The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the fourth Tuesday and the second
regularly scheduled meeting of the month of April 2010. Audio and video recordings of
this meeting will be held on file for a minimum of five (5) years in the office of the Clerk
to the Board of Supervisors.
IN RE: CALL TO ORDER
Chairman Church called the meeting to order at 3:00 p.m.

IN RE: OPENING CEREMONIES
The invocation was given by Pastor E. B. Shoemaker of Poages Mill
Church of the Brethren. The Pledge of Allegiance was recited by all present.
IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS
1. Recognition of Roanoke County Fire and Rescue for receiving
two Red Cross Heroes Awards (Richard E. Burch, Jr., Chief of Fire
and Rescue)
Chief Burch introduced Volunteer Assistant Chief David Carroll of the Fort
Lewis Station, who briefly described the snow storm of December 2009, for which their

rescue efforts won their station the Red Cross/WSLS Channel 10 Firefighter Hero
Award.
Chief Burch introduced Assistant Chief Barry Yates of the Masons Cove
Station and Ms. Amy Egan, who was rescued on Dragon's Tooth on the Appalachian
Trail when she fell and broke her leg. Roanoke County won the Emergency Responder
Hero Award.
Ms. Egan expressed her appreciation and gratitude, described what an
ordeal it was and how it took all 18 of the rescue personnel many hours to get her to
safety as a result of the rough terrain.
2. Proclamation declaring the Month of May 2010 as Building Safety
and Pool Safety Awareness Month in the County of Roanoke
(Tarek Moneir, Deputy Director of Development)
Accepting the proclamation with Mr. Moneir were Joel Baker, Building
Commissioner; Justin Biller, Assistant Building Commissioner; Brenda Harris, Customer
Service Supervisor, Office of Building Safety; and Gary Huffman, Fire Marshall.
IN RE: BRIEFINGS
1. Annual report from Center in the Square (Dr. Jim Sears, President
and General Manager)
Dr. Jim Sears provided to the Board a brief update on the renovation to
Center in the Square. Dr. Sears indicated 37-45 percent of their patrons are County
citizens. Also addressing the board were Jim Wade, President of Advance Auto Parts;
Tom Tiller, Vice President of the Virginia Tech Alumni Association; and George
Cartledge, CEO of Grand Piano and Assistant Director of Center in the Square.
IN RE: NEW BUSINESS
1. Request to approve the Roanoke Valley Television (RVTV) Budget
for fiscal year 2010-2011 (Elaine Bays, Cable Access Director)

$23,617.65 from Clearbrook Volunteer Fire Company as

There was no discussion. Supervisor Church moved to approve the
request and to accept and appropriate the Clearbrook Volunteer Fire Company's funds
into the Fire and Rescue Department's operating budget and approve to roll over 100
percent of any unspent funds to the next fiscal year. The motion carried by the following

3. Request to appropriate $120,000 from the Asset Forfeiture
Account for rebuilding of the Law Enforcement Firing Range
(Daniel R. O'Connell, Assistant County Administrator; Ray

Chairman Church asked Mr. O'Donnell to reiterate where the funds were
coming from for this allocation. Mr. O'Donnell explained that the funds would be taken
from the ITT settlement funds, which came from the Federal government and can only
be used for law enforcement purposes. Mr. O'Donnell further explained that no local tax
dollars would be used.
Supervisor Church moved to approve the request from the ITT settlement
funds in the Asset Forfeiture Account. The motion carried by the following recorded
vote:

IN RE: SECOND READING OF ORDINANCES
1. Ordinance authorizing conveyance of a 20' water line easement to
the Western Virginia Water Authority to be located within a public
right-of-way known as Martindale Avenue, said right-of-way
having been dedicated to the Board of Supervisors, Hollins
Magisterial District (Paul M. Mahoney, County Attorney)
There were no changes since the first reading. There was no discussion.
ORDINANCE 042710-4 AUTHORIZING CONVEYANCE OF A 20'
WATER LINE EASEMENT TO THE WESTERN VIRGINIA WATER
AUTHORITY TO BE LOCATED WITHIN A PUBLIC RIGHT-OF-
WAY KNOWN AS MARTINDALE AVENUE, SAID RIGHT-OF-
WAY HAVING BEEN DEDICATED TO THE BOARD OF
SUPERVISORS, HOLLINS MAGISTERIAL DISTRICT
WHEREAS, the Western Virginia Water Authority (WVWA) requires an easement
for an underground waterline within the right-of-way known as Martindale Avenue to
provide water service to the area, all as shown on the plat entitled "NEw 20' PUBLIC
WATERLINE EASEMENT FOR WESTERN VIRGINIA WATER AUTHORITY ACROSS THE PROPERTY
OF ROANOKE COUNTY" (Exhibit A) dated March 22, 2010; and
WHEREAS, Martindale Avenue was dedicated in fee simple to Roanoke County
by subdivision plat of Bell Haven dated October 19, 1956, and recorded in Plat Book 3,
page 237 in the Roanoke County Circuit Court Clerk's Office; and
WHEREAS, the proposed right-of-way will serve the interests of the public and is
necessary for the public health, safety and welfare of the citizens of Roanoke County.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by
ordinance. A first reading of this ordinance was held on April 13, 2010, and a second
reading was held on April 27, 2010.
2. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, the interest in real estate to be conveyed is hereby declared to be surplus, and

is hereby made available for other public uses by conveyance to WVWA for the
provision of water service.
3. That donation to WVWA of an easement for an underground waterline and
related improvements, within the easement area designated on the above-mentioned
map, on the County's property known as Martindale Avenue to provide water service to
the area is hereby authorized and approved.
4. That the County Administrator, or any Assistant County Administrator, is
hereby authorized to execute such documents and take such further actions as may be
necessary to accomplish this conveyance, all of which shall be on form approved by the
County Attorney.
5. That this ordinance shall be effective on and from the date of its adoption.

TO JENNY G. BAKER, DEPUTY SHERIFF, UPON HER
RETIREMENT AFTER MORE THAN FIFTEEN YEARS OF
SERVICE
WHEREAS, Jenny G. Baker was hired on November 14, 1994, as a Deputy
Sheriff in the Corrections Division; and
WHEREAS, Deputy Jenny G. Baker retired on April 30, 2010, as a Deputy
Sheriff after fifteen years and five months of dedicated, loyal and capable service with
the Roanoke County Sheriff's Office; and
WHEREAS, Deputy Baker has shown leadership and supervisory potential by
taking charge of emergency situations while assigned to the floors; and
WHEREAS, Deputy Baker has demonstrated completion of all tasks in a
thorough and accurate manner and in accordance with County values, policies and
procedures.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to JENNY G. BAKER for more than fifteen years of
dedicated service to Roanoke County; and

RESOLUTION 042710-5.c EXPRESSING THE APPRECIATION

TO CHARLES M. BECKNER, FIREFIGHTER/EMT, UPON HIS
RETIREMENT AFTER MORE THAN TWENTY-SEVEN YEARS
OF SERVICE
WHEREAS, Charles M. Beckner was hired on June 9, 1982, as a Meter Reader
and transferred to the Fire/Rescue Department as a Firefighter on October 7, 1985; and
WHEREAS, Mr. Beckner retired on April 30, 2010, as a Firefighter/EMT after
twenty-seven years and ten months of devoted and accomplished service to Roanoke
County; and
WHEREAS, Mr. Beckner served on the Fire and Rescue Department for
twenty-four years and seven months starting out as volunteer firefighter with the Hollins
Fire Department; and
WHEREAS, Mr. Beckner was one of the original team members of the Roanoke
Valley Regional Hazardous Material Team, providing response to all of Southwest
Virginia; and
WHEREAS, Mr. Beckner provided leadership and mentoring to countless fellow
junior firefighters through his experience and knowledge of the fire service; and
WHEREAS, throughout his career, Mr. Beckner served on numerous department
and County committees for the purpose of improving the overall services provided to the
citizens.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia expresses its deepest appreciation and the appreciation of
the citizens of Roanoke County to CHARLES M. BECKNER for more than twenty-
seven years of dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy
and productive retirement.

IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS
Steve Mabry of 11232 Bottom Creek Road, Bent Mountain spoke on the
future use of the Bent Mountain School property. His wife is the principal at the school
and they love the area. He stated that School Board member Drew Barrineau attended
a meeting last week to see what citizens wanted. He spoke of the special community
aspect that exists on Bent Mountain. He asked Mr. Barrineau to support the
community's request at that meeting and it was his hope that the Board would also
support the community's wishes.
Genevieve Craighead Henderson of 5412 Twelve O'Clock Knob Road,
Roanoke spoke. She attended the school and spoke of the pride and community there.
She voiced her concern of what will happen to the school. She feels the community
should benefit from the property and not an outside agency. She feels the community
deserves it. She thanked the Board for affording her the opportunity to speak.
Bradley R. Foro of 8235 Poor Mountain Road, Bent Mountain presented
the Clerk with a petition signed by 145 interested citizens of Bent Mountain requesting
the Roanoke County School Board convey the property to the County. He spoke of the
Floyd County company, June Bug, who has allegedly approached the School Board
about renting the school building for $1. He felt that neither Board has anything to lose.
Karen Scott of 8443 Poor Mountain Road, Bent Mountain spoke to the
Board about the lifestyle on Bent Mountain, describing the neighbors, generations of
families, Roanoke commuters, farmers, festivals and the coffee pot at the local store
(like the Texas Tavern with half the seats). She commented that Green Ridge
Recreation Center is 25 miles away. She stated the community needs a place to get
together. She is worried about their park, library, ball field, gym, mountain legacies,
activities together, sitting and talking, community dinners and seniors lunch. She felt
losing the school would be losing quite a bit for the community.
Eldon Karr of 8011 Poor Mountain Road, Bent Mountain also spoke on the
future of Bent Mountain School. He stated Bent Mountain is a community of
approximately 1500, which includes 852 County residents according to the 2000
Census and may be more by now. He stated Bent Mountain is a very special place and
the school has been a gathering place since 1872. While it is currently the property of
the School Board, residents must be given a primary role in negotiating the use. He
commented that in return for their taxes, they had been provided a school. Now that will
be gone. The Roanoke County School Board has entertained and published a proposal
from anon-profit for use of this school and he suspects the stockpiling of property. He
asked for the Board's support through their Civic League with staff's assistance. He felt
they have been hit harder than most in the County through budget constraints and
deserve some replacement for their tax dollars. They are willing to do their part and
need the County to recognize that they deserve this.

IN RE: WORK SESSIONS (Training Room - 4t" Floor)
1. Work Session on Roanoke County's 2010 Legislative Program
and preparation for the 2011 session of the Virginia General
Assembly (Paul M. Mahoney, County Attorney; Eldon James,
Roanoke County Legislative Liaison)
The work session was held from 4:42 p.m. until 5:29 p.m.
Mr. Mahoney and Mr. James reviewed the results of the County's
legislative proposals for the past session of the General Assembly. Passing the General
Assembly and signed by the Governor were the initiatives to add surcharges on traffic
summons to support the criminal justice academy and to extend the reversion of
Explore Park to the State Park System.
The initiative for the Virginia Retirement System (VRS) to manage post-
employment benefits was defeated; however, the County is confident with the change to
the Virginia Municipal League/Virginia Association of Counties pool joined last year, so
it was recommended not to move forward with this again. Also defeated was the
initiative to expand elements of the Community Development Authority; however, with
some changes, this may be one to try again in the next session.
Mr. James indicated that each new administration normally hits the ground
running on what they want their legacy to be. Accordingly, Governor McDonnell was
elected on a jobs platform. Governor McDonnell's first executive order was to establish
a Chief Jobs Creation Officer, which is the Lt. Governor, and the Governor's Economic
Development Commission, with 64 appointments announced April 19t", will focus on six
areas relating to economic development. The Commission will break into six working
groups, with the first report due back to the Governor by October 16, 2010.
Mr. James indicated that executive order two is the Governor's
Commission on Government Reform and Restructuring. No appointments have been
announced. This commission will focus on four items relating to state government and
shared relationships, which will ultimately have an impact on local governments. The
goal is to save money. Some items discussed were potential merging of Department of
Rehabilitative Services and Social Services; repayment to VRS starting in 2013 and
whether there is economic growth to support; the role of Secretary of Health and Human
Resources and initiatives for the aging and individuals with disabilities through 2025;

and telecommunication tax status and how it is reflected in the budget.
Mr. Mahoney advised the Board that he and Mr. James met with Mr.
Goodman and Mr. O'Donnell this morning and had polled directors on initiatives for
2011. The first initiative discussed was the Comprehensive Services Act for At Risk
Youth and Families (CSA) funding and whether there would be a cap placed on State
funding, which would require localities to provide the remaining resources.
Supervisor Elswick inquired how much funding is provided to the State
from the Federal government for charter schools. Mr. James was not familiar with the
appropriation and did not have a specific number. Supervisor Elswick indicated that if
the State gives localities final authority to determine if a charter school is established,
there may be an opportunity that the County is not exploring and asked if this is
something we should address. Mr. James advised he would research and advise.
There was discussion of requesting another extension of the reversion of
Explore Park to the State Park System; however, Mr. Mahoney and Mr. James agreed
there is a possibility it would not pass again. They advised it would be in the County's
best interest for the Virginia Recreation Facilities Authority (VRFA) to be active when
and if a reversion takes place. They also advised that the County should have a
definitive plan ready as soon as possible, no later than the end of this year. If the
County or VRFA does not have a feasible proposal and the park reverts to the State,
the State would gate and lock the park until funding and development plans could be
obtained.
The following items were also discussed as possible 2010-2011 initiatives:
opposing a cap on CSA funding; allowing correctional officers as well as police officers
to serve warrants at the regional jail; opposing a state tax on landfill tonnage and
supporting an increase in permitting fees for the opening of new cells within a landfill,
which would be the lesser financial impact than a tax.
Supervisor Altizer inquired about the effect of the new stormwater
regulations on local government. Mr. James advised that implementation of the newest
water quality requirements have not been finalized and there would be several years
before the County would have to implement any new costly permitting or enforcement
measures.
Mr. Mahoney requested direction as to which initiatives the Board would
like to target for 2010-2011 and indicated that he and staff would prefer to meet with our
legislators during the summer months when our General Assembly officials have more
time to devote to the County's proposals. Chairman Church indicated that the Board
should come up with initiatives that have a reasonable chance and they would submit
ideas directly to Mr. Mahoney.
Chairman Church then indicated that the Board would take a five minute
break.

2. Work session to discuss the future use of the Bent Mountain
Elementary School property (B. Clayton Goodman III, County
Administrator)
The work session was held from 5:37 p.m. until 6:21 p.m.
Mr. Goodman referenced the Board report in the agenda packet which
was based on conversations with staff, citizens and Supervisor Elswick.
Supervisor Elswick indicated the report shows the kinds of activities that
could be held at the facility. He felt the citizens that spoke earlier well represented the
community's position. In a small rural area, minimal County funds are used. The school
should be kept as a community asset. He looked at the plan proposed by June Bug,
which mentioned room for community activities. Most facilities utilized in the County for
community events are owned by Roanoke County. Supervisor Elswick advised that he
is of the opinion that Bent Mountain School should be under the Department of Parks,
Recreation and Tourism. Bent Mountain Civic League and Women's League could
assist. He indicated he had gone to Floyd Saturday to June Bug. He surveyed people
there and all indicated that June Bug is not involved in community activities. He picked
up a Floyd magazine and June Bug is not mentioned in it once. He stated that the fancy
proposal made by June Bug to the School Board says they are heavily involved in
community. He stated we should base decisions on what is proven. Bent Mountain
citizens have proven they are involved in their community. Once they are involved and
get organized, they should be able to run the facility. The citizens will need some
funding up front, but not a lot of money has been spent in this rural area. The people
have spoken well. He feels it is time for the Board members to express their opinions
and for the Board to make a proposal to the School Board. It is his opinion that it is the
Board's responsibility to represent the citizens to say to the School Board that
maintenance of community centers has always been the responsibility of the County
and not doing so is neglecting that responsibility.
Supervisor Altizer indicated that there was no plan proposed yet for the
community to decide on. He felt that things needs to slow down, stating that he
admired Supervisor Elswick for what he is attempting; however, the Board needs to
think about the proper way to do this and what consequences it might have on future
buildings. He stated the School Board owns the building and has control. The citizens
need to know what the outside business (June Bug) plans and see what can be
intertwined and come to a conclusion. It was Supervisor Altizer's suggestion to let the
School Board move through the process and let the citizens see the proposal before
making a decision.
Supervisor Flora indicated that his concern stems from the fact that the
County would be asking Schools to spend capital money when they had to close the

school because they didn't have the money to begin with. He felt the best compromise
would be no cost to Schools or the County.
Supervisor Church indicated that no vote is taken in work session and all
Supervisors have valid points. He noted that the School Board does own property and
has control. The Board could vote 5-0 to turn the school over to the citizens, but the
School Board could still turn it down. The Board of Supervisors cannot dictate to the
School Board what to do with the property. They can simply make a recommendation.
Supervisor Church also asked the citizens to go through the process and see what the
School Board's proposal will be. He requested a meeting of the Chairs, School
Superintendent and County Administrator to discuss a starting point.
3. Work session to discuss the proposed fiscal year 2010-2011
budget (Brent Robertson, Director of Management and Budget)
This work session was postponed until after the 7:00 p.m. evening
session.
The work session was held from 7:34 p.m. until 7:48 p.m.
Supervisor Elswick stated that he is concerned that Roanoke County does
not more closely analyze the agencies contributed to through the budget process.
After discussion, it was the consensus of the board to keep in place the
process that is currently being used.
IN RE: CERTIFICATION RESOLUTION
At 7:00 p.m., Supervisor Church moved to return to open session and
adopt the certification resolution.
RESOLUTION 042710-6 CERTIFYING THE CLOSED MEETING
WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a closed meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by

RESOLUTION 042710-7 OF CONGRATULATIONS TO
GLENVAR HIGH SCHOOL WRESTLING TEAM FOR WINNING
THE VHSL STATE GROUP A CHAMPIONSHIP
WHEREAS, team sports are an important part of the curriculum at schools in
Roanoke County, teaching cooperation, sportsmanship and athletic skill; and

WHEREAS, the Glenvar High School Wrestling Team won its third Virginia High
School League State Group A Championship in four years at the Salem Civic Center on
February 20, 2010; and
WHEREAS, the team championship was established with a concluding score of
140, a remarkable 20 points over the second place team from Galax; and
WHEREAS, the team had seven state qualifiers, of which all placed in the top
seven at the state tournament; and
WHEREAS, Kahlil Carazo won the Highlanders' first title with a 10-3 decision
over Northampton in the 112-pound division; and
WHEREAS, Zach Hill earned the team's second individual title with a 9-4
decision over Castlewood in the 160-pound division; and
WHEREAS, Alex Asimakopoulos won in an overtime decision against Clark
County in the 189-pound division; and
WHEREAS, the Highlanders were also Three Rivers District and Region C
Champions; and
WHEREAS, the Highlanders are under the dedicated leadership of Head Coach
Kevin Clifford, Assistant Coaches Cecil Coleman and John Altizer and are managed by
Katie Cundiff.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke
County, Virginia, does hereby extend its sincere congratulations to the members of the

Raleigh Gilchrist, Case Manager, thanked the Board for their continued
support of Brain Injury Services of Southwest Virginia.
Daniel Cobb of 4347, Apartment G, Garst Mill Road, Roanoke addressed
the Board. He is a participant at Brain Injury Services of Southwest Virginia. He thanked
the Board for their contribution through the County's budget.
IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Church advised Saturday, May 8th will be the annual Stamp
Out Hunger mail carriers' food drive.
