The Board of Supervisors of Roanoke County met this day at the Salem-Roanoke Valley Civic Center in Salem, Virginia, bein the second Tuesday and the first regular meeting of the month. MEMBERS PRESENT: Chairman R. E. Hilton, Jr., Vice- Chairman John G. Seibel, C. Lawrence Dodson and May Winn Johnson. ABSENT: Richard C. Flora. William F. Clark, County Administra- tor and Edward A. Natt, County Attorney, were also in attendance. Chairman Hilton called the meeting to order at 1:00 p.m. and recognized William F. Clark, County Administrator, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Hilton. At this point, Chairman Hilton introduced Mrs. May Winn Johnson, Supervisor of the Cave Spring Magisterial District. The minutes of the regular meeting of October 8, 1974 were approved as spread by the Chairman. IN RE: PETITION OF SHELL OIL COMPANY AND THE SOUTHLAND CORPORATION FOR REZONING .459 ACRES LOCATED ON THE NORTH SIDE OF FERNCLIFF AVENUE AND ADJACENT TO BEST PRODUCTS, INC., NORTHWEST OF HERSHBERGER ROAD FINAL ORDER This matter came on to be heard before the Roanoke County Board of Supervisors at its regular meeting held at the Salem-Roanoke Valley Civic Center in Salem, Virginia, on Tuesday, November 12, 1974 at 1:00 p.m., the same having previously been filed with the Board, referred to the Planning Commission and upon notice and public hearing before the Planning Commission and -~ recommendation of the Planning Commission, and upon notice of public hearing before the Board of Supervisors advertised and held this date and upon the appearance of the petitioner by counsel and upon the recommendation of the Planning Commission, j 11-12-74 39 and the Board having heard and weighed the evidence in the case and being of the opinion that the rezoning of the property in question would be in accord with the laws of the Commonwealth of Virginia and consistent with the Zoning Ordinance of the County of Roanoke, it is accordingly: ORDERED that the property described in the petition presently classified as Business B-3 be rezoned, in accordance with a site plan attached hereto, to Business B-2 on the zoning map of Roanoke County, and that the map be amended to reflect such change: The use of the property shall henceforth be in conform ance with all uses allowed under the County Zoning Ordinance in the classification known as Business B-2. And the said Zoning Ordinance and zoning map as they relate to said property are likewise accordingly amended. IN RE: PETITION OF OSCEOLA LODGE NO. 47,) KNIGHTS OF PYTHIAS, FOR REZONING) 3.21 ACRES LOCATED ON THE NORTH ) SIDE OF ODGEN ROAD ) .; CONTINUED Supervisor Johnson moved that the public hearing on the petition of OSCEOLA Lodge No. 47, Knights of Pythias, for rezoning 3.21 acres located on the north side of Odgen Road and adjacent to Odgen Hills Subdivision from R-l to R-2 be continued to the November 26, 1974 meeting of the Board. CHEWNING FOR A ) SPECIAL USE PERMIT TO ALLOW A DRAPERY ) SHOP TO BE OPERATED ON AN 0.8 ACRE ) FINAL ORDER TRACT LOCATED ON THE SOUTH SIDE OF ) ROUTE 24 NEAR THE BLUE RIDGE PARKWAY ) WHEREAS, application has been made to the Board of Supervisors of Roanoke County for issuance of a Special Use Permi to allow a drapery shop to be operated on 0.8 acre, known as Lot 2 as shown on survey made for Alvin Lawhorn, April 11, 1953, by T. P. Parker, S.C.E. and being on the south side of Route 24 near the Blue Ridge Parkway in a R-l zoning; and WHEREAS, the Roanoke County Planning Commission has recommended that the heretofore described request for issuance of a Special Use Permit in a R-l zoning be approved; and WHEREAS, notices required have been published and mailed in accordance with law; WHEREAS, the hearing provided for in said notice was held this date before the Board of Supervisors, at which hearing all parties in interest and citizens were given an opportunity to be heard, both for and against said request; and -....' WHEREAS, the Board, after considering the evidence as herein provided, is of the opinion that the Special Use Permit should be issued for the heretofore described land. THEREFORE, BE IT ORDAINED by the Board of Supervisors 0 Roanoke County that a Special Use Permit to allow a drapery shop to be operated on 0.8 acres, more or less, located on the south side of Route 24 near the Blue Ridge Parkway in a R-l Zoning be issued for a five-year period. BRANCH FOR REZONING 2.18 ACRES ON THE SOUTHEASTERLY SIDE OF ROUTE 419 (STARKEY ROAD) FINAL ORDER WHEREAS, Maury L. Strauss and Billy H. Branch, Partners, petitioned this Board and requested the Roanoke County Zoning Ordinance be amended so as to provide that certain property described in said petition be rezoned and reclassified as Industrial District M-l, which petition was filed at a regular meeting of this Board held on May 28, 1974, and by order entered that day was referred to the Planning Commission for recommenda- tion; and WHEREAS, the said Planning Commission, by a resolution adopted at a meeting held on June 18, 1974, after hearing evidenc touching on the merits of said petition, recommended to this Board that said County Zoning Ordinance not be amended to change the classification of the property described in said petition from Residential District R-3 to Industrial District M-l; and WHEREAS, the Clerk of this Board did set the regular meeting of this Board, held on September 24, 1974, as the date for a public hearing on the aforesaid proposed amendment to said County Zoning Ordinance and advertised the same by notice duly published in accordance with law; and WHEREAS, said public hearing was held on the proposed amendment on the 24th day of September, 1974; and WHEREAS, the public hearing was continued generally and came again before this Board on the 12th day of November, 1974; and WHEREAS, this Board, after giving careful consideratio to said petition and to said recommendation, after hearing evidence touching on the merits of the said proposed amendment t '-- the County Zoning Ordinance, being of the opinion that said County Zoning Ordinance should be amended as requested in said petition. RUBY HAWKINS FOR A SPECIAL EXCEPTION TO OPERATE A BEAUTY SHOP IN HER HOME LOCATED AT 712 LANDFAIR DRIVE IN VINTON APPROVED Supervisor Seibel moved that the request of Mrs. Ruby Hawkins for a special exception to operate a beauty shop in her home located at 712 Landfair Drive in Vinton, Virginia, be approved subject to the provisions of the County Zoning Ordinanc as it pertains to home occupation. The motion was seconded by Supervisor Johnson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Hilton NAYS: None ABSENT: Mr. Flora Mrs. Hawkins was present at the public hearing. MCDANIEL FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A ONE-ACRE TRACT ON THE SOUTH SIDE OF ROUTE 622 APPROVED Supervisor Seibel moved that the application of Mrs. Maude V. McDaniel for a special exception to park a mobile home on a one-acre tract located ~ mile east of the Montgomery County line on the south side of Route 622 on the property of R. J. Garman, Jr. be approved subject to the provisions of the County Zoning Ordinance for mobile homes as a special exception. The motion was seconded by Supervisor Johnson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Hilton NAYS: None ABSENT: Mr. Flora The application of Mrs. McDaniel was presented by Mr. R. J. Garman. There was no opposition. IN RE: REQUEST TO NAME STATE ROUTE 603 BABE LOUIS ROAD Supervisor Seibel moved that the request to name State Route 603 (old 460) located at Bonsack in the Vinton Magisterial District as "Babe Louis Road" be approved. The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Dodson, Mrs. Johnson, Mr. Seibel, Mr. Hilton NAYS: None ABSENT: Mr. Flora IN RE: BINGO PERMIT - SOUTHVIEW ELEMENTARY SCHOOL PTA Supervisor Johnson moved that a Bingo Permit be issued to Southview Elementary School PTA to become effective this date for a period of one year. The motion was seconded by Supervisor Seibel and adopted by the unanimous voice vote of the members present. 4~4 11-12-74 IN RE: ITEMS REFERRED TO THE PLANNING COMMISSION On the motion of Supervisor Dodson, seconded by Supervisor Seibel and the unanimous voice vote of the members present, the following item was this date received, filed and referred to the Planning Commission for recommendation: Petition of Trustees of Unity of Roanoke Valley (a religious organization) for rezoning 28.36 acres located on the southeast corner of State Route 629 and 628 (Loch Haven Road) in the Catawba District from R-l to RE in order to permit the construction of a church building. IN RE: TRAILER PERMIT APPLICATION - GUSS EVERETT WHEELING The Board indicated its willingness to consider the application of Guss E. Wheeling for a permit to park a mobile home, which application is referred to the Board of Zoning Appeals for its recommendation back to the Board. IN RE: RESOLUTION NO. 1148 AUTHORIZING THE PURCHASE OF CERTAIN EQUIPMENT TO BE USED IN THE PUBLIC WORKS DEPARTMENT WHEREAS, bids were received on Friday, November 1, -' 1974, and opened in the office of the Public Works Superintendent of Roanoke County for a wheel-type loader backhoe, which equip- ment was included in the 1974-1975 fiscal year budget; and WHEREAS, a recommendation has been made that the County purchase the wheel-type loader backhoe from the bidder hereinafte specified, said bid being the best bid received by the County. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the bid of the Mount Castle Ford Tractor Sales in the amount of $14,800 for the Ford 6500 wheel-type loader backhoe be, and the same is hereby accepted, the County Administrator to notify said bidder of the acceptance of said bid and to complete the necessary purchase order for said equipment. On motion of Supervisor Dodson, seconded by Supervisor Johnson and adopted by the following recorded vote: AYE S : Mr. Dodson, Mrs. Johnson, Mr. Hilton NAYS: None ABSTAINING: Mr. Seibel ABSENT: Mr. Flora .1 '^, 11-12-74 J4 -5 IN RE: RESOLUTION NO. 1149 AUTHORIZING THE PURCHASE AND INSTALLATION OF A GASOLINE STORAGE TANK AND PUMP WHEREAS, bids were received and opened in the office of the Public Works Superintendent of Roanoke County for the purchase and installation of a gasoline storage tank and pump to dispense non-leaded gasoline; and WHEREAS, a recommendation has been made that the County purchase the gasoline storage tank and pump from the bidder hereinafter specified, said bid being the lowest and best bid received by the County. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the bid of Webb Oil Company in the amount of $3,503 for the complete installation of a 6,000-gallon, underground storage tank and gasoline pump for the dispensing of non-leaded motor fuel be, and the same is hereby accepted, the County Administrator to notify said bidder of the acceptance of said bid and to complete the necessary purchase order for said equipment. On motion of Supervisor Johnson, seconded by Superviso Seibel and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Seibel NAYS: Mr. Hilton ABSENT: Mr. Dodson, Mr. Flora At 2:05 p.m., Supervisor Dodson left the meeting. IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1150 - GASOLINE TANK On motion of Supervisor Johnson, seconded by Super- visor Seibel, the General Appropriation Ordinance of Roanoke County, adopted June 25, 1974, be, and the same is hereby, amended as follows to become effective November 12, 1974. ,-.. ~ ~6 11-12-74 EXPENDITURES 318f - Miscellaneous Operating Functions 499 - Purchase Gasoline Tank: An additional appropriation of $3,503 is hereby made from the General Operating Fund for the period ending June 30, 1974, for the function and purpose hereinabove indicated. MOTOR VEHICLES AND TRAFFIC OF THE ROANOKE COUNTY CODE BE IT RESOLVED by the Board of Supervisors of Roanoke County that a public hearing be held on January 28, 1975, at 7:30 p.m., at a regular meeting of said Board, at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 10. Motor Vehicles and Traffic, Article I. In General, be amended by the addition of a new section numbered, Section 8.1 and entitled Disposition of unregistered or unli~ensed motorcycles. -" This amendment to take effect on January 28, 1975. The Clerk of this Board is directed to publish the proposed amendment and notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the 1950 Code of Virginia, as amended, once a week for two consecutive weeks, in the Roanoke World News, a newspaper having a general circulation in Roanoke County. A copy of the proposed amendment is on file in the Clerk's Office of the Circuit Court of Roanoke County and the County Administrator's Office at 306A East Main Street in Salem. BUILDINGS OF THE ROANOKE COUNTY CODE BE IT RESOLVED by the Board of Supervisors of Roanoke County that a public hearing be held on January 28, 1975, at 7:30 p.m., at a regular meeting of the said Board, at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 7. Buildings, Section 7-2. Same - Permit Fees be amended and readopted. This amendment to take effect on January 28, 1975. The Clerk of the Board is directed to publish the proposed amendment and notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the 1950 Code of Virginia, as amended, once a week for two consecutive weeks in the Roanoke World News, a newspaper having a general circulation in Roanoke County. Said proposed amendment and notice of hearing thereon shall be published and posted at the front door of the Roanoke County Courthouse. IN RE: COUNTY PAYROLLS On the motion of Supervisor Seibel, seconded by Supervisor Johnson and the following recorded vote, the County Payrolls (Bi-weekly 10/25/74), (Semi-monthly 10/30/74) and (Bi-weekly 11/8/74) were approved for payment in the gross 11-12-74 48 amount of $120,865.66 from which the sum of $14,761.14 F.I.T, $2,691.17 State Tax, $6,845.02 F.I.C.A., $2,940.68 Blue Cross, $2,468.59 VSRS, $324.30 L.I., $451.00 ACC, $380.55 T.P., $154.40 A.F., $178.16 S.B., $42.42 U.F., $411.72 Misc., are deducted leaving a net payroll of $89,216.51. Chairman Hilton relinquished the Chair to Vice-Chairman Seibel. IN RE: REQUEST OF COUNTY SHERIFF FOR CORRECTIONS PERSONNEL The request of the County Sheriff for corrections personnel was continued to the November 26, 1974 meeting of the Board. IN RE: RESOLUTION NO. 1152 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS FOR THE FAVORABLE CONSIDERATION GIVEN BY THE VOTERS OF ROANOKE COUNTY ON THE REFERENDUM FOR AUTHORIZATION OF $14.8 MILLION OF WATER AND SEWER BONDS WHEREAS, the Roanoke County Public Service Authority has heretofore recommended that said Authority be phased out and that the operation of the water and sewer utilities in Roanoke County be taken over and operated directly by the County; and WHEREAS, the Public Service Authority and the Board of Supervisors thereafter retained consultants to formulate and develop comprehensive plans for the establishment of a County- wide water and sewer system, which plan was developed and presented to the Board of Supervisors; and WHEREAS,the Board of Supervisors, upon receipt of said plan, requested the Circuit Court of Roanoke County to order that a referendum be held at the November general election to consider the authorization for the issuance of $14.8 million of water and sewer bonds in order to accomplish the programs set out in the consultant's plan; and L.. NOW, THEREFORE, BE IT RESOLVED by the Board of Super- visors of Roanoke County that said Board expresses its sincere appreciation to the various news media located in the Roanoke Valley for the coverage and explanations given by said media on the referendum. BE IT FURTHER RESOLVED that said Board further express its appreciation to the citizens committee appointed by the mem- bers of the Board of Supervisors, which committee worked diligent y in order to secure a favorable response to the referendum. BE IT FINALLY RESOLVED that said Board expresses its appreciation to the voters of Roanoke County who approved the questions on the ballot authorizing the issuance of $14.8 million of water and sewer bonds and that said Board pledges to the Citizens of the County its efforts to continue to provide the most effective and efficient governmental serVlces that can be provided to the citizens of Roanoke County. On motion of Supervisor Seibel, seconded by Supervisor Johnson and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Seibel NAYS: None ABSTAINING: Mr. Hilton ABSENT: Mr. Dodson, Mr. Flora IN RE: RESOLUTION NO. 1153 CANCELING THE SECOND MEETING OF THE BOARD OF SUPERVISORS IN DECEMBER WHEREAS, the Board of Supervisors is required to meet no less than one time each month in regular session; and WHEREAS, the Board of Supervisors desires to cancel their regular meeting scheduled for December 24, 1974. . ! ,-'"'!. 11-12-74 51 NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the regularly scheduled meeting of said Board set for December 24, 1974, be, and the same is hereby canceled. BE IT FURTHER RESOLVED that any business set for the aforesaid meeting be continued until the next regularly scheduled meeting of the Board of Supervisors. BE IT FINALLY RESOLVED that the Clerk of the Board be, and he hereby is directed to publish this resolution once a week for two weeks in the Roanoke World News, a newspaper having general circulation in Roanoke County. Said resolution shall also be published and posted at the front door of the Roanoke County Courthouse. On motion of Supervisor Johnson, seconded by Superviso Seibel and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Seibel, Mr. Hilton NAYS: None ABSENT: Mr. Dodson, Mr. Flora IN RE: APPOINTMENT - AIR POLLUTION ADVISORY AND APPEALS BOARD Mrs. Hugh Rutrough was appointed to serve as the representative from the Catawba Magisterial District on the Air Pollution Advisory and Appeals Board for a term of four years ending on November 12, 1978. IN RE: APPOINTMENT - WELFARE BOARD Supervisor May Winn Johnson was appointed to fill the unexpired term of Mr. Thomas H. Beasley, Jr. on the County's Welfare Board, which term ends on January 22, 1978. At 2:35 p.m., on the motion of Supervisor Johnson, seconded by Supervisor Seibel and the unanimous voice vote of the members present, the Board went into Executive Session to discuss matters involving real estate. ~. .", 11-12-74 52 At 2:55 p.m., the Supervisors returned to the Civic Center and on the motion of Supervisor Seibel, seconded by Supervisor Johnson and the unanimous voice vote of the members present, the Board reconvened in open session. IN RE: RESOLUTION NO. 1154 ENDORSING THE PROJECT OF ESTABLISHING A PARK IN THE NORTH COUNTY AREA WHEREAS, the Board of Supervisors of Roanoke County has determined the need for the establishment of a park in the North County area in the Hollins vicinity; and WHEREAS, the Board of Supervisors at its meeting held on August 13, 1974, authorized the execution of an option for purchase of a parcel of land containing thirty-nine (39) acres, more or less, situate in the Catawba Magisterial District in the Hollins area of Roanoke County; and WHEREAS, the Board of Supervisors desires to affirm its endorsement of the establishment of a park in the North County area in the Hollins vicinity. NOW, THEREFORE, BE IT RESOLVED by the Board of Super- visors of Roanoke County that said Board hereby endorses the project of the establishment of a park in the North County area in the Hollins vicinity, said park to contain thirty-nine (39) acres, more or less, and that said Board further endorses the filing of an application with the Commission of Outdoor Recrea- tion for Federal and State funds to be utilized in the cost of acquisition of said property. On motion of Supervisor Seibel, seconded by Supervisor Johnson and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Seibel, Mr. Hilton NAYS: None ABSENT: Mr. Dodson, Mr. Flora IN RE: RESOLUTION NO. 1155 INDICATING THE INTEREST OF ROANOKE COUNTY IN THE ACQUISITION OF SURPLUS FEDERAL GOVERNMENT PROPERTY WHEREAS, notice has been given by the Federal governrnen that approximately 38.676 acres of wooded land identified as a portion of the Veterans Administration Reservation, Salem, Virgini~, has been determined to be surplus government owned property; and WHEREAS, the Board of Supervisors of Roanoke County, pursuant to the applicable Federal regulations, desires to indicate its interestin the acquisition of said property. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County pursuant to the provisions of Section 15.1-262 of the Code of Virginia that said Board hereby indicates its interest in the acquisition of the 38.676 acre tract of surplus Federal government property in fee simple by said Board. BE IT FURTHER RESOLVED that the purposes for which said Board would use said property are as a public park and recreation area and as a wildlife conservation area.
