HomeMy WebLinkAbout3/19/2008 - MinutesROANOKE BOUNTY BOARD OF ZONING APPEALS- MINUTES OF PUBLIC HEARING MARCH 19, 2008 BZA Members Present: Mr. Richard Jones, Chairman Mr. Kevin Barnes Mr. Eric Thomas Mr. Carlton Wright Absent: Mr. Eldon Karr Staff Present: Mr. Christopher Patriarca, Alternate Secretary Mr. Joseph Obenshain, Senior Assistant County Attorney Mr. John Murphy Mr. Bill Richardson Ms. Nicole Gilkeson Ms. Becky Meador, Recording Secretary Mr. Jones called the meeting to order at 7:00 p.m. APPROVAL OF AGENDA Mr. Wright moved to approve the agenda, which carried unanimously. PUBLIC HEARING Mr. Theodore Arven, III of 1929 High Crest Court, presented his petition for two (2) separate variances. He requested a reduction of the side setback from ten (10) feet to seven (7) feet and a reduction in the rear setback from twenty -five (25) feet to sixteen and six - tenths (16.6) feet for the purpose of an addition to the primary structure. Mr. Arven explained the addition is needed for handicapped accessibility for his four (4) year old son, who is permanently in a wheelchair. He wishes to extend his garage five (5) feet to accommodate the wheelchair ramp on their van only. He wishes to keep the general look and use of the home as intended at purchase. Mr. Arven stated he could not build onto the other side of the home because the slope is too great for a wheelchair and it would block view of his neighbor's home. He also stated that the entire roof would be replaced to match. He noted that his neighbors are agreeable. He noted he was asking for only what was necessary. There were no other citizens that requested to appear before the board. Mr. Thomas requested the board vote on each variance separately. Mr. Wright moved to approve the rear yard variance based solely on his heart, which he requested be recorded. Mr. Thomas noted the unusual shape of the rear property line justified the variance. Mr. Patriarca called the roll and the motion passed 4 -0. AYES: Thomas, Jones, Wright, Barnes NAYES: None ABSTAIN: None ROANOKR COUNTY BZA MBETIN ...NUTBS MARCH 19, 2008 Mr. Wright asked Mr. Arven if there were any other way to accommodate the van ramp, possibly a one car garage. Mr. Arven stated he would like to keep the two (2) car garage as intended at purchase, noting he has other children. Mr. Barnes explained precedence and adhering to State Supreme Court rulings, then made motion to deny the request on the side yard variance based on there not being an extraordinary situation or condition affecting the property. Mr. Wright seconded the motion, which passed 3 -1. AYES: Jones, Wright, Barnes NAYES: Thomas ABSTAIN: None Mr. Patriarca explained to Mr. Arven about the thirty (30) day appeal process and instructed him not to obtain any building permits during that time period. APPROVAL OF MINUTES for January 16 2008 Mr. Wright made a motion to approve the minutes. Mr. Thomas seconded the motion, which carried with the following vote: AYES: Thomas, Jones, Wright, Barnes NAYES: None ABSTAIN: None COMMENTS Mr. Patriarca briefed the board of HomeTown Bank's petition for two (2) sign variances that will be heard at the upcoming May 21, 2008 Public Hearing.
