HomeMy WebLinkAbout1/17/2007 - AgendaROANOKE COUNTY BOARD OF ZONING APPEALS MEETING MINUTES PUBLIC HEARING —JANUARY 17, 2007 BZA Members Mr. Kevin Barnes, Chairman Present: Mr. Richard Jones Mr. Eric Thomas Mr. Eldon Karr Mr. Carlton Wright Staff Present: Mr. John Murphy, Secretary Ms. Amanda Komar Mr. Bill Richardson Mr. Josh Gibson Ms. Susan Carter, Recording Secretary Mr. Barnes called the meeting to order at 7:00 p.m. APPROVAL OF AGENDA Mr. Wright moved to approve the amended agenda. Mr. Thomas seconded the motion, which carried unanimously. PUBLIC HEARING PETITION 1. The petition of a variance requested by Charles Berkeley, III and Susan Schelenberg- Berkeley of Section 30- 34 -3(B)1 a of the Roanoke County Zoning Ordinance to reduce the minimum front setback for a principal structure from the required 30 feet to a proposed 21 feet. The purpose of this request is to construct an addition to an existing structure located at 5065 Catawba Valley Drive, Catawba Magisterial District. Mr. Charles Berkeley, III, explained he is requesting the variance because it would be difficult to construct the addition on the rear of the property due to its steep rocky slope. He stated most of the structure which would be in the setback would be a covered front porch. He stated he is attempting to have the lot line vacated by the state but the process takes approximately 1 8 -18 months in order to receive a resolution. He also stated the property is "V" shaped. Mr. Karr asked if the petitioner would continue to pursue having the lot line vacated even if the variance is granted. Mr. Berkeley affirmed he would continue to pursue the vacation of the lot line. Mr. Thomas asked if any neighbors had made any adverse comments about the request. Mr. Berkeley explained the distance his neighbors are from his home. Mr. Thomas inquired about the height of the structure. Mr. Berkeley explained the completed structure will be a single story home which will be approximately 18 -19 feet above grade. Mr. Wright made the motion to approve the variance. His motion was based on the findings that the property was acquired in good faith, the property is of an unusual shape and has exceptional topographic conditions consisting of a steep rocky slope, a strict application of the County's zoning ordinance would unreasonably restrict the use of the property by the owner, a strict application of the zoning ordinance would cause undue hardship to the property owner, such a hardship is not shared generally by other properties in the same zoning district and same vicinity, the authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting the variance. Mr. Jones seconded the motion, which carried with the following vote: AYES: Thomas, Wright, Jones, Karr, Barnes NAYS: None ABSTAIN: None ELECTION OF OFFICERS Mr. Thomas moved to nominate Mr. Barnes as 2007 BZA Chairman. Mr. Jones seconded the motion. AYES: Karr, Thomas, Jones, Wright NAYS: None ABSTAIN: Barnes 2 Mr. Karr moved to nominate Mr. Jones as 2007 BZA Vice Chairman. Mr. Thomas seconded the motion. AYES: Barnes, Karr, Thomas, Wright NAYS: None ABSTAIN: Jones APPROVAL OF MINUTES Mr. Jones moved to approve the November 15, 2006 minutes. Mr. Wright seconded the motion, which carried with the following vote: AYES: Thomas, Karr, Barnes, Jones, Wright NAYS: None ABSENT: None BZA 2006 ANNUAL REPORT AND 2007 PUBLIC HEARING CALENDAR Mr. Murphy gave an overview of the reports and calendar. Mr. Karr motioned that the reports and calendar be accepted into the County records. The motion passed unanimously.
