Chairman Flora announced that the 7:00 p.m. evening session of the Board meeting would not be held today. He advised that the scheduled public hearing for the petition of Edward Rose Properties, Inc. to rezone properties had been postponed indefinitely. IN RE: CALL TO ORDER Chairman Flora called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Richard C. Flora, Vice-Chairman Michael W. Holton, Deputy Clerk to the Board; Teresa Hamilton Hall, Public Information Officer IN RE: OPENING CEREMONIES The invocation was given by Pastor Bill Booth, Vinton Baptist Church. The Pledge of Allegiance was recited by all present. December 16, 2008 852 IN RE: INTRODUCTION AND APPOINTMENT 1. Request to adopt a resolution appointing the County Administrator and approve an employment agreement. (Paul Mahoney, County Attorney) R-121608-1 Mr. Mahoney advised that this item is to request that the Board adopt a resolution appointing a new County administrator and approving his employment agreement. He summarized the process that was used to select the new administrator after Elmer Hodge retired in June 2008. He advised that the Board hired Springsted Incorporated in May 2008 to provide executive search services, and after a nationwide search, the Board interviewed the finalists in October and selected B. Clayton Goodman, III. Mr. Mahoney requested that the Board insert Mr. Goodman’s name into the resolution at the appropriate places. He advised that Mr. Goodman was present and would address the Board. Supervisor Flora moved to adopt the resolution appointing B. Clayton Goodman III and approving the employment agreement. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None Supervisor Flora welcomed Mr. Goodman as the new Roanoke County Administrator and advised that the Board interviewed people from outside Virginia as December 16, 2008 853 well as the surrounding localities, and they were very impressed with Mr. Goodman during the interview process. He advised that his personal criteria for a county administrator would include a person with the highest possible ethical standards who had extensive chief administrative experience in local government, preferably in Virginia local government, and he felt that Mr. Goodman possessed these traits. He advised that he knew Mr. Goodman well and that the localities where Mr. Goodman formerly worked thought highly of his abilities. Supervisor Church welcomed Mr. Goodman and advised that the County is facing difficult situations in the future. He advised that the Board wanted to hire a person who had integrity, a good reputation, and he felt that Mr. Goodman was the man for the job. He advised that the Board holds a sacred trust from the citizens who elect them to work hard, be honest, and look after the community’s best interests. He advised that the Board was following these guidelines when they selected Mr. Goodman from an excellent group of candidates, and he and the Board look forward to working with Mr. Goodman. He stated that he hoped that the staff and community would welcome Mr. Goodman to Roanoke County because he is a hometown man and will make the Board’s job a little easier. Supervisor Altizer advised that he was fortunate to work with Mr. Goodman for approximately 18 months before Mr. Goodman left his position as Vinton Town Manger, and he had acquired insight into how Mr. Goodman functioned on the job and what kind of individual he was. Supervisor Altizer advised that integrity was the December 16, 2008 854 highest quality that the Board was seeking and they found this in Mr. Goodman. He advised that another deciding factor was the demeanor of Mr. Goodman, and he felt that Mr. Goodman’s style of management would be compatible with the citizens and staff. He advised that he is looking forward to Mr. Goodman working with the County and he understands that Montgomery County was reluctant to see him leave. He stated congratulations and welcome aboard to Mr. Goodman. Supervisor McNamara advised that his fellow supervisors had mentioned that integrity was very important, and while he agreed that Mr. Goodman was certainly a man of the highest integrity, he wanted the listening audience to know that people of integrity were working with the County before and now. He advised that the search firm did an excellent job in providing great candidates. He advised that he was pleased with the selection of Mr. Goodman, and he had enjoyed the opportunities to work with him at the Town of Vinton and Western Virginia Regional Jail Authority. He advised that Mr. Goodman would have his support and the support of the other Board members. He advised Mr. Goodman that the County would be pleased to have Mrs. Goodman become a member of the Library Advisory Board again if she would be interested. Supervisor Moore welcomed Mr. Goodman to the County and advised that she agrees with the other Board members that he is an excellent choice for this position. She stated that the citizens, staff and Board members are looking forward to working with him. December 16, 2008 855 Supervisor Flora advised that integrity was very high on the list of qualifications that the Board wanted, and as Supervisor Altizer pointed out, having the personality to fit in with the County and staff was also important. He felt that Mr. Goodman had shown this compatibility with County staff while working with the Town of Vinton. Mr. Goodman expressed appreciation to the Board members for their support in selecting him as Roanoke County Administrator. He stated that it means a great deal to him that the Board feels comfortable in allowing him to take this position, and he pledged to work with the Board in any way possible to ensure that they meet the needs of the citizens of Roanoke County. He advised that it is important during these difficult times throughout the country and Virginia, that instead of focusing on the negatives, to focus on the positives and take the opportunities to improve things by doing them differently, creatively, and innovatively. He pledged to build and strengthen the County’s organization and work on behalf of the citizens, the Board and the staff. He stated that he appreciates that the Board has entrusted him with this opportunity, and he will endeavor to ensure that they made the right decision. Chairman Flora advised that the Board looks forward to working with Mr. Goodman for a long time and thanked him for his comments. December 16, 2008 856 RESOLUTION 121608-1 OF APPOINTMENT OF THE COUNTY ADMINISTRATOR AND APPROVAL OF AN EMPLOYMENT AGREEMENT WHEREAS, Section 4 of the Roanoke County Charter provides for the appointment of a County Administrator, his or her powers and duties, compensation and tenure of office; and, WHEREAS, Section 15.2-1540 of the Code of Virginia provides for the appointment of a chief administrative officer by the governing body of that locality; and, WHEREAS, Section 15.2-1541 of the Code of Virginia establishes the various duties and responsibilities of the administrative head of the local government; and, WHEREAS, an employment agreement between the county administrator and the Board of Supervisors has been negotiated. NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That B. Clayton Goodman III is hereby appointed County Administrator for Roanoke County, and that his/her tenure shall commence on or before March 15, 2009. 2. That B. Clayton Goodman III shall exercise all of the powers and fulfill all of the duties and obligations of County Administrator as provided in the Roanoke County Charter, the Code of Virginia, the position description, the policies and regulations adopted by the Board, and the legal directives of the Board. 3. That the employment agreement negotiated between the Board and B. Clayton Goodman III is hereby approved, and the Chairman of the Board is hereby authorized to execute this agreement of behalf the Board. Each of the Supervisors thanked Ms. Brandt for her service and wished her well in her new position with the Western Virginia Regional Jail Authority. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None RESOLUTION 121608-2 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS TO MARY V. BRANDT, DEPUTY CLERK TO THE BOARD OF SUPERVISORS, FOR HER SERVICE TO ROANOKE COUNTY WHEREAS, Mary V. Brandt was employed by Roanoke County on May 27, 2003, as a part-time Office Support Specialist, and became a full-time employee by Board action on December 16, 2003; and WHEREAS, Ms. Brandt, who also served as Assistant Deputy Clerk and as Deputy Clerk to the Board, has resigned to accept an administrative position with the Western Virginia Regional Jail and whose last day will be December 24, 2008; and WHEREAS, Ms. Brandt was the creator of the electronic agenda process used by the Clerk’s Office, was the primary author of the training manual used by the Board and Senior Staff, and trained others in the new agenda process both internally and externally; and WHEREAS, Ms. Brandt acted as the records manager and database administrator for the Clerk’s Office and served on the County’s Wellness Committee, acting as committee chairman, and assumed a lead role in organizing an employee health fair in 2007; and WHEREAS, during her tenure with the County, Ms. Brandt earned the designation of Certified Professional Secretary, completed the requirements for certification as a Certified Municipal Clerk, and was an active member of the International Association of Administrative Professionals, the Virginia Municipal Clerks Association, and the International Institute of Municipal Clerks; and WHEREAS, Ms. Brandt’s administrative expertise and willingness to assist and train others were greatly valued by County staff and her co-workers, and contributed to the growth and development of the County. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to MARY V. BRANDTfor her capable, loyal, and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes to Ms. Brandt in her future endeavors. December 16, 2008 858 On motion of Supervisor Moore to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None IN RE: BRIEFINGS 1. Briefing on the results of the 2009 Real Estate Valuation General Reassessments. (Billy Driver, Director of Real Estate Valuation) Mr. Driver gave a PowerPoint presentation about the 2009 general reassessments. He advised that Roanoke County has not suffered the great decreases in market values that Northern Virginia and other areas of the Commonwealth have experienced. He stated that due to decreases in real estate values, many of the property owners in the localities in Northern Virginia suffered foreclosures; however, locally there have been relatively few foreclosures during the past year. He advised that the estimated foreclosure rate nationally is 2.5 percent, in the State of Virginia it is 1.25 percent, and it is 0.75 percent in the Roanoke area. He advised that the unemployment rate nationally is 6.1 percent; 4.2 percent in the State of Virginia, and locally 3.3 percent as of October 2008. He stated that there was a slight increase in 2009 reassessments, which can be attributed to $1.11 million for new construction or 1.46 percent and market values of $191 million at 2.51 percent. He advised that the 2.51 percentage increase for properties is an overall percentage comprised of residential, multi-family, agriculture, commercial, and industrial properties and is the smallest increase since 1992. He advised that the number of sales in Roanoke County was over 1,200, and the appraisal staff was able to quantify these sales and apply them to the neighborhoods and use as December 16, 2008 859 an indicator as to whether the values were increasing within those neighborhoods. He advised that residential values increased just slightly more than the County average at 2.75 percent. He advised that the 2.51 percent of increase shows that the market values are slowing down and that the market place will be making a correction. Mr. Driver advised that he wanted to remind the public that the Tax Relief or for the Elderly Program is available for those citizens who are disabled who are aged 65 or older and have a combined income of less than $56,566, and net assets not exceeding $200,000 beginning in tax year 2009. He stated that these citizens may be eligible to receive tax relief. He advised that the net financial worth of citizens was $175,000 for 2008 and the Board increased that to $200,000 for 2009 and the Board should be commended because this amount is one of the higher net assets in any surrounding locality. He advised that citizens should contact the Commissioner of Revenue’s office to determine if they can qualify for this program. Supervisor Church pointed out that the net financial worth of $200,000 excludes the principal home and one acre of land. Mr. Driver reported on the land use assessment program and advised that the land use participants just recently returned their revalidation forms, and he wanted to make sure that citizens know about the program. He advised that if someone wants to apply for the land use program, they should call the Real Estate Valuation Office and talk with the Land Use Coordinator to determine if they qualify for this program. He advised that reassessment notices will be mailed January 2, 2009, and there will be an December 16, 2008 860 informal appeals process starting January 19 through 27, 2009. He stated that there will be a formal appeals process through the Board of Equalization from March through December 2009. He advised that the 2008 Board of Equalization rendered decisions on 36 appeals. Mr. Driver responded to questions from Supervisors Altizer and Church about the land use program, specifically the 20 to 99 undeveloped acres category, which showed an increase of 11.9 percent. Mr. Driver advised that the majority of the citizens in the land use program have agricultural land and the land use values are created by the State Land Evaluation Advisory Committee (SLEAC), an organization in Virginia that provides the dollar amounts for the agricultural, horticultural, and forestry classifications, and most of those rates decreased this year. He stated that the only classification that had an increased rate was forestry. Supervisor Altizer advised that a citizen in a rural area who owns 100 acres and cows would not experience an 11 percent increase and that this increase would be on developed properties. Mr. Driver advised that this was correct. Supervisor Church advised that he and Supervisor Altizer represent the two districts with the most land available for the land use program and forestry. He advised that from the phone calls and emails that he has received, citizens are surprised to learn that there has been an increase of any kind. December 16, 2008 861 Mr. Driver added that he works with a great staff and they strive to ensure that they comply with the standards set for market values. He assured the Board and citizens that most neighborhoods are well within these standards, although some neighborhoods decreased while some properties increased this year. Supervisor McNamara inquired if there was an average market increase for single family urban or suburban residential. Mr. Driver advised that the increase was 2.51 percent and this figure did not include new construction. Supervisor Flora advised that nationally the foreclosure rate is 2.5 percent. He advised that when he was on vacation in Florida recently, that state had 25,000 foreclosures waiting to go through the court system. He advised that in one Florida County, 800 foreclosures went through the Court system in one day. He advised that the County is very fortunate compared to what is happening in other parts of the country. He thanked Mr. Driver for the information that he presented. IN RE: NEW BUSINESS 1. Request to accept a donation from the Rotary Club of Roanoke Valley in the amount of $2,000 for the Lifesaver Project of the Roanoke County Police Department. (Ray Lavinder, Chief of Police; Tarek Moneir, Deputy Director of Development) A-121608-3 Mr. Chambliss advised that the Rotary Club of the Roanoke Valley provided a contribution this year to the Roanoke County Police Department for Project December 16, 2008 862 Lifesaver and this past fall, they also had an additional fund-raising effort and wanted to present an additional $2,000 contribution to the Police Department. He advised that Project Lifesaver is beneficial to help locate those patients who have conditions such as Alzheimer’s and also pays for supplies necessary for the equipment to function. He advised that the request is to accept the contribution of $2,000 and appropriate it for the use of the Police Department. He advised that representatives from the Rotary Club and Police Department were present. Chief Lavinder advised that Project Lifesaver is an excellent program and that Sergeant Linda Payne and Eric Orange, who are in charge of the program, were present. He expressed his appreciation to the Rotary Club for their contributions to the program. Tarek Moneir, Deputy Director of Development, and President of the Rotary Club of Roanoke Valley, introduced the following members of the Rotary Club who were present: Earline Orndorff, William Orndorff, Everett Werness, and Don Nevins. He presented a check for $2,000 on behalf of the Rotary Club of Roanoke Valley to Sergeant Payne and advised that the $2,000 was in addition to the $10,000 donated last year. He advised that the Rotary Club raised enough money to also assist several additional local organizations. He thanked the members of the club and their families who participated this year. December 16, 2008 863 Supervisor Flora moved to approve the staff recommendation (accept the donation of $2,000 from the Rotary Club of Roanoke Valley for Project Lifesaver). The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None Each of the supervisors expressed appreciation to the Rotary Club, Sergeant Payne and Officer Orange for their support of Project Lifesaver and advised that they feel the program provides a beneficial service for citizens. 2. Request to adopt a resolution to support the Safe Routes to School Infrastructure Grant to encourage use of the Wolf Creek Greenway. (Janet Scheid, Greenway Planner) R-121608-4 Ms. Scheid advised that the Safe Routes to School Program is a federally- funded program and is administered through the Virginia Department of Transportation. She stated that the purpose of the program is to improve the conditions so that school children can walk or bike to school. She advised that in 1969, about half of all students walked or bicycled to school, and today, fewer than 15 percent of all school trips are made by walking or bicycling, and over half of all children arrive at school in private automobiles which impacts health and traffic issues. She stated that the Safe Routes to School is a two part program as follows: (1) a grant was awarded and used to study the traffic patterns and ways children get to school around William Byrd Middle School, December 16, 2008 864 which was chosen because of its proximity to the Wolf Creek Greenway; (2) a Safe Route to School Infrastructure Grant needs to be applied for to help make the Wolf Creek Greenway suitable for children to use. She advised that this grant will request $400,000 in funding and there is no match required for the grant. She advised that staff is recommending that the Board approve the resolution to support the Safe Route to School Infrastructure Grant which is due on December 31, 2008. Supervisor Altizer advised that it is no secret that there are many traffic problems at William Byrd Middle and High Schools and anything that can be done to get children to use other ways to get to school would be great. He advised that he supported the application for the grant. Supervisor Moore advised that this is a fabulous idea, and she would like to see more of these ideas brought forward in the future. Supervisor Altizer moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None RESOLUTION 121608-4 OF SUPPORT TO SUBMIT A GRANT APPLICATION TO THE VIRGINIA DEPARTMENT OF TRANSPORTATION FOR A SAFE ROUTES TO SCHOOL (SRTS) INFRASTRUCTURE GRANT WHEREAS, in accordance with Virginia Department of Transportation procedures, it is necessary that a request by resolution be received from the Board of Supervisors of Roanoke County in order for the Virginia Department of Transportation to accept an application for SRTS funds from Roanoke County; and December 16, 2008 865 WHEREAS, Roanoke County is committed to building, and supporting others to build, a connected greenway system throughout the entire Roanoke Valley; and WHEREAS, ten years ago Roanoke County, in cooperation with the Town of Vinton, built the Wolf Creek Greenway in eastern Roanoke County and in 2007 completed the last remaining section on this 2.2 mile trail; and WHEREAS, Roanoke County recognizes that greenways are not only important for recreation, physical activity and economic development but are also important transportation links in our communities between the places where we live and public facilities such as schools, parks and libraries; and WHEREAS, Roanoke County has identified some impediments on the Wolf Creek Greenway that discourage active transportation on the greenway and the County seeks to strategically solve these problems by implementing a Safe Routes to Schools program. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, supports the submission of the Safe Routes to Schools Infrastructure Grant application. On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None 3. Resolution adopting a legislative program for the 2009 session of the Virginia General Assembly. (Paul Mahoney, County Attorney) R-121608-5 Mr. Mahoney advised that he drafted a resolution adopting the 2009 legislative program for the Board’s consideration and it includes the eight items that the Board had previously requested that the upcoming General Assembly consider. He advised that work sessions were held in May and July with the Board and Eldon James, Legislative Liaison, and these issues were discussed. He reviewed the information contained in the eight items in the draft resolution. December 16, 2008 866 Supervisor Moore requested that Mr. Mahoney contact Delegate Fralin to discuss the issue of litter and support the proposal that cigarette butts should be included and considered as litter. Supervisor Altizer requested that Item 9 be added to the resolution which opposes reductions in the per diem reimbursement rate paid for housing State prisoners in local or regional jails. He read the following statement: “The Board opposes reductions in the per diem reimbursement rate paid for housing State prisoners in local or regional jails. The elimination or reduction of this reimbursement combined with the failure to transfer State prisoners to State correctional facilities could result in a loss of over $1.8 Million for the Western Virginia Regional Jail Authority and Roanoke County.” It was the consensus of the Board to add the item requested by Supervisor Altizer to the resolution as paragraph 9. Supervisor Flora moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None RESOLUTION 121608-5 ADOPTING A LEGISLATIVE PROGRAM FOR THE 2009 SESSION OF THE VIRGINIA GENERAL ASSEMBLY, AND PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER THE TOPICS AND ISSUES ADDRESSED HEREIN WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified major legislative issues of state-wide concern to be considered by the 2009 session of the Virginia General Assembly; and WHEREAS, the Board adopts this resolution as its Legislative Program for the 2009 session of the Virginia General Assembly. December 16, 2008 867 NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the following legislative initiatives are submitted for its legislative program for the 2009 session of the Virginia General Assembly for its favorable consideration and adoption. Community 1. Roanoke County will consider proposals for the creation of Development Authorities (CDA). Additional sources of local tax revenues could be instrumental in the success of such authorities. Therefore the Board supports (a) Amending Sec. 15.2-5158 to increase taxing power within established CDAs to pay the principal and interest of CDA issued revenue bonds for public infrastructure improvements. This enhanced local taxing power could be applied to the transient occupancy tax, meals tax, or sales tax generated by activities within the CDA. (b) Amending Sec. 15.2-5113 to allow members of Industrial Development Authorities/Economic Development Authorities to serve on CDA. 2. The Board supports continued funding for mental health services under the Comprehensive Services Act In these difficult economic times the pool of children eligible for funding for mental health services is expanding. The Board is concerned that the budget dollars will be insufficient to satisfy the demand for services. The State pays only a percentage of the cost of mandated services. State funds will be insufficient and localities will be required to shoulder a significantly greater share of these costs. The Board opposes changing the match rates for CSA. 3. The Board supports amending the State Code to authorize the Virginia Retirement System to manage and invest trust funds for localities for other post employment benefits (OPEB) as required by GASB #45. Explore Park's future 4. may be a major concern if Virginia Living History does not exercise the lease option. Funding of the park, reversion of the land to the State, and other options for the use of the park will need to be determined. HB 1142/Chapter 655 extended the term of the reversion of the VRFA to the Commonwealth in the event it ceases to operate a project until July 2009. The Board seeks a partnership with the Commonwealth to determine the future of this valuable resource, if the lease is not exercised. 5. The General Assembly should fully fund its unfunded liabilities in the Virginia Retirement System and restore VRS to an actuarially sound status. cash proffer system 6. A Joint Study Committee will be looking at how to improve the ability of local land use changes government to implement the embodied in HB3202 (2007). This 2-year study is charged with making interim recommendations for the 2009 session. The Board believes the committee’s work should be monitored closely for potential recommendations impacting local land use authority both positive and negative. December 16, 2008 868 7. Annexation Moratorium. The Board requests the General Assembly extend the annexation moratorium. 8. Transportation Funding. The Board requests the General Assembly provide funding for the widening of I-81, construction of I-73, and improvements to U.S. Routes 11/460, 220, and 221. 9. The Board opposes reductions in the per diem reimbursement rate paid for housing State prisoners in local or regional jails. The elimination or reduction of this reimbursement combined with the failure to transfer State prisoners to State correctional facilities could result in a loss of over $1.8 Million for the Western Virginia Regional Jail Authority and Roanoke County. Request to approve staffing for the Fire and Rescue Department for the Clearbrook Station, and appropriation of $156,000 for current year funding. (John Chambliss, County Administrator ) A-121608-6 Mr. Chambliss advised that the County received a notice from the City of Roanoke that on September 23, 2008, they intend to cancel the Clearbrook agreement effective June 30, 2009. He stated that this notice is in compliance with the conditions of the October 29, 2001, agreement whereby the City provided six staff assigned to the Clearbrook station. He advised that this staff, in addition to the County staff, allowed for the proper staffing of one ambulance and one fire truck 24/7. He advised that with three December 16, 2008 869 shifts in order to provide the 24/7 coverage, this effectively removes the staffing for the ambulance unit at the station. Mr. Chambliss stated that the reason for presenting this item to the Board is that at the November 11, 2008, meeting, Chief Burch briefed the Board on staffing needs for the upcoming five years that reflected the administrative staff for the fire and rescue department and the requests from the volunteer fire and rescue organizations throughout the County. He advised that one of the needs for the current fiscal year was to replace the six people who are being removed from the Clearbrook Station since the Clearbrook Station is a core station that provides backup to other areas of Roanoke County such as Cave Spring, Mount Pleasant, and Roanoke City. He stated that an academy will start in February primarily to train the staff for the new station off Hershberger Road that is currently being constructed. He advised that if new hires are to attend the academy in February, the offers for employment need to be made immediately. He advised that if the Board were to choose not to fill these positions at this time, Chief Burch would be required to reduce services around the County based on need which would cause difficulties in other areas. He advised that Roanoke County employees are not being terminated, and that Roanoke City employees are being removed from the County system. December 16, 2008 870 Mr. Chambliss stated that the cost for the balance of this fiscal year or approximately five months’ service would be $156,000, and on an annual basis, $334,000 would be needed in future budgets. He advised that the next item on the agenda is to unappropriate $175,000 which was previously set aside for a one-time purpose of architect and engineering services for the Southview School project. He stated that regardless of where the funds are obtained, $334,000 in new revenue would be needed for next year’s budget for this purpose. He advised that Chief Bruch was present to answer questions. Supervisor Moore advised that she thought the staff should be replaced in the Clearbrook Station. She stated that public safety should be a top priority for the Board and it is their duty to make sure that all citizens have coverage and are protected. She advised that at the appropriate time she would make a motion to approve replacing the six fire EMS personnel at the Clearbrook Station. She thanked Mr. Chambliss for the report. Supervisor Flora inquired if there will be enough revenue in next year’s budget to fund this request without laying off other employees. Mr. Chambliss advised that he could not answer in the affirmative because he did not know the impact of the Governor’s budget message tomorrow and the impact on the County’s budget for the next fiscal year. He advised that the County would need $334,000 of new revenue or they would need to change other County services or functions of people. December 16, 2008 871 Supervisor McNamara inquired as to how many positions have been kept vacant since the Job Bank System was started. Mr. Chambliss advised that the Job Bank started the first of November and there are approximately four or five positions that have not been filled; however, other positions have been put on hold until the impact of the Governor’s budget is known. Supervisor McNamara inquired as to the amount of expenses that the Board has already committed to for next year’s budget such as the 14 firefighters in North County and the jail startup. Mr. Chambliss advised that the jail will open in March 2009, there will be some startup expenses for the multi-generational center and the fleet service center, although these expenses may be covered by fees for services, and there are some other capital related items already programmed into the next fiscal year. Supervisor McNamara advised that he thought the Job Bank needs to be taken seriously; however, there is no choice but to fill fire and rescue positions. Supervisor McNamara stated that only in the recent past has the Board used funds from another year’s budget, and he felt the County should be very cautious when spending funds from next year’s budget and using one-time money for expenses. Supervisor Church advised that he has always been a supporter of public safety and the County should always put forth its best efforts to protect the public. He advised that there have been recent local fires where people died and he would never be pleased until every station in Roanoke County has basic coverage for all hours. He advised that he realizes this cost will create budget problems; however, in his opinion, December 16, 2008 872 the Board must do what is necessary to take care of the citizens first. Supervisor Altizer advised that although there will be a prioritization of budget items after the first of the year, the Board must find ways to maintain public safety as a top priority. He advised that there has been an agreement with Botetourt County concerning Read Mountain Fire Station since 1985, and he requested that the motion to approve the funding for staffing at Clearbrook Station include direction to the interim County Administrator to start negotiations with Botetourt County to make the agreement more equitable due to the current conditions. He advised that in the Read Mountain area during the first 11 months of 2008, there were 323 rescue calls and Vinton responded to 272 and Hollins responded to 42, which causes him to believe that some adjustments to the agreement are necessary. Supervisor Flora advised that he did not think it was appropriate to use the $175,000, which will come before the Board in the next agenda item, to fund the staffing at Clearbrook Station. He advised that the $175,000 was appropriated from minor capital to provide for architectural and engineering services at Southview Elementary School, and these funds should be returned to the minor capital account. He stated that any funds approved for staffing at Clearbrook Station should come from fund balance. Chairman Flora inquired if Supervisor Moore’s motion was to approve Alternative 1 (Appropriate the $156,000 from the $175,000 previously assigned for the A/E work at Southview and consider the funding for the next fiscal year during the budget process) and when the response was affirmative, advised that he would not December 16, 2008 873 support that motion. Supervisor Altizer inquired if an amendment could be added to the motion that the interim County Administrator would start negotiations with Botetourt County concerning the agreement for the Read Mountain Fire Department. Supervisor Church inquired if Supervisor Moore would yield to a substitute motion to approve staff recommendation Alternative 2 (appropriate the $156,000 from the General Fund Unappropriated balance) because it is important to approve this item, and he prefers that the $175,000 be returned to the unappropriated balance. Supervisor Moore advised that she would amend her motion from approving Alternative 1 to approving Alternative 2 and add Supervisor Altizer’s amendment to the motion. Chairman Flora inquired if Supervisor Moore would withdraw her original motion to make a primary motion. Supervisor Moore agreed to withdraw her motion and restated the motion. Supervisor Moore moved to approve Alternative 2 (appropriate the $156,000 from the General Fund Unappropriated balance) and add an amendment from Supervisor Altizer that the interim County Administrator start negotiations with Botetourt County concerning the agreement for the Read Mountain Fire Department). The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None December 16, 2008 874 Chief Burch expressed his appreciation to the Board for approving this item and advised that they are committed to keeping a high level of service. He advised Supervisor Altizer that he supported a review of the agreement with Botetourt County since it has not been reviewed in many years. Supervisor Flora advised that his reason for questioning the use of funds from next year’s budget is because the County’s increase in obligations for next year will be in the $3 million range and the increase in real estate revenues will only be $2 million, which leave the County down $1 million. He expressed the opinion that staff should make mandatory that any vacancies that occur are brought back to the Board for approval other than emergency services. 5. Request to allocate the $175,000 previously unappropriated from the Southview Elementary School renovations. (Diane Hyatt, Chief Financial Officer) A-121608-7 Ms. Hyatt advised that on December 4, 2007, the Board of Supervisors voted to unappropriate the $175,000 that was previously approved to pay for half of the architect and engineering fees for Southview Elementary School. She stated that the Schools have now decided to surplus and sell this building, and these funds are no longer necessary. She advised that the Board’s decision on where to deposit the $175,000 was deferred until this meeting. She advised that staff had provided three alternatives as follows: (1) General Fund Unappropriated Balance; (2) Minor Capital December 16, 2008 875 Reserve, which is where the funds came from originally; or (3) Use the funds as the Board saw fit for another non-recurring source, which could have been for the previous agenda item. Ms. Hyatt advised that the staff recommendation had been to deposit the funds into the General Fund Unappropriated Balance; however, she advised that since the Board’s last action had removed funds from the general fund, she was amending the staff recommendation to deposit the funds into the minor capital reserve. Supervisor McNamara questioned Ms. Hyatt’s decision to amend the staff recommendation to deposit the funds into the minor capital reserve and not the general fund. He stated that the Board had just approved taking funds from the general fund balance to pay for staffing, and if the Board deposited the $175,000 funds into the general fund, that previous reduction to the general fund would be covered. Ms. Hyatt advised that it was the Board’s choice to decide the appropriate place to deposit the funds. Supervisor McNamara advised that if the Board returned the funds to the minor capital reserve, the general fund balance would be effectively reduced to 9.28 percent from the 9.51 percent where it was a year ago. He advised that during difficult times it would seem responsible to him to put these funds into the general fund which would be a savings account. He advised that since funding has been provided for the firefighters, he preferred that these funds be put back into the general fund. December 16, 2008 876 Supervisor Flora advised that he understood that it was a good idea to maintain the general fund balance as high as possible; however, since the funds originally came from minor capital, he thought it appropriate to put them back into the minor capital account. He advised that funds in the minor capital and general fund balances can only be used with the Board’s approval. Supervisor Church advised that he wanted to point out that the 9.28 percent fund means that the general fund contains $17,650,000. He advised that the Board does not generally take funds from the unappropriated fund balance; however, he could envision situations arising next year which might make it necessary to use some of these funds. Supervisor Flora moved to approve Alternative 2 (deposit the funds into the minor capital reserve). December 16, 2008 883 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor McNamara: He stated that since this is the last scheduled meeting for 2008, he wanted to thank the citizens for the opportunity to serve them again this year and advised that many things have been accomplished together. He advised that since there has been some interest expressed about Roanoke City mileage and expense accounts by the newspaper, he wanted to report that in the 11 years he has been on the Board, he has not had any mileage reimbursements from the County and does not expect any reimbursement in the coming year. He wished everyone a Merry Christmas and welcomed Mr. Goodman to the County. Supervisor Moore: She wished a Merry Christmas and Happy and Safe New Year to everyone, especially all of the service men and women who will be unable to come home for Christmas. Supervisor Church: He expressed appreciation to the staff for the fine jobs that they are doing while the County is facing these tough times. He stated God Bless and asked for safety for our troops as well as law enforcement and public safety personnel. He wished Merry Christmas to the Board members and advised that they have done a good job under trying circumstances. Mr. Chambliss advised that since the Governor’s budget message with the proposed additional decreases in state funding for localities will not be published until tomorrow, the impact to the County is not known at this time. He reviewed the steps that staff has already taken to deal with the shortfall in the current year’s budget and December 16, 2008 886 advised that staff may have to bring a mid-year budget adjustment to the Board for approval. During a general discussion of budget concerns, the Board members gave direction to staff as follows: (1) The job review team was directed to bring back to the Board for approval all vacancies that the team deemed necessary to be replaced. (2) Staff was asked to provide additional information about items approved by the Board last year which will affect next year’s budget. (3) Staff was asked to schedule additional budget meetings on the Tuesdays that the Board does not have a regularly scheduled meeting. (4) Department directors were asked to review line budgets carefully and realistically. (5) The Board advised that an increase in the tax rate is not anticipated. (6) The Board advised that pay increases for employees are not anticipated at this time and expressed their hopes that layoffs of employees will not be necessary. (7) The Board advised that there will be no increase in the amount of funds for contributions to human and social agencies, and cultural, tourism and other agencies. Mr. Chambliss advised that staff is preparing a communications plan to inform and update employees regarding the current budget situation.
