HomeMy WebLinkAbout5/17/2000 - MinutesMINUTES OF A MEETING OF THE ROANOKE COUNTY BOARD OF ZONING APPEALS PUBLIC HEARING - MAY 17, 2000 Present: Mr. Rodney McNeil, Chairman Mr. Eldon Karr Mr. Eric Thomas Mr, Richard Jones Mr. Tim Beard, Secretary Absent: Mr. Carlton Wright Mr, McNeil called the meeting to order at 7:00 p.m. Mr. Jones moved approval of the agenda. Mr. Karr seconded the motion which carried unanimously. PUBLIC HEARING REQUESTS Variance requested by Cliff Carlton of Section 30- 33 -3(B) I.b. of the Roanoke County Zoning Ordinance to reduce the required front yard setback from 140 feet to 68 feet„ The purpose of this request is to construct a detached garage in front of the principal structure, located at 3646 Rutrough Road, Vinton Magisterial District, Mr. Carlton began his presentation by stating that his home was built on this property in 1985 and that he had wanted to add the proposed garage for many years, but was financially unable to do so, He explained that the proposed location (halfway between the house and Rutrough Road) would not harm views from any adjoining residences or reduce nearby property values taking the steep topography of the site into considration. The applicant noted that getting his vehicles under roof would enhance the neighborhood and that the Carlton family intends to reside onsite for a long time. Mr. Karr asked the petitioner if he had considered attaching the garage to the house to which Mr, Carlton said that he had explored this possibility, but that several oak trees along the rear and side border would be destroyed underscoring how important those particular' trees are. Mr. Tones noted that a breezeway connection from the west side of the house could alleviate the need fox' a variance from the front yard requirement. Mr. Karr moved to approve the request based on difficult site topography and the unusual triangular shape of the parcel which combine to create a hardship. Mr. Thomas seconded the motion which carried with the following vote: AYES: McNeil, Karr, Thomas NAYS: Tones 2. Variance requested by Daryl and Sonya David of Section 30- 41- 3(B)4. of the Roanoke County Zoning Ordinance to reduce the required front (corner) yard setback from 30 feet to 15 feet. The purpose of this request is to construct an attached garage located at 5505 Galloway Circle, Windsor Hills Magisterial District. Mr, & Mrs. David presented their request with Mr's. David noting that the family's recent move to Roanoke was accomplished quickly and that they were not aware of the 30 -foot minimum setback imposed on each street side of a corner lot. Referencing difficulties constructing any additional buildings in the back yard, Mr. David stated that the garage would only enhance the neighborhood. The applicants had also looked into moving their driveway to access Galloway Drive but gained only a few feet in terns of distance from the right-of-way. Mr. Karr asked if the petitioners planned to widen their existing driveway off Galloway Circle to which the Davids' replied that they would slightly. Driveway pavement at its intersection with the curb of Galloway Circle is not as wide as the double garage would be. The Board offered the applicants an opportunity to postpone further discussion and a vote on this matter until the next scheduled hearing due to the absence of one member. The Davids elected to have their request voted on without delay. Mr. Jones moved to deny the request based on lack of a legal hardship demonstrated by the petitioners. Mr. Karr seconded the motion which carried with the following vote: AYES: Karr, Jones NAYS: McNeil, Thomas ABSENT: Wright Approval of Minutes: Mr_ .Tones moved to approve the minutes of April 19, 2000, . Mr. Karr seconded the motion which carried unanimously. Corner Lot Setbacks: Per the Zoning Administrator's recommendation, The Board of Zoning Appeals directed staff to prepare a memorandum officially requesting the Planning Commission to consider amending the zoning ordinance relative to corner lot regulations, The specific ordinance reads "where a lot fronts on more than one street, front yard setbacks shall apply to all streets" and appears in AG -3, AGA, AR, AV, R -1, R -2, R -3, R -4, NC, C -1, C -2, I -1 and I -2 district requirements.
