Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: CALL TO ORDER Chairman Church called the meeting to order at 3:00 p.m. MEMBERS PRESENT: Chairman Joseph B. "Butch" Church, Vice Chairman Eddie "Ed" Elswick, Supervisors Michael W. Meador, Clerk to the Board; Teresa Hamilton Hall, Director of Public Information IN RE: OPENING CEREMONIES The invocation was given by Reverend J. Barton "Bart" Weakley of Northview United Methodist Church and the Roanoke County Fire and Rescue Department. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO OR CHANGE THE ORDER OF AGENDA ITEMS Mr. Goodman, the County Administrator requested the removal of the work session to review policy for informational displays at Roanoke County Parks and Recreation facilities. 220 June 22, 2010 Mr. Goodman also requested the addition of a closed meeting, pursuant to the Code of Virginia, Section 2.2-3711(A)(29): Discussion of the award of a public contract involving the expenditure of public funds, where the discussion in open session would adversely affect the bargaining position or negotiating strategy of the County, namely amended the intergovernmental agreement with the City of Roanoke for digital radio services. Chairman Church requested Appointments be added to the agenda after New Business items. There were no objections. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Certificate of recognition to Rachael Sloan, Hidden Valley High School, for being selected for All-State Choir Ms. Sloan was honored by being the only student in Roanoke County selected for All-State Choir this year. Her mother, School Superintendent Dr. Lorraine Lange, Principal Rhonda Stegall and Choir Director John Meyer were in attendance. 2. Recognizing the Fire and Rescue Department for receiving two Regional Emergency Medical Services Awards Chief Richard Burch introduced Rob Logan, Executive Director of the Western Virginia Emergency Medical Services (EMS) Council. Chief Burch and Battalion Chief Billy Duff accepted the Outstanding EMS Agency Award on behalf of the Fire and Rescue Department. Captain Jeff Lawson accepted the Outstanding Pre- Hospital Provider Award. Also in attendance were Division Chiefs Dustin Campbell and Steve Simon. Additionally, Chip Wood; Raymond Wells; Patrick English and Captain Barry Hurley from the Clearbrook Station were in attendance IN RE: NEW BUSINESS 1. Request for authorization to pick up the employee's contributions to Virginia Retirement System for Plan 2 employees (Diane D. Hyatt, Assistant County Administrator) There was no discussion. RESOLUTION 062210-1 FOR AUTHORIZATION TO PICK UP THE EMPLOYEE'S CONTRIBUTION TO VIRGINIA RETIREMENT June 22, 2010 22 SYSTEM UNDER § 414(h) OF THE INTERNAL REVENUE CODE FOR PLAN 2 EMPLOYEES WHEREAS, the Virginia General Assembly, in its 2010 session passed legislation creating a separate retirement plan for employees hired on or after July 1, 2010, (hereafter referred to as "Plan 2 Employees"). The legislation stipulates that Plan 2 Employees will pay their 5 percent member contribution and that, absent other action by the employer, such contribution will be paid through salary reduction according to Internal Revenue Code § 414 (h) on a pre-tax basis; and WHEREAS, the legislation allows certain employers, including the County of Roanoke, Virginia, to pick up and pay all or a portion of the member contributions on behalf of its Plan 2 Employees as an additional benefit not paid as salary; and WHEREAS, the election to pick up and pay all or a portion of the member contributions on behalf of its Plan 2 Employees as an additional benefit not paid as salary shall, once made, remain in effect for the applicable fiscal year (July 1 -June 30) and shall continue in effect beyond the end of such fiscal year absent a subsequent resolution changing the way the 5 percent member contribution is paid; and WHEREAS, employee contributions that are picked-up as an additional benefit not paid as salary are not considered wages for purposes of VA Code § 51.1-700 et seq. nor shall they be considered salary for purposes of VA Code § 51.1-100 et seq.; and WHEREAS, the County of Roanoke, Virginia desires to pick up and pay its Plan 2 Employees' member contributions to VRS as an additional benefit not paid as salary in an amount equal to 5 percent of creditable compensation; and WHEREAS, VRS tracks such picked-up member contributions and is prepared to treat such contributions as employee contributions for all purposes of VRS. NOW, THEREFORE, IT IS HEREBY RESOLVED that effective the first day of July, 2010, the County of Roanoke, Virginia shall pick up member contributions of its Plan 2 Employees to VRS as an additional benefit not paid as salary in an amount equal to 5% of creditable compensation subject to the terms and conditions described above; and it is further RESOLVED that such contributions, although designated as member contributions, are to be made by the County of Roanoke, Virginia in lieu of member contributions; and it is further RESOLVED that nothing herein shall be construed so as to permit or extend an option to VRS members to receive the picked-up contributions made by the County of Roanoke, Virginia directly instead of having them paid to VRS. On motion of Supervisor Church to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church 222 June 22, 2010 NAYS: None ABSENT: Supervisor Flora 2. Request to approve a resolution granting a waiver under Section 13-23 of the Roanoke County Code to the provisions of the County's noise ordinance -Article II. "Noise" of Chapter 13. "Offenses-Miscellaneous" of the Roanoke County Code to Counts and Dobyns at the request of Branch Family LLC and Timberbrook Properties - Buck Mountain Road Improvement Project (Arnold Covey, Director of Community Development) Supervisor Moore stated that she is in agreement that work of this nature is safer at night as long as only the items outlined are performed and the Virginia Department of Transportation (VDOT) has approved. Supervisor Elswick asked what constituted evening hours. Mr. Covey responded that granting the waiver would allow work to be performed during the hours of 10:00 p.m. through 7:00 a.m. Chairman Church indicated that the Board wants to do what is best for the safety of the citizens. RESOLUTION 062210-2 GRANTING A WAIVER UNDER SECTION 13-23 OF THE ROANOKE COUNTY CODE TO THE PROVISIONS OF THE COUNTY'S NOISE ORDINANCE - ARTICLE II. "NOISE" OF CHAPTER 13. "OFFENSES - MISCELLANEOUS" OF THE ROANOKE COUNTY CODE TO COUNTS AND DOBYNS AT THE REQUEST OF BRANCH FAMILY LLC AND TIMBERBROOK PROPERTIES - BUCK MOUNTAIN ROAD IMPROVEMENT PROJECT WHEREAS, Branch Family LLC and Timberbrook Properties have requested a waiver of the County's noise ordinance as contemplated under Sec. 13-23. "Undue hardship waiver" be given to Counts and Dobyns, the contractors for the Buck Mountain Road improvement project, to permit the road construction to be performed at night to take advantage of lower traffic volumes beginning on June 12, 2010, and ending August 17, 2010; and WHEREAS, Wolverton and Associates had previously prepared road improvement plans for the Walmart project. These plans have been reviewed and approved by both the County and Virginia Department of Transportation (VDOT). The applicants for this waiver have modified these plans for their development. Therefore, these modified plans must be reviewed and approved by Wolverton and Associates, Walmart, the County and VDOT before the applicant can commence this project; and June 22, 2010 223 WHEREAS, Section 13-23 of the Roanoke County Code establishes certain standards for the Board of Supervisors to grant waivers from the provision of the Roanoke County Noise Ordinance -Article II. "Noise" of Chapter 13. "Offenses - Miscellaneous" to avoid undue hardship upon consideration of certain factors set forth in subsection (b) of Sec. 13-23 and after making certain alternative findings. BE IT RESOLVED by the Board of Supervisors of the County of Roanoke, Virginia, as follows: 1. In making its determination as to whether to grant the requested waiver to Counts and Dobyns from the County's noise ordinance, the Board of Supervisors has considered the following factors: a. The time of day the noise will occur and the duration of the noise: Beginning at approximately 10:00 p.m. on June 23, 2010, and ending 7:00 a.m. on August 17, 2010. b. Whether the noise is intermittent or continuous: The noise produced during the process of performing road construction is done in order to take advantage of lower traffic volumes, minimizing impacts on the public, while maximizing safety to the public and construction workers. Tasks currently identified as those that will be performed at night include but are not limited to: storm drain piping and structures including road crossing; water line relocation; curb and gutter and concrete medians that tie to US 220 from Buck Mountain Road; all road widening, profiling and paving and pavement marking. The noise waiver will not be utilized on a daily basis; rather it will be used when necessary and prudent to do so. c. The extensiveness of the noise: May be extensive at times depending upon the nature of the work. d. The technical and economic feasibility of bringing the noise into conformance with the noise ordinance: This work has to be completed at night in order to minimize impacts on the traveling public, while maximizing safety to the public and construction workers. Also the Virginia Department of Transportation requests that this work be done at night. e. Other matters related to the impact of the noise on the health, safety and welfare of the community and the degree of hardship resulting from enforcement of the ordinance: Work is being done at this time to avoid disruption to the opening of Roanoke County Schools (Clearbrook Elementary) and nearby Faith Christian School. f. The extent to which the noise is necessary and incidental to the commercial and industrial use generating the sound: The noise to be generated by this road work is necessary and incidental to fulfilling the conditions of the special use permit approved by the Board of Supervisors for the Clearbrook Walmart development and will allow the Buck Mountain 224 June 22, 2010 Road improvement project to open to the public simultaneously to the new traffic patterns from the Walmart development. 2. The Board of Supervisors makes the following finding: Compliance with the provisions of the County's noise ordinance concerning the specific act of noise disturbance by operation of equipment for road construction under subsection (1) of Sec. 13-21. "Specific acts as noise disturbance" or under the provision of Sec. 13-20. "General prohibition" would produce serious economic hardship for Branch Family LLC, Timberbrook Properties and Counts and Dobyns without producing any substantial benefit to the public, further it would result in greater impacts on the public using U.S. Route 220, increase safety hazards both for the public and the construction workers and be contrary to the directives of the Virginia Department of Transportation. 3. That the provisions of Sec.13-21. "Specific acts as noise" subsection (1) and Sec. 13-20. "General prohibition" of Article II. "Noise" of Chapter 13. "Offenses - Miscellaneous" be WAIVED for a period from June 23, 2010, until August 17, 2010. 4. This waiver is granted specifically to Counts and Dobyns, their officers, employees and agents for road construction work and related activities on Buck Mountain Road at Route 220 at the Clearbrook WalMart development in Roanoke County, Virginia. 5. That this waiver is subject to the following approvals: a. Any modifications to the Wolverton and Associates road improvement plans by Lumsden Associates, on behalf of the applicant, be approved by Wolverton and Associates and Walmart b. By the County for compliance with the special use permit conditions c. By the Virginia Department of Transportation 6. That this waiver may only be extended upon written application and approval by the Board of Supervisors. 7. That this resolution shall be in full force and effect from its passage. On motion of Supervisor Moore to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church NAYS: None ABSENT: Supervisor Flora IN RE: APPOINTMENTS Supervisor Altizer appointed Jason Peters to the Roanoke County Planning Commission to represent the Vinton Magisterial District. Chairman Church asked that confirmation of the appointment be placed on the Consent Agenda. June 22, 2010 225 IN RE: CONSENT AGENDA RESOLUTION 062210-3 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM F- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for June 22, 2010, designated as Item F -Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 5 inclusive, as follows: 1. Approval of minutes -March 23, 2010; April 13, 2010 and April 27, 2010 2. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to Sarah S. Alls, Accounts Representative, upon her retirement after more than thirty-one years of service 3. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to Dorothy P. Dickason, Treasurer Clerk III, upon her retirement after more than thirty-five years of service 4. Confirmation of appointments to the Roanoke County Planning Commission and the Total Action Against Poverty (TAP) Board of Directors On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church NAYS: None ABSENT: Supervisor Flora RESOLUTION 062210-3.a EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO SARAH S. ALLS, ACCOUNTS REPRESENTATIVE UPON HER RETIREMENT AFTER MORE THAN THIRTY-ONE YEARS OF SERVICE WHEREAS, Sarah S. Alls was hired on June 1, 1979, as a Clerk Typist; promoted to Clerk Stenographer on July 1, 1980; Account Clerk I I on February 1, 1981, and lastly was promoted to the position of Accounts Representative on July 1, 2005; and 226 June 22, 2010 WHEREAS, Ms. Alls retired as Accounts Representative on June 30, 2010, after a total of thirty-one years and one month of devoted, faithful and competent service with the County; and WHEREAS, during her time as Accounts Representative, Ms. Alls was responsible for providing excellent customer service to those departments to which she was assigned; and WHEREAS, Ms. Alls was also responsible for promptly and accurately processing payments to County vendors, employees and citizens; and WHEREAS, Ms. Alls processed payments for the Board of Supervisors, County Administration, Community Development, Library, Police, Finance and Human Resources; and WHEREAS, Ms. Alls was also responsible for payments for the Roanoke Valley Resource Authority, Roanoke Valley Television and the Western Virginia Regional Jail Authority. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to SARAH S. ALLS for more than thirty-one years of capable, loyal, and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church NAYS: None ABSENT: Supervisor Flora RESOLUTION 062210-3.b EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO DOROTHY P. DICKASON, TREASURER CLERK III, UPON HER RETIREMENT AFTER MORE THAN THIRTY-FIVE YEARS OF SERVICE WHEREAS, Dorothy P. Dickason was hired on February 1, 1975, as Account Clerk I and was promoted through the ranks to Treasurer Clerk II then subsequently promoted to Treasurer Clerk III on June 28, 1986; and WHEREAS, Mrs. Dickason retired as Treasurer Clerk III on July 1, 2010, after a total of thirty-five years and five months of devoted, faithful and accomplished service with the County; and WHEREAS, during her time as Treasurer Clerk, Mrs. Dickason, was first hired to work part-time during her high school years as a teenager in the Roanoke Valley; and June 22, 2010 227 WHEREAS, Mrs. Dickason, during these early years was responsible for manually reviewing the Treasurer's Office tax books and would hand write the delinquent tax tickets that were to be mailed; and WHEREAS, Mrs. Dickason, survived these early years to see the Treasurer's Office convert to its first electronic billing system; and WHEREAS, Mrs. Dickason, proved herself to be a model of consistency in her attendance and work ethic; and WHEREAS, Mrs. Dickason, acted in accordance with the appropriate integrity worthy of every County employee; and WHEREAS, Mrs. Dickason, pursued a higher level of job performance for the advancement of her skills through professional educational courses administered through the Weldon Cooper Center of the University of Virginia for the Treasurers' Association of Virginia; and WHEREAS, Mrs. Dickason, has held herself accountable to a higher standard in the performance of her duties to adhere to the monetary fiduciary responsibilities beholden to public trust. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Dorothy P. Dickason for more than thirty-five years of capable, loyal, and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church NAYS: None ABSENT: Supervisor Flora IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS Mr. Max Beyer of 2402 Coachman Drive, Roanoke commented on the work session on amending the policy for the use of the Roanoke County Administration Center Board meeting room. Mr. Beyer stated he would prefer there be no charges for using the room and wants all custodial services to be discretionary. IN RE: REPORTS Supervisor Moore moved to receive and file the following reports. Comparative Statement of Budgeted and Actual Revenues for the month ended May 31, 2010 IN RE: CLOSED MEETING At 3:31 p.m., Supervisor Church moved to go into closed meeting pursuant to the Code of Virginia Section 2.2-3711(A)(1): Personnel, namely discussion concerning appointments to the Building Code Board of Adjustments and Appeals (Fire Code Board of Appeals); Social Services Advisory Board and Virginia Western Community College Advisory Board and Section 2.2-3711(A)(29) Discussion of the award of a public contract involving the expenditure of public funds, where the discussion in open session would adversely affect the bargaining position or negotiating strategy of the County, namely amending the intergovernmental agreement with the City of Roanoke for digital radio services. The motion carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Elswick, Church NAYS: None ABSENT: Supervisor Flora At 3:32 p.m., Chairman Church recessed to the 4t" floor for work sessions followed by closed meeting. The closed meeting was held from 5:32 p.m. until 5:53 p.m. IN RE: WORK SESSIONS (Training Room - 4t" Floor) June 22, 2010 229 1. Work session to discuss the upcoming redesign of Roanoke County's website (Teresa Hamilton Hall, Director of Public Information; Bill Greeves, Director of Communications and Information Technology) The work session was held from 3:45 p.m. until 4:24 p.m. Mr. Greeves presented a PowerPoint presentation, a copy of which is on file for inspection in the office of the Clerk to the Board. He updated the Board on the history of the County's current website, the plan for the new design and the timeline for implementation. He also advised that Roanoke County partnered with Economic Development and the Town of Vinton for cost savings. Supervisor Elswick asked if there is a way to determine what portion of site visits are from out-of-state and what portion is visited the most. Mr. Greeves advised there is a way to determine what pages are visited the most. The main page, libraries, Geographic Information Services (GIS) and the employment pages are visited most often. During budget time, the budget pages are visited quite often also. Supervisor Altizer suggested that the County site be intertwined somehow with the Town of Vinton to refer citizens to procedures handled by Vinton and to the County for procedures handled by the County in order to alleviate citizens being passed back and forth. Ms. Hall indicated Roanoke County had partnered with Civic Plus for this redesign. Civic Plus focuses exclusively on government and schools. Civic Plus will be interviewing employees who are on the telephone a great deal to determine what for what information the citizens are calling. Additionally, a survey has been conducted to obtain citizen input. Civic Plus was sent the County's annual report and 90 various photographs so they could get a feel for Roanoke County. Ms. Hall indicated that the anticipated go live date is November 12, 2010. She also advised that the new site will be hosted offsite, with a guaranteed uptime in the 90 percentile with penalties for downtime. Mr. Greeves explained that the Communications Information Technology Department will no longer maintain the site, which will enable staff to focus more on the Emergency Communications Center and GIS. The Public Information Office will still maintain complete control of all content. Supervisor Church requested an analysis to show the Board and citizens the cost effectiveness of this project. Chairman Church inquired if the new design will include tools to bring in more users. He requested that mockups be shown to the Board before implementation. It was the consensus of the Board that they want to be involved in the redesign project. 2. Work session on amending the policy for the use of the Roanoke County Administration Board meeting room (Paul M. Mahoney, County Attorney) 230 June 22, 2010 The work session was held from 4:24 p.m. until 4:48 p.m. Mr. Mahoney reviewed the key changes made to Option B based on his understanding of the Board's direction from the last work session on this item. Chairman Church advised he felt it was important to state a maximum number with regard to capacity. It was the consensus of the Board to use a maximum capacity of 105. It was also the consensus of the Board to remove social gatherings as a permitted use from the policy and add Homeowner Associations under permitted non- governmental uses. Supervisor Altizer requested a sentence stating whose responsibility it will be to control capacity. It was the consensus of the Board that the off-duty police officer will be responsible for monitoring the room capacity. He also commented that the County must be consistent with custodial charges. It was decided to advertise for a public hearing for the July 27, 2010, Board meeting. 3. Work session to review policy for informational displays at Roanoke County Parks and Recreation facilities (Pete Haislip, Director of Parks, Recreation and Tourism) This item was removed from the agenda by Mr. B. Clayton Goodman III, County Administrator, under Requests to postpone, add to, or change the order of agenda items. 4. Work session on the amended Roanoke County Employee Handbook (Joe Sgroi, Director of Human Resources) The work session was held from 4:49 p.m. until 5:17 p.m. Mr. Sgroi discussed a point of contention in the new amendments to the employee handbook. The Human Resources Department would like the Board's direction on allowing firearms on County property in employees' personal vehicles. Mr. Sgroi cited statistics from the Bureau of Justice Statistics and the Bureau of Labor Statistics on violent incidents in the work place. Work places where guns were permitted were five to seven times more likely to have a violent incident. Supervisor Altizer indicated that he felt that we would be imposing a restriction on our employees that we cannot impose on our citizens and asked if Roanoke County had any instances of workplace violence. Mr. Sgroi stated that the County has had employees threaten each other and County property, but not with a gun. June 22, 2010 23 Mr. Goodman indicated as an employer, the County does have the right to address behavior to a certain extent. As an individual, Mr. Goodman stated that he believes in gun rights, but has the obligation to protect County employees. Chairman Church indicated the laws of a society are made for a few individuals and stated if the County is going to make an error, he would much rather have an employee throw a punch instead of firing a gun. He noted that all human life is precious and cannot have a price put on it. Supervisor Moore stated that guns don't kill people, people kill people and feels it would be unconstitutional to force this on employees. Supervisor Elswick agreed with Supervisor Moore. It was the consensus of the Board to allow guns in personal vehicles only, not under the auspice of County business or in a county vehicle. IN RE: CERTIFICATION RESOLUTION At 7:00 p.m. Chairman Church called the meeting back into open session with Supervisor Flora absent. RESOLUTION 062210-4 CERTIFYING THE CLOSED MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each member's knowledge: 1. Hyatt, Assistant County Administrator) a) Request to appropriate an amount not to exceed $6 million for a new Glenvar Library Janet Stice of 4377 Barley Drive, Salem brought her therapy dog, Crystal, and spoke about the Delta Society. She described Pet Partners, where children read to therapy dogs. She commented how events like these at the Glenvar Library are so important for the children to practice their reading with a nonjudgmental friend. Ann Franco of 341 Polly Circle, Salem spoke in support of the new library. With the end of the laptop initiative in Roanoke County Schools, she believes computer use at the libraries will increase. Glenvar deserves the same advantages as other areas and she knows the Board is always striving for equity. James Vonderhaar of 5048 Cherokee Drive, Salem spoke on behalf of himself and his wife, Marlene. He stated the need fora modern, handicapped accessible library with computer space, Wi-Fi and teen, senior and children spaces. He felt optical equipment for visually impaired would be very beneficial. He would appreciate the Board's favorable vote. Diana Beamer of 1804 Foxfield Circle, Salem spoke in favor of the new library, stating it is much needed and well deserved. She serves on the Library Board for the Glenvar District and represents the voices of many. Ms. Beamer noted there have been little or no renovations since the doors opened in 1979, adding it is easy to see how the wonderful and positive staff has utilized every nook and cranny of this limited space and they should be commended. She has received many calls and emails asking her to mention the inadequate book drop, lack of handicapped access, heavy doors and the distance to these areas for elderly and handicapped. She felt the Board's vote should be 3 to 2, but voiced her understanding that when there are money, tight budgets, controversy and differences in opinion involved, not everyone will see eye to eye. Ms. Beamer stated it is the Glenvar community's hope that the Board will vote `yes' while the construction costs seem to be affordable and money is available. She thanked the Board for their time in listening to citizens of the Glenvar community. Michael Allen Stanley of 4706 Great Glen Drive, Salem spoke in favor of the new library. He stated the current library has only one positive, which is its location and everything else is a negative. He commented that North County got a new recreation center and South County got a new library, so it is time to do what is right and give Glenvar a new library. June 22, 2010 233 Tonia Dillman of 1858 Wildwood Road, Salem advised that several years ago she was on the committee to rebuild the new library, but the project was put off. She feels the time is now, noting the shelves are at maximum, the tight confines and the computers that can be accessed by adults in the children's section are inappropriate. She asked the Board to please see fit to build the new library before they are stacked on top of each other just to check out books. Lorraine Bratton of 511 East Augusta Avenue, Vinton is a member of the Board of the Friends of the Roanoke County Library. They recently bought a self check- out station for the headquarters library and they pay for the summer reading program. She advised that the Friends of the Library strongly supports the project. She noted that as a citizen of Vinton, she does support the Glenvar Library, but asked the Board not to forget that Vinton needs a library too. Nancy Wheeler of 4416 Alleghany Drive, Salem spoke in support of the project. She is disabled and checks out about 35 books per week. Ms. Wheeler stated that while doing anything at the Glenvar library, you are stepping over, backing into or bumping into something and after school when the kids are coming in, it is extremely crowded. She feels the library is hugely inadequate for the need and has been passed over. She advised that the entire second floor of the Salem Library is not handicapped accessible. John Koelsch of 4416 Alleghany Drive, Salem worked with the library system, teaching a resume writing class. He stated that access to computers and space to make notes and work on the computer was not adequate. He is also an author, who donated his poetry book to the Glenvar Library. He advised that a library is a lot more than a place to read and offered his support of the project. James Lynn of 3720 Knollridge Road, Apt. 417, Richfield Retirement Community spoke in favor. He reported that most residents and employees of Richfield visit the library during the week. He spoke of devoting his life to teaching school and how libraries are terribly important. Mr. Lynn commented the library is so crowded that if you bring in a sheet a paper, another sheet has to go out. Deborah Kipps of 5375 Sundance Road, Salem spoke in favor of a new library. When she first moved to the area, she drove past the Glenvar branch because the outward appearance. She feels the community has grown and a new larger library would attract more patrons. She wants the library to be a place to be proud of. Dr. Julie Myers, Principal of Glenvar Middle School, spoke in support of the project, stating the library is an outreach of the schools' learning community. When school closes at the end of the day, they want the children to feel comfortable going to the library to continue their learning. Sarah McHatton of 4844 Warrior Drive, Salem stated she was not a library user when she moved to Cherokee Hills and thought the small building would not have anything to offer her. She was embarrassed to admit she hates to search the stacks and orders online for pick up. She feels the programs are very impressive, but can only 234 June 22, 2010 imagine what they could be with a decent facility and a new library would be the pride of Glenvar. Ed Fulton of 4844 Warrior Drive, Salem walks to the library. He was disappointed to see how small the library was when they moved to the area. He also uses the online system and feels it would be nice to use it for more than just acheck-out box. Mr. Fulton commented that with the asphalt plant, it appeared the Board may have been imposing something on the community they did not want and now is the chance for the Board to give them something they do want. Laurie DeMarco of 1649 Mill Pond Drive, Salem thanked Supervisor Church for placing this item on the agenda. She declared that someone in her family has been in the Glenvar Library every week since 1991 and described how the stacks changed as her daughters grew, going from bad to worse. She asked the Board to please consider replacing the Glenvar Library. Norman R. Therrien of 725 Foxstone Lane, Salem asked for the Board's support of the new Glenvar Library. James L. Maddex of 3717 Bredlow Circle, Richfield Retirement Community spoke in support of the new library. He noted that Glenvar is the only public library located adjacent to a retirement community and many residents are very much still on the go, who vote, shop, and etc. Their wish list would include books, periodicals and large prints. He would like to see programs where retired residents could tutor students at the library. Carter Turner of 6960 Campbell Drive, Salem spoke in favor of the project. He declared a new library would be an investment in their children and a love for learning. He felt it would be something to call their own, a sense of community pride. He stated that $6 million is a lot of money, but if it helps attract high paying jobs, it is a bargain. Dot Eller of 3611 McDaniel Drive, Salem spoke in favor. She informed the Board they are much better looking and in tune with what the citizens need than when the previous Board started trying to build this library. She stated she just knew the Board would approve the request. Judy Conyers of 4844 Little Bear Road spoke on behalf of Citizens for Positive Growth. She advised that all in Glenvar petition the Board to vote in favor as improvements are needed in the area. She commented that last year meeting space was needed in the area and there was none. A library would provide this. She also reminded everyone of the community meetings at Fort Lewis Baptist Church. She encouraged everyone to attend. Barry Garst of 5251 Cherokee Hills Drive, Salem spoke on an investment in children and summer learning loss. He advised that library summer programs can keep children updated. Minorities and low-income families are at risk. He asked the Board to remember the families who could not attend the meeting because they did not have the resources to get there. Jacqueline Phillips, 4825 Celtic Circle, Salem spoke on behalf of homeschoolers, stating a library is invaluable for their curriculum. ORDINANCE 062210-5 AMENDING CHAPTER 2 - "ADMINISTRATION" OF THE ROANOKE COUNTY CODE BY THE ADOPTION OF A NEW SECTION 2-10 - "ASSESSMENT OF COURT COSTS TO SUPPORT LOCAL CRIMINAL JUSTICE TRAINING ACADEMY" WHEREAS, the 2010 session of the Virginia General Assembly adopted an amendment to Section 9.1-106 of the Code of Virginia authorizing Roanoke County to impose a fee to support its local independent criminal justice training academy; and WHEREAS, the Board of Supervisors of Roanoke County finds that the assessment of this fee will benefit the citizens of Roanoke County by providing for the training of its police officers and sheriff's deputies, thereby enhancing the public health, safety and welfare of the County and its citizens; and WHEREAS, the first reading of this ordinance was held on May 25, 2010, and the second reading and public hearing was held on June 22, 2010. (a) In addition to any other fees imposed by law there is hereby imposed in every criminal or traffic case in which costs are assessable pursuant to Code of Virginia, §§ 16.1-69.48:1, 17.1-275.1, 17.1-275.2, 17.1-275.3, 17.1-275.4, 17.1-275.7, 17.1- 275.8, or 17.1-275.9. an additional fee of Five Dollars ($5.00) to support the County's criminal justice training academy. The clerks of the district and circuit courts shall charge and collect this assessment as a part of the fees taxed as costs. The Board passed a resolution in September 2009; at which time they were told it was about a nine-month process and has not heard anything regarding the community meetings to date. Mr. Goodman will obtain the information and provide the Board a full report.
