The Board of Supervisors of Roanoke County met this day at the Salem-Roanoke Valley Civic Center in Salem, Virginia, being the fourth Tuesday and the second regular meeting of the month. Members Present: Chairman R. E. Hilton, Jr., Vice- Chairman John G. Seibel, Thomas H. Beasley, Jr., C. Lawrence Dods n and Richard C. Flora. William F. Clark, County Administrator, and Edward A. Natt, County Attorney, were also in attendance. Chairman Hilton called the meeting to order at 7:30 p.m. and recognized Reverend C. Lawrence Dodson, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Hilton. On the motion of Supervisor Seibel, seconded by Supervisor Beasley and the unanimous voice vote of the Board, the minutes of the regular meeting of September 24, 1974 were approved as spread. IN RE: PETITION OF OAK GROVE PROPERTIES, INC. ) FOR REZONING 22 ACRES ALONG THE NORFOLK ) FINAL ORDE AND WESTERN R/W IN THE GLADE CREEK SECTION) WHEREAS, Oak Grove Properties, Inc., by petition filed with this Board, requested the County Zoning Ordinance be amende so as to provide that the 22 acre parcel described in said petition be reclassified from Agricultural A-I to Industrial M-2; and WHEREAS, the Planning Commission of Roanoke County, by resolution adopted at its meeting held on the 17th day of September, 1974, recommended that said County Zoning Ordinance be amended so as to change the classification of the 22 acre parcel from Agricultural A-I to Industrial M-2; and ~... -... _ ______~____. __ _______~_ ,....h._~_._._._,...""""."~" ~._................__"'-__.._........ NOW, THEREFORE, BE IT BESOLVED AND ORDERED, at this meeting of the Board of Supervisors, held on the 22nd day of October, 1974 that the Roanoke County Zoning Ordinance be, and the same hereby is amended so as to classify the property des- cribed in said petition presently zoned Agricultural A-I to Industrial M-2. FOR ) REZONING 6.083 ACRES LOCATED ON THE ) NORTH SIDE OF ROUTE 117 (PETERS CREEK ) ROAD) AT THE INTERSECTION OF THE WEST ) FINAL ORDER SIDE OF DEER BRANCH ROAD AND ADJOINING ) NORTH 11 DRIVE-IN THEATER ) WHEREAS, John M. Oakey, Inc. has heretofore filed a petition to amend the Roanoke County Zoning Ordinance by reclas- sifying certain property situate in Roanoke County, described in said petition from Business District B-1 to Business District B-2; and 10-22-74 23 WHEREAS, the Board at a special meeting on August 28, 11974, referred the matter to the Planning Commission of Roanoke I County for its report and recommendation; and WHEREAS; the Planning Commission at a meeting held on September 17, 1974, fully considered the petition and reported to this Board by resolution its recommendation that the tract in question be rezoned from Business District B-1 to Business District B-2; and WHEREAS, the matter was set for public hearing this date after due advertisement in accordance with law; and WHEREAS, a public hearing was duly held on October 22, 1974, and a full opportunity was accorded all interested parties to express their views concerning the proposal; and WHEREAS, at the conclusion of the public hearing and after full consideration of this matter, this Board is of the opinion that the change in classification would promote the public interest, prosperity and welfare of the citizens of Roanoke County. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the Zoning Ordinances of Roanoke County, as amended, be and they hereby are further amended to reclassify and rezone from Busines District B-1 to Business District B-2 that parcel of land des- cribed in said petition. BE IT FURTHER RESOLVED AND ORDERED that the Clerk of this Board furnish a certified copy of this resolution to the Secretary of the Planning Commission and a copy to counsel for petitioner herein. BE IT FURTHER RESOLVED AND ORDERED that the Clerk of this Board furnish the Secretary of the Planning Commission a certified copy of this resolution and a copy to counsel for petitioners herein. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the petitioner and its successors in title be and hereby is granted a permit under Section 21-7 of the County Zoning Ordinance to allow the use as a tennis and squash court facility and to allow other recreational facilities to be constructed and used on the property, on that certain tract of 3.5 acres, said tracts being more fully described in the petition, said use having been recommended by the Planning Commission. BE IT FURTHER RESOLVED AND ORDERED that the Clerk of this Board furnish the Secretary of the Planning Commission a certified copy of this resolution and order and a copy to counsel for petitioner herein. Thurman for a special exception to park a mobile home on a one-acre tract located 0.3 mile east of the intersection of Route 737 and Route 639 on a private road be approved subject to the provisions of the Zoning Ordinance for mobile homes as a special exception. IN RE: APPLICATION OF TOMMY AND AUDREY FERGUSON ) FOR A PERMIT TO PARK A MOBILE HOME ON ) ROUTE 220 SOUTH, NORTH OF THE INTERSECTION) APPROVED OF ROUTE 220 AND ROUTE 615 ) Supervisor Beasley moved that the application of Tommy and Audrey Ferguson for a permit to park a mobile home on a one-acre tract located on Route 220 south, 300 feet north of the intersection of Route 220 and Route 615 on the property of Harry A. and Beulah E. LaPrade be approved subject to the conditions set forth by the Planning Commission. WHEELER FOR A PERMIT TO PARK A MOBILE HOME ON THE SOUTH SIDE OF ROUTE 875, OFF ROUTE 904 NEAR STARKEY APPROVED Supervisor Beasley moved that the application of C. B. Wheeler for a permit to park a mobile home on a .8-acre tract located on the south side of Route 875, off Route 904 near Starkey be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Seibel and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None The application of C. B. CLATTERBUCK FOR A PERMIT TO PARK A MOBILE HOME ON THE WEST SIDE OF STATE ROUTE 745 (RAN LYNN ROAD) APPROVED Supervisor Beasley moved that the application of Harry L. Clatterbuck for a permit to park a mobile home on a 10.36-acre tract located on the west side of State Route 745 (Ran Lynn Road) next to the property of Spring Run Swim Club be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Seibel and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None The application of Harry L. WARD FOR A PERMIT TO PARK A MOBILE HOME ON THE WEST SIDE OF ROUTE 612 APPROVED Supervisor Beasley moved that the application of Herbert D. and Ruth R. Ward for a permit to park a mobile home on a 3.7BB-acre tract located on the west side of Route 612 in the Bent Mountain area be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYE S : Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None The application of Herbert D. and Ruth R. IN RE: APPLICATION OF DEBRA KAY RICHARDS FOR ) A PERMIT TO PARK A MOBILE HOME ON THE ) EAST SIDE OF ROUTE 116 (JAE VALLEY ) APPROVED ROAD) SOUTH OFF ROUTE 659 ) Supervisor Seibel moved that the application of Ms. Debra Kay Richards for a permit to park a mobile home on a 1.46-acre tract located on the east side of Route 116 (Jae Valle Road), about 1,000 feet south off Route 659 (Mayfield Drive) in the Mount Pleasant community be approved subject to the con- ditions set forth by the Planning Commission and the additional condition that within eight months, the present residence on the property shall be demolished and the mobile home moved to the agreed upon point marked on the site plan submitted by Mrs. C. W Eddy, adjoining property owner. Both Ms. Richards and Mrs. Eddy have initialed the agreed upon point on the said site plan. Speaking in opposition were: Mrs. C. W. Eddy, resident of Mount Pleasant Boulevard, Mrs. Robert Early, resident of Mount Pleasant Boulevard and Mr. Willard B. Kelly, adjoining property owner. Mrs. Eddy submitted a petition signed by 14 residents of Jae Valley Road and Mayfield Drive opposing the request of Ms. Richards. It was agreed that the above residents would not oppose the request of Ms. Richards if she complied with the eight-month condition of demolishing the present residence on the property and moving the mobile home to the agreed upon point marked on the said site plan. Ms. Richards has agreed to this condition. IN RE: REQUEST OF COUNTY SCHOOL BOARD FOR APPROPRIATION TO SUPPORT PLANNING FOR A REGIONAL PLANETARIUM Mr. Arnold R. Burton, Superintendent of Schools, appear d before the Board and requested an appropriation in the amount of $5,265 to support planning for a regional planetarium. _/ Supervisor Seibel moved that the request of the School Board for an appropriation to support planning for a regional planetarium be referred back to said School Board for their financing. Chairman Hilton relinquished the Chair to Vice-Chairman Seibel. The motion was seconded by Supervisor Hilton. At this point, Supervisor Seibel withdrew his motion to refer the above matter back to the School Board. Supervisor Flora moved that the County appropriate the sum of $5,265 toward the development of plans for a regional planetarium to be constructed in connection with the Western Division of the State Science Museum and that Salem City Council be requested to share in this expenditure in an amount comparable to Salem's participation in the cost of educational services, or approximately 20 percent. """" '''''f'" 10-22-74 3:-1 The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: Mr. Hilton IN RE: CONFIRMATION OF EMPLOYMENT 4-H EXTENSION AGENT Supervisor Seibel moved that the Board confirm and accept the employment of Miss Judy Cloud as a 4-H Extension Agent with the VPI & SU Extension and Continuing Education Service effective October 16, 1974, at a salary of $5,700.00 annually. The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None At 9:05 p.m., the Board took a brief recess. At 9:15 p.m., the Supervisors returned to the civic Center and the Board reconvened in open session. On the motion of Supervisor Beasley, seconded by Supervisor Seibel and the unanimous voice vote of the Board, the communication from the President of the Roanoke County Council of PTA's and attached resolution expressing concern over retaining the high quality of education presently found in the County's school system was this date received and filed. IN RE: ITEMS REFERRED TO THE PLANNING COMMISSION On the motion of Supervisor Seibel, seconded by Supervisor Flora and the unanimous voice vote of the Board, the following petition was this date received, filed and referred to the Planning Commission for its recommendation: Petition of Strauss Construction Company, Inc. for rezoning 87.9 acres located on the northeast side of Loch Haven Road (State Route 628) from RE to R-3 in order to allow the construction of townhouses. 32"' 10-22-74 IN RE: RESOLUTION NO. 1145 ACCEPTING A CERTAIN BID FOR PROTECTIVE COATS FOR THE COUNTY'S FIRE DEPARTMENTS WHEREAS, funds were included in the 1974-75 budget for Fire Prevention and Extinction for the purchase of fifty protec- tive coats for members of Roanoke County's fire departments; and WHEREAS, on Monday, October 7, 1974, four (4) bids for said coats were received and opened in the office of the County Administrator, and the County Administrator has, in his report to the Board of Supervisors dated October 22, 1974, recommended the award of the bid as hereinafter set out, said bid being the lowest bid received by the County fully meeting the County's specifications for said coats. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the bid of Slagle Fire Equip- I ment Company in the amount of $2,959.00 for fifty firefighter's ! protective coats be, and the same is hereby accepted, the County I Administrator to notify said bidder of the acceptance of said bidj and to complete the necessary purchase order for said bid. I On motion of Supervisor Seibel, seconded by Supervisor I Beasley and adopted by the following recorded vote: I AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: RESOLUTION NO. 1146 AUTHORIZING THE PURCHASE OF CERTAIN RADIO EQUIPMENT FOR ROANOKE COUNTY WHEREAS, the 1974-75 budget adopted by the Board of Supervisors provided for the purchase of certain radio equipment to be used by various departments of the County; and WHEREAS, the Commonwealth of Virginia has heretofore received bids from major communications companies for the purcha e of radios, which bids may be utilized by the Board of Supervisor in the purchase of equipment and which bids are considerably lower than the standard purchase price; and .' ~ ~I 10-22-74 3-r3 WHEREAS, the County Administrator has recommended that the purchase be made through the Commonwealth of Virginia, in which recommendation the Board of Supervisors concurs. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby directs the County Administrator to purchase through the Commonwealth of Virginia, pursuant to the bids heretofore received by the Commonwealth of Virginia, the following equipment from the R.C.A. Corporation: 12 - 100-watt output, 100% solid state, multi-frequency, supplied with spring base whip antenna ($949.00 each) ................. $11, 388.00 2 - portable radios, two-frequency low- band hand-held type, 4-watt, equipped with NICAD battery ($665.00 each)................ 1,330.00 2 radio chargers ($34.00 each)........... 68.00 2 - spare batteries ($37.00 each).......... 74.00 Total Amount of Order $12,860.00 On motion of Supervisor Beasley, seconded by Superviso Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: Mr. Hilton IN RE: NOTICE OF INTENTION TO AMEND CHAPTER 9, LICENSES OF THE ROANOKE COUNTY CODE BE IT RESOLVED by the Board of Supervisors of Roanoke County that a public hearing be held at an adjourned meeting of the Board on the 27th day of December, 1974, at 1:00 p.m. at the Salem-Roanoke Valley Civic Center, at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 9. Licenses be amended and reordained. This ordinance shall be in full force and effect upon and after the 1st day of January, 1975. IN RE: RESOLUTION NO. 1147 GUARANTEEING THE RIGHT OF WAY FOR CERTAIN INDUSTRIAL ACCESS ROADS WHEREAS, the Board of Supervisors by Resolution No. 1061 adopted on May 28, 1974, recommended and urged the initia- tion of a project to provide industrial access to certain new manufacturing plants to be located in Roanoke County; and WHEREAS, pursuant to the provisions of the Code of Virginia, it is necessary for the Board of Supervisors to guarantee the right of way for such industrial access roads. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby guarantees and assures the Virginia Division of Highways and Transportation that said Board of Supervisors does hereby guarantee that it will provide adequate rights of way for the construction of the projects described in Resolution No. 1061 of the Board of Supervisors of Roanoke County, adopted on May 28, 1974. Cooper be appointed to serve as a member of the Cave Spring Magisterial District on the Building Code Board of Adjustments and Appeals for a term of four years ending on October 22, 1978. The motion was seconded by Supervisor Seibel and adopted by the unanimous voice vote of the Board.
