The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the organizational meeting held on
the second Tuesday and the first regularly scheduled meeting of the month of January
2010. Audio and video recordings of this meeting will be held on file for a minimum of
five (5) years in the office of the Clerk to the Board of Supervisors.
IN RE: CALL TO ORDER
Chairman Altizer called the meeting to order at 2:00 p.m.

IN RE: ORGANIZATION OF COUNTY BOARD
1. Election of Officers
a. Chairman
Supervisor Altizer nominated Supervisor Flora to serve as Chairman. The
nomination was defeated by the following recorded vote:
AYES: Supervisors Flora, Altizer
NAYS: Supervisors Moore, Church, Elswick
Supervisor Moore advised that she was voting against Supervisor Flora as
Chairman not because he would not make a great Chairman, as he had been one in the
past, but she wanted to see a bipartisan Chairman and bipartisan government.

Supervisor Moore nominated Supervisor Church to serve as Chairman.
Supervisor Church was elected by the following recorded vote:
AYES: Supervisors Moore, Church, Elswick
NAYES Supervisors Flora, Altizer
At this time, prior Chairman Altizer turned the meeting over to new
Chairman Church.
b. Vice Chairman
Supervisor Church nominated Supervisor Elswick to serve as Vice
Chairman. There were no other nominations for Vice Chairman. Supervisor Elswick
was elected by the following recorded vote:
AYES: Supervisors Moore, Altizer, Flora, Elswick, Church
NAYS: None
2. Resolution establishing a meeting schedule for the Board of
Supervisors of Roanoke County for calendar year 2010
Mr. Paul Mahoney, County Attorney advised the Board that four options
had been provided for review. The reason for the number of options was due to the
slight anomaly with the November and December holidays. The goal is to avoid conflict
with these major holidays and maintain some consistency with what the Board has done
in the past. Mr. Mahoney advised additional meetings could be held with ample
published notice.
Supervisor Church suggested the 2011 organizational meeting be held on
Monday, January 3, 2011, and advised he felt this change will help facilitate and ease
into the new year for the new incoming Chairman and Vice Chairman with regard to the
Board agenda and would align Roanoke County with other local governing bodies, in
particular the School Board and others.
Supervisor Church moved to adopt approval of Option 1 with the
organizational meeting on Monday, January 3, 2011 at 10:00 a.m.

Chairman Church declared the meeting in recess at 2:10 p.m.
IN RE: CALL TO ORDER
Chairman Church called the meeting to order at 3:00 p.m. with all
members present.
IN RE: OPENING CEREMONIES
The invocation was given by Mr. Tim Thompson, Minister of Penn Forest
Christian Church. The Pledge of Allegiance was recited by all present.
IN RE: REQUESTS TO POSTPONE, ADD TO OR CHANGE THE ORDER OF
AGENDA ITEMS
Mr. Mahoney requested the addition of a closed session, pursuant to the
Code of Virginia Section 2.2-3711.A.7. Consultation with legal counsel and briefings by
staff members pertaining to probable litigation, namely, the operation of and expenditure
of public funds and donated funds by Clearbrook Volunteer Fire Department.
There were no objections.
IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS
1. Resolution of appreciation to Michael W. Altizer for his service as
Chairman of the Roanoke County Board of Supervisors in 2009
Chairman Church presented the resolution and gift to Supervisor Altizer.
RESOLUTION 011210-2 OF APPRECIATION TO MICHAEL W.
ALTIZER FOR HIS SERVICE AS CHAIRMAN OF THE BOARD
OF SUPERVISORS IN 2009
WHEREAS, Michael W. Altizer served as Chairman of the Roanoke County
Board of Supervisors during 2009; and
WHEREAS, during Mr. Altizer's term as Chairman, many noteworthy
achievements took place, including the dedication and opening of the following facilities:
> Western Virginia Regional Jail

> North County Fire and Rescue Station
> Fleet Service Center
> Green Ridge Recreation Center
> Roanoke Valley Regional Fire Training Tower; and
WHEREAS, the following other accomplishments also occurred during Mr.
Altizer's term as Chairman:
> Groundbreaking for the South County Library
> Completion of the $9 million upgrade of the emergency radio system
> Welcoming of Franklin County as a member of the Western Virginia Water
Authority
> Completion of the Route 220 water line project in Roanoke County
> Inauguration of a Roanoke County e-newsletter for citizens
> Ribbon cutting and dedication celebrating completion of work to restore Mudlick
Creek at Garst Mill Park; and
WHEREAS, Chairman Altizer consistently supported the improvement of schools
by approving major construction and renovation projects; and
WHEREAS, Chairman Altizer was a steadfast supporter of economic
development and participated in the Coca-Cola expansion to the Valley Gateway shell
building; and
WHEREAS, Chairman Altizer was instrumental in supporting and celebrating
Kroger's continued investment in the County, which included more than 80,000 square
feet of newly renovated and expanded store space at locations in Vinton, Hollins, and
Tanglewood and over $28 million in new investment, most notably Kroger's newest and
largest retail facility in the region - an 84,000-square-foot store and mixed-use retail
development on Route 460 at Valley Gateway; and
WHEREAS, Chairman Altizer assisted with the opening of the 15,000-square-
foot Division of Motor Vehicles Customer Service Center on Peters Creek Road; and
WHEREAS, Chairman Altizer chose a positive approach to governing by
encouraging open communication and prompt responses to citizens; and
WHEREAS, Chairman Altizer worked diligently throughout the year to represent
the citizens of Roanoke County by emphasizing sound financial strategies and practices
to benefit all of the residents of the Roanoke Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, does hereby extend its deepest appreciation to MICHAEL W.
ALTIZER for his service as Chairman during 2009 and for his belief in democracy and
championing of citizen participation in local government.

IN RE: BRIEFINGS
1. Briefing on the Snow Emergency December 18-19,2009 (Richard
E. Burch, Jr., Chief of Fire and Rescue)
Joining Chief Burch were Division Chief Steve Simon, Battalion Chief of
Operations Daryell Sexton, Volunteer Fire Chief Woodrow Henderson and Assistant
Chief of Police Donna Furrow.
The group described the evacuation and sheltering of approximately 70
motorists who were stranded on Interstate 81 during the height of the storm. Several
letters, cards and donations have been received from people as far away as Florida,
Alabama and Mississippi.
Chief Sexton thanked Richfield Nursing Center for providing hot meals for
breakfast and lunch for approximately 125 people at no charge and on very short notice.
Additionally, Chief Burch thanked Mr. Goodman for not hesitating to trust
him to declare an emergency situation and the Board for coming in quickly to ratify.
IN RE: PUBLIC HEARINGS
1. Public Hearing to receive citizen comments regarding proposed
amendments to the fiscal year 2009-2010 budget in accordance
with Section 15.2-2507, Code of Virginia (W. Brent Robertson,
Director of Management and Budget)
There was no discussion and no citizens spoke on this public hearing.
IN RE: NEW BUSINESS
1. Request to approve the Second Amendment to the New River
Valley Commerce Park Project Participation Agreement and to
support an amendment to Section 15.2-6415 of the Code of
Virginia related to the Virginia Regional Facilities Act, specifically
the withdrawal of a locality from the Authority (Doug Chittum,
Director of Economic Development)

Mr. Chittum and Mr. Mahoney explained that nothing in the amendment
document further obligates Roanoke County financially. Any requested incentive
agreements or increase in fiscal responsibility would have to come before the Board of
Supervisors for approval.

Supervisor Moore moved to approve the staff recommendation to
approve the Second Amendment to the New River Valley Commerce Park Project
Participation Agreement and to support an amendment to Section 15.2-6415 of the
Code of Virginia related to the Virginia Regional Facilities Act, specifically the
withdrawal of a locality from the Authority. The motion carried by the following recorded

IN RE: FIRST READING OF ORDINANCES
1. Ordinance authorizing the operation of golf carts and utility
vehicles on designated public highways in Roanoke County,
establishing a review and approval process, and providing for the
allocation of the costs of installation and continuing maintenance
of traffic signage for such highway usage, by the addition of a
new Article VI "Golf Cart and Utility Vehicle Operations" in
Chapter 12 "Motor Vehicles and Traffic" of the Roanoke County
code (Paul M. Mahoney, County Attorney)
Mr. Mahoney reported that under new regulations, the Virginia
Department of Transportation (VDOT) no longer maintains golf cart crossing signage
and has transferred the responsibility to localities; however, they have not yet begun
enforcement. Downed signage creates an illegal crossing. The proposed ordinance is
intended to convey the responsibility and liability from the County to the owner of the
golf course where the crossing is located. The ordinance does not impose any arduous
process on farmers, who may use crossings for tractors on their land.
Supervisor Altizer moved to approve the first reading and directed the
County Attorney to send a copy of the draft ordinance to the owners or managers of
existing golf courses located in the County for their review and comment prior to the
Board's consideration of this ordinance at the second reading on January 26, 2010. The
motion carried by the following recorded vote:

IN RE: SECOND READING OF ORDINANCES
1. Ordinance authorizing conveyance of a 20' and a variable width
sanitary sewer easement and a 10' temporary construction

Mr. Paul M. Mahoney advised that there have been no changes since the
first reading of the ordinance. There was no discussion.
ORDINANCE 011210-4 AUTHORIZING CONVEYANCE OF A 20'
AND VARIABLE WIDTH SANITARY SEWER EASEMENT AND A
10' TEMPORARY CONSTRUCTION EASEMENT TO THE
WESTERN VIRGINIA WATER AUTHORITY TO BE LOCATED
WITHIN BOUNDS OF HANGING ROCK BATTLEFIELD TRAIL,
PROPERTY OF ROANOKE COUNTY BOARD OF
SUPERVISORS ADJACENT TO KESSLER MILL ROAD, ROUTE
NO. 630, CATAWBA MAGISTERIAL DISTRICT
WHEREAS, the Western Virginia Water Authority (WVWA) requires an easement
for an underground sanitary sewer and temporary construction easement within the
parcel known as Hanging Rock Battlefield Trail, to provide sewer service to the Hanging
Rock area of Roanoke County, all as shown on the plats entitled "Easement Plat from
Records for WESTERN VIRGINIA WATER AUTHORITY Showing A New 30,931 +/-
Square Feet Sanitary Sewer Easement Located on Tax Parcel 36.03-1-62, Property of
Roanoke County Board of Supervisors, Catawba Magisterial District, ROANOKE
COUNTY, VIRGINIA" Sheets No 1 & 2, (Exhibit A), and "Easement Plat from Records
for WESTERN VIRGINIA WATER AUTHORITY Showing A New 2,159.4 Square Feet
Sanitary Sewer Easement Located on Tax Parcels 36.03-1-62 and 36.03-1-1.1,
Property of Roanoke County Board of Supervisors, Catawba Magisterial District,
ROANOKE COUNTY, VIRGINIA", (Exhibit B), prepared by ACS DESIGN, dated
October 21, 2009; and
WHEREAS, Roanoke County previously acquired the real estate on which is
located a portion of the Hanging Rock Battlefield Trail, Tax Map Number 36.10-1-62, by
deed recorded in Deed Book 1671, page 474, in the Roanoke County Circuit Court
Clerk's Office; and
WHEREAS, the Western Virginia Water Authority has proposed to extend
sanitary sewer service within the parcel containing the existing Hanging Rock Battlefield
Trail to businesses located in the Hanging Rock area of Roanoke County in the vicinity
of the intersection of Thompson Memorial Drive, State Secondary Route 311 and State
Secondary Route 419; and
WHEREAS, the proposed easement will serve the interests of the public and is
necessary for the public health, safety, and welfare of the citizens of Roanoke County.

THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by
ordinance. A first reading of this ordinance was held on December 15, 2009, and a
second reading and public hearing was held on January 12, 2010.
2. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, the interest in real estate to be conveyed is hereby declared to be surplus, and
is hereby made available for other public uses by conveyance to WVWA for the
provision of sanitary sewer service.
3. That donation to WVWA of an 20' and variable width easement and a 10'
temporary construction easement for an underground sanitary sewer and related
improvements, within the easement area designated on the attached Exhibits "A" and
"B", which are incorporated herein by reference, on the County's property known as
Hanging Rock Battlefield Trail, to provide sanitary sewer service to the Hanging Rock
area of Roanoke County is hereby authorized and approved.
4. That the County Administrator, or any Assistant County Administrator, is
hereby authorized to execute such documents and take such further actions as may be
necessary to accomplish this conveyance, all of which shall be on form approved by the
County Attorney.
5. That this ordinance shall be effective on and from the date of its adoption.

IN RE: APPOINTMENTS
1. Length of Service Awards Program (LOSAP/VIP)
The Fire and Rescue Board of Trustees recommended appointment of
Jeff Edwards as the Fire Volunteer representative and Wayne Guffey as the Volunteer
At-Large representative. These appointments are four-year terms, which expire on
December 31, 2013. Confirmation of the appointments was placed on the Consent
Agenda.

Supervisor Altizer moved to adopt the Consent Resolution, with Item 3
removed for separate consideration, as requested by Supervisor Elswick.

RESOLUTION 011210-5.a EXPRESSING THE APPRECIATION
OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY
TO FREDDIE L. COOPER, JR., LIBRARY ASSISTANT, UPON
HIS RETIREMENT AFTER MORE THAN THIRTY-THREE YEARS
OF SERVICE
WHEREAS, Freddie L. Cooper, Jr. was hired on July 21, 1976, as a Library
Page and was promoted to Library Assistant on January 1, 1980; and
WHEREAS, Mr. Cooper retired as Library Assistant on January 1, 2010, after a
total of thirty three years and five months of devoted and accomplished service to
Roanoke County; and
WHEREAS, during his time as Library Assistant, Mr. Cooper assumed numerous
important responsibilities for the Library, including creating and managing an efficient
patron record and request system; regularly submitting accurate branch financial
reports; and expanding a vertical file that contained unique and valuable information,
which benefited many patrons, especially students; and
WHEREAS, Mr. Cooper also provided in-depth research assistance, answered
diverse reference questions, resolved computer and Internet issues for patrons and
managed interlibrary loans for the Vinton Branch Library; and
WHEREAS, he was consistently patient, with a friendly smile for all visitors, and
provided such excellent customer service to the patrons of the Vinton Branch and
Headquarters libraries that people regularly sought him out when visiting the library and
repeatedly commended him to his supervisors; and
WHEREAS, Mr. Cooper has been a valued and respected colleague and friend
to everyone in the Library system.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to FREDDIE L. COOPER, JR. for more than thirty-three
years and five months of capable, loyal and dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy
and productive retirement.

LANE INTO THE VIRGINIA DEPARTMENT OF
TRANSPORTATION (VDOT) SECONDARY SYSTEM
WHEREAS, the streets described on the attached Addition Form AM-4.3, fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of
the Circuit Court of Roanoke County, and
WHEREAS, the representative for the Virginia Department of Transportation has
advised this Board that the street(s) meet the requirements established by the Virginia
Department of Transportation's Subdivision Street Requirements, and
WHEREAS, the County and the Virginia Department of Transportation have
entered into an agreement on March 9, 1999, for comprehensive stormwater detention
which applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the street(s) described on the attached Additions
Form AM-4.3 to the secondary system of state highways, pursuant to §33.1-229, Code
of Virginia, and the Department's Subdivision Street Requirements, after receiving a
copy of this resolution and all outstanding fees and documents required of the
developer, whichever occurs last in time.
BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted
right-of-way, as described, and any necessary easements for cuts, fills and drainage,
and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be
forwarded to the Residency Administrator for the Virginia Department of Transportation.

WHEREAS, the representative for the Virginia Department of Transportation has

IN RE: REQUEST TO ACCEPT AND APPROPRIATE FUNDS IN THE AMOUNT
OF $2,103,940 TO THE ROANOKE COUNTY PUBLIC SCHOOLS

Mr. Elswick advised that he was not familiar with where these funds
originated and why they are being appropriated to the schools. He asked for further
discussion to clarify where these funds should go. He stated that the funds are all
taxpayer money and would like time for better understanding.
Mr. Goodman explained that it was his understanding that a prior Board
and School Board had an agreement regarding the sale of this property, a part of which
was obtaining the land from the School Board for the new Public Safety Center. The
Board agreed to convey the proceeds to the School Board strictly for capital costs. The
building has been sold to the State for expansion of the forensic lab located directly
behind it.
Supervisor Flora moved to approve the staff recommendation to
appropriate $2,103,940 to the Roanoke County Public Schools. The motion carried by

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Moore issued an invitation to everyone to a pre-prom fashion
show at Northside High School on Saturday January 16, 2010, at 1:00 p.m., which
benefits a drug free prom.
Supervisor Elswick advised that he and Mr. Goodman have toured many
County facilities. He feels The County is very fortunate to have Mr. Goodman and a very
capable staff to help get through these hard times. He announced a new community
organization, Common Sense, whose function will be to get more citizens involved in
County government. The first meeting will be on January 21, 2010, at the 419 Library.
Chairman Church spoke on the success of the community meeting the
night before on the Glenvar Community Plan.
IN RE: CLOSED MEETING
The closed meetings here held from 4:32 p.m. until 5:10 p.m.
At 4:16 p.m., Chairman Church moved to go into closed meeting followed
by the work sessions pursuant to the Code of Virginia as follows: 1) Section 2.2-
3711.A.1. personnel, namely discussion concerning appointments to the Audit
Committee; Grievance Panel; Length of Service Awards Program; Roanoke Regional
Airport Commission; Roanoke Valley -Alleghany Regional Commission; Roanoke
Valley - Alleghany Regional Comprehensive Economic Development Strategy
Committee; Roanoke Valley Area Metropolitan Planning Organization; School
Construction Committee; and Southwest Development Financing, Inc.; and 2) Section
2.2-3711.A.7. consultation with legal counsel and briefings by staff members pertaining
to probable litigation, namely, the operation of and expenditure of public funds and
donated funds by Clearbrook Volunteer Fire Department.

IN RE: WORK SESSIONS
Budget Work Session (Brent Robertson, Director of Management and
Budget)
The work session was held from 5:20 p.m. until 6:38 p.m.
Mr. Robertson presented a PowerPoint on an overview of Governor
Kaine's State budget proposal, a copy of which is available for inspection in the office of
the Clerk to the Board of Supervisors. He stated that the numbers do not include the
School Board changes, which he expects to have significant impact of approximately
$6-7 million. Mr. Robertson provided the proposed Budget Development Calendar for
fiscal 2010-2011.
It was the consensus of the Board that should staff notify outside agencies
requesting budget funding ahead of time that their requests should reflect a 10 percent
decrease from the prior fiscal year.
Supervisor Altizer requested the analysis of Capital Improvements be
broken down further by one-time money and ongoing funding. Ms. Owens indicated she
would add this information and resend the worksheet to the Board.
IN RE: CERTIFICATION RESOLUTION
Chairman Church returned to open session at 6:38 p.m. and moved to
adopt the certification resolution.
RESOLUTION 011210-7 CERTIFYING THE CLOSED MEETING
WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a closed meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by
the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby certifies that, to the best of each member's
knowledge:

1. Only public business matters lawfully exempted from open meeting
requirements by Virginia law were discussed in the closed meeting which this
certification resolution applies, and
