Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO OR CHANGE THE ORDER OF AGENDA ITEMS Mr. Goodman, County Administrator deferred to Assistant County Administrator Daniel R. O'Donnell, who requested postponement of Item E-2 (Request to appropriate funds in the amount of $323,969 from the Police Department asset forfeiture account for reconstruction of the law enforcement firing range) to refine the scope and budget before bringing before the Board. 44 February 9, 2010 IN RE: NEW BUSINESS 1. Presentation from the U. S. Marine Corps Reserve Unit and the Marine Corps League and appropriation of funds in the amount of $10,000 from the 14t" annual Marine Mud Run (Pete Haislip, Director of Parks, Recreation and Tourism) A-020910-1 Greg Martin, Manager of Camp Roanoke and Moses Stevens and Doug Phillips of Marine Corp. Unit 426 presented the check to Pete Haislip. Mr. Martin advised that Camp Roanoke was very appreciative to the Marines and stated it would be hard to provide their current service levels without them. Supervisor Elswick moved to approve the staff recommendation to accept and appropriation the $10,000 contribution from the 14t" annual Marine Corps League Mud Run to the Camp Roanoke Fee Class Account. The motion carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None 2. Request to appropriate funds in the amount of $323,969 from the Police Department asset forfeiture account for reconstruction of the law enforcement firing range (Daniel R. O'Donnell, Assistant County Administrator; Ray Lavinder, Chief of Police) This item was removed from the agenda under Requests to postpone, add to or change the order of agenda items for postponement. 3. Request to accept and appropriate funds in the amount of $10,000 from the Western Virginia Water Authority (WVWA) for after-hours service call reimbursement (Bill Greeves, Director of Communications Information Technology) A-020910-2 Supervisor Church moved to approve staff recommendation to appropriate funds in the amount of $10,000 to the County's Emergency Communications Center for the purpose of receiving and processing WVWA after-hours service calls. The motion carried by the following recorded vote: February 9, 2010 45 AYES: Supervisors Moore, Flora, Elswick, Church NAYS: None ABSTAIN: Supervisor Altizer IN RE: FIRST READING OF ORDINANCES 1. Ordinance authorizing and approving the exchange of technology services with the City of Salem (Due to time constraints, it is requested that, upon afour-fifths vote of the Board, the second reading be waived and the ordinance adopted as an emergency measure.) (Paul M. Mahoney, County Attorney; Bill Greeves, Director of Communications Information Technology) Supervisor Flora asked if the only item that the City of Salem is asking for is the webcam. Mr. Greeves advised that they are asking for the webcam and a wireless router, two separate items. The webcam is going to be used for public safety and the router is to provide a "mesh" network. Mr. Greeves will inquire further and provide additional information to the Board. Supervisor Church moved to adopt the ordinance and waive the second reading as an emergency measure. ORDINANCE 020910-3 AUTHORIZING AND APPROVING EXECUTION OF A ROOFTOP LEASE AGREEMENT WITH CITY OF SALEM FOR A WEB CAMERA AND WIRELESS ACCESS POINT ON THE SALEM BANK & TRUST BUILDING AT 220 EAST MAIN STREET, SALEM, VIRGINIA, OWNED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY; AND INSTALLATION AND USE OF A FIBER CONNECTION BETWEEN THIS BUILDING AND THE COUNTY COURT SERVICES BUILDING WHEREAS, the Board of Supervisors of Roanoke County, Virginia, is the owner of several parcels of land, containing .68 acre, located at 220 East Main Street in the City of Salem, Virginia, and designated on the Salem Land Records as Tax Map #106- 13-6, #106-13-2, and #106-13-1, and commonly referred to as the Salem Bank and Trust Building (hereafter the "Building"); and WHEREAS, said property was purchased on May 15, 2001, subject to leases with the County of Roanoke to provide office space for the Department of Social Services and Blue Ridge Behavioral Health Care on the third, fourth and fifth floors of the Building, and subject to a number of commercial leases for the first and second floors of the Building and the rooftop for antenna space; and 46 February 9, 2010 WHEREAS, the Department of Social Services currently is connected to Roanoke County's computer network only through an unreliable and slow wireless connection from the roof of the Building to the Roanoke County Courthouse. This unreliable connection requires the County to maintain a dedicated computer server at this Department to permit its staff to continue using their computers when connection to the County's network is lost; and WHEREAS, the City of Salem is currently installing fiber connections in the downtown area of the Building and has offered to provide, without charge, the materials and labor to install a hard fiber connection between the Building and the Court Services Building to serve the Department of Social Services. In return, the City of Salem is requesting authority to install a web camera with their own wireless access point on the roof of the Building; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition or conveyance of an interest in real estate, including leases, shall be accomplished by ordinance; the first reading of this ordinance was held on February 9, 2010; and an emergency being found to exist, the second reading was waived upon a four-fifths vote of the Board. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That a Rooftop Lease between the Board of Supervisors of Roanoke County, Virginia, successor in interest to East Main Properties, L.L.C, and the City of Salem, Virginia, for installation of a web camera and related wireless access point on the premises at 220 East Main Street, Salem, Virginia, commencing March 1, 2010, is hereby authorized and approved. No charge for electrical utility services for the camera and related equipment will be made to the City of Salem. 2. That in consideration of the authorization to install a web camera and related wireless access point on the roof of the Salem Bank & Trust Building, the City of Salem, at its own expense, will provide to the County of Roanoke a dedicated fiber connection between this Building and the Roanoke County Court Services Building. 3. That the County Administrator or an Assistant County Administrator is hereby authorized to execute a lease agreement on behalf of the Board of Supervisors of Roanoke County and to execute such other documents and take such further actions as are necessary to accomplish this transaction, all of which shall be upon form and subject to the conditions approved by the County Attorney. 4. That this ordinance shall be effective on and from the date of its adoption. On motion of Supervisor Church to adopt the ordinance, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None February 9, 2010 47 IN RE: SECOND READING OF ORDINANCES 1. Ordinance amending Section 2-6. Assessment of fees in courts for construction, renovation or maintenance of courthouse, jail or court-related facilities of the Roanoke County Code (Paul M. Mahoney, County Attorney) Mr. Mahoney advised there were no changes from the first reading. There was no discussion. ORDINANCE 020910-4 AMENDING SECTION 2-6. ASSESSMENT OF FEES IN COURTS FOR CONSTRUCTION, RENOVATION OR MAINTENANCE OF COURTHOUSE, JAIL OR COURT-RELATED FACILITIES OF THE ROANOKE COUNTY CODE WHEREAS, the first reading and public hearing of this ordinance was held on January 26, 2010, and the second reading was held on February 9, 2010. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Roanoke County Code be amended to read and provide as follows: Sec. 2-6. Assessment of fees in courts for construction, renovation, or maintenance of courthouse, jail or court-related facilities. (a) Pursuant to the authority found in section T .~~~17.1-281 of the Code of Virginia, as amended, there is hereby assessed a fee to be taxed as the costs in each civil, criminal, and traffic case in the district and circuit courts serving Roanoke County the sum of two dollars ($2.00). (b) The fees assessed by this section shall be expended for the purposes as provided in said statute, specifically, for the construction, renovation and maintenance of the courthouse or jail and court-related facilities and to defray increases in the cost of heating, cooling, electricity, and ordinance maintenance. This assessment shall be in addition to other fees and costs prescribed by law. (c) This assessment shall be collected by the clerk of the court in which the action is filed and remitted to the Treasurer of Roanoke County and held by him subject to disbursements appropriated by the Board of Supervisors for the purposes specified herein. 2. That this ordinance shall be in full force and effect from and after its adoption. On motion of Supervisor Altizer to adopt the ordinance, and carried by the following recorded vote: 48 February 9, 2010 AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None IN RE: CONSENT AGENDA RESOLUTION 020910-5 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM I- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for February 9, 2010, designated as Item I -Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 7 inclusive, as follows: 1. Resolution requesting federal recognition and financial support for the Interstate 81 Corridor Coalition On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None RESOLUTION 020910-5.e EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO GERALD S. HOLT, SHERIFF, UPON HIS RETIREMENT AFTER MORE THAN THIRTY-THREE YEARS OF SERVICE February 9, 2010 49 WHEREAS, Gerald Holt was first hired on June 15, 1970, as a Deputy Sheriff Jailor and later became a Patrol deputy; and WHEREAS, during his time as a Deputy Sheriff, Mr. Holt served in numerous capacities within Roanoke County including Corrections Deputy, Uniform Patrol Deputy, Uniform Patrol Supervisor-Lieutenant and Crime Prevention Officer; and WHEREAS, during his time as the Deputy Sheriff-Sergeant-Crime Prevention Deputy, he assisted more than one hundred communities in establishing Neighborhood Watch Programs. In 1973, Mr. Holt initiated the Roanoke County Auxiliary Force, in which volunteer citizens were trained to be auxiliary Deputy Sheriffs; and WHEREAS, Mr. Holt became a Roanoke County Police Officer on July 1, 1990, and served in this capacity until January 1, 1992, when he took Office as Sheriff of Roanoke County; and WHEREAS, Sheriff Holt was instrumental in the creation of the Roanoke County Criminal Justice Academy; and WHEREAS, Sheriff Holt is responsible for the daily operation of the Roanoke County/Salem Jail, Civil Process Service and security for all courtrooms in the County of Roanoke. Since being elected, Sheriff Holt has been actively involved in the community and has had the pleasure to serve on numerous criminal justice boards and committees including the following: • Virginia Crime Prevention Association • Law Enforcement Torch Run for Special Olympics • Mental Health Commission • Virginia Law Enforcement Professional Standards Commission Board • Liaison Committee for Virginia Department of Corrections • Cardinal Criminal Justice Academy • Board of Directors, Virginia Sheriff's Association • Family Violence Court Program Committee • Court Community Corrections Board • Roanoke County Criminal Justice Academy • Chairman of the Western Virginia Regional Jail Authority WHEREAS, Sheriff Holt assisted with the establishment of the Roanoke County Criminal Justice Academy; and WHEREAS, Sheriff Holt will retire on March 1, 2010, as Sheriff after more than thirty- three years of devoted, faithful and expert service with the Roanoke County Sheriff's Office. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to GERALD S. HOLT for more than thirty-years of capable, loyal, and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. 50 February 9, 2010 On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None RESOLUTION 020910-5.f REQUESTING FEDERAL RECOGNITION AND FINANCIAL SUPPORT FOR THE INTERSTATE 81 CORRIDOR COALITION WHEREAS, the Interstate 81 Corridor is a national strategically significant transportation thoroughfare through which people and material goods pass by highway, rail and aviation; and WHEREAS, the nature of the thoroughfare offers many collective opportunities but also presents many challenges and issues; and WHEREAS, 12% of the nation's Gross Domestic Product flows through this Corridor thereby contributing to a multitude of economic opportunities to communities along the Corridor while also shielding economic downturns; and WHEREAS, the I-81 Corridor Coalition has been formed to collectively and constructively address our mutual concerns and take advantage of our mutual opportunities; and WHEREAS, the Coalition has representation and perspectives from federal, state and local governments, as well as transportation organizations from all six states in the Corridor: New York, Pennsylvania, Maryland, West Virginia, Virginia and Tennessee. NOW, THEREFORE, BE IT RESOLVED, that the Roanoke County Board of Supervisors hereby urges the collective elected federal representatives of the I-81 Corridor to join together in obtaining federal recognition for this effort, in addition to sponsorship of a $1.7 million appropriation through the 2011 Transportation, Housing and Urban Development Appropriations Bill. On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None IN RE: REQUESTS FOR PUBLIC HEARINGS 1. Request for public hearing to consider the formation of a Community Development Authority (CDA) for South Peak (Paul M. Mahoney, County Attorney) A-020910-6 February 9, 2010 51 There was discussion of providing the citizens with as much information on this issue as possible. A new page on the Board of Supervisors' website will be created with information on the project and Community Development Authorities, which will be referenced in the published legal ad. The Board and staff would like as much citizen feedback as possible. Supervisor Moore reported that, under full disclosure, she was advising that her landscaping company has done work on several properties owned by Mr. Smith, the developer of South Peak. She further advised that she had discussed this matter with the Commonwealth Attorney, Randy Leach, and the County Attorney, Paul Mahoney, and has been advised that this is not a conflict of interest. Supervisor Moore moved to approve the staff recommendation that the Board schedule a public hearing on this item for February 23, 2010. The motion carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS Mr. David S. Courey of 3419 Ashmeade Drive, SW, Roanoke spoke. He thanked the Board for arranging his meeting with Mr. Driver, the Director of Real Estate Valuation. He was appreciative of him and learned a lot from their discussion; however, he voiced concern of the County having aforeign-made vehicle in their fleet. He also felt the County owns too many vehicles and something should be done to lower the tax burden. He stated that renters get a break and homeowners are penalized. Proclamation signed by the Chairman IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Elswick expressed his appreciation for Mr. Courey coming in. He would like to see more and more citizens get involved. Supervisor Altizer asked Mr. Goodman to convey to the Virginia Department of Transportation (VDOT) that they did a better job clearing the roads after this last snowfall. He expressed the Board's appreciation for the long hours they worked. Supervisor Flora expressed to Richard Caywood and Dan Collins of VDOT what a good job they did. He noted that Administration got a letter of appreciation from a citizen. Supervisor Church reported that a lot was happening this week. On January 28t" he attended the School Board meeting to honor the Northside High School Vikings football team. On January 29t" he spoke to a large crowd of students at the groundbreaking for Masons Cove Elementary School. He thanked Ms. Moore for braving the weather to make comments to the students. On February 4t" he attended the signing of letters of intent at Northside High School for Dustin Phelps and Nick Sigmon, who asked him to come. Mr. Sigmon will be attending Liberty University and Mr. Phelps will be attending the University of Charleston, West Virginia. On February 7t" he presented a Proclamation of Congratulations to the Boy Scouts of America for their 100t" anniversary. Among the crowd were Congressman Bob Goodlatte, Mayor Brad Grose from Vinton and Miss Roanoke Valley, Madison VanDuyne, who also presented a proclamation. The Boy Scouts have a long standing tradition of honesty, integrity and citizenship. IN RE: CLOSED MEETING At 3:46 p.m. Chairman Church moved to go into closed meeting following the work sessions pursuant to the code of Virginia Section 2.2.3711.A.1, personnel, namely discussion concerning appointments to the Economic Development Authority, League of Older Americans Advisory Council and Roanoke Regional Airport Commission. The motion carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Flora, Elswick, Church NAYS: None The closed meeting was held from 4:23 p.m. until 4:25 p.m. IN RE: WORK SESSIONS (Training Room - 4t" floor) February 9, 2010 53 At 3:47 p.m. Chairman Church adjourned to the 4t" floor for the work session and closed meeting. 1. Work session to discuss fiscal year 2010-2011 budget development (Brent Robertson, Director of Management and Budget) The work session was held from 4:00 p.m. until 4:15 p.m. Mr. Goodman advised this would be a short work session for a brief budget update. A recent Virginia Municipal League newsletter estimated an additional 50 percent cut in state funding to localities. This could result in a $1 million cut for the County and $3 million for Schools. Additionally, there is a bill in the General Assembly to phase-out machinery and tool taxes. Ms. Hyatt briefed the Board on the Schools' budget status. Changes in the Composite Index, which determines the amount of funding public schools receive from the state, could total an additional $900,000 cut. Mr. Goodman advised Roanoke County will be hard pressed to continue service levels with cuts of this magnitude from the state. Roanoke County will make it work, but now it has become serious. There should be more details by the March 2, 2010, work session. Mr. Robertson and staff updated the Board on some of the measures that are being taken to address next year's budget reductions. Roanoke County departments have been asked to present operating budgets that reflect a 10 percent reduction over last year's funding. These budgets will be reviewed with the Budget Team to make sure the departments are able to effectively absorb the cuts. Informational letters were mailed to the Human Service and Cultural and Tourism organizations that receive funding from the County. These letters asserted that requests for funding be at least 10 percent less than the prior year. Mr. Goodman noted that Roanoke County had sent fire fighters to Alexandria to assist. IN RE: CERTIFICATION RESOLUTION At 4:25 p.m., Chairman Church moved to return to open session and moved to adopt the certification resolution. RESOLUTION 020910-7 CERTIFYING THE CLOSED MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA 54 February 9, 2010 WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each member's knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting which this certification resolution applies, and 2. Only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Board of Supervisors of Roanoke County, Virginia.
