HomeMy WebLinkAbout4/19/2000 - MinutesMINUTES OF A MEETING OF THE ROANOKE COUNTY BOARD OF ZONING APPEALS PUBLIC HEARING -APRIL 19, 2000 Present: Mr, Rodney McNeil, Chairman Mr. Richard Jones Mr. Eldon Karr Mr. Eric Thomas Mr. Tim Beard, Secretary Absent: Mr. Carlton Wright Mr. McNeil called the meeting to order at 7:00 p.m. Mr. Jones moved approval of the agenda. Mr. Thomas seconded the motion which carried unanimously. PUBLIC HEARING REQUESTS Variance requested by Robert E, Johnson of Section 30- 33- 3(B)2.a, of the Roanoke County Zoning Ordinance to reduce the required side yard setback from 20 feet to 10 feet. The purpose of this request is to construct a single family dwelling located adjacent to and west of 7620 t=ort Mason Drive, Cave Spring Magisterial District. Mr. Johnson began his presentation by saying that the home proposed in this request would be his personal residence. He stated that the 100 -foot wide well arcs indicated on the site plan affect his septic location in addition to his proposed house, The petitioner said that, other than a possible movement southeast along the west boundary, options are extremely limited for changing location of the proposed structure. Mr. Johnson noted that the adjoining property to the east has only a 10 -foot side yard ( this area was not tinder the 20 -foot side yard requirement at the time of construction on the adjoining site) and he assumed only a 10 -foot side yard would be sufficient on his lot. Responding to a variety of questions from Board members McNeil and Karr, the applicant acknowledged that building is permitted within the 100 -foot well arcs, that the septic field must be located as shown and that the Health Department instructed that the natural drainage swale on the east side of the parcel remain undisturbed. A septic tank for this tract has been installed. Other suggestions from the Board included shifting the building footprint south toward the temporary construction shed, east or northeast to accommodate setbacks; a redesign of the proposed house, a redesign of the driveway shortening distance to the septic field and/or entering the proposed house from its north instead of south end with a basement garage. Mr. Johnson noted that he must maintain 20 feet between the basement wall and septic field (per Health Department) and the private covenants of Fort Mason require a minimum of 1,500 square feet of liveable floor space which he is only roughly 700 square feet above with his existing design. The petitioner also stated that the location of the house adjoining the subject site on the east is such that moving his house footprint in this direction is illogical since the two homes would be in close visible proximity to each other. Messrs. Karr and Jones recommended looking at rotating the axis of the house footprint, adjusting the porch location slightly or narrowing and redesigning the house. Mr. McNeil asked if owners of adjoining property to the west had been approached regarding the potential of selling enough land to alleviate the setback situation. Mr, Johnson replied that he had not contacted those landowners. 2 Mr. Jones moved to deny the request based on insufficient hardship demonstrated by the applicant. Mr. Karr seconded the motion which carried with the following vote° AYES: Jones, Karr, McNeil, Thomas NAYS: None ABSENT: Wright B r_o of MuLutm Mr. .Jones moved to approve the minutes of March 15, 2000, Mr. Thomas seconded the motion which carried unanimously. Comments Staff distributed copies of the Board's record relative to building setback and, more specifically, corner lot setback variance requests acted on over the past five years. Following discussion of this material, staff was asked to research other corner lot setback ordinances for further Board study.
