Members Present: John G. Seibel, Vice-Chairman, Thomas H. Beasley, Jr., C. Lawrence Dodson and Richard C. Flora. Absent: R. E. Hilton, Jr., Chairman. In the absence of Chairman Hilton, Vice-Chairman Seibe called the meeting to order at 7:30 p.m., recognized Reverend Edwin Wallace, First Wesleyan Church, who offered the invocation1 I The Pledge of Allegiance to the flag was given in unison. IN RE: PETITION OF A. F. AND HESTER C. HOBACK) FOR REZONING OF A 0.972 ACRE TRACT ) LOCATED NEAR THE EAST SIDE OF FERNCLIFF) AVENUE AND HERSHBERGER ROAD AND WEST OF) 1-581. ) FINAL ORDER WHEREAS, A. F. Hoback and Hester C. Hoback, petitioned this Board and requested that the County Zoning Ordinance (1970) be amended so as to provide that certain property described in said petition be rezoned and reclassified, which petition was filed at a regular meeting of this Board on the 22nd day of January and by order entered on that day was referred to the Planning Commission for a recommendation; and WHEREAS, the Planning Commission by resolution adopted at its meeting held on the 19th day of February recommended to this Board that the County Zoning Ordinance be amended as requested in said petition; and WHEREAS, the Board of Supervisors did by its order entered on the 22nd day of January order that the Clerk of this Board, upon receipt of said recommendation from the Planning Commission, forthwith set the same down for a public hearing and give notice thereof by publication; and L I I I 333 2-26-74 WHEREAS, the Clerk of this Board did set the regular meeting of this Board held on the 26th day of February as the date and time for a public hearing and gave notice and adver- tised the same by publication; and I WHEREAS, said public hearing was this date had on the said proposed amendment to the County Zoning Ordinance; and WHEREAS, this Board after giving careful consideration to said petition and to the recommendation of the Planning Commission and after hearing evidence touching on the merits of said proposed amendment to the County Zoning Ordinance being of the opinion that said County Zoning Ordinance should be amended as requested in said petition and as recommended by said Planning Commission. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this regular meeting of the Board of Supervisors held on February 26, 1974, the said County Zoning Ordinance be and the I same is hereby amended so as to classify as Business B-3 prop- erty all that tract or parcel of land described as follows: CONTAINING 0.972 acres, according to a plat of survey for A. F. Hoback and Hester C. Hoback, made by David Dick & Associates, October 17, 1972, together with the right to the use of the 50 foot roadways from said property to the Hershberger Road service roads and to Ferncliff Avenue, said property and roadways shown on a copy of said plat dated October 17, 1972, and incorporated in the petition in this matter. IT IS FURTHER ORDERED AND RESOLVED that the Clerk of this Board shall forthwith certify a copy of this resolution and order to the Secretary of the Planning Commission and a copy to Plunkett & Logan, attorneys for the petitioner. There was no opposition. 334 -26-74 IN RE: ADOPTION OF AN AMENDMENT TO CHAPTER 10, MOTOR VEHICLES AND TRAFFIC, ARTICLE V, COUNTY VEHICLE LICENSES, SECTION 10-43 PRORATION OF TAX. WHEREAS, the Board of Supervisors deems certain amend- ments to the Roanoke County Code to be necessary in the best I interests of the health, safety and general welfare of the I citizens of Roanoke County; and WHEREAS, a Notice of Intention to amend the Roanoke County Code as proposed, and public hearing thereon, have been advertised and posted in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Board of Super- visors of Roanoke County, that the Roanoke County Code be amended as follows: Chapter 10, Motor Vehicles and Traffic, Article V. County Vehicle Licenses, Section 10-43, Proration of Tax, as follows: Only one-half of the license tax prescribed by this article shall be assessed and collected whenever any such license tax becomes assessable after October 1 of any license tax year. Each license issued upon the payment of the license tax thereon shall expire at the end of the license tax year in which the same is issued. I This amendment to take effect on February 26, 1974. On motion of Supervisor Dodson, seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: APPLICATION OF HAROLD J. BOONE FOR A PERMIT TO PARK A MOBILE HOME ON TOP OF BENT MOUNTAIN ON ROUTE 786 NEAR COPPER HILL APPROVED Supervisor Beasley moved that the application of I Harold J. Boone for a permit to park a mobile home on a 14.6- t acre tract on top of Bent Mountain on Route 786 near Copper Hill approximately l~ miles off of Route 221 on the property of murray A. Boone was presented by Mr. Boone. No one appeared in opposition. IN RE: APPLICATION OF GALEN W. WADE FOR A PERMIT TO PARK A MOBILE HOME ON A TRACT SITUATE ON THE SOUTH SIDE OF U.S. ROUTE 11-460 WEST OF SALEM CONTINUED Supervisor Dodson moved that the public hearing on the application of Galen W. Wade for a permit to park a mobile home on a 1 3/4 acre tract situate on the south side of U. W. Route 11-460 west of Salem opposite the intersection of State Route 927 be continued to the March 12, 1974 meeting of the Board. I The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton The application of Galen W. Wade was presented by Mrs. Wade. Speaking in opposition were Mr. Powell and Mr. Stanley Wingo of Glenvar Heights. Mr. Powell submitted a petition with 51 signatures of residents of the Glenvar Heights Subdivision opposing the request. IN RE: APPLICATION OF FRED W. MOORE FOR A PERMIT TO PARK A MOBILE HOME ON A PRIVATE ROAD ON THE EAST SIDE OF ROUTE 774 NEAR FORMER GREENHILL COUNTRY CLUB APPROVED I Supervisor Beasley moved that the application of Fred W. Moore for a permit to park a mobile home on a 7.06-acre tract on a private road on the east side of Route 774 about 3/4 mile from the former Greenhill Country Club be approved subject to the conditions set forth by the Planning Commission. IN RE: JUVENILE DETENTION HOME Supervisor Dodson moved that the County Attorney be directed to prepare the necessary papers regarding the develop- ment of programs of outreach detention and of regional trans- portation by the Roanoke Juvenile Detention Home. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the members present. At this point, Supervisor Seibel, a member of the Roanoke Juvenile Detention Home Committee, commented on the I various needs of the Roanoke Juvenile Detention Home. IN RE: BINGO PERMIT - WILLIAM BYRD HIGH SCHOOL ATHLETIC BOOSTERS CLUB Supervisor Flora moved that a Bingo Permit be granted to the William Byrd High School Athletic Boosters Club effective this date for a period of one year. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora NAYS: None ABSTAINING: Mr. Seibel ABSENT: Mr. Hilton I '"', .. , ~~ 337 2-26-74 IN RE: BINGO PERMIT - OAK GROVE ELEMENTARY SCHOOL P.T.A. Supervisor Flora moved that a Bingo Permit be issued to the Oak Grove Elementary School P.T.A. effective this date I for a period of one year. The motion was seconded by Supervisor Beasley and I adopted by the unanimous voice vote of the members present. IN RE: BINGO PERMIT - VIRGINIA'S JUNIOR MISS PAGENT, INC. Supervisor Beasley moved that a Bingo Permit be issued to the Virginia's Junior Miss Pagent, Inc. effective this date for a period of one year. The motion was seconded by Supervisor Flora and adopted by the unanimous voice vote of the members present. IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE - OFFICE EQUIPMENT - GENERAL DISTRICT COURT AND JUVENILE AND DOMESTIC RELATIONS COURT I On motion of Supervisor Beasley, seconded by Super- visor Dodson, the General Appropriation Ordinance of Roanoke County, Virginia, adopted June 27, 1973, be, and the same is hereby, amended as follows to become effective February 26, 1974 EXPENDITURES 305b - County Court (General District Court) 405 - Office Furnishings and Equipment: An additional appropriation of $757.00 is hereby made from the General Operating Fund for the period ending June 30, 1974 for the function and purpose herein- above indicated. 305d - Juvenile and Domestic Relations Court I 405 - Office Furnishings and Equipment: An additional appropriation of $757.00 is hereby made from the General Operating Fund for the period ending June 30, 1974 for the function and purpose hereinabove indicated. Petition of K. B. Graham Builder, Inc. for rezoning of 3 parcels of land, containing approximately 37 acres located at the corner of Penn Forest Boulevard and Chaparral Drive from R-I to R-3 for a Planned Unit Development. I b. Petition of American Valley Inns, Inc. for rezoning of a portion of a 4.095-acre tract located on the south side of U. S. Route 220, south of Tanglewood Mall and north of Hunting Hills, immediately adjacent to Valley Avenue on the north side from R-3 to B-2 so a motel may be constructed thereon. IN RE: COUNTY PROPERTY MAPS Supervisor Flora moved that the Board approve the report of the County Administrator regarding County Property Maps and that the County Administrator be authorized to proceed with implementation so that the existing County Property Maps may be reproduced on mylar film. I The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: A RESOLUTION INDICATING THE BOARD'S INTENT TO ENTER INTO AN AGREEMENT TO ESTABLISH AND OPERATE A MANPOWER AREA PLANNING COUNCIL WHEREAS, pursuant to Federal requirements in the area of Revenue Sharing, it is necessary to establish Manpower Area Planning Councils throughout the Commonwealth of Virginia; and WHEREAS, the political subdivisions comprising the I Fifth Planning District have been designated as Virginia II Manpower Area under which a variety of manpower programs will be administered; and WHEREAS, the Board of Supervisors desires to indicate its intent to enter into an agreement to establish such a Manpower Area Planning Council. 2-26-74 339 NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby indicates its intent to enter into an agreement to establish and operate a Manpower Area Planning Council. I BE IT FURTHER RESOLVED, that the Clerk of the Board of Supervisors transmit a certified copy of this resolution to the National Office of the united States Department of Labor in Philadelphia not later than March 1, 1974. On motion of Supervisor Beasley, seconded by Super- visor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: EMERGENCY VEHICLE GASOLINE SUPPLY Supervisor Flora moved that the Board approve the I action of the County Administrator regarding fuel for emergency vehicles in the Mount Pleasant area. The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: A RESOLUTION AUTHORIZING THE PURCHASE OF MOTOR VEHICLES FOR USE BY THE SHERIFF'S DEPARTMENT WHEREAS, bids were received by Roanoke County on February 21, 1974 on the purchase of two new 1974 compact automobiles for use by the Sheriff's Department; and I WHEREAS, the bid of Vinton Motor Company, Inc. on Ford Maverick automobiles was the lowest and best bid received by the County for such vehicles, which bid met all of the County's specifications; and WHEREAS, the Board of Supervisors is of opinion that the bid of Vinton Motor Company, Inc. should be accepted. __ _ __-----"---'-_~ L!lImIiL~.~_._---,,---,------.L....-.dol..~ ...........t..--,,--a.,.L _ ""-"'--'--....~~ _.~-_-'"----_~.-"---"-_~---"-~._._._~~_ ...H.____ 340 2-26-74 --'T-'-' NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the bid of vinton Motor Company, Inc. for two Ford Maverick automobiles in the amount of $3,042.24 for each vehicle be and the same is hereby accepted. BE IT FURTHER RESOLVED that the County Administrator be authorized and directed to sign the necessary purchase order to provide for the purchase of said automobiles. I AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: A RESOLUTION AUTHORIZING THE ENTERING INTO OF A CONTRACT PROVIDING BULK CONTAINER SERVICE FOR THE COUNTY REFUSE COLLECTION WHEREAS, the County Administrator has, in report submitted to the Board of Supervisors on February 26, 1974, recommended that the said Board authorize the entering into of an agreement with Cycle Systems, Inc. whereby said firm would provide bulk container service in certain areas of the County; and WHEREAS, the Board of Supervisors is of opinion that an agreement with said firm would be in the best interest of Roanoke County and that such service should be provided in the Catawba Valley and in the Bent Mountain areas of Roanoke County. NOW, THEREFORE BE IT RESOLVED by the Board of Super- visors of Roanoke County that the County Administrator be and he is hereby authorized to enter into a written contract with Cycle Systems, Inc. whereby said firm provides bulk container service in the Catawba Valley and Bent Mountain areas of Roanoke County for the fee of $19.50 per month for container rental and $7.00 per pick-up; said contract to provide that aforesaid service be on a trial basis for six (6) months; and to be otherwise in such form as is approved by the County Attorney. AYES: Mr. Beasley, Mr. Dodson, Mr. Flora NAYS: None ABSTAINING: Mr. Seibel ABSENT: Mr. Hilton I IN RE: DOG KENNELS Supervisor Beasley moved that the County Attorney be directed to prepare the necessary papers regarding revision of certain sections of the Roanoke County Code pertaining to Dog Kennels in accordance with the recommendations of the Planning Commission. The motion died for lack of a second. I At 9:35 p.m., on the motion of Supervisor Beasley, seconded by Supervisor Dodson and the unanimous voice vote of the members present, the Board went into Executive Session to discuss a matter involving real estate. At 9:42 p.m., the Supervisors returned to the Civic Center and on the motion of Supervisor Flora, seconded by Supervisor Beasley and the unanimous voice vote of the members present, the Board reconvened in open session. At 9:44 p.m., on the motion of Supervisor Beasley, seconded by Supervisor Flora and the unanimous voice vote of the members present, the Board went into Executive Session to discuss a personnel matter. At 10:03 p.m., the Supervisors returned to the Civic Center and on the motion of Supervisor Flora, seconded by Supervisor Dodson and the unanimous voice vote of the members present, the Board reconvened in open session. I 343 2-26-74 IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE - COUNTY LIBRARY OPERATING FUND On motion of Supervisor Dodson, seconded by Supervisor Beasley, the General Appropriation Ordinance of Roanoke County, I adopted June 27, 1973, be, and the same is hereby, amended as follows to become effective February 26, 1974. REVENUES 1300 - County Library Operating Fund 607 - State Funds: A deletion of $726.00 is hereby made from the Library Operating Fund for the period ending June 30, 1974 for the function and purpose hereinabove indicated. 0684 - Federal Funds: An additional estimate of $5,246.0 is hereby made to the Library Operating Fund for the period ending June 30, 1974 for the function and purpose hereinabove indicated. 1300 - County Library Operating Fund I 314 - Library Books, Magazines, and Binding: An additional appropriation of $4,538.00 is hereby made from the Library Operating Fund for the period ending June 30, 1974 for the function and purpose hereinabove indicated. The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel I NAYS: None ABSENT: Mr. Hilton 344 2-26-74 IN RE: COMMITTEE TO STUDY COMMUNICATIONS RESOLUTION -----1--..- I I authorize Supervisor Beasley moved that the Chairman be to appoint a committee to study the resolution concerning communications which was adopted at the February 12, 1974 meeting I of the Board and to hold in abeyance any action on the Communica- tions Resolution until said committee has submitted its report to the Board. The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: CABLE TV Supervisor Dodson moved that the City of Roanoke be given 30 days notice to report their intentions regarding Cable TV in the Roanoke Valley. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: SMOKING AT BOARD MEETINGS Due to a tie vote on the motion made by Supervisor Beasley at the February 12, 1974 Board meeting that smoking be permitted at Board meetings, there was a recall on the vote. The motion was adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Flora NAYS: Mr. Seibel ABSTAINING: Mr. Dodson ABSENT: Mr. Hilton I I I ~ 3~45 2-26-74 IN RE: 1974/75 BUDGET - COST OF LIVING Supervisor Beasley moved that the Department Heads be instructed to submit a $500.00 cost of living increase for all employees and that this be a one-time deal. I The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: A RESOLUTION ESTABLISHING A VOLUNTARY PLAN FOR COORDINATING HOURS OF OPERATION OF SERVICE STATIONS IN ROANOKE COUNTY BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby establishes a voluntary plan for implementation and use by operators of service stations situate in Roanoke County in order to coordinate the hours of operation I of such service stations in accordance with Executive Order Number 2 issued by the Governor of Virginia; the hours estab- lished for operation to be as follows: Monday thru Friday: open at 7:30 a.m. open at 4:30 p.m. Saturday: open at 8:00 a.m. BE IT FURTHER RESOLVED that the Clerk transmit a certified copy of this resolution to the Roanoke Chapter of the Virginia Gasoline Retailer's Association and to the Clerk's of all Valley governing bodies.
