HomeMy WebLinkAbout6/20/2001 - Minutes ROANOKE COUNTY BOARD OF ZONING APPEALS –MEETING MINUTES PUBLIC HEARING –JUNE 20, 2001 PRESENT: Mr. Eldon Karr, Chairman Mr. Rodney McNeil Mr. Eric Thomas Mr. Richard Jones Mr. Carlton Wright Mr. Timothy Beard, Secretary Ms. Tammi Wood, Recording Secretary Mr. Eldon Karr called the meeting to order at 7:00pm. APPROVAL OF AGENDA Mr. Carlton Wright moved to approve the agenda. Mr. Eric Thomas seconded the motion, which carried unanimously. PUBLIC HEARING PETITION 1.Variance requested byTony D. and Teresa A. Spraker of Section 30-23-3(A)1. of the Roanoke County Zoning Ordinance to enlarge a nonconforming building and of Section 30-54- 3(B)3.a. of the Roanoke County Zoning Ordinance to reduce the rear yard setback from 15 feet to 3 feet located at 4410 Old Cave Spring Road, Windsor Hills Magisterial District. The purposes of these requests are to construct an addition to the existing dwelling and to attach a . deck to the rear of the dwelling, respectively Ms. Teresa Spraker, 4410 Old CaveSpring Road, Co-owner of the property presented the petition. Ms. Spraker stated that the purpose of the petition is that they want to add an addition and make improvements on the property. The uniqueness of the petition is that they own the original Cave Spring and the hardship is that the property is a “cabin” of 934 square feet, which is much too small. Ms. Spraker is requesting the addition to add an extra bedroom with a closet and a deck to the top of her existing home. Mr. Jones stated that due to the topography, there was not a lot of level area on the property to expand. Mr. Richard Jones motioned to grant the requested variance. Mr. Carlton Wright seconded the motion with the following vote: AYES:Thomas, Jones, Wright, McNeil, Karr NAYS:None ABSENT:None 2.Variance requested by Craw-mart, Inc. of Section 30-85-13(C)1. to increase square footage from 3,000 to 3,600 square feet of gross floor area located at 5944 Catawba Valley Drive, Catawba Magisterial District. The purpose of this request is to construct a new convenience store. Mr. Jones stated that he would not be participating in the petition due to a potential conflict of interest; therefore he would abstain from voting. 1 Mr. Glenn Edward Martin, 5463 Catawba Valley Drive, President of Craw-mart presented the petition. Mr. Martin stated that the purpose of the petition is that he was unaware of the square footage restriction ordinance prior to the April BZA meeting. Mr. Martin stated that due to the growth in the Catawba area, astore expansion to 3600 square feet would be required to supply the needs of the people in the area. The additional 600 square feet expansion to the store will provide additional service to the citizens and become more of a grocery store than a convenience store. The population statistics show a decrease in the area, which is due to residents of the Catawba Hospital relocating. These statistics were confirmed by the local Fire Department. Per Mr. Martin, Mr. Wright confirmed that nothing had changed onthe petition from the original petition two months ago. There are topography restrictions on this property. Mr. Eric Thomas asked if the store would be a convenience store with a small deli rather than a full service deli with meat cases. Mr. Martin stated that the proposal is for a convenience store with a small deli. Mr. Martin verified the size of the coolers occupying the square footage of the store, with an 18-door cooler proposed. Mr. Carlton Wright motioned to grant the requested variance. Mr.Rodney McNeil seconded the motion, which carried with the following vote: AYES:Thomas, Wright, McNeil, Karr ABSTAIN:Jones NAYS:None ABSENT:None APPROVAL OF MINUTES Mr. Wright moved to approve the May 16, 2001 minutes. Mr. Rodney McNeil seconded the motion, which carried with the following vote: AYES:McNeil, Thomas, Jones, Wright, Karr NAYS:None ABSENT:None There being no further business, the meeting was adjourned at 7:12 pm.
