HomeMy WebLinkAbout6/16/1999 - MinutesMINUTES OF A MEETING OF THE ROANOKE COUNTY BOARD OF ZONING APPEALS PUBLIC HEARING - JUNE 16, 1999 Present: Mr. Carlton Wright, Chairman Mr, Richard Jones Mr. Rodney McNeil Mr. Tim Beard, Secretary Absent: Mr. Herbert Snyder Mr. Eldon Karr Mr, Wright called the meeting to order at 7 p.m. Mr. McNeil moved approval of the agenda. Mr. Jones seconded the motion which carried unanimously., PUBLIC HEARING REQUESTS Variance requested by James D, Moore of Section 30- 41- 3(B)2.b of the Roanoke County Zoning Ordinance to reduce the required side yard setback from 10 feet to 5 feet. The purpose of this request is to construct a detached garage, located at 6533 Woodbrook Drive, Windsor Hills Magisterial District, Mr. Moore presented his request, beginning by noting the property's severe rear yard topographic conditions and how any building placed there would disrupt the existing septic system. He described the proposed structural footprint (24' square) and architecture (one story; brick and vinyl). The applicant stated that all adjoining property owners, to his knowledge, supported the request, particularly those immediately south of the subject site who would be the most impacted, In his justification for hardship, Mr. Moore stated that he would have changed the chronological order of projects on -site had he known of this ordinance requirement which would have altered the home's rear building line regarding a recently attached rear deck. Had this addition been constructed after the proposed garage, the garage could have been built in its preferred location without a variance (only a 3' side yard standard would have been in effect). Mr. Jones inquired as to the height of the finished rear wall of the proposed garage. Mr. Moore replied that the entire rear of the structure would be walled and that no exterior storage area would be available underneath portions of the garage floor. One neighbor spoke in opposition to the request based on his concern for a precedent being established and noting his desire for all neighborhood building restrictions to be maintained. Mr, Jones moved to approve the request due to severe topographic conditions and the lack of other viable locations for building onsite. Mr„ McNeil seconded the motion which passed with the following vote: AYES: Jones, Wright, McNeil NAYS: None ABSENT: Karr, Snyder 2. Variance requested by L. C. Peters of Section 30- 42- 3(A)3.a and 3.b of the Roanoke County Zoning Ordinance to reduce the minimum lot area from 7,200 square feet to 4,330 square feet and to 4,569 square feet, respectively, and to reduce the minimum lot frontage from 60 feet to 41.35 feet and to 43.65 feet, respectively, on a publicly owned and maintained street. The purpose of this request is to subdivide an existing parcel, located in the 5300 block of Century Drive, Hollins Magisterial District. 2 Ed Natt, attorney for the petitioner, presented this request describing the unusual history of the subject property dating back to rezoning in the middle- 1980's for residential construction. Mr.. Natt stated that the property conformed with all ordinances at that time and that, unlike several other properties developed by L. C. Peters nearby, the applicant maintained ownership of this site and inadvertently failed to officially record the platted, approved subdivision of the property in 3985. Mr. Natt believed this technically provides uniqueness compared to other lots developed by the petitioner. The attorney noted that the actual recording is not necessary until such time as property conveyance occurs., One citizen inquired about previous sales of the developed property. There have apparently been no other transactions involving this site. Mr. McNeil moved to approve the request. Mr. Jones seconded the motion which carried with the following vote: AYES: Jones, Wright, McNeil NAYS: None ABSENT: Karr, Snyder AP o val of Minut Mr. McNeil moved to approve the minutes of April 21, 1999.
