HomeMy WebLinkAbout11/28/1995 - Minutes MINUTES Industrial Development Authority of Roanoke County,Virginia November 28, 1995 Members Present: Absent: Bill Branch Rick Cranwell Carson Quarles Carole Brackman Darnall Vinyard Ron Martin Timothy Gubala, Secretary-Treasurer Others present: Edward Natt, Counsel Brian Duncan Don Wetherington John Fulton Jim Brock Vice chairman Bill Branch called the meeting to order at 10:37 a.m. on Technology Drive, Valley TechPark adjacent to the Rusco project. This meeting was adjourned from the November 22, 1995, meeting for the purpose of viewing landscaping plans for Rusco. Don Wetherington, Attorney for Rusco, presented renderings of a landscape plan prepared by John Fulton of Balzer and Associates. A series of plantings was proposed on the right side of the entrance road and between the entrance road to the Rusco building and the interior driveway to the building entrance. Ron Martin questioned whether the metal panels facing Technology Drive are to be considered as the expansion wall. Vice chairman Branch suggested that another series of plantings and a berm be placed on the left side of the entrance road as well as berms in the other locations. There was a discussion about the Authority meeting of August 4, 1995, and the action(s) needed to be taken at this meeting. There was a general consensus among the Authority members that the location of plantings should be located on the right and left side of the entrance road and located on both sides of the interior driveway. The plantings would be placed on berms. Ron Martin stated that there were too many unknowns; i.e., what was Rusco's expansion schedule which would determine the length of time that the metal wall would be facing Technology Drive, what would the final site elevations be, would there be additional costs at the entrance required by VDOT for sight distance? Ron Martin was concerned that the restrictive covenants were not being complied with and that the rendering and site plan did not address his concerns. 1 At 11:15 a.m.,Rick Cranwell made a motion that the Authority go into executive session under Section 2.1- 344(A)(3)to discuss a real estate matter. Ron Martin seconded and the motion passed unanimously. At 11:40 a.m.,upon a motion by Ron Martin, seconded by Rick Cranwell, the Authority voted to return to open session and certified by.resolution(attached)that the executive session was held in conformance with the Code of Virginia. Rick Cranwell made a motion to (1) authorize the execution of the agreement presented to the Authority, (2) to waive the requirements of a masonry wall cited in the restrictive covenants (3), to approve the temporary metal wall and the landscaping plan (as presented) which will substantially screen the building conditioned upon (1) Review authority of the final landscape plan is given to the Secretary-Treasurer to determine when substantial screening is complied with. (2) The final wall constructed at the completion of Rusco's expansion must comply with the restrictive covenants. Carole Bradman seconded and the motion passed unanimously. On another matter, Tim Gubala reported that the Beahm option could be extended for one year for $2,500. On motion by Ron Martin, seconded by Rick Cranwell, the Authority voted to extend the option. Motion passed unanimously. Bill Branch asked that negotiations continue with the Beahm's to secure the option for an additional year. There being no further business, the Authority adjourned at 11:45 a.m. Respectfully submitted, 441 W` Timothy W. Gubala Secretary-Treasurer Attachment 2 AT A REGULAR MEETING OF THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON NOVEMBER 28, 1995 Resolution certifying Executive Meeting was held in conformity with the Code of Virginia Whereas,the Industrial Development Authority of Roanoke County, Virginia has convened an executive meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and Whereas, Section 2.1-344.1 of the Code of Virginia requires a certification by the Industrial Development Authority of Roanoke County, Virginia,that such executive meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Industrial Development Authority of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2. Only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Industrial Development Authority of Roanoke County, Virginia.
