APPROVAL OF MINUTES .: There was a motion:to.approve the July 17, 2024 minutes, which passed 3-0-2, with Mr. . . . Thomas and Mr. Pevarski.abstaining. • PUBLIC HEARING • 1. The petition.for a variance requested by Stephan Jones of Section 30-41-3(B)3: : of the Roanoke County.Zoning Ordinance to reduce rear:setback line of new subdivided lot, from 25 feet to 15 feet. The property is located at 3506 View Avenue, Tax map #: 077.14-04-59.00-0000, Roanoke, VA 240=18::The property:is: :: zoned R-1, Low Density Residential District, and is located in the Cave Spring Magisterial District: Marcy Jones, 3506 View Avenue, noted that her husband'would be here but was called away for work. She explained,that their goal:here. is to build "Marcy's dream home". She noted that they want to utilize their property the best-that they can. She noted that they: have lived in this area for sixteen years:and don't want to move outside of the area where they have built their lives. Their goal is•to maximize the.potential of their.property She noted that aesthetically it already looks like two pieces of property.The area that . they call the "bottom lot" is where they.wish to build::their.dream home:::Recently, her husband met with staff where they learned of their option for a variance due to_the topography and where the sewer main is located. She noted that they feel that they have exhausted their options, and this is their last hope. She noted that if they subdivide that lot, their current home meets setbacks. She noted that they have approached their neighbor about purchasing the wooded land behind their current home, and he was not interested in selling to them. It would just be the home they wish to build that would need a variance. She noted that they have spoken to Black Crow Sewer about rerouting the plumbing and sewer in their current home. They were assured that there are no issues. Her husband has also spoken with AEP about moving the power pole that exists on the land. She noted that they have lots of road frontage, and that can be utilized to build their dream home there. She noted that this will not be a detriment to the neighborhood and would only increase the value of the land. Mr. Richardson presented and noted that he spoke with Mr. Jones about the property. He noted that Mr. Jones has been very intentional about what he wishes to do with the property. He noted that Mr. Jones of his surroundings when it pertains to the variance request. Mr. Richardson noted that the topography does lend to developing on the lower area of the property. He also noted that the sewer easement does create challenges. Mr. Bill Richardson presented the staff report. He noted that the applicant was very methodical in his approach. Mr. Richardson reiterated the change in elevation and noted that this site has challenges due to the sewer easement. Mr. Jones opened the public hearing, and with no one wishing to speak, closed the public hearing. Ms. Moore questioned if the petitioner has considered building onto their existing property. Ms. Jones noted that they have built on to the existing home in 2020. Mr. Armstrong asked if they had investigated building a home that would fit the lot without the setback changes. Ms. Jones noted that Stephan had gone to the County to consider building a two-car garage in that area rather than the proposed:home. Mr. Pevarski questioned if the applicant has considered building the garage underneath the proposed home so they can still meet setback requirements. Ms. Jones noted that they have not considered that as they do not feel a three-story home would keep with the character of the neighborhood. Ms. Moore made a motion to deny the variance. The motion passed 3-2. AYES: Thomas, Moore, Jones NAYES: Armstrong, Pevarski ASTAINS: None Discussion of Board of Zoning Appeals 2025 Meeting Schedule Mr. Armstrong made a motion to approve the Board of Zoning Appeals 2025 Meeting Schedule and to change their public hearing meeting times to 6:00 p.m. The motion passed 5-0. Page 2 of 3 BOARD OF ZONING APPEALS MINUTES DECEMBER 18, 2024 Discussion of Board of Zoning Appeals Bylaws Ms. Lower presented the proposed updates to the Board of Zoning Appeals Bylaws. With recommended changes from the Board of Zoning Appeals, the bylaws were approved to be posted for thirty days before final approval at a later meeting. Comments of Board and Staff No comments.
