Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: CALL TO ORDER Chairman Flora called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Richard C. Flora; Supervisors Joseph B. "Butch" Church and Charlotte A. Moore MEMBERS ABSENT: Supervisors Altizer and Elswick STAFF PRESENT: B. Clayton Goodman III, County Administrator; Paul M. Mahoney, County Attorney; Teresa H. Hall, Director of Public Information and Deborah C. Jacks, Clerk to the Board IN RE: OPENING CEREMONIES The invocation was given by Pastor Tim Martin of Grace Church. The Pledge of Allegiance was recited by all present. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to Gregory A. King, Fire Captain, upon his retirement after twenty -eight (28) years of service (Richard E. Burch, Jr., Chief of Fire and Rescue; Steve Simon, Division Chief) In attendance for this recognition were Captain Greg King and his wife Mona; Chief Richard E. Burch; Division Chief Steve Simon; Division Chief Joey Stump and Division Chief Todd Maxey. All Supervisors offered their thanks and congratulations. 602 October 9, 2012 RESOLUTION 100912 -1 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO GREGORY A. KING, FIRE CAPTAIN, UPON HIS RETIREMENT AFTER TWENTY - EIGHT (28) YEARS OF SERVICE WHEREAS, Gregory A. King was hired on September 17, 1984, and has worked as a Firefighter, Fire Lieutenant and Fire Captain during his tenure with Roanoke County; and WHEREAS, Captain King retired on October 1, 2012, after twenty -eight (28) years and four (4) months of devoted, faithful and expert service with the County; and WHEREAS, during his time serving Roanoke County, Captain King served on the Safety and Health Committee for over 20 years reviewing all accidents to persons and apparatus to help reduce future injuries or accidents; and WHEREAS, Captain King was one of the Department's most qualified fire engine pump instructors and used that knowledge to train hundreds of career and volunteer personnel in the proper operation of the hydraulic systems of fire trucks; and WHEREAS, Captain King through -out his tenure with Roanoke County Fire and Rescue Department was a mentor to new employees always with a calm and reassuring approach to garner the best out of new personnel; and WHEREAS, Captain King through his positive attitude and open approach was successful in ensuring the transition from volunteer personnel to career personnel at the Back Creek station with a seamless process. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to GREGORY A. KING, for twenty -eight (28) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Church to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Flora NAYS: None ABSENT: Supervisors Altizer, Elswick 2. Recognition of Fred Corbett for receiving the Virginia Recreation and Park Society Distinguished Volunteer Service Award (Doug Blount, Director of Parks, Recreation and Tourism) Mr. Blount advised this award is not given out every year, but is based on a lifetime of service. Mr. Corbett thanked the Board for the opportunity to serve and October 9, 2012 603 noted they have come a long way and it is an honor to serve the community. All Supervisors offered their thanks and congratulations. IN RE: BRIEFINGS 1. Briefing on Roanoke County Carbon Footprint 2010 (Anne Marie Green, Director of General Services; Janet Scheid, Vice Chairman, Roanoke County Community Leaders Environment Action Roundtable (RCCLEAR) and Dr. Sean McGinnis, Virginia Tech) Ms. Green gave a brief overview and then provided the audience with a brief biography for Janet Schied and Dr. McGinnis. Ms. Scheid gave a brief outline on what RCCLEAR has been doing, i.e. Save -A -Ton; weatherization, unplugging, reducing car trips, and keeping tires properly inflated. She advised everything is input into an energy calculator to see what savings they have. She indicated the major focus going forward for RCCLEAR would be the Sav -A -Ton campaign. She indicated the carbon footprint is to reduce CO2 by three percent (3 %) each year; Roanoke County has achieved this reduction in 2010. Dr. McGinnis stated he is here in his capacity as a consultant and is not representing Virginia Tech. Dr. McGinnis gave a brief overview of the process and indicated the analysis for 2011 is not yet complete. Supervisor Moore thanked Dr. McGinnis for attending and thanked RCCLEAR for making the County run more efficient and save energy. She also invited everyone to attend the Green Energy Expo to be held November 2 nd and 3 rd at the Roanoke Civic Center. It is free; there will be lots of games and fun for everyone in the family and RCCLEAR will be there representing the County. Please try to come and thanked Anne Marie Green for all that she has done. Chairman Flora also thanked the representatives for coming and enlightening the Board on the process. He also stated he wanted to commend Roanoke County schools; back twelve years ago they entered into a program designed to conserve energy and many of this things Ms. Scheid spoke about they did and much more, which resulted in millions of dollars of savings. There is a direct correlation between money saved and the benefit to the environment. Chairman Flora then thanked RCCLEAR for all the work they do. It is a good program; if you are saving people money, you are saving them energy. There was no additional discussion. IN RE: NEW BUSINESS 1. Resolution approving the allocation of revenue sharing funds for fiscal year 2013 -2014 (David Holladay, Planning Administrator) 604 October 9, 2012 Mr. Holladay explained the resolution and the four projects: Wildwood Road, Kenwick Trail, Belle Mead Drive and Merriman Road. There was no discussion. RESOLUTION 100912 -2 REQUESTING APPROVAL AND ADOPTION OF THE REVENUE SHARING PROJECTS AND FUNDS FOR THE FISCAL YEAR 2013 -2014 WHEREAS, the Board of Supervisors reviewed the projects identified in Roanoke County Revenue Sharing Program for fiscal year 2013 -2014; and WHEREAS, the Board of Supervisors desires to submit an application for an allocation of funds of up to $500,000 through the Virginia Department of Transportation fiscal year 2013 -2014, Revenue Sharing Program; and WHEREAS, $500,000 of these funds are requested to fund the projects identified in Roanoke County Revenue Sharing Program for fiscal year 2013 -2014. NOW, THEREFORE, BE IT RESOLVED that Roanoke County Board of Supervisors hereby approves the Revenue Sharing Project list for fiscal year 2013 -2014 and supports this application for an allocation of $500,000 through the Virginia Department of Transportation Revenue Sharing Program; and BE IT FURTHER RESOLVED that the County Administrator is authorized to sign the Letter of Intent and defer appropriation of the funds ($500,000) until July 1, 2013. On motion of Supervisor Flora to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Flora NAYS: None ABSENT: Supervisors Altizer, Elswick 2. Resolution approving the sale of Roland E. Cook School by the County School Board of Roanoke County and authorizing the School Board to retain the proceeds of such sale (Paul M. Mahoney, County Attorney) Mr. Mahoney explained the need for the resolution and advised Mr. Stovall from the School Board was in attendance to answer any questions. Mr. Stovall gave a brief history of the school and advised the School Board has plans for the proceeds, which will go back into the districts. Chairman Flora advised there had been a recent discussion to contact the Town of Vinton to see if the could use the building. Mr. Stovall advised a meeting would be held on October 17 will all the stakeholders. He advised he has met with the Mayor and does not feel they will want the building. October 9, 2012 605 Supervisor Church inquired of Mr. Mahoney what the procedure would be and Mr. Mahoney responded if the Town was interested, the School Board could still go forward with the sale. RESOLUTION 100912 -3 APPROVING THE SALE OF ROLAND E. COOK SCHOOL BY THE COUNTY SCHOOL BOARD OF ROANOKE COUNTY AND AUTHORIZING THE SCHOOL BOARD TO RETAIN THE PROCEEDS OF SUCH SALE WHEREAS, the County School Board of Roanoke County has determined that it has no further use for the former Roland E. Cook School, and that it intends to sell said school; and WHEREAS, pursuant to Section 22.1 -129 of the Code of Virginia, the School Board may sell such property and retain the proceeds of such sale upon the approval of the Board of Supervisors and after the School Board holds a public hearing; and WHEREAS, the Board of Supervisors intends to approve the sale of the Roland E. Cook School property by the School Board and to allow the School Board to retain the proceeds of such sale in a capital improvements fund. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: 1. That the sale of the Roland E. Cook School property by the County School Board of Roanoke County is hereby approved. 2. That the School Board shall hold a public hearing on the sale of the Roland E. Cook School property and the retention of the sale proceeds. 3. That the School Board may retain the proceeds from the sale of the Roland E. Cook School property. The proceeds of this sale shall be retained in a capital improvement fund to be used only for new school construction, school renovation and major school maintenance projects. 4. That this resolution shall be effective from and after the date of its adoption. On motion of Supervisor Moore to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Flora NAYS: None ABSENT: Supervisors Altizer, Elswick IN RE: APPOINTMENTS 1. Clean Valley Council Chairman Flora recommended the appointment of Theresa Passeretti to fill the unexpired term of Debbie Melnick, which will expire on June 13, 2013. Ms. 606 October 9, 2012 Passeretti is from the Cave Spring Magisterial District. Confirmation has been placed on the Consent Agenda. 2. Library Board (appointed by District) Vice Chairman Michael W. Altizer has recommended the reappointment of Heather Lawrence to serve an additional four -year term, which will expire on December 31, 2016. Ms. Lawrence will represent the Vinton Magisterial District. Confirmation has been placed on the Consent Agenda. 3. Total Action Against Poverty (TAP) Board of Directors (Designee of Richard C. Flora) Chairman Flora has recommended the appointment of Ms. Charlotte A. Moore to serve as his designee for a two -year term that will expire October 9, 2014. Confirmation has been placed on the Consent Agenda. IN RE: CONSENT AGENDA RESOLUTION 100912 -4 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM G- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for October 9, 2012, designated as Item G - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 8 inclusive, as follows: 1. LAWSON, BUILDING MAINTENANCE TECHNICIAN, UPON HIS RETIREMENT AFTER MORE THAN EIGHT (8) YEARS OF SERVICE WHEREAS, Donald P. Lawson was hired on January 20, 2004, and has worked as a Building Maintenance Technician during his tenure with Roanoke County; and WHEREAS, Mr. Lawson retired on October 1, 2012, after eight (8) years and nine (9) months of devoted, faithful and expert service with the County; and WHEREAS, during his time serving Roanoke County, Mr. Lawson held a variety of Virginia trade licenses, including Master Mechanical, Master Plumbing, Master Gas Fitter, Journeyman Electrician and Back Flow tester, all of which helped him perform many tasks in house, saving the County thousands of dollars in outside fees; and WHEREAS, Mr. Lawson also had strong skills in the area of Heating, Ventilation and Air Conditioning (HVAC), including a thorough knowledge of pneumatic controls used in those systems, which allowed him to maintain and fix that equipment and allowed the County to save money by eliminating service contracts; and WHEREAS, Mr. Lawson's positive attitude and strong work ethic resulted in numerous compliments from the departments that he provided with service and support for equipment and facilities; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of 608 October 9, 2012 the citizens of Roanoke County to DONALD P. LAWSON, for eight (8) years and nine (9) months of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Church to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Flora NAYS: None ABSENT: Supervisors Altizer, Elswick A- 100912 -4.e A- 100912 -4.f A- 100912 -4.g IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS Noah Tickle of 1603 Frosty Lane in Salem, Virginia stated he has been a Roanoke County resident since 1956. He stated a picture is worth a thousand words and provided two charts for the Board to review and provided the following information. ICLEI's - - -The International Council of Local Environmental Initiatives most obvious indirect connection to Roanoke Co Board of Supervisors stems from this conduit of influence: ICLEI- Sierra Club -Cool Cities Coalition- Roanoke Valley Cool Cities Coalition - RCCLEAR- Roanoke County Board of Supervisors. However, as you can see, there are multiple paths ICLEI's influence takes to get to you. You only see the interaction you may occasionally have with certain local organizations that appear to have no influence from ICLEI. But, as you are about to find out that is not the case. So, as you or your County employees interact with the local organizations that we are going to mention just remember ICLEI's influence is indirectly there. We are going to discuss some of these conduits for you. Let's begin. ICLEI -350. organization- Roanoke Valley Cool Cities Coalition -The Board. ICLEI is a partner with 350.org. 350.org is an international environmental organization with the goal of building a global grassroots movement to raise awareness of "so called" anthropogenic climate change, to confront climate change denial and to cut emissions of one of the greenhouse gases, carbon dioxide in order to slow the rate of "so called" global warming." 350,org /1 SKY shows the Roanoke Valley Cool Cities Coalition as being an ally on the 350.org website. You hear regularly from members of the Cool Cities Coalition. Certain County employees also have a working relationship with members of the Roanoke Valley Cool Cities Coalition. Doctors Christopolus and McInnis are behind the County's annual carbon emissions report, which was discussed at this very Board meeting. They are directly helping RC CLEAR driving the ICLEI Milestones program. RC CLEAR reports to you (The Board). ICLEI - APA-VA Chapter of the APA- Roanoke Valley Alleghany Regional Commission — October 9, 2012 609 Roanoke County — Roanoke Valley Area Metropolitan Planning Organization Policy Board.- Board members Moore and Flora are members of that policy board - The Board. ICLEI describes The National Association of Counties as a partner on the ICLEI website. One of National Association Counties' chapters is the Virginia Association of Counties (or VACo). The Board should be familiar with VACo. One Board member represents the County for VACo. By the way, VACo is a partner with the Virginia Municipal League, which is also indirectly influenced by ICLEI. Also, he has twenty - three (23) more signatures to eliminate ICLEI from Roanoke County from Roanoke County citizens. Mr. Tickle indicated his display will be out in the hall after the meeting for as long as needed for reviewing and asking questions. Our offer still continues to educate county staff about ICLEI. Bill Gregory of 3312 Pamlico Drive in Roanoke Virginia and has been a County resident for twenty (20) years stated ICLEI indicates that the Sierra Club is one of their partners. The Sierra Club is described as being supported by Earth Share. Earth Share has the Land Trust Alliance as one of its members. The Land Trust Alliance is a client of Jeff Jones Strategies. Jeff Jones was a founding member of the Weather Underground whose goal was to create a clandestine, revolutionary party for the violent overthrow of the US government during the Vietnam War. The Land Trust Alliance represents 1700 land trusts across the United States. The Western Virginia Land Trust is one of them. The Western Virginia Land Trust is mentioned in Chapter 6 of the Roanoke County future land use guide on the Roanoke County website. Roanoke County contributes to the Western Virginia Land Trust. Another link from ICLEI through Earth Share is the League of Conservation Voters. The League of Conservation Voters is a public sector member of Earth Share. The Virginia League of Conservation Voters is a chapter. The League of Conservation Voters has the Western Virginia Land Trust as one of its members. Western Virginia Land Trust has colloraborated with the Clean Valley Council of the Roanoke Valley. The Clean Valley Council indicates that the Sav -A -Ton campaign is one of their partners. Linda Laprade of 5509 Will Carter Lane stated she is from the Cave Spring District. She stated the first thing she would like to do today is dispel any notion that ICLEI has no relationship with the United Nations. We have heard that from a number of people and have seen it on a number of websites. The following information is all from the ICLEI websites. ICLEI USA is a sub - corporation of ICLEI Global. The term ICLEI -Local Governments for Sustainability is trademarked by ICLEI Global. ICLEI USA uses the same Charter as ICLEI Global and has voting rights on changes to that Charter. This charter states in Charter 1.2 - The Association shall maintain its formal institutional relationships with its founder patrons, the United Nations Environment Programme (UNEP) among others. The Association seeks an agreement with United Cities and Local Governments whereby ICLEI serves as the World Organization's environmental and sustainable development agent. In the Bylaws, 1.7a - ICLEI offices shall: encourage members to endorse the Earth Charter Principles and report back to ICLEI; provide promotional material on ICLEI's association with the Earth Charter to 610 October 9, 2012 local governments interested in ICLEI membership. Charter 2.5 - Obtaining Membership - Membership may be requested by submitting an application, through which process the Charter is explicitly accepted, and paying an annual dues fee. The ICLEI Global Programs page and she has included that for the Board has another excerpt of international goals and and agreements. (She provided the list in lieu of reading them all) but includes three UN goals and includes Agenda 21 as part of those goals. The Earth Charter, which it endorses ends with the following paragraph, "In order to build a sustainable global community, the nations of the world must renew their commitment to the United Nations, fulfill their obligations under existing international agreements, and support the implementation of Earth Charter principles with an international legally binding instrument on environment and development." The relationship of ICLEI to the United Nations is plain as day so let's end that denial. She stated she sent a FOIA request several weeks ago for a signed and dated membership application. This serves as a contract to ICLEJ. None could be found. What was provided was an unsigned and undated copy. Is Roanoke County even a member of ICLEI without that contract? If Roanoke County is not a member, why are we paying dues to them? IN RE: REPORTS Supervisor Church moved to receive and file the following reports. Reserve for Board Contingency IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Church asked if the information concerning an unsigned application is correct with Mr. Goodman responding in the affirmative. Supervisor Church stated he thought that was a little bit unusual for Roanoke County with Mr. Goodman responding in the affirmative, but apparently the signed application was sent with the initial dues. Supervisor Church asked Mr. Goodman to recheck into that. He then offered his condolences and prayers to Dr. Betty McCrary who served the Roanoke County Social Services for many years in the loss of the loss of her husband and best friend, Rick, a few days ago. He was a former neighbor of his in the Western County and was a great person. Roanoke County grieves with Betty and asks God to be with you during this difficult time and hopefully you can find comfort with your family, October 9, 2012 611 friends and loved ones. Next, Supervisor Church gave a special hello to Laurie Gray and her husband Jim. She has been missing in action for a while; we are so happy to see you and may God bless you and continue in good health and healing. Just wanted you to know that we missed you; we miss the people that come. It is so good to see you. Lastly, the Board had a work session a month or two ago and discussed some items that we wanted to discuss with Mr. Mahoney about items the Board would want to send to the General Assembly for possible discussion. The date is not critical, but it has been within the last couple of months. During that discussion, one of the items we talked about was, we do not vote in work session, was to consider asking the General Assembly to allow our School Boards taxing authority. It was consensus with the things that have been going on. He stated he would like to make the request that we do make that one of our concerns to send to Richmond. He stated we read the newspaper and television reports about loss of funding from the federal and state level and each year it never seems to stop that we have potential school closings and cutbacks, even to the tune of last year, of closing Mason's Cove which was a multimillion dollar brand new school in the Catawba District. He stated with families and parents and everyone concerned it would give the School Board an opportunity to address head on the revenue situation or lack of it. So, he would like to discuss this and believes it was consensus at the work session, please check it. He stated he thinks we need to move forward on that to allow the School Board a chance to determine their own destiny so to speak. Supervisor Moore stated she just wanted to take a moment and thanked everyone who came out with the Roanoke River cleanup this past Saturday. Again, another year, another ton of debris that was taken from the river. Thanks to everyone who came out to help. Chairman Flora stated he just wanted to comment on the Greenway Ribbon Cutting that was Saturday out in Hollins. He advised they actually had a significant number of people present. It was a nice day; it was pretty and went downhill after the ribbon cutting. We had a huge turnout and he wanted to thank Hollins University for their participation in that. They are a major player in the Hollins area and they have been very helpful; they have worked side by side with the County and doing studies and they have been an excellent corporate partner to the County. We had a great turnout; we had a great ribbon cutting and does not think they could have handled any more people. He stated he sees a number of people here today that were out there; thank you to all who came. IN RE: CLOSED MEETING At 3:59 p.m., Chairman Flora moved to go into closed meeting following the work sessions pursuant to the Code of Virginia Section 2.2 -3711 A.1 personnel, namely discussion concerning appointments to the Grievance Panel. The motion carried by the following recorded vote: 612 October 9, 2012 AYES: Supervisors Moore, Church, Flora NAYS: None ABSENT Supervisor Altizer, Elswick At 4:00 p.m. Chairman Flora recessed to the fourth floor work session and closed meeting. IN RE: WORK SESSIONS 1. Work session to review the preliminary financial results for June 30, 2012, for the County of Roanoke (Rebecca Owens, Director of Finance) In attendance for this work session were B. Clayton Goodman, County Administrator; Rebecca Owens, Director of Finance; Laurie Gearheart, Assistant Director of Finance and Brent Robertson, Director of Management and Budget. The work session was held from 4:20 p.m. until 4:55 p.m. Mr. Goodman gave a brief overview and noted the County barely made revenue and turned the session over to Ms. Owens. Ms. Owens went through a PowerPoint presentation, a copy of which is on file in the office of the Clerk to the Board of Supervisors and gave an overview of the preliminary financial results for June 30, 2012. She indicated this was a joint effort with Management and Budget. The auditors will be finishing up within the next week or two and final results will be presented at the Board meeting on November 13, 2012. Ms. Owens went through the General Fund Revenues and then turned the meeting over to Mr. Robertson. Supervisor Church inquired of Billy Driver where Roanoke County currently stands with Mr. Goodman advising revenue may be more than anticipated as indicated in the 2012 -2013 budget. He advised the Revenue Team would be meeting this week to discuss. Mr. Robertson indicated the expectation to be relatively flat, which was the new normal and to expect this to be the new normal for the next two to three years. Mr. Goodman noted staff is basically working on three budgets, prior present and future simultaneously. It was noted that Rescue fees will go back into the Fire and Rescue Department unappropriated account, the General Fund unappropriated balance remains strong and is viewed favorably by the rating agencies. Major Capital remains at approximately $1 million. Mr. Goodman explained the unappropriated fund is used for cash flow for Roanoke County as well as Roanoke County Schools. Supervisor Church inquired of the balance in the Minor Capital with Ms. Owens responding $1.7 million. October 9, 2012 613 Ms. Owens indicated departments had expenditure savings of $1 million for unfilled position, $1.2 million in capital or technology projects that have been delayed and $1.7 from a variety of non - reoccurring accounts, i.e. Cortran and employee benefits. Ms. Owens then finished the presentation. She noted that last year Roanoke County paid the lower VRS rate and there is an unfunded $1.6 liability. Staff recommends that the funds are not actually sent to the State, but to fund and hold at Roanoke County. Chairman Flora asked if Roanoke County had opted for a five -year phase in with Ms. Owens responding in the affirmative. Ms. Owens noted that an Audit Committee meeting will be held on November 7 to review the final numbers with the outside auditors.
