The Board of Supervisors of Roanoke County, Virginia met this day atthe
Roanoke County Administration Center, this being fourth Tuesday and the second
regularly scheduled meeting of the month of January, 2010. Audio and video
recordings of this meeting will be held on file for a minimum of five (5) years in the office
of the Clerk to the Board of Supervisors.

RESOLUTION 012610-2 DISSOLVING THE CLEARBROOK
VOLUNTEER FIRE DEPARTMENT
WHEREAS, Section 27-10 of the Code of Virginia authorizes the governing body
of any county, city or town for any reason it deems advisable may dissolve a fire/EMS
company; and
WHEREAS, by Resolution 042396-2 the Board of Supervisors recognized the
existence of the Clearbrook Volunteer Fire Company; and
WHEREAS, the Clearbrook Volunteer Fire Company has failed for more than two
years successively to consist of twenty effective members and that it has failed to
respond to fire emergencies and calls for service; and
WHEREAS, the Board of Supervisors finds that it is advisable to dissolve the
Clearbrook Volunteer Fire Company.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the authority found in Section 27-10 of the Code of
Virginia, 1950 as amended, the Clearbrook Volunteer Fire Company is hereby
dissolved.
2. That the provisions of Resolution 042396-2 are hereby repealed as they
apply to the recognition of the existence of the Clearbrook Volunteer Fire Company.
3. That this resolution of dissolution is effective immediately upon adoption.

IN RE: FIRST READING OF ORDINANCE AND PUBLIC HEARING
1. Ordinance amending Section 2-6. Assessment of fees in courts
for construction, renovation or maintenance of courthouse, jail or
court-related facilities of the Roanoke County Code (Paul M.
Mahoney, County Attorney)

Supervisor Flora moved to approve the first reading and schedule the
second reading for February 9, 2010. The motion carried by the following recorded

IN RE: SECOND READING OF ORDINANCE AND PUBLIC HEARING
1. Ordinance authorizing the operation of golf carts and utility
vehicles on designated public highways in Roanoke County,
establishing a review and approval process, and providing for the
allocation of the costs of installation and continuing maintenance
of traffic signage for such highway usage, by the addition of a
new Article VI “Golf Cart and Utility Vehicle Operations” in
Chapter 12 “Motor Vehicles and Traffic” of the Roanoke County
code (Paul M. Mahoney, County Attorney)
Mr. Mahoney advised that there have been no changes since the first
reading of the ordinance. There was no discussion and no citizens spoke on this item.
ORDINANCE 012610-3 AUTHORIZING THE OPERATION OF
GOLF CARTS AND UTILITY VEHICLES ON DESIGNATED
PUBLIC HIGHWAYS IN ROANOKE COUNTY, ESTABLISHING A
REVIEW AND APPROVAL PROCESS, AND PROVIDING FOR
THE ALLOCATION OF THE COSTS OF INSTALLATION AND
CONTINUING MAINTENANCE OF TRAFFIC SIGNAGE FOR
SUCH HIGHWAY USAGE, BY THE ADDITION OF A NEW
ARTICLE VI “GOLF CART AND UTILITY VEHICLE
OPERATIONS” IN CHAPTER 12 “MOTOR VEHICLES AND
TRAFFIC” OF THE ROANOKE COUNTY CODE
WHEREAS, the 2004 session of the Virginia General Assembly (Acts of
Assembly 746, codified as Sections 46.2-916.2 and 46.2-916.3) authorized the

governing bodies of counties, cities and towns to adopt local ordinances to regulate the
operation of golf carts and utility vehicles on designated public highways; and
WHEREAS, public health, safety and welfare require that the County review and
approve the highway usage for golf cart crossings at locations on designated highways;
and
WHEREAS, there are four golf courses located in Roanoke County: Hanging
Rock, Hunting Hills, Hidden Valley and Ballyhack; and each of these golf courses have
locations where golf carts cross a public highway; and
WHEREAS, the County intends to recover any and all costs associated with the
review and approval of the use and operation of golf carts and utility vehicles on
designated public highways, and to shift the costs of installation and continuing
maintenance to the organizations, individuals or entities requesting such highway
usage; and
WHEREAS, the first reading of this ordinance was held on January 12, 2010, and
the second reading and public hearing was held on January 26, 2010.
BE IT ORDAINED by the Board of Supervisors of Roanoke County as follows:
1. That Chapter 12 of the Roanoke County Code is amended by the addition
of a new article VI “Golf Cart and Utility vehicle Operations” as follows:
Sec. 12-130. Review and Approval
No portion of any public highway in Roanoke County may be designated for use by golf
carts and utility vehicles unless such use has been reviewed and approved such
highway usage as provided herein.
Sec. 12-131. Application
Any person seeking to designate a portion of a public highway for use by golf carts and
utility vehicles shall submit to the County Administrator or his/her designee an
application consisting of the following information:
a) A plat or map showing the location of the public highway and the proposed
designated crossing(s);
b) Data showing the speed, volume and character of motor vehicle traffic using the
public highway;
c) Schematic engineering diagrams showing the design, placement, types and
location of traffic control devices and signalization in accordance with the current edition
of the Manual on Uniform Traffic Control Devices for Streets and Highways for the
proposed crossing(s);
d) Explanation of how the proposed crossing(s) are compatible with transportation
plans of the Commonwealth of Virginia and Roanoke County;
e) Explanation of how the proposed crossing(s) are compatible with the
Commonwealth’s Statewide Pedestrian Policy provided for in Section 33.1-23.03:001 of
the Code of Virginia.
f) Payment of an application and review fee of $500.00.
Sec. 12-132. Standards for Review

The County Administrator or his/her designee shall review this application with the Chief
of Police, Director of Community Development, the Commonwealth of Virginia, Virginia
Department of Transportation, and such other agencies and departments as may be
necessary, and shall report his/her findings and recommendations to the Board of
Supervisors. This review shall be completed within 60 days of the receipt of a complete
application and payment of fees; if additional information is requested from the
applicant, the review time period shall be extended until that additional information is
provided.
The Board of Supervisors shall review the application information and materials, the
recommendation of the County Administrator, and such other information it deems
relevant and material to the application. The Board shall render a decision by
considering the adoption of an ordinance approving or disapproving the proposed
highway usage within 30 days of receipt of the County Administrator’s recommendation.
Any ordinance approving designated highway usage by golf carts and utility vehicles
may impose such restrictions and limitations of such operations, provided that such
restrictions and limitations are no less stringent than the restrictions or limitations
imposed by Article 13.1 of Chapter 8 of Title 46.2 of the Code of Virginia.
No such golf cart or utility vehicle operation shall be permitted on any public highway
where the speed limit is greater than 35 miles per hour.
The design, placement and types of traffic control devices shall be in accordance with
the Manual on Uniform Traffic Control Devices (MUTCD).
Sec. 12-133. Installation, Maintenance, Liability
Upon approval of designated public highway usage by golf carts and utility vehicles, the
applicant shall furnish the County with a letter of credit or cash escrow or such other
financial assurances acceptable by the County, guaranteeing that the applicant shall be
responsible for the costs of installation and continuing maintenance of any signs and
traffic control devices and signalization pertaining to the operation of the golf carts and
utility vehicles. The County declines to be responsible for the installation and continuing
maintenance of signs and traffic control devices and signalization that may be required
for such highway usage by the operation of golf carts and utility vehicles, nor shall it pay
the cost of installation and continuing maintenance of any signs and traffic control
devices and signalization pertaining to the operation of golf carts and utility vehicles.
The applicant shall furnish the County with liability insurance coverage sufficient to hold
the County and its officers and employees harmless from any and all liability arising
from the use and operation of the public highways by golf carts and utility vehicles as a
result of any approved application.
The applicant agrees to immediately repair or replace any traffic control devices which
may be damaged. The applicant agrees to cease golf cart and utility vehicle crossing
operations across or along the designated public highway until the signs; traffic control
devices and signalization are repaired or replaced. Failure to repair or replace any sign,
traffic control devices or signalization shall result in an immediate termination of the

operation of golf carts and utility vehicles at this public highway and the County’s
revocation or cancellation of the VDOT crossing permit.
Sec. 12-134. Definitions
The words and phrases used in this ordinance shall have the meanings as provided in
Title 46.2 of the Code of Virginia.
2. That this ordinance is effective from and after the date of its adoption. This
review and approval provisions of this ordinance shall not apply to those golf cart and
utility vehicle usage and crossings previously approved either by the Commonwealth of
Virginia, Virginia Department of Transportation, or Roanoke County. If the
Commonwealth of Virginia requires the County to review and approve the highway
usage by golf carts and utility vehicles that the Commonwealth had previously
approved, then the provisions of this ordinance shall apply to that review and approval.
The cost recovery provisions for installation and continuing maintenance of signs and
traffic control devices and signalization shall apply to all previously approved golf cart
and utility vehicle highway usage and crossings.

TECHNICIAN II, UPON HIS RETIREMENT AFTER MORE THAN
TEN YEARS OF SERVICE
WHEREAS, Daniel F. Schott was hired on April 5, 1999, as a maintenance
technician and promoted to Building Maintenance Technician II on October 25, 2003;
and
WHEREAS, Mr. Schott will retire as Building Maintenance Technician II on
January 31, 2010, after a total of ten years and ten months of hard work and devoted
service with the County; and
WHEREAS, during his time as Building Maintenance Technician II, Mr. Schott
obtained a Backflow Prevention Device Certification on July 16, 2005; and
WHEREAS, Mr. Schott has been one of two lead Heating, Ventilation and Air
Conditioning (HVAC) technicians and has always been very supportive of his
coworkers, consistently volunteering to assist them as necessary; and
WHEREAS, Mr. Schott has maintained his assigned buildings in an outstanding
manner, while sustaining a cheerful and helpful attitude with other employees, vendors
and citizens.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County , Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to DANIEL F. SCHOTTfor more than ten years of
capable, loyal, and dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy
and productive retirement.

RESOLUTION 01-26-10-4.d AUTHORIZING THE APPLICATION
FOR STATE AID TO PUBLIC TRANSPORTATION
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that
the County Administrator is authorized for and on behalf of the Board of Supervisors
hereafter referred to as Roanoke County to execute and file an application to the
Department of Rail and Public Transportation, Commonwealth of Virginia, hereafter
referred to as the Department, for a grant of financial assistance in the amount of
$22,303 to defray the costs borne by Roanoke County for public transportation
purposes and to accept from the Department grants in such amounts as may be
awarded, and to authorize the County Administrator to furnish to the Department such
documents and other information as may be required for processing the grant request.

The Board of Supervisors of Roanoke County certifies that the funds shall be
used in accordance with the requirements of Section 58.1-638.A.4 of the Code of
Virginia, that Roanoke County will provide funds in the amount of $52,042, which will be
used to match the state funds in the ratio as required in such Act, that the records of
receipts of expenditures of funds granted to Roanoke County may be subject to audit by
the Department and by the State Auditor of Public Accounts, and that funds granted to
Roanoke County for defraying the expenses of Roanoke County shall be used only for
such purposes as authorized in the Code of Virginia.

RESOLUTION 012610-4.f OF CONGRATULATIONS TO MIKE
HAYMAN FOR HIS SERVICE TO ITT NIGHT VISION AND
RETIREMENT FROM THE COMPANY
WHEREAS, Mike Hayman served as President and General Manager of ITT
Night Vision since 2006; and
WHEREAS, ITT Night Vision, based in Roanoke, Virginia, is the world’s leading
developer, producer and supplier of Gen 3 image intensifier technology for U.S. and
allied military forces, as well as the homeland security market, and has served the U.S.
military with premier research, development, production and logistics for analog and
digital fusion solutions for 50 years; and
WHEREAS, Mr. Hayman was responsible for the operational excellence and
strategic growth of ITT Night Vision, resulting in a 24% increase in employment with the
creation of 381 new jobs and total capital investments of $58.1 million during his tenure
with the company; and
WHEREAS, In 1996, Mr. Hayman received the President’s Award for quality
system improvements and was presented the ITT Gold Ring in 1997 for teaming with
ITT value centers to improve customer-contractor relations while reducing costs for the
Government and industry; and
WHEREAS, Mr. Hayman has 36 years of service with ITT in various production
and development divisions including Vice President and Director of Operations of ITT
Communication Systems, as well as management and technical positions in
engineering, systems supply chain production control and procurement, quality control,
customer service and integrated logistics throughout his career.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia does hereby extend its sincere appreciation to Mr. Mike
Hayman for his leadership and service to ITT Night Vision and its impact on Roanoke
County;

TO M. ELAINE CARVER, CHIEF INFORMATION OFFICER,
UPON HER RETIREMENT AFTER TWENTY-EIGHT YEARS OF
SERVICE
WHEREAS, Elaine Carver was hired on December 14, 1981, as Systems Analyst
– End User Computing and Office Automation Specialist and promoted to: Director of
Procurement on December 9, 1991; Director of General Services on May 14, 1999;
Director of Management Information Systems on May 16, 2000; Director of Information
Technology on December 23, 2000; and Chief Information Officer on September 6,
2007; and
WHEREAS, Ms. Carver retired on December 31, 2009, as Chief Information
Officer after twenty-eight years of devoted, faithful and expert service with the County;
and
WHEREAS, during her time as Systems Analyst – End User Computer and
Office Automation Specialist, Ms. Carver served as a hands-on liaison, set the
foundation of communications with other departments and played an integral role in the
early advancements of technology within the County; and
WHEREAS, during her time as Director of Procurement, Ms. Carver provided
cost-effective purchasing practices, ensured strict adherence to all purchasing
regulations and continuously streamlined the County’s business processes relevant to
purchasing; and
WHEREAS, during her time as Director of General Services, Ms. Carver created
a plan to finance the replacement of a badly aging fleet of solid waste vehicles,
improved morale among the staff of the department and obtained annual funding for a
building capital maintenance program; and
WHEREAS, during her time as Director of Management Information Systems and
Information Technology, Ms. Carver championed the integration of technology with the
County’s business needs; and
WHEREAS, during her time as Chief Information Officer, Ms. Carver established
an independent Emergency Communications Center, advocated major technology
initiatives including the transition of the County’s public safety radio system to a digital
format and the migration of the County’s revenue assessment and collection systems to

a modern format, while constantly providing strategic vision and empowering leadership
to the County; and
WHEREAS, Ms. Carver believes in the power of the human spirit and has
demonstrated this belief again and again in the various departments in which she has
worked. Seeing people as assets and trusting the talent of Roanoke County employees
allowed her to work with departments to find their greatest potential and to work most
effectively as a cohesive group.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to M. ELAINE CARVERfor twenty-eight years of
capable, loyal, and dedicated service to Roanoke County; and

TO BETTY L. COLEMAN, CHIEF DEPUTY COMMISSIONER OF
THE REVENUE, UPON HER RETIREMENT AFTER FIFTEEN
YEARS OF SERVICE
WHEREAS, Betty L. Coleman was hired on September 12, 1994, as a Tax Clerk
II and later served as Tax Compliance Deputy before being promoted to the position of
Chief Deputy Commissioner by Commissioner of the Revenue Nancy Horn on June 18,
2001; and
WHEREAS, Ms. Coleman retired as Chief Deputy Commissioner on December
31, 2009, after more than fifteen years of dedicated, loyal, and capable service with the
County; and
WHEREAS, in the role of Chief Deputy, Ms. Coleman assisted with the
assessment methodology, personal property book, real estate tax relief program,
Virginia state income taxes, local option taxes, audits and the appeals process; and
WHEREAS, Ms. Coleman’s primary responsibility was business license
compliance, where she greeted taxpayers and handled inquiries with warmth, courtesy
and professionalism that left each customer with a positive and lasting impression of the
Commissioner’s office; and
WHEREAS, on a daily basis, Ms. Coleman served citizens of the County,
partners in government and her fellow employees by providing clear definition of

procedures and expectations with regard to the purpose and function of the
Commissioner’s office; and
WHEREAS, Ms. Coleman fostered a team atmosphere, encouraging her fellow
employees to work together and increase productivity; and
WHEREAS, Ms. Coleman set an example for her fellow employees with her
attendance – never being tardy in her career at Roanoke County; and
WHEREAS, in 2003, Ms. Coleman attained the designation of Master Deputy
Commissioner of the Revenue by following the standards set forth by the State
Compensation Board. These standards include: Experience, Service to the
Commissioners of the Revenue Association, Continuing Education and Compliance with
the Standards of Accountability; and
WHEREAS, Ms. Coleman earned her Master Deputy Commissioner of the
Revenue Certification in the program administered by the University of Virginia’s
Weldon Cooper Center for Public Service, the University’s school of continuing
education, and the Career Development Committee under the auspices of the
Commissioners of the Revenue Association of Virginia; and
WHEREAS, one of Ms. Coleman’s major accomplishments as Chief Deputy
involved working with the County’s Information Technology Department to prepare for
the 2008 conversion to a new software program for calculating the Business,
Professional and Occupational License, or BPOL tax; and
WHEREAS, as challenges arose during this process, Ms. Coleman stepped up to
the plate and found ways to adapt the changes to various procedures; and
WHEREAS, the staff of the Commissioner of the Revenue’s office held Ms.
Coleman in the highest regard, stating she had a smiling disposition that brightened
everyone who had contact with her and was often referred to as Snow White; and
WHEREAS, Ms. Coleman consistently displayed to her fellow co-workers
honesty, compassion and fairness, presented herself as a trustworthy mediator,
displayed allegiance to management and to the principles and standards of the County
of Roanoke.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to BETTY L. COLEMANfor more than fifteen years of
capable, loyal , and dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy
and productive retirement.

Supervisor Altizer inquired about the Comparative Statement of Budget
and Actual Expenditures Report, noting that Public Health is $262,000 above what it
was for last year. Rebecca Owens, Director of Finance, explained there was a
classification error and this was a correcting entry.
Supervisor Altizer also asked about the Benefits line showing over
$621,000 over last year’s figure. Ms. Owens responded this is due to termination pay,
insurance and post-employment benefits for retirees and 2009-2010 being the first year

Roanoke County made payment to the Virginia Municipal League/Virginia Association of
Counties Trust.

At 3:43 p.m., Chairman Church moved to go into closed meeting following

namely discussion concerning appointments to the Economic Development Authority,

IN RE: WORK SESSIONS
1. Work session on the Vinton Area Corridors Plan (Philip
Thompson, Deputy Director of Planning; Lindsay Blankenship,
Planner II)
The work session was held from 4:53 p.m. until 5:13 p.m.
Ms. Blankenship presented a PowerPoint with an overview of each
chapter of the draft Vinton Area Corridors Plan, which is a collaboration with the Town
of Vinton, Roanoke County and the Roanoke Valley-Alleghany Regional Planning
Commission. Additionally, Ms. Blankenship reviewed the adoption process, goals,
recommendations, implementation strategies and proposed funding sources. The public
hearing and adoption are planned for the February 23, 2010, Board meeting.
2. Work session to discuss two law enforcement capital projects:
(a) Law Enforcement Firing Range and (b) Criminal Justice
Academy (Daniel R. O’Donnell, Assistant County Administrator
and Ray Lavinder, Chief of Police)

Mr. O’Donnell and Chief Lavinder explained that the clean-up of the firing
range is almost complete. The plan is for other law enforcement agencies to be able to
use the firing range. Fees for service will be charged and used for maintenance of the
range. The present shoot house cannot be renovated due to the condition and cost.
Having a shoot house at another location on the site may be an alternative. Tactical
teams could use air soft pellets or similar type ammunition for practice as a safety
precaution.
Mr. O’Donnell and Chief Lavinder also explained that the Public Safety
Center is being used for the Criminal Justice Academy, which is causing scheduling and
use conflicts. The building was not designed for this type of use. They discussed using
the land adjacent to the School Board offices to construct a new building for the
academy. The Board asked staff to research possibly using the 419 Library building for
this purpose.
3. Work session to consider the request to form a Community
Development Authority (CDA) for South Peak (B. Clayton
Goodman III, County Administrator)
The work session was held from 5:53 p.m. until 6:38 p.m.
Mr. Goodman noted that no petition has been filed for a CDA and the
discussion on the subject would be general in nature. He indicated that any figures
would be projections only.
Hunter Smith and Angie Stanfill from Smith-Packett, the developer of
South Peak, were present for the work session. Mr. Goodman informed the Board that
Roanoke County has been in negotiations with Smith-Packett for several months
regarding a CDA for South Peak. To move forward, a petition must be filed, a
Memorandum of Understanding must be signed and an ordinance must be created by
State Code. Tax revenue would be approximately $2.1 million. Annual debt payment
would be approximately $1.4 million, with a maximum at year 20 of approximately $1.9
million, based on a 70 percent ratio. Roanoke County has never done a CDA. There is
no financial risk for the County; however, should the project fail, it could affect the
County’s rating from rating agencies, such as Fitch Ratings Ltd. Should the project fail,
the bond holders would be the parties affected.
The Board requested information on a CDA most comparable to South
Peak. Mr. Goodman will research and bring the information back to the Board.
Supervisor Altizer commented that the County would be changing the way
it does business and this could be seen as incentivizing residential development. He
noted that, even if condominiums are not part of the CDA, they will benefit from the
roads and water and sewer infrastructure constructed from the CDA. He wants to be
sure the County accomplishes the first one correctly and does not open doors for future
issues.

February 9, 2010 agenda.

Pastor J. Michael Palmer spoke on behalf of the church’s petition stating
the space is needed for Sunday school rooms. He affirmed they are agreeable with the
proposed proffers. The only renovation needed is to add a handicap ramp to comply
with code.

on this matter was held on January 26, 2010.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board finds that the granting of a special use permit to Green
Ridge Baptist Church for religious assembly on 0.259 acre located at 2721 Diplomat
Drive in the Catawba Magisterial District is substantially in accord with the adopted 2005
Community Plan, as amended, pursuant to the provisions of Section 15.2-2232 of the
1950 Code of Virginia, as amended, and that it shall have a minimum adverse impact
on the surrounding neighborhood or community, and said special use permit is hereby
approved with the following conditions:

a) No alterations shall be made to the exterior of the home which will
detract from the appearance of it being a single family residence.
b) No signage shall be permitted.
c) A limit of three vehicles parked in the driveway. (Planning
Commission recommendation. County Attorney recommendation:

one time.”)
2. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed
to amend the zoning district map to reflect the change in zoning classification authorized
by this ordinance.

County school to win a state football championship; and
WHEREAS, Northside High School won the VHSL Group AA Division 3
Championship on December 12, 2009, at Virginia Tech’s Lane Stadium, in Blacksburg,
by defeating Bruton High School by 20 to17; and
WHEREAS, the Northside Vikings finished their season with an outstanding
record of 12 wins and 2 losses; and

WHEREAS, the Northside Vikings earned their first trip to a State championship
game by defeating Cave Spring High School in the Group AA Division 3 semifinal game
by 28 to 7; and
WHEREAS, the Northside Vikings won the Region III Championship by defeating
Liberty High School, and won the Blue Ridge District Championship by defeating
Staunton River High School and becoming the school’s first district champion since
2002; and
WHEREAS, the Vikings are under the dedicated leadership of Head Coach Burt
Torrence, Assistant Coaches Jeff Johnson, Joe Kormann, Keith Robinson, Steele
Whishant, David Heath, and Shawn Eaves.
