HomeMy WebLinkAbout4/18/2001 - Minutes ROANOKE COUNTY BOARD OF ZONING APPEALS –MEETING MINUTES PUBLIC HEARING –APRIL 18, 2001 PRESENT: Mr. Eldon Karr, Chairman Mr. Rodney McNeil Mr. Eric Thomas Mr. Richard Jones Mr. Carlton Wright Mr. Timothy Beard, Secretary Ms. Tammi Wood, Recording Secretary Mr. Karr called the meeting to order at 7:00pm. APPROVAL OF AGENDA Mr. Wright moved to approve the agenda. Mr. McNeil seconded the motion which carried unanimously. PUBLIC HEARING PETITION 1.Variance requested by Craw-Mart, Inc. of Section 30-36-3(B)1.a. of the Roanoke County Zoning Ordinance to reduce the front yard setback from 35 feet to 5 feet and from 35 feet to 0 feet for two separate structures located at 5944 Catawba Valley Drive, Catawba Magisterial District. The purposes of these requests are to construct a new convenience store and to allow the encroachment of and to enlarge an existing fuel pump island canopy, respectively. Mr. Glenn Edward Martin, 5463 Catawba Valley Drive, President of Craw-mart presented the petition. Mr. Martin stated that the purpose of the petition is that he must have variances to upgrade and construct his expanding business. The existing building was constructed in 1940, and the area growth dictates a larger building due to increased customertraffic. Mr. Wright questioned if there would be an additional pump added. Mr. Martin confirmed that there would be one more island added with two pumps as well as one additional underground tank. There will be no shifting due to the fill dirt in the area the tank will be placed. DEQ and EPA have been contacted and they have no problem with the addition of the tank. The building will be new construction, the area where the existing building is presently located will become the parking lot for the business. Mr. McNeil questioned when the existing canopy was constructed. Mr. Martin verified in January 2000. A contractor performed this construction, a variance was not applied for at that time. Mr. Beard verified that there was no existing variance on the property. Mr. Carlton Wright motioned to grant the requested variance due to the irregular shape of the property with the condition: The existing building will be torn down. Rodney McNeil seconded the variance. Mr. Carlton Wright then motioned to amend the variance with the following two conditions: 5 feet applies to the width of the new building only 0 feet applies to the width of the canopy only The motion was seconded by Mr. McNeil with the following vote: AYES:McNeil, Thomas, Jones, Wright, Karr NAYS:None ABSENT:None 2.Variance requested by Craw-Mart, Inc. of Section 30-91-5(B)1. of the Roanoke County Zoning Ordinance to reduce the distance between access points from 500 feet to 280 feet in order to maintain two existing entrances from an arterial highway located at 5944 Catawba Valley Drive, Catawba Magisterial District. Mr. Glenn Edward Martin, 5463 Catawba Valley Drive, President of Craw-mart presented the petition. Mr. Martin stated that the exiting entrances have been in place since 1968, since then 311 has been widened. He has owned the business since 1986 and the location of the entrances works well as they are. Mr. Martin stated that delivery trucks, tractor-trailers and customers use these entrances and there has been no accidents since he has owned the business. Mr. Rodney McNeil questioned whether VDOT has issued a commercial entrance. Mr. Martin stated that he was told to wait for the BZA ruling on the variance. Mr. Carlton Wright motioned to grant the requested variance to leave the entrances as they are. Mr. Eric Thomas seconded the motion, which carried with the following vote: AYES:McNeil, Thomas, Jones, Wright, Karr NAYS:None ABSENT:None APPROVAL OF MINUTES Mr. McNeil moved to approve the March 21, 2001 minutes. Mr. Jones seconded the motion, which carried with the following vote: AYES:McNeil, Thomas, Jones, Wright, Karr NAYS:None ABSENT:None There being no further business, the meeting was adjourned at 7:17pm.
