HomeMy WebLinkAbout6/19/2002 - MinutesROANOKE COUNTY BOARD OF ZONING APPEALS - MEETING MINUTES PUBLIC HEARING M JUNE 19, 2002 PRESENT: Mr. Richard .Tones, Chairman Mr. Carlton Wright Mr, Rodney McNeil Mr. Eldon Karr Mr. Eric Thomas Mr. Timothy Beard, Secretary Mr, .Tones called the meeting to order at 7:00 p-m. APPROVAL OF AGENDA Mr. Wright moved to approve the agenda. The motion was seconded by Mr. McNeil and carried unanimously. PUBLIC HEARING PETITION 1. Variance requested by First Baptist Church of Bent Mountain of ,Section 30- 34- 3(B)3.a of the Roanoke County Zoning Ordinance to reduce the rninimum rear yard from 25 feet to 2lfeet. The purpose of this request is to expand the existing principal structure located at 10056 Slings Gap Road, Windsor Hills Magisterial District. Roger Brown, 2875 Summit Ridge Road, introduced himself as the project builder representing the church. He stated that the church's goals are to have a permanent baptismal and to provide handicap accessible facilities at the rear of the building. Mr. Brown noted that he has received written statements of support for the addition frorn three of the adjoining property owners and that the surrounding landowner's generally back the proposal. Jinn. Woltz, an adjacent property owner, spoke in favor of the request, noting that the church is a cornerstone of the community, Reverend Wallace Brown, pastor of Bent Mountain Baptist Church, also spoke in support of the petition stating that the church's long range plans include having a community center within the building. Mx. McNeil asked Mr. Brown if an adjoining owner's driveway, which crosses a rear corner of the subject parcel, would interfere with the proposed constnrction. Mr, Brown replied that it would not and that this particular property owner has endorsed the project, Mr. Wright moved to approve the request due to exceptional topographic conditions that, under a strict application of the ordinance, unreasonably restrict the use of the property (Section 30- 24- 1(B)I.) He also stated that this hardship is not shared by other properties in the same vicinity, Mr. Thomas seconded the motion which carried with the following vote: AYES: .Tones, Wright, McNeil, Karr, Thomas NAYS: None ABSENT: None APPROVAL OF MINUTES Mr, Wright moved to approve the minutes of May 15, 2002, Mr. Thomas seconded the motion which carried unanimously., COMMENTS Staff updated Board members on the Saunders manufactured home case whose variance conditions by deed declaration were recorded in the Roanoke County Cleric's Office on Tune 17, The Saunders have until May 1, 2003 to relocate the structure on the property OR provide the Board of Zoning Appeals witha cash bond or letter of credit in the amount of $5,000 to secure performance of the following conditions: 1) If both Alfred and Patsy Saunders are absent from the property for a period exceeding six months, the structure shall be removed or relocated under the presumption that the parties no longer live in the structure; 2) All local permits shall be secured including Residential Construction Application and Certification of Setback Compliance, There being no further business, the meeting was adjourned at 7:12 p.m. Respectfully submitted, Timothy Beard, Planner Secretary to the Board of Zoning Appeals
