I being the second Tuesday and the first regular meeting of the month. Members Present: R. E. Hilton, Jr., Chairman, John G. Seibel, Vice-Chairman, Thomas H. Beasley, Jr., C. Lawrence Dodson and Richard C. Flora. William F. Clark, County Administrator, and Edward A. Natt, County Attorney, were also in attendance. Chairman Hilton called the meeting to order at 1:00 p.m. and recognized Reverend Tommy Toms, Ridgewood Baptist the flag was given in unison, led by Chairman Hilton. tol I I I I Church, who offered the invocation. IN RE: PETITION OF LANDMARK PROPERTIES FOR REZONING APPROXIMATELY .574 ACRES SITUATE ON THE SOUTH SIDE OF ROUTE 117 (PETERS CREEK ROAD) AND ON THE WEST SIDE OF ROUTE 628 (LOCH HAVEN ROAD) FINAL ORDER An Ordinance to amend the Roanoke County Zoning Ordinance. AND WHEREAS, the Planning Commission has recommended that the heretofore described land be rezoned from Manufacturing District M-l to Business District B-2; and WHEREAS, notices required by law relating to the zoninc have been published as required; and WHEREAS, the hearing provided for in said notice was held on June 11, 1974, at 1:00 p.m. before the Board of Super- I visors at which hearing all parties in interest and citizens were given an opportunity to be heard, both for and against the proposed rezoning; and WHEREAS, the Board, after considering the evidence as herein provided, is of the opinion that the heretofore described land should be rezoned. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County that the heretofore described land be and the same is hereby rezoned and Zone Designation changed from Manufacturing District M-l to Business District B-2. '~ ~ 450 6-11-74 IN RE: PETITION OF BOARD OF SUPERVISORS OF ROANOKE COUNTY FOR REZONING A TRACT OF LAND SITUATE ON THE SOUTH SIDE OF ROUTE 118 (AIRPORT ROAD) FINAL ORDER WHEREAS, the Board of Supervisors, on its own motion, at a meeting held on April 23, 1974, referred to the Planning Commission the matter of rezoning the hereinafter described property from Business District B-2 and Industrial District M-2 to Residential District R-l for the Planning Commission's report and recommendation; and WHEREAS, the Planning Commission at a meeting held on May 21, 1974, after an advertisement as required by law, fully considered the matter and reported to the Board its recommenda- tion that the property be rezoned as hereinabove set out; and WHEREAS, a public hearing was held by the Board of Supervisors after advertisement as required by law and a full opportunity was accorded all persons to express their views concerning the matter; and WHEREAS, at the conclusion of said public hearing and after full consideration of the matter, this Board if of opinion that the rezoning is proper and would promote the public interes , prosperity and welfare of the citizens of Roanoke County; and WHEREAS, all requirements of law have been complied with. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Board of Supervisors of Roanoke County that pursuant to the provisions of law, the following property be reclassified and rezoned as follows: A. From Business District B-2 to Residential District R-l: BEGINNING at the northeast corner of the J. B. Natt, County Attorney, appeared on behalf of the Board of Supervisors. There was no opposition. IN RE: RESIGNATION OF MISS CAROLYN RASTLE, EXTENSION AGENT Supervisor Seibel moved that the Board of Supervisors accept with regret the resignation of Miss Carolyn Rastle, Extension Agent, effective July 15, 1974. The motion was seconded by Supervisor Dodson and adopted by the unanimous voice vote of the Board. IN RE: REGIONAL MUSEUM AND PLANETARIUM Mr. Charles L. Haeussler, Executive Director of the I Fifth Planning District Commission, appeared before the Board and requested an appropriation of $500.00 from Roanoke County towards the site selection study for the Science Museum of Virginia. The County Finance Officer was instructed by the Board to prepare the appropriate Appropriation Ordinance for same for the June 25 meeting of the Board. 452 6-11-74 IN RE: ITEMS REFERRED TO THE PLANNING COMMISSION On the motion of Supervisor Flora, seconded by Super- visor Dodson and the unanimous voice vote of the Board, the following petitions were this date received, filed and referred to the Planning Commission for recommendation: a. Petition of Douglas W. and Martha B. Murray for rezoning a portion of Lot No. 1 of the plat made for S. E. Pace (7925 Williamson Road) opposite entrance to Hollins College from B-1 to B-2 in order to continue to operate a craft shop. b. Petition of Robert E. Chewning for rezoning of 0.8 acres as shown on survey made for Alvin Lawhorn and situate on the south side of Route 24 from R-l to B-2 in order to operate a drapier shop. c. Petition of Jeanette W. Carter for rezoning of 3.66 acres located on the east side of Route 1110 (formerly Route 641) on which was formerly operated the Guy N. Watson Trucking Corporation from R-l to R-3 in order to construct multi-family dwellings. IN RE: EMPLOYEE GRIEVANCE PROCEDURE The Board received the report on employee grievance procedure as submitted by the County Administrator. IN RE: RESOLUTION NO. 1062 AUTHORIZING AND DIRECTING THE EXECUTION OF AN AMENDMENT TO THE AREA MANPOWER PLANNING AGREEMENT WHEREAS, the Board of Supervisors, by Resolution No. 1038, adopted on March 26, 1974, authorized the execution I of the "Agreement for Planning and Operation of Manpower service~ under the Comprehensive Employment and Training Act of 1973;" ani WHEREAS, the Board has been advised that it is I necessary to make certain amendments to said agreement to pro- vide for the establishment of an executive committee to serve as the prime sponsor for implementation of said contract; and WHEREAS, amendments to said contract have been propose which would provide for the establishment of said executive committee, which amendments are deemed by the Board of Super- visors to be in the best interests of Roanoke County. On motion of Supervisor Dodson, seconded by Supervisor Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: RESOLUTION NO. 1063 AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE NATIONAL SAFETY COUNCIL PROVIDING FOR DEVELOPMENT OF A TRAFFIC RECORDS SYSTEM WHEREAS, the Board of Supervisors, during April of 1973, authorized the filing of certain grant applications with the State Highway Safety Division, one of which applications was for the development of a traffic records system within the County Sheriff's Department; and WHEREAS, said State Highway Safety Division has approv d said program and has authorized the County to enter into a contract with the National Safety Council for the purpose of conducting a traffic records workshop, the cost of the workshop to be paid totally from Federal funds heretofore authorized; and WHEREAS, the Board of Supervisors is of opinion that said program would benefit Roanoke County and that the aforesaid contract should be entered into with the National Safety Council NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Chairman and the Clerk be, and they are hereby authorized and directed to enter into a . . 454 6-11-74 -~ I , contract with the National Safety Council for a traffic records system workshop, said contract to be upon a form approved by the County Attorney. AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: RESOLUTION NO. 1064 ACCEPTING BIDS ON VARIOUS RADIO AND COMMUNICATIONS EQUIPMENT WHEREAS, bids for certain radio and communications equipment have heretofore been received and opened on May 24, 1974, by Roanoke County following advertisement for the receipt of such bids; and WHEREAS, said bids have been evaluated and report has been made to the Board recommending purchase of the hereinafter described equipment, which bids represent the lowest and best bids received by the County fully meeting the County's specifi- cations for said equipment; and WHEREAS, said equipment has been previously approved for purchase pursuant to Highway Safety Project #PT-74-080-009- 101. NOW, THEREFORE, BE IT RESOLVED by the Board of Super- visors of Roanoke County that the bids hereinafter described be'l and the same are hereby accepted, the County Administrator being authorized and directed to issue purchase orders for said equipment, incorporating the County's specifications therefor, as follows: 1. Purchase of 13 portable two-way radios with vehicular mounted battery charger for the sum of $880 each from Public Systems, Inc. 2. Purchase of a medium power base station for the sum of $2,221 from RCA Corporation. 4. Purchase of a high power base station for I the sum of $3,339.90 from General Electric Company. On motion of Supervisor Seibel, seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None IN RE: RESOLUTION NO. 1065 AUTHORIZING AND DIRECTING THE EXECUTION OF A CONTRACT PROVIDING FOR THE CONSTRUCTION OF THE MURRAY RUN SEWER LINE WHEREAS, a need exists for the construction of a sewer line paralleling the existing Murray Run sewer line in I order to provide for needed additional capacity in the Murray Run watershed for the City of Roanoke and the County of Roanoke; and WHEREAS, the contract between the City of Roanoke and the County of Roanoke and/or the Roanoke County Public Service Authority has been negotiated between the City and the County, which contract provides for the terms and conditions under which said sewer line is to be constructed; and WHEREAS, the Board of Supervisors of Roanoke County is of opinion that the construction of said line would be in the best interests of Roanoke County and is of further opinion that the proposed contract should be executed on behalf of the County. I NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that that certain contract betweer the City of Roanoke and the County of Roanoke and/or the RoanokE County Public Service Authority, as the same has been submitted 456 6-11-74 to the Board of Supervisors, be, and the same is hereby approved the Chairman and the Clerk being herein authorized and directed to execute said contract on behalf of Roanoke County. EXPENDITURES 30lf - County Attorney 299 - Miscellaneous Legal Settlements: An additional appropriation of $7,167 is hereby made from the General Operating Fund for the period ending June 30, 1974, for the function and purpose hereinabove indicated. AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Hilton NAYS: None ABSTAINING: Mr. Seibel I The report on Delinquent Accounts for the month of May, 1974 and the Treasurer's monthly report were received by the Board. On the motion of Supervisor Dodson, seconded by Supervisor Beasley and the unanimous voice vote of the Board, the Jail Physician request for additional compensation for expended medical services was continued indefinitely. IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1067 On motion of Supervisor Seibel, seconded by Supervisor Flora, the General Appropriation Ordinance of Roanoke County, Virginia, adopted June 27, 1973 be, and the same is hereby I amended as follows to become effective June 11, 1974. I Adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel, Mr. Hilton NAYS: None 460 6-11-74 U'-r' I IN RE: RESOLUTION NO. 1070 COMMENDING THE EFFORTS OF THE ACTION COMMITTEE TO SURVIVE (ACTS) WHEREAS, a group of residents of Roanoke County, in an effort to present and have recognized the feelings of a vast majority of the citizens of Roanoke County who are opposed to the efforts of the City of Roanoke and the City of Salem in attempting to annex all or any portion of Roanoke County, have formed an organization named the Action Committee to Survive (ACTS); and WHEREAS, said committee has held several mass meetings at various locations throughout the County and has publicly stated its position opposing the division of Roanoke County or the annexation of any portion of Roanoke County to either the City of Roanoke or the City of Salem; and WHEREAS, the Board of Supervisors desires to commend said committee for its efforts made in the past and to be made in the future in opposing any annexation. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby commends the efforts of the Action Committee to Survive (ACTS) in opposin the division of Roanoke County or the annexation of any portion of Roanoke County to either the City of Roanoke or the City of Salem. I I I I I I 461 6-11-74 IN RE: CIVIC CENTER - MANAGEMENT STUDY Supervisor Flora moved that the County approve the concept of a management study for the Salem-Roanoke Valley Civic Center. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the Board. IN RE: RESOLUTION NO. 1071 AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE CIVIC CENTER AGREEMENT WHEREAS, the City of Salem and the Board of Supervisor of Roanoke County have heretofore entered into an agreement unde date of March 16, 1965, whereby the City and the County agreed upon the method of construction, up-keep, maintenance and operation of a joint Civic Center; and WHEREAS, the city and the County have heretofore appointed a joint committee to study the existing situation concerning said Civic Center; and WHEREAS, said committee has recommended that the membership of the Salem-Roanoke Valley Civic Center Commission be increased from five to seven members, the City and the County each appointing three members and the City and the County alternately appointing the seventh member; and WHEREAS, the Board of Supervisors of Roanoke County is of opinion that said amendment to the Civic Center agreement would provide the Civic Center Commission with a means of pro- viding more effective operation and government of the Civic Center. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby approves the increase from five to seven of the membership of the Civic Center Commission; said membership to consist of three members appointed by the City of Salem and three members appointed by the Board of Supervisors of Roanoke County; the seventh member .~ 462 6-11-74 --l---- to be appointed jointly for a term of two years by the City and the County following recommendation made by the six members appointed as set out above. BE IT FURTHER RESOLVED that the Chairman and the Clerk be, and they are hereby authorized and directed to execute on behalf of Roanoke County an amendment to the agreement dated March 16, 1965, which would provide for the above-mentioned changes. BE IT FINALLY RESOLVED that the Clerk transmit a certified copy of this resolution to the City Clerk of the City of Salem. On motion of Supervisor Flora, seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Hilton NAYS: None ABSTAINING: Mr. Seibel At 1:45 p.m., Supervisor Dodson moved that the Board go into Executive Session to discuss matters involving litigatior and personnel. The motion was seconded by Supervisor Flora and adopted by the unanimous voice vote of the Board. Members Present: R. E. Hilton, Jr., Chairman, John G. Seibel, Vice-Chairman, Thomas H. Beasley, Jr., C. Lawrence Dodson and Richard C. Flora. William F. Clark, County Administrator, and Edward A. Natt, County Attorney, were also in attendance. Chairman Hilton called the meeting to order at 7:00 p.m. I IN RE: PUBLIC HEARING ON PROPOSED BUDGET FOR 1974-75 A public hearing was this date held on the proposed 1974-75 Budget for the County of Roanoke.
