The Board of Supervisors of Roanoke County met this day at the Salem-Roanoke Valley Civic Center in Salem, Virginia, being the fourth Tuesday and the second regular meeting of the month. MEMBERS PRESENT: John G. Seibel, Vice-Chairman, Thomas H. Beasley, Jr., C. Lawrence Dodson and Richard C. Flora. ABSENT: Chairman R. E. Hilton, Jr. In the absence of Chairman Hilton, Vice-Chairman Seibel called the meeting to order at 7:30 p.m. and recognized Reverend C. Lawrence Dodson who offered the invocation. The Pledge of Allegiance to the flag was given in unison. On the motion of Supervisor Beasley, seconded by Supervisor Dodson and the unanimous voice vote of the members present, the minutes of the regular meeting of June 11, 1974 and the adjourned meeting of June 11, 1974 were approved as spread. IN RE: PETITION OF THOMAS H. BEASLEY, JR. FOR REZONING OF 5 PARCELS OF LAND CONTAINING 140 ACRES BOUNDED ON THE SOUTHEAST BY STATE ROUTE 221; BOUNDED ON THE NORTH AND WEST BY STATE ROUTE 690; AND BOUNDED ON THE WEST BY STATE ROUTE 745, AND KNOWN AS THE PARRISH FARM FINAL ORDER WHEREAS, Thomas H. Beasley, Jr., by petition filed with this Board, requested the County Zoning Ordinance be amended so as to provide that five parcels of land comprising 140 acres more or less and described in said petition be reclassified from Residential District R-l to Residential Estate RE; and 466 6-25-74 WHEREAS, the Planning Commission of Roanoke County, by resolution adopted at its meeting held on the 21st day of May, 1974, recommended that said County Zoning Ordinance be amended so as to change the zoning classification of the aforementioned 140 acre tract from Residential District R-l to Residential I Estates District RE; and WHEREAS, upon receipt of the recommendation from the Planning Commission, this matter was set for a public hearing at this meeting of the Board and notice thereof given by pUblicatiOn! in accordance with law; and I ! WHEREAS, this Board, after giving due consideration to I l ! said petition and to the recommendation of the Planning commissioh concerning the merits of said proposed amendment to the County I Zoning Ordinance is of the opinion that said County Zoning I I Ordinance should be amended as requested. NOW, THEREFORE, BE IT RESOLVED AND ORDERED at this meeting of the Board of Supervisors that the Roanoke County Zoning Ordinance be, and the same is hereby amended so as to I reclassify the aforementioned property from Residential District R-l to Residential Estates District RE. '. ....... 467 6-25-74 IN RE: ADOPTION OF ORDINANCE NO. 1072 AMENDING CHAPTER 19, TAXATION, OF THE ROANOKE COUNTY CODE. WHEREAS, the Board of Supervisors deems certain I amendments to the Roanoke County Code to be necessary in the best interests of the health, safety and general welfare of the citizens of Roanoke County; and WHEREAS, a Notice of Intention to amend the Roanoke County Code as proposed, and public hearing thereon, have been advertised and posted in accordance with law. NOW, THEREFORE, BE IT ORDAINED by the Board of Super- visors of Roanoke County, that the Roanoke County Code be amended as follows: Chapter 19, Taxation, amended by the addition of a new section, Section 19-8. Exemption of certain taxes on property of certain elderly persons. a. General Provisions. I The commissioner of the revenue shall, upon applica- tion made and within limits as hereinafter provided, order exemption of tax on real property owned and occupied as the sole dwelling house of a person or persons not less than sixty-five years of age, upon the terms and conditions hereinafter set out. To be eligible for such exemption, the total combined income during the immediately preceding calendar year from all sources of the owners on such property shall not exceed Ten Thousand Dollars, ($10,000), provided that the first Four Thousand Dollars, ($4,000), of income of each relative, other than spouse of the owner, or owners, who is living in the dwelling shall not be included in such total, and the net combined financial worth of said persons, includ- ing equitable interests, as of the thirty-first day of December of the immediately preceding calendar year, excluding the value of the dwelling and the land, not exceeding one acre upon which it is situated, shall not exceed Thirty-five Thousand Dollars, ($35,000). I The owner or owners claiming such exemption shall file annually with the commissioner of revenue an affidavit setting out an identification of the taxable real estate, the names of the persons occupying such real estate, that the total combined income of the owners and relatives living in the dwelling on said property for the preceding calendar year did not exceed Ten Thousand Dollars, ($10,000), and that the total com- bined net worth of such owners and relatives as of the thirty-first day of December of the immediately 468 6-25-74 .-l----' , preceding calendar year did not exceed Thirty-five Thousand Dollars, ($35,000). Such affidavit shall be filed not later than the fifteenth day of February of each year. Any false statement made in connection with the filing of an application under this section shall constitute a misdemeanor, punishable by fine not exceeding one hundred dollars. The commissioner of revenue shall make further inquiry of persons seeking such exemption as may be reasonably necessary in determining the qualifications therefor. Such further inquiries shall be answered under oath. No person or persons receiving public assistance, other than medical assistance of any form, shall be eligible for the within provided exemption. All information received by the commissioner of revenue in connection with any application for such exemption shall be deemed to be confidential and shall not be revealed other than in the official admini- stration of this section. I b. Amount of exemption. The amount of tax exempted on anyone property for any year shall be a sum equal to the amount by which the tax for any tax year exceeds the amount of tax on the property for the tax year in which the owner attained sixty-five years of age. Any eligible owner sixty- five years of age or older as of December 31, 1974, shall be entitled to an exemption equal to the sum by which the tax on anyone property for any year exceeds the tax due on that property for the year 1974 c. Procedure I The commissioner of revenue shall indicate on the landi. books of the county the amount of tax exempted pursuan to the provisions of this section. He shall, with the approval of the county administrator, adopt and pro- I mulgate rules and regulations not inconsistent with the provisions of this section, as deemed necessary I for the effective administration of this section. This amendment to take effect on January 1, 1975. SMITH FOR A PERMIT TO PARK A MOBILE HOME ON A 4 ACRE TRACT LOCATED ON THE SOUTH SIDE OF ROUTE 624 WITHDRAWN The application of Dennis o. Smith for a permit to park a mobile home on a 4-acre tract located on the south side of Route 624, 1.9 miles from Route 620 on the property of Stacil Garman was withdrawn at the request of the applicant. IN RE: APPLICATION OF TILDON L. OYLER FOR A PERMIT TO PARK A MOBILE HOME ON A 21.29 ACRE TRACT LOCATED ON THE WEST SIDE OF ROUTE 220 APPROVED Supervisor Beasley moved that the application of Tildon L. Oyler for a permit to park a mobile home on a 21.29 acre tract located on the west side of Route 220, ~ mile north of Route 677 on the property of Annie E. Duncan be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton The application of Tildon L. Oyler was presented by Mrs. Oyler. No one appeared in opposition. IN RE: APPLICATION OF DONALD R. SPANGLER FOR A PERMIT TO PARK A MOBILE HOME ON A l~ ACRE TRACT LOCATED ON THE SOUTH SIDE OF ROUTE 460 APPROVED Supervisor Beasley moved that the application of Donald R. Spangler for a permit to park a mobile home on a l~-acre tract located on the south side of Route 460, between Surface Equipment Company and Fisher Trailer Sales on the property of Mrs. Edith Blankenship be approved subject to the conditions set forth by the Planning Commission. . 470 6-25-74 The motion was seconded by Supervisor Dodson and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None I ABSENT: Mr. Hilton The application of Donald R. GRIM FOR A PERMIT TO PARK A MOBILE HOME ON A 48 ACRE TRACT LOCATED ON THE NORTH SIDE OF ROUTE 737 APPROVED Supervisor Dodson moved that the application of Mrs. Juanita N. Grim for a permit to park a mobile home on a 48-acre tract located on the north side of Route 737, ~ mile south of Route 639 on the property of Horace Obenchain be approved subject to the conditions set forth by the Planning Commission. The motion was seconded by Supervisor Beasley and I adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton The application of Mrs. Juanita N. Grim was presented by Mrs. Grim. A petition submitted by residents of Route 737 and Route 639 opposing the Grim application was received by the Board. IN RE: BINGO PERMIT - GLENVAR YOUTH BOOSTERS Supervisor Flora moved that a Bingo Permit be renewed for Glenvar Youth Boosters effective this date for a period of I one year. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the Board. ~ -'w.' 6-25-74 471 IN RE: REQUEST OF TEMPLE BAPTIST CHURCH I Supervisor Flora moved that the request of Temple Baptist Church for the use of County-owned property the week of July 7 be approved and referred for Administrative action. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the members present. IN RE: ROANOKE ELECTRIC STEEL CORPORATION I Mrs. Cora Scott appeared before the Board and submitte a signed petition from residents of Cherryhill Park regarding the emission problem from the Roanoke Electric Steel Corporation Also submitted by said residents were suggestions for control of the emission problem. Supervisor Dodson moved that the Chairman be authorize to appoint a committee to study the emission problem brought about by Roanoke Electric Steel Corporation. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the members present. At 8:55 p.m., the Board took a brief recess. At 9:05 p.m., the Supervisors returned to the Civic Center and reconvened in open session. At this point, the Chairman recognized Roanoke City Delegate A. Victor Thomas, Sr. and Roanoke County Delegate Raymond R. Robrecht. Both Delegates Thomas and Robrecht were present on behalf of the Ordinance adopted regarding tax relief for certain elderly persons. IN RE: ITEMS REFERRED TO THE PLANNING COMMISSION I On the motion of Supervisor Flora, seconded by Supervisor Beasley and the unanimous voice vote of the members present, the following petitions were this date received, filed and referred to the Planning Commisssion for a recommendation: 472 6-25-74 a. Petition of First Wesleyan Church for rezoning to RE 3.94 acres located on the northeast corner of Peters Creek Road and Hartman Lane so that a child care center may be constructed thereon. b. Petition of Roanoke Development Corporation for rezoning two parcels of land containing approximately 8 acres, located between Route 419 and Cave Spring Road, S.W. from R-l to B-1 in order that same may be used as an office park. I IN RE: HIGHWAY DEPARTMENT MASTER PLAN FOR SECONDARY ROADS Mr. George L. Robertson, Resident Engineer, and Mr. Hubert Shockey, Assistant Resident Engineer, Virginia Department of Highways, appeared before the Board and submitted the Highway Department Master Plan for improvement of Secondary Roads throughout Roanoke County. On the motion of Supervisor Beasley, seconded by Supervisor Dodson and the unanimous voice vote of the members present, the matter was continued to the July 9 meeting of the I of time to review the Master Plan. IN RE: RESOLUTION NO. 1073 SETTING THE TAX LEVY ON PERSONAL PROPERTY FOR THE PERIOD JANUARY 1, 1974 TO DECEMBER 31, 1974 BE IT RESOLVED that the levy for the twelve month period beginning January 1, 1974, and ending December 31, 1974, be, and it hereby is set for a tax rate of $2.95 per ONE HUNDRED DOLLARS of assessed valuation on all taxable, tangible personal property, excluding all those classes of household goods and personal effects as are defined in Section 58-829 of the 1950 Code of Virginia, as amended to date, but including the property separately classified by Sections 58-829; 58-829.3; I 58-831; 58-831.1; and 48-831.2 in the Code of Virginia of 1950, as amended to date, located in this County on January 1, 1974, tangible personal property including the property separately classified by Sections 58-829.2; 58-829.3; 58-831; 58-831.1; andl .. ,~ 473 6-25-74 58-831.2 in the Code of Virginia of 1950, as amended to date, of public service corporations based upon the assessed value thereof fixed by the State Corporation Commission and duly certified. I On motion of Supervisor Flora, seconded by Supervisor Beasley and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: RESOLUTION NO. 1074 DIRECTING ADVERTISEMENT FOR BIDS FOR AWARD OF A FRANCHISE TO USE THE STREETS AND OTHER PUBLIC PLACES OF ROANOKE COUNTY FOR A SYSTEM OF COMMUNITY ANTENNA TELEVISION (HEREINAFTER CABLE TELEVISION OR CATV), WIRES CONDUITS, CABLES AND FIXTURES UPON CERTAIN TERMS AND CONDITIONS BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Clerk to the Board of Supervisors do cause to be advertised once a week for four successive weeks in the I "Roanoke World News," a newspaper having general circulation in Roanoke County, the proposed ordinance hereinafter set out entitled "AN ORDINANCE granting to the right, for the term and upon the conditions herein_stated, to use the streets, alleys and public ways upon obtaining all necessary approvals of all regulatory agencies and all individua~s having an interest in any said streets, alleys and public ways, to erect, construct, operate and maintain a CATV system and to construct, install and maintain poles, cables, wires, conduits and appurtenances necessary to the sale and distribution of CATV service in and along the streets, alleys and other public ways in Roanoke County, Virginia, with necessary approvals; I establishing conditions controlling the exercise of said fran- chise and the sale and distribution of CATV services; and regu- lating the manner of using the streets, alleys and public ways, the term of which proposed franchise has been approved by the 474 6-25-74 --------j---_._----------- ! The foregoing resolution was adopted on motion of Supervisor Dodson, seconded by Supervisor Flora and the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton IN RE: COUNTY PAYROLLS I On the motion of Supervisor Flora, seconded by Supervisor Beasley and the following recorded vote, the County Payrolls (Semi-monthly 6/l4/74) and (Bi-weekly 6/2l/74) were approved for payment in the gross amount of $77,218.21 from which the sum of $9,256.17 F.I.T., $1,639.42 State Tax, $4,417.33 F.I.C.A., $1,581.13 Blue Cross, $1,976.33 VSRS, $268.50 L.I., $54.25 ACC, $219.50 T.P., $118.30 A.F., $131.28 S.B., $44.67 U.F., $130.79 Misc., are deducted leaving a net payroll of $57,380.54. SPRAKER (DENIAL) Supervisor Flora moved that the Board deny the Fowl Claim of Mrs. James R. Spraker in the amount of $17.50 for seven chickens killed by wild dogs on May 10, 1974, since the normal policy of the Board is to approve claims only if a per- I sonal property return was properly filed. The motion was seconded by Supervisor Dodson and adopted by the unanimous voice vote of the members present. A copy of this ordinance is ordered to be certified to Alfred C. Anderson, Treasurer, and George F. Ferrell, Finance Officer for the County of Roanoke. C. Self, et ux, et al - Meadowood Road north off State Route 659 (Mayfield Road), 0.16 mile to Lori Drive 40 foot right of way (2) Charles A. Brizendine, et ux, et al - Extension of Route 854, 0.13 mile to D. E. 50 foot right of way (3) R. L. Moran, et ux, et al - Extension of Route 774, 0.10 mile to D. E. 50 foot right of way who this day filed their petitions for inclusion in the secondar1 Highway System of Highways in Roanoke County, it is ordered that A. A. Guepe, County Engineer, view the grounds and report to thi~ Board the convenience and the inconvenience that will result as well to individuals as to the public if such roads shall be as proposed, and especially whether any yard, garden, orchard, or any part thereof will, in such cases, have to be taken, and that no road or landings shall be established upon or through the lands of any cemetery or through the lands of any seminary of learing without the consent of the owners thereof; and the said I I I ... . 6-25-74 479 I County Engineer shall also ascertain and report to this Board whether the said roads will be of such mere private convenience as to make it proper that said roads should be opened and kept in order by the person or persons for whose convenience they are desired. He shall also assess and report what damages, if any, the landowners are entitled to and accompany his report with a plat or diagram of said roads. AND IT IS FURTHER ORDERED that the Clerk of this Board be, and hereby is, directed to issue process to summon the State Highway Commissioner of Virginia as a defendant to these road proceedings. The summons shall be directed, executed, and returned as process or a summons may be in other cases except that it may be served upon the Resident Engineer of the State Highway Department of Virginia having supervision of maintenance and construction of highways in Roanoke County and provided fur- ther that a certified copy of this order, certified by the Clerk of this Board, shall be attached to said summons or process to said State Highway Commissioner to be served as aforesaid. And these road proceedings are continued. On motion of Supervisor Beasley, seconded by Supervisol Flora and adopted by the following recorded vote: AYES: Mr. Beasley, Mr. Dodson, Mr. Flora, Mr. Seibel NAYS: None ABSENT: Mr. Hilton I I On the motion of Supervisor Dodson, seconded by Supervisor Beasley and the unanimous voice vote of the members present, the County Attorney was directed to prepare a Notice of Intention for the July 9 Board meeting for amendments to the Zoning Ordinance as it pertains to placement of mobile homes on privately owned property. . 480 6-25-74 Supervisor Beasley moved that the Planning Commission recommendation for amendments to the Zoning Ordinance in regard to certain requirements for the development of a mobile home park be continued to the August 13 meeting of the Board. The motion was seconded by Supervisor Dodson and adopted by the unanimous voice vote of the members present. Supervisor Flora moved that the Planning Commission recommendation for an amendment to the Zoning Ordinance in regard to removing duplex dwellings as a permitted use in A-I zoning be continued to the August 13 meeting of the Board. The motion was seconded by Supervisor Beasley and adopted by the unanimous voice vote of the members present. Supervisor Beasley moved to refer back to the Planning Commission clarification of its recommendation regarding the removal of two-family and multi-family dwellings as a permitted use in B-1 zoning; whereby, apartments would be allowed in B-1 zoning only when included in joint complex with business. IN RE: AMENDMENT TO GENERAL APPROPRIATION ORDINANCE NO. 1077 - REGIONAL MUSEUM AND PLANETARIUM On motion of Supervisor Flora, seconded by Supervisor Beasley, the General Appropriation Ordinance of Roanoke County, Virginia, adopted June 27, 1973, be, and the same is hereby amended as follows to become effective June 25, 1974. Expenditures 31Sf - Miscellaneous Operating Functions 702j - Regional Museum and Planetarium: An additional appropriation of $500 is hereby made from the General Operating Fund for the period ending June 30, 1974 for the function and purpose hereinabove indicated.
