HomeMy WebLinkAbout8/18/2004 - Minutes ROANOKE COUNTY BOARD OF ZONING APPEALS –MEETING MINUTES PUBLIC HEARING –AUGUST 18, 2004 PRESENT: Mr. Eric Thomas, Chairman Mr. Richard Jones Mr. Carlton Wright Mr. Eldon Karr Mr. Kevin Barnes Mr. Joseph Obenshain, Senior Assistant County Attorney Mr. Timothy Beard, Secretary Ms. Susan Carter, Recording Secretary Mr. Eric Thomascalled the meeting to order at 7:00p.m. APPROVAL OF AGENDA Mr. Wrightmoved to approve the agenda. Mr.Karrseconded the motion, which carried unanimously. PUBLIC HEARING PETITION 1.Variance requested by Alfred and Patsy Saunders of Section 30-32-3(B)1.a of the Roanoke County Zoning Ordinance to reduce the minimum front yard setback from 41 feet to 32 feet. The purpose of this request is to construct a roofover the existing front patio located at 3530 Simsmore Avenue, Vinton Magisterial District. Mr. Alfred Saunders, 3530 Simsmore Avenue, stated he would like to put a cover back up over his patio. He stated the porch cover would improve the appearance of his home, allow him to special order vinyl porch structures, block the sunfrom the house, provide protection from sleet and snow, and would be in line with the driveway. He stated the structure would be same dimensions as the 8’ x 24’ patiowhich it wouldcover.He stated Mulch N’More will backfill the property as soon as the brick has been laid. He stated although he planned to have the project completed by this evening’s meeting, he could not do so due to a problem with the bricklayer.He presented an estimate for the brick work which needs to be done. He stated his new bricklayer is scheduled to begin work on the project Monday, August 23, 2004. Mr. Karr inquired about the status of the $5,000 bond which is being in escrow by the county.Mr. Beard indicated the bond remains in escrow. Mr. Karr asked when the bond would be released. Mr. Beard stated the bond would be released when all inspections have been completed and approved. Mr. Karr asked if the patio cover was the only issue to beaddressedduring this hearing. Mr. Beard indicatedthe legal ad for the petition addressed the setback variance to construct the patio coveronly.Mr. Karr expressed appreciation to the petitioner regarding the work which has been completed on the project. Mr. Karrmoved to grant the requested varianceto reduce the minimum front yard setback from 41 feet to 32 feet. Mr. Jones seconded the motion with the following vote: 1 AYES:Thomas, Karr, Barnes NAYS:Wright, Jones ABSENT:None APPROVAL OF MINUTES Mr. Jonesmoved to approve minutes of July 21, 2004as amended. Mr. Karrseconded the motion. COMMENTS Mr. Wright expressed concern regarding granting the Saunders’ variance.
