HomeMy WebLinkAbout5/17/2023 - Minutes _.9 + County of Roanoke BOARD OF ZONING APPEALS ROANOKE COUNTY BOARD OF ZONING APPEALS Wednesday, May 17, 2023 PUBLIC HEARING MINUTES BZA Members Present: Mr. Richard Jones, Chairman Mr. Eric Thomas, Vice-Chairman Mr. Jeffrey Armstrong Ms. Charlotte Moore BZA Members Absent: Mr. Robert Arthur Staff Present: Ms. Rebecca James, Secretary Mr. William Richardson, Alternate Secretary Ms. Mary Beth Nash, Senior Assistant County Attorney Mr. Lionel Cruz-Cruz Ms. Cecelia Thomas, Recording Secretary CALL TO ORDER Mr. Jones called the meeting to order at 6:59 p.m. APPROVAL OF AGENDA Ms. Moore made a motion to pass the agenda with suggested amendments which passed 4-0. ELECTION OF OFFICERS Mr. Thomas made a motion that Mr. Jones continues as chairman, which passed 4-0. Ms. Moore made a motion that Mr. Thomas continues as Vice-chairman which passed 4-0. Mr. Jones made a motion to approve staff members as is, which passed 4-0. APPROVAL OF THE BOARD OF ZONING APPEALS 2023 MEETING SCHEDULE Mr. Thomas made a motion to pass the 2023 meeting schedule, which passed 4-0. APPROVAL OF MINUTES Ms. Moore made a motion to pass the May 18, 2022 minutes, which passed 4-0. CONSENT AGENDA: JUNE 21, 2023 1. The petition for a variance requested by Brian Pomerville of Section 30-32-3(B) of the Roanoke County Zoning Ordinance to build a primary structure (house) behind the existing accessory structure (barn), located at 7889 Bradshaw Road Salem, VA 24153. The property is zoned AG3 Agricultural/Rural Preserve District and is located in the Catawba Magisterial District. BOARD OF ZONING APPEALS MINUTES MAY 17, 2023 PUBLIC HEARING 1. The petition for a variance requested by David Kahn of R-1, Section 30-41-3, of the Roanoke County Zoning Ordinance to reduce the side yard setback from 10 feet to 3 feet, located at 6191 Ran Lynn Drive, Roanoke, VA 24018. The property is zoned R1 Low Density Residential District and is located in the Windsor Hills Magisterial District. Mr. Khan presented his case for a variance, noting that his property is limited in size with many trees. To optimize the power of the solar panel system, he would need a variance to reduce the setback. Mr. Jones questioned if the array will behind the applicants house. Mr. Khan noted that most of the array will be behind the back edge of his house. Mr. Armstrong questioned the number of panels, which Mr. Khan noted that there will be approximately 20 panels. Mr. Khan noted that he has spoken with his neighbors, and they all approve of it. He also noted that he is planning on putting shrubs to make the panels look nicer. Ms. Charlotte Moore questioned the height above the grade, which Mr. Khan noted should be about 2 feet above the grade due to the slope. Mr. Jones opened the public hearing, and with no speakers closed the public hearing. Mr. Richardson provided a history of the case. Noting that Mr. Richardson and Mr. Khan met in the County offices. Mr. Richardson noted that during their conversations they noted that any solar collector on the parcel would be difficult due to the shape of the property. Mr. Richardson would note that according to Mr. Khan this would be the best place for solar collection on the property, and that the County understands his request for a variance. Mr. Jones noted that he does believe that this solar array is a good idea. He noted that he always likes to consider the neighbors. He noted that the originally approved location would serve to be more disagreeable for neighbors than the proposed location in the variance. Mr. Armstrong noted that he was impressed that it will be well hidden due to the slope. Ms. Moore made a motion to approve the variance, which passed 4-0. AYES: Moore, Thomas, Armstrong, Jones NAPES: None ASTAINS: None APPROVAL OF SCHEDULE Ms. Moore made a motion to approve the 2022 schedule for the Board of Zoning Appeals which passed 4-0. COMMENTS OF BOARD AND STAFF Ms. James noted that there will be a hearing June 21, 2023 for a variance application.
