ROANOKE COUNTY BOARD OF ZONING APPEALS –MEETING MINUTES
PUBLIC HEARING –MARCH 16, 2005

Mr. Thomascalled the meeting to order at 7:00p.m.
APPROVAL OF AGENDA
Mr.Wrightmoved to approve the agenda. The motion was seconded by Mr.Joneswhich carried
unanimously.
PUBLIC HEARING PETITION
1.Variance requested by John David and Robin L. Campbell of Section 30-85-18(B)2. of
the Roanoke County Zoning Ordinance to reduce the minimum setback from 100 feet to
60 feet. The purpose of this request isto construct a commercial kennel at 7184 Newport
Road, Catawba Magisterial District.
Mr. John David Campbell and Mrs. Robin Campbell spoke regarding the petition. Mr.
Campbell stated they want to build the facility in the proposed location due to the
position of the existing well and septic, and in order to conceal it from view of
surrounding neighbors. Mr. Thomas inquired about the prospective use of silencers.
Mrs. Campbell stated it is not a shock collar but something which hangs on the kennel.
Mr. Wright asked if it was necessary for the kennel to be as large as currently proposed.
Mrs. Campbell explained she currently owns eleven dogs whichshe breeds. She
explained she wants the kennel large enough to be able to board other dogs. Mr. Wright
asked if the position of the kennel could be adjusted. Mr. Campbellexplained they are
trying to position the building around the right-of-way, a rock ledge,the current well,and
septic system. He stated a shorter building would not provide the spacethey need. Mr.
Thomas asked about the position of the kennel septic system. Mr. Campbell stated the
system would be located in front of the building. He stated he does not want to put the
septic tank where vehicles would be driving over it. Mr. Thomas inquired about the size
of the kennel. Mr. Campbell stated it would be an 18 ft. x 60 ft. cinderblock building
with a metal roof. Mr. Karr inquired about size of individual kennels. Mr. Campbell
stated the kennels would be 4 ft. x 6 ft. inside and 4 ft. x8 ft. outside. Mr. Wright
inquired about the location of the septicsystem. Mr. Campbell explained. Ms.
Campbell presented a septic layout approved by Mr. Dave Taylor, Roanoke County
Health Department. The BZAmembers reviewed the drawing. Mr. Jones inquired about
the septic drainfield. Mr. Campbellexplained the drainfield would be in front of the
building towards the road. He also explained there would be a fenced area so thedogs

could have an openplay area. Mr. Wright stated he was not convinced the petitioners
havetried to find a better way to fit the building intothe space. Mr. Campbell explained
the restrictions of the site. Mr. Wright stated it looks like enough room is available. Mr.
Campbell stated they are trying to keep the site secluded. He stated they cannot move the
building site downhill due to the rock ledge. Mr. Wright suggested decreasing the size
of kennel. Mr. Campbell explained they need all the space possible to take care of their
dogs and others which they plan to board. Mr. Wright stated there is land that cannot be
used. He explained if they deny the petition it would not be confiscation of the property
since it is currently being used for its intended purpose as a residential site. He stated he
wants specific guidelines submitted. Mr. Thomas asked if the petitioners had received
any negative feedback from neighbors. Mrs. Campbell stated she had called surrounding
neighbors to answer questions but no one complained.Mr. Beard stated he has received
several calls requesting more details on the proposed kennel. Mr. Wright asked if they
could make the kennel smaller. Mrs. Campbell statedshe has clients which would like
her to board their dogs. She stated she is planning for her retirement when she is unable
to groom dogs. Mr. Campbell stated the rock ledgeand well casing prevent them from
the moving the site. Mr. Jones suggested shifting the septic to the other side of the ridge.
He suggested the petitioners look at other options and provide the members with a
drawing to scale. Mr. Karr explained the importance of submittingdrawings which are to
scale. He suggested continuing the petition for one month in order for the petitioners to
acquire a scaled drawingand research other options. The petitioners agreed to continue
the petition for one month. Mr. Barnes also discussed the possibility of a property line
adjustment with adjacent property.
Mr. Karrmotioned to continue the requestto the April 20, 2005 BZA Public Hearing:

Mr. Karr moved to elect Mr. John Murphy to the position of Secretary to the BZA.

Mr. Jones moved to elect Mr. Tim Beard to the position of Alternate Secretary to the BZA.
