F., are deducted leaving a net payroll of $70,723.32. On the motion of Supervisor Flora and the unanimous voice vote of the Board, the statement of travel expenses for the month of May for the Sheriff's Department was this date received and filed. IN RE: EMPLOYMENT OF ADDITIONAL SECRETARY IN SHERIFF'S DEPARTMENT Sheriff O. S. Foster appeared before the Board and requested an additional appropriation of $2,100.00 for employment of an additional secretary. Supervisor Engleby moved that an additional sum of $2,100.00 be appropriated to the Sheriff's Department for employment of an additional secretary. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Dodson NAYS: Mr. Hilton, Mr. Seibel IN RE: REQUEST OF OLD DOMINION HOMES FOR A SUBDIVIDER'S AGREEMENT OR BOND A resolution directing the Roanoke County Executive Officer to establish the total cost of the improvements required in the Vermont Heights Subdivision, of record in Plat Book 7 at page 74 in the Office of the Clerk of the Circuit Court of Roanoke .. . WHEREAS, Old Dominion Homes, Inc., has petitioned this Board for permission to submit the agreement or bond required under the provisions of Section 17-17 of the Code of the County of Roanoke; and WHEREAS, it appears that Old Dominion Homes, Inc., has subdivided certain property in Roanoke County as shown on the Map of Vermont Heights, of record in Plat Book 7 at page 74 in the Office of the Clerk of the Circuit Court of Roanoke County and that such agreement or bond is required to be given to assure the completion of the improvements in said subdivision. NOW, THEREFORE, BE IT RESOLVED that the County Executive Officer be, and he hereby is, authorized and directed to estab- lish the cost of improvements required under Chapter 17, Article IV of the Code of the County of Roanoke for the Vermont Heights Subdivision, of record in Plat Book 7 at page 74 in the Office of the Clerk of the Circuit Court of Roanoke County, and, on behalf of the County of Roanoke, execute such agreement or accept such bond from Old Dominion Homes, Inc., as may be approved by the Attorney for the County of Roanoke to the end that Roanoke County be guaranteed that the required improvements aforesaid will be installed on or before October 1,1973. Supervisor Flora offered a substitute motion that Mr. Seibel, Mr. Clark and Mr. Natt constitute a Juvenile Deten- tion Committee to work out any subsequent agreement between Roanoke County and Roanoke City regarding Juvenile Detention I Home facilities. The substitute motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None IN RE: CANCELLATION OF SECOND MEETING IN AUGUST Supervisor Seibel moved that the County Attorney be authorized to prepare the necessary papers in regard to cancel- ling the August 28, 1973 meeting of the Board of Supervisors. IN RE: APPOINTMENTS - TAP BOARD OF DIRECTORS Supervisor Flora moved that the Chairman be authorized to appoint two members to the TAP Board of Directors. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Hilton, Mr. Seibel, Mr. Dodson NAYS: None IN RE: SALARY SUPPLEMENTS - JUDGES OF THE 23rd JUDICIAL CIRCUIT COURT Supervisor Flora moved that the County Attorney be authorized to prepare the necessary papers regarding salary supplements of Judges of the 23rd Judicial Circuit Court. The motion was adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Seibel, Mr. Dodson NAYS: Mr. Hilton On the motion of Supervisor Seibel and the unanimous voice vote of the Board, the petitions commending Elizabeth W. Stokes for her service to the people of Roanoke County was this date received and filed. Pursuant to the adjournment of the meeting of June 26, 1973, the Roanoke County Board of Supervisors met this day and convened in open session at the Salem-Roanoke Valley Civic Center, Salem, Virginia. MEMBERS PRESENT: C. Lawrence Dodson, Chairman, John G. Seibel, Vice-Chairman, J. Thomas Engleby, III and Richard C. Flora. ABSENT: R. E. Hilton, Jr. Chairman Dodson called the meeting to order. IN RE: A RESOLUTION CANCELING THE SECOND MEETING OF THE BOARD OF SUPERVISORS IN AUGUST WHEREAS, the Board of Supervisors is required to meet no less than one time each month in regular session; and WHEREAS, the members of the Board of Supervisors will, on August 28, 1973, the date of the second regularly scheduled meeting in August, be attending the Local Government Officials Conference; and WHEREAS, the Board of Supervisors, therefore, desires to cancel their regular meeting scheduled for August 28, 1973. THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the regularly scheduled meeting of the said Board set for August 28, 1973, be, and it is hereby canceled. BE IT FURTHER RESOLVED that any business set for the aforesaid meeting be continued until the next regularly scheduled meeting of the Board of Supervisors. I I I I I I 6-27-73 17 BE IT FINALLY RESOLVED that the Clerk of the Board be, and he is hereby directed to publish the resolution once a week for two weeks in the Roanoke World News, a newspaper having general circulation in Roanoke County. Said resolution shall also be published and posted at the front door of the Roanoke County Courthouse. On motion of Supervisor Seibel and adopted by the following recorded vote: AYES: Mr. Engleby, Mr. Flora, Mr. Seibel, Mr. Dodson NAYS: None ABSENT: Mr. Hilton IN RE: A RESOLUTION DIRECTING THAT SALARY SUPPLEMENTS OF JUDGES OF THE 23rd JUDICIAL CIRCUIT BE INCLUDED IN THE 1973-74 BUDGET WHEREAS, the Board of Supervisors has for the past several years paid supplements to the Judges of the Circuit Court of Roanoke County, said supplements being in addition to the regular compensation fixed in the general appropriation act; and WHEREAS, the Board of Supervisors is desirous of including in the 1973-74 budget a sum sufficient to continue the payment of said supplement to the Judges of the 23rd Judicial Circuit under the reorganization of the court structure of the Commonwealth of Virginia. THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby directs that the salary supplement for the Judges of the 23rd Judicial Circuit be included in the budget of Roanoke County for the up-coming fiscal year.
