The Board of Supervisors of Roanoke County met this day at the Salem-Roanoke Valley Civic Center in Salem, Virginia, being the second Tuesday, and the first regular meeting of the month. Members Present: R. E. Hilton, Jr., Chairman, John G. Seibel, Vice-Chairman, Thomas H. Beasley, Jr., C. Lawrence Dodson and Richard C. Flora. William F. Clark, County Administrator, and Edward A. Natt, County Attorney, were also in attendance. Chairman Hilton called the meeting to order at 1:00 p.m recognized Reverend Barnard P. Edwards, First Christian Church of Salem, who offered the invocation. The Pledge of Allegiance to the flag was given in unison, led by Chairman Hilton. The minutes of the regular meetings of February 12 and February 26, 1974 were approved as submitted by the Chairman. IN RE: ANNUAL SECONDARY ROAD HEARING Mr. George Robertson, Resident Engineer of the Virginia! Department of Highways, appeared before the Board for the purpose of discussing proposed work to be done on the Secondary System for the 1974-75. IN RE: PETITION OF HOLLOW CREEK SWIM CLUB, INC. ) FOR REZONING OF ABOUT 2.48 ACRES ON NORTH) SIDE OF HERSHBERGER ROAD NEAR PLANTATION ) FINAL ORDER ROAD ) This matter carne on to be heard before the Board of Supervisors, the same having previously been filed with the Boar referred to the Planning Commission, and upon notice and public hearing before the Planning Commission and recommendation of the Planning Commission, and upon notice of public hearing before th I I I ., , -r 3-12-74 347 Board of Supervisors, advertised and held on March 12, 1974 at 1:00 p.m.; and upon the appearance of the petitioner by counsel and upon the recommendation of the Planning Commission, and the Board having heard and weighed the evidence in the case and I being of the opinion that the rezoning of the property in question from R-l to B-2 would be in accord with the laws of the Commonwealth of Virginia and consistent with the Zoning OrdinancE of Roanoke County, it is accordingly: ORDERED that the following property presently classi- fied as R-l be rezoned to B-2 on the zoning map of Roanoke County which is a part of the Zoning Ordinance of Roanoke County, and that said map be amended to reflect such change: I BEGINNING at a point on the northerly side of the right of way line of Hershberger Road adjacent to the property of Hawkins; thence N. 54 degrees 40' w. 21.93 feet to a point; thence N. 56 degrees 3' 20" E. 240.70 feet to a point; thence N. 28 degrees 22' 20" E. 278.25 feet to a point; thence N. 87 degrees 17' E. 170.40 feet to a point; thence S. 7 degrees 30' E. 190.40 feet to a point; thence S. 36 degrees 46' W. 252.0 feet to a point on the northerly right of way line of Hershberger Road; thence with said right of way line S. 88 degrees 30' 17" W. 358.36 feet to the point and place of BEGINNING. There was no opposition. .& 348 -12-74 IN RE: PETITION OF COLONIAL-AMERICAN NATIONAL BANK OF ROANOKE FOR REZONING OF A 1.98 ACRE TRACT LYING ON THE WEST SIDE OF ELECTRIC ROAD AND SOUTH OF KEAGY ROAD DENIAL Prior to any discussion on the petition of Colonial- American National Bank of Roanoke, Supervisor Flora stated that he had a potential conflict of interest and must abstain from all discussion. Supervisor Dodson moved that the petition of Colonial- American National Bank of Roanoke for rezoning of a 1.98-acre tract lying on the west side of Electric Road (Virginia Route No. 419) and on the south side of Keagy Road (Virginia Secondary Route No. 685) from R-l to B-1 for the construction of a branch bank be denied. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Hilton NAYS: Mr. Seibel ABSTAINING: Mr. Flora Mr. Michael K. Smeltzer, Attorney, appeared on behalf of the petitioners. Mr. Scott, Bank Representative was also present at the meeting. Mr. Smeltzer presented a letter from David Dick and Associates stating that there would be no problem with drainage. Mr. Robert Frank, Attorney, appeared in opposition to the rezoning. Mr. Frank represented approximately~5 persons in the area opposing the rezoning. He stated that the entire area was presently zoned Residential and the residents wished to keep it that way. He also stated that this rezoning would lead to additional commercial development of the area and that there were 14 branch banks located between Apperson Drive and Route 220. Mr. Frank submitted a petition signed by 125 people who were in opposition to the rezoning. ......"l..~". I I I " ~q 349 3-12-74 At 2:15 p.m., the Board took a brief recess. At 2:25 p.m., the Supervisors returned to the Civic Center and reconvened in open session. I IN RE: APPLICATION OF GALEN W. WADE FOR A PERMIT TO PARK A MOBILE HOME SITUATE ON THE SOUTH SIDE OF U.S. ROUTE 11-460, OPPOSITE INTERSECTION OF STATE ROUTE 927 DENIAL Supervisor Dodson moved that the Board deny the application of Galen W. Wade for a permit to park a mobile home on a 1 3/4-acre tract situate on the south side of U. S. Route 11-460, west of Salem opposite the intersection of State Route 927. The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Dodson, Mr. Flora, Mr. Hilton NAYS: Mr. Beasley, Mr. Seibel I The application of Galen W. Wade was presented by Mrs. Wade. Mr. Earl E. Powell appeared in opposition and presented a petition containing 51 signatures of residents of the Glenvar Hieghts Subdivision opposing the request. IN RE: APPLICATION OF MRS. SHIRLEY ANN BECKNER GINN FOR A PERMIT TO PARK A MOBILE HOME SITUATE ON THE EAST SIDE OF STATE ROUTE 311 NEAR BENNETT SPRINGS APPROVED Supervisor Beasley moved that the application of Mrs. Shirley Ann Beckner Ginn for a permit to park a mobile home on a 4~-acre tract situate on the east side of State Route 311 near Bennett Springs about ~ mile north of the 311 Grill on the property of Walter T. Beckner be approved subject to the I conditions set forth by the Planning Commission. Arthur for a permit to park a mobile home on a 1 3/4- acre tract situate on the south side of State Route 675 (Indian Grave Road) about l~ miles west off Route 220 south, on the property of A. L. Childress be approved subject to the condition set forth by the Planning Commission and the additional conditioj that a double wide modular home type building be placed on the I i I lot. IN RE: APPLICATION OF MAYANRD LEO HESLEP FOR A PERMIT TO PARK A MOBILE HOME IN RIO VISTA CAMP, SOUTH OF U.S. ROUTE 11, WEST OF STATE ROUTE 612 APPROVED Supervisor Dodson moved that the application of Maynard Leo Heslep for a permit to park a mobile home on a 1/3 acre tract in Rio Vista Camp, south of U. S. Route lIon the west side of State Route 612, lots 6 and 7 be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None The application of Maynard Leo Heslep was presented by Mr. Heslep. TOBEY FOR A PERMIT TO PARK A MOBILE HOME ON THE WEST SIDE OF STATE ROUTE 612 OFF OF ROUTE 777, NORTH OF 1-81 APPROVED Supervisor Dodson moved that the application of Gerald W. Tobey for a permit to park a mobile home on a one- acre tract on the west side of State Route 612 off of Route 777, about 1,200 feet north of Interstate 81 on the property of Walter W. Vipperman be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None The application of Gerald W. Tobey was presented by Mr. Tobey. There was no opposition. IN RE: EMPLOYMENT OF ASSISTANT ASSESSOR AND COMPENSATION THEREOF Supervisor Beasley moved that Mr. Robert A. Davis be employed as an assistant assessor for the County's 1974 general reassessment of real estate at a salary of $800.00 per month and reimbursement for expenses in the amount of $400.00 per month. The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None On the motion of Supervisor Seibel, seconded by Supervisor Dodson and the unanimous voice vote of the Board, the report of the Fifth Planning District Commission on Commission activities for the period April 1, 1973 through February 25, 1974 was this date received and filed. ~~52 3-12-74 ~---_.~ i j On the motion of Supervisor Dodson, seconded by Supervisor Flora and the unanimous voice vote of the Board, the following items were this date received, filed and referred to the Planning Commission for a recommendation: a. Petition of Ward's Mobile Home Sales of Virginia, Inc., W. W. McCathern, English Showalter and William Watts for rezoning from B-2 to B-3 two adjacent tracts of land; one containing 3.46 acres, and the other consisting of 2.24 acres located on the south side of U. S. Route 460 (Melrose Avenue) across from Elliott Buick in order to provide proper zoning for use of said two parcels as a mobile home sales lot. I b. Petition of Norman T. Wright for rezoning from B-2 to M-l .91 acres located at the northwest corner of Starkey Road (Virginia State Route No. 904) and Crescent Heights Boulevard in order to construct an automobile service center. c. Petition of Robert E. Blair, et ux for rezoning to M-2 six acres of land located in Riverdale on the east side of 16th Street, S. E. between Carlisle Avenue and Underhill Avenue, adjacent to Roanoke City corporate limits in order that same may be used for an automotive garage. IN RE: NOTICE OF INTENTION TO AMEND CHAPTER 11, OFFENSES-MISCELLANEOUS, SECTION 11-2. FIREWORKS - POSSESSION, SALE, DISCHARGE, ETC., PROHIBITED. I BE IT RESOLVED by the Board of Supervisors of Roanoke County that a public hearing be held on April 9, 1974, at 1:00 p.m., at a regular meeting of the Board of Supervisors at which time it will be moved that the Roanoke County Code be amended as follows: Chapter 11, Offenses-Miscellaneous, Section 11-2. Fireworks - Possession, Sale, Discharge, etc., Prohibited. This amendment to take effect on April 9, 1974. The Clerk of this Board is directed to publish the proposed amendment and notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the 1950 Code of Virginia, I as amended, once a week for two consecutive weeks in the Roanoke World News, a newspaper having a general circulation in Roanoke County. ; ;. __o~_~ ... IN RE: REPLACEMENT OF MOTOR VEHICLES - SHERIFF'S DEPARTMENT I Supervisor Seibel moved that the County Administrator be authorized to seek proposals from local sources for the replacement of motor vehicles used by the Sheriff's department. The motion died for lack of a second. At this point, Supervisor Beasley moved that replacem nt of motor vehicles to be used by the Sheriff's department be purchased through the State Department of Purchases and Supply. The motion was seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Hilton NAYS: None ABSTAINING: Mr. Seibel I IN RE: UPPER MASON CREEK FLOOD PLAIN INFORMATION REPORT Lieutenant Colonel Pleasant H. West, Deputy District Engineer for the Wilmington District of the Corps of Engineers, appeared before the Board and discussed the general findings of the Corps of Engineers relating to the local flood situation along Mason Creek upstream. 354 3-12-74 Supervisor Seibel moved that the County accept the Upper Mason Creek Flood Plain Information Report submitted by the Wilmington District Corps of Engineers. The motion was seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: A RESOLUTION INDICATING THE INTENT OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO JOIN WITH OTHER GENERAL PURPOSE UNITS OF LOCAL GOVERNMENT IN THE FIFTH PLANNING DISTRICT TO DEVELOP AND IMPLEMENT A PLAN RESULTING IN A COORDINATED WASTE TREATMENT MANAGEMENT SYSTEM FOR THE AREA WHEREAS, pursuant to Section 208 of the Federal Water Pollution Control Act Amendments of 1972, P. L. 92-500, the Administrator of the United States Environmental Protection Agency has by regulation published guidelines for the identifi- cation of those areas which, as a result of urban-industrial concentrations or other factors, have substantial water quality control problems; and WHEREAS, the Fifth Planning District satisfies the criteria contained in the aforesaid Act and guidelines and designation of the area pursuant to Section 208 and those guidelines are desirable; and WHEREAS, Section 126-10 of the guidelines requires, among other things, that the affected general purpose units of local government within the problem area must indicate their intent, through formally adopted resolutions, to continue in the planning process to develop and implement a plan which will result in a coordinated waste treatment management system for the area; and I I I 355 3-12-74 I WHEREAS, such planning process and waste treatment management system is a necessary and significant measure to control present point and non-point sources of water pollution and to guide and regulate future development and growth in the area which may affect water quality, in order to prevent, abate and solve existing and potential substantial water quality control problems. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board, recognizing that the Fifth Planning District has substantial water quality control problems, supports designation of the Area pursuant to Section 208 and the EPA guidelines. BE IT FURTHER RESOLVED that said Board indicates its intention to continue its participation with other affected general purpose units of local government within the boundaries of the area to develop and implement a plan which will result in a coordinated cost effective and economically feasible waste treatment management system for the area. BE IT FURTHER RESOLVED that, inasmuch as the Fifth Planning District Commission is a single representative organi- zation with elected officials or their designees from local governments and is capable of developing effective areawide waste treatment management plans for the Area, said Board supports the designation of said organization as the planning agency for the Area. BE IT FINALLY RESOLVED that all proposals for grants for construction of publicly owned treatment works within the boundaries of the designated area will be consistent with the approved plan. EXPENDITURES 30lf - County Attorney 299 - Miscellaneous Legal Settlements: An additional appropriation of $500.00 is hereby made from the General Operating Fund for the period ending June 30, 1974 for the function and purpose herein- above indicated. Adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: NUMBERING OF RESOLUTIONS AND ORDINANCES The Board concurred in the numbering of resolutions and ordinances, which procedure will be retroactive to January 1, 1974. IN RE: A RESOLUTION APPROVING THE FORM OF LAND SUBDIVIDER'S AGREEMENT AND A LAND SUBDIVIDER'S BOND WHEREAS, Section 17-17 of the Roanoke County Code provides that in any case wherein a developer proposed to subdivide a tract of land, he shall, prior to the recording of the final plat of such subdivision, install all physical improvements or shall have submitted an acceptable agreement or bond with surety in an amount equal to the total cost of such improvements guaranteeing that such improvements will be com- pleted within a specified length of time; and WHEREAS, a form of Land Subdivider's Bond and a form of Land Subdivider's Agreement have been prepared and presented to the Board of Supervisors for its consideration; and I I I .... . ," " 357 3-12-74 I WHEREAS, the Board of Supervisors is of the opinion that the proposed Land Subdivider's Bond and the proposed Land Subdivider's Agreement should be adopted for use by all persons subdividing real property situate in Roanoke County and, further that the County Administrator and the County Engineer shall determine the amount of such bond. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the hereinafter set out Land Subdivider's Bond and Land Subdivider's Agreement be, and they are hereby declared to be the standard form of Land Subdivider's Bond and Land Subdivider's Agreement to be utilized by all per- sons subdividing land situate in Roanoke County; the County Administrator and the County Engineer to determine the amount of said bond based upon the physical improvements to be installed by the developer in such subdivision. On motion of Supervisor Seibel, seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton I NAYS: None IN RE: COUNTY PAYROLLS I On the motion of Supervisor Flora, seconded by Supervisor Seibel and the following recorded vote, the County Payrolls (Semi-monthly 2/28/74) and (Bi-weekly 3/1/74) were approved for payment in the gross amount of $76,357.61 from which the sum of $9,112.14 F.I.T., $1,590.04 State Tax, $4,353.79 F.I.C.A., $1,489.43 Blue Cross, $1,990.82 VSRS, $266.40 L.I., $189.75 ACC, $211.50 T.P., $138.85 A.F., $112.51 S.B., $48.17 U.F., $86.72 Misc., are deducted leaving a net payroll of $56,767.48. AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: A RESOLUTION DIRECTING AND PROVIDING FOR THE ACQUISITION OF A CERTAIN PARCEL OF LAND IN FEE SIMPLE NEEDED BY THE COUNTY FOR THE CONSTRUCTION OF A FIRE STATION; FIXING THE CONSIDERATION TO BE OFFERED TO BE PAID BY THE COUNTY FOR SAID PARCEL OF LAND AND PROVIDING FOR THE COUNTY'S ACQUISITION OF SAID LAND BY CONDEMNATION, UNDER CERTAIN CIRCUNSTANCES WHEREAS, in order to provide for the construction of a fire station in the Clearbrook Section of Roanoke County, the parcel of land hereinafter described, is wanted and needed by the County for the aforesaid purpose, said property being needed to be acquired in fee simple; and WHEREAS, the County has determined that the valuation hereinafter set out is fair and reasonable. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. On motion of Supervisor Beasley, seconded by Super- visor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, I Mr. Hilton NAYS: None --.. ...,..- - -po '... ~'-. ..."'" ... 3-12-74 363 IN RE: A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CITY OF SALEM PER- TAINING TO THE SALEM-ROANOKE VALLEY CIVIC CENTER WHEREAS, the City of Salem and the Board of Super- I visors of Roanoke County have heretofore entered into an Agree- ment under date of March 16, 1965, whereby the City and the County agreed on the method of construction, upkeep, maintenance and operation of a joint Civic Center; and WHEREAS, the City and the County have heretofore appointed a joint committee to study the existing situation j concerning said Civic Center; and WHEREAS, said committee has recommended that the City of Salem acquire all of the County's interest in said Civic Center upon certain terms and conditions and said com- mittee has further recommended a proposed Agreement to be entered into accomplishing said acquisition; and WHEREAS, the Board of Supervisors of Roanoke County I is of opinion that it would be in the best interests of Roanoke County to dispose of the County's interest in said Civic Center upon the terms and conditions set out in said proposed Agree- mente NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Agreement to be entered into as of the 15th day of March, 1974, be and the same is hereby approved by the Board of Supervisors; and that the Chairman and the Clerk be, and they are hereby authorized and directed to execute the said Agreement on behalf of the Board of Supervisors of Roanoke County. IN RE: A RESOLUTION INDICATING THE BOARD'S INTENTION TO PARTICIPATE IN THE DEVELOPMENT OF PROGRAMS OF OUTREACH DETENTION AND REGIONAL TRANSPORTATION WHEREAS, the City of Roanoke, owner of the Roanoke Juvenile Detention Horne at Coyner Springs, Virginia, has authorized and directed development of a program of outreach detention and a program of regional transportation, as additional services to be provided by the Roanoke Juvenile Detention Horne, I and has invited all other governmental subdivisions in the Fifth' Planning District to support its development of said programs and, after such additional programs are made available, to share in the use of the same and the facilities of the Juvenile Detention Horne under agreement for payment of a per diem cost of all such services and programs used by such other governmental units; and WHEREAS, the Board of Supervisors of Roanoke County is of opinion that it would be in the best interests of Roanoke County to enter into an agreement with the City of Roanoke whereby a program of outreach detention and a program of regional transportation would be provided as additional services by the Juvenile Detention Horne. .., I I I ....~ .. .> 365 3-12-74 NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board concurs with and supports the development of a program of outreach detention and a program of regional transportation as additional services to I be provided by the Roanoke Juvenile Detention Home; and hereby indicates its desire and willingness to make use of the services of said additional programs upon them being made available, under provisions of an agreement to be entered into for payment to the City of Roanoke of a per diem cost of the operation of said programs as so used by this political subdivision. BE IT FURTHER RESOLVED that the Clerk transmit certi- fied copies of this resolution to the governing body of the various political subdivisions served by said Juvenile Detention Home.
