CALL TO ORDER Mr. Karr called the meeting to order at 7:00 p.m. APPROVAL OF AGENDA Mr. Jones made a motion to approve the amended agenda, which passed unanimously. APPROVAL OF MINUTES Mr. Barnes made a motion to approve the minutes. Mr. Jones seconded the motion, which carried with the following vote: AYES: Thomas, Karr, Barnes, Jones NAYES: None ABSTAIN: None PUBLIC HEARING The variance requested by Media General, Inc. of Sections 30-87-2(D)2, 30-32-3(B)2, of the Roanoke County Zoning Ordinance thus reducing the side yard setback for a broadcast tower from the minimum setback distance of 25 feet to 3.8 feet. The purpose of this request is to subdivide a new parcel in the AG-3 zoning district causing a broadcast tower on the adjacent parcel to be closer than 25 feet to the proposed side property line in the 8100 block of Honeysuckle Road in the Windsor Hills Magisterial District. BOARD OF ZONING APPEALS MINUTES SEPTEMBER 16, 2009 Mr. Kenneth Campbell spoke regarding the petition. He explained the hardship would be if WVTF to remove the tower. He stated the tower would benefit the area by allowing them to expand their signal. He stated they are not in the business of subdividing property. Mr. Karr noted he is an adjoining property owner to this parcel. He expressed concern regarding several construction debris piles on the property. He encouraged the petitioner to dispose of the debris piles. Mr. Campbell stated they plan to take better care of the property in the future. Mr. Thomas asked about the type of debris on the property. Mr. Campbell noted he was not sure of the exact type of debris Mr. Karr was referencing. Mr. Karr and Mr. Obenshain discussed requiring disposal of the debris. Mr. Barnes made a motion to approve the variance request based on the on the findings: the property was acquired by the owner in good faith, that the property is narrow, shallow ridge and an unusual shape, a strict application of the zoning ordinance affect the use of the property, such hardship is not shared generally by other properties in the same zoning district and the same vicinity, the authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting the variance. AYES: Thomas, Karr, Barnes, Jones NAYES: None ABSTAIN: None COMMENTS Mr. Karr stated he would appreciate the removal of the extraneous material from the parcel.
