HomeMy WebLinkAbout8/15/2007 - AgendaROANOKE COUNTY BOARD OF ZONING APPEALS MEETING MINUTES PUBLIC HEARING — AUGUST 15, 2007 BZA Members Mr. Kevin Barnes, Chairman Present: Mr. Richard Jones Mr. Eldon Karr Mr. Eric Thomas BZA Member Mr. Carlton Wright Absent: Staff Present: Mr. John Murphy, Secretary Mr. Philip Thompson, Deputy Director of Planning Mr. Bill Richardson Ms. Becky Mahoney Mr. Chris Patriarica Ms. Susan Carter, Recording Secretary Mr. Barnes called the meeting to order at 7:00 p.m. APPROVAL OF AGENDA Mr. Karr moved to approve the agenda. Mr. Jones seconded the motion, which carried unanimously. PUBLIC HEARING PETITION 1, The petition of Sonnie L. Taylor for the request of a variance to Section 30- 34- 3(B)2a, Roanoke County Zoning Ordinance, in order to reduce the side setback for an attached carport from 15 feet to 5 feet, located at 10396 Ivy Ridge Road, Windsor Hills Magisterial District. Ms. Sonnie Taylor, 10396 Ivy Ridge Road, spoke regarding the request. She stated she would like to construct a double car carport on her property. She stated her request was due to the location of the septic system, size of property, and topography of the property. She expressed personal safety concerns during inclement weather. She provided photos of the property and concept drawings of the proposed garage. She stated the garage 1 would be an improvement to the property. Mr. Barnes inquired about comments from neighbors. Ms. Taylor stated there have not been any negative comments made regarding the request. Mr. Karr inquired about location of neighbor. Ms. Taylor provided photos showing her adjoining neighbor's property. Mr. Karr made the motion to approve the variance. His motion was based on the findings that the property was acquired in good faith, a strict application of the County's Zoning Ordinance would unreasonably restrict the use of the property by the owner, the property has exceptional topographic conditions consisting of a steep slope to the rear of property and existing septic system, such hardship is not shared generally by other properties in the same zoning district and the same vicinity, the authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting the variance. Mr. Jones seconded the motion, which carried with the following vote: AYES: Thomas, Wright, Jones, Barnes, Karr NAYS: None ABSTAIN: Wright APPROVAL OF MINUTES Mr. Jones moved to approve the June 20, 2007 minutes. Mr. Karr seconded the motion, which carried with the following vote: AYES: Thomas, Jones, Karr, Barnes NAYS: None ABSENT: Wright COMMENTS Mr. Karr requested more information regarding making a motion for approval. Mr. Obenshain discussed. Mr. Murphy stated the BZA meeting on September 19, 2007, has been cancelled. He discussed upcoming 1 St Floor Board Room renovations. He stated the BZA will conduct its hearings in the 4th Floor Training Room, Room 438, until renovations are completed. PJ- Mr. Murphy introduced Mr. Chris Patriarica, Planner. Mr. Murphy also provided an update on the McNeil Asphalt petition. He requested clarification from the BZA concerning the McNeil Asphalt petition continuance. The discussion was for a 120 day continuance. Mr. Murphy inquired as to whether the intent was to continue the petition until the October 17, 2007, regularly scheduled public hearing. The BZA members indicated that was in fact the intent. Mr. Murphy indicated that he would send a letter to Mr. Ed Natt, Esq. and the McNeils.
