HomeMy WebLinkAbout11/15/2006 - MinutesROANOKE COUNTY BOARD OF ZONING APPEALS MEETING MINUTES PUBLIC HEARING — NOVEMBER 15, 2006 BZA Members Mr. Kevin Barnes, Chairman Present: Mr. Richard Jones Mr. Eric Thomas Mr. Eldon Karr Mr. Carlton Wright Staff Present: Mr. John Murphy, Secretary Mr. Bill Richardson Ms. Susan Carter, Recording Secretary Mr. Kevin Barnes called the meeting to order at 7:00 p.m. APPROVAL OF AGENDA Mr. Jones moved to approve the agenda. Mr. Wright seconded the motion, which carried unanimously. PUBLIC HEARING PETITION 1. The petition of Aubrey D. Creasy for the request of a variance to Section 30- 41- 3(B)2a., Roanoke County Zoning Ordinance, in order to reduce the side setback for an attached carport from 10 feet to 7 feet, located at 5571 Capito Street, Hollins Magisterial District. Mr. Barnes, Chairman, recused himself due to a potential conflict of interest. Mr. Jones, Vice - Chairman, assumed the role of Chairman. Mr. Aubrey Creasy, 5571 Capito Street, spoke regarding the request. He explained the purpose of the request is to provide shelter for his wheelchair bound daughter -in -law while getting in and out of the vehicle. He discussed the plot plan and setbacks. Mr. Jones inquired if the plot plan is the exact request. Mr. Creasy affirmed the plan is the requested variance. He discussed the shape of the lot. Mr. Karr inquired about the type of wheelchair being used. Mr. Creasy stated his daughter -in -law's disease is 1 rapidly progressing. Mr. Karr inquired about how she will get into the house without getting wet. Mr. Creasy explained that there is an entrance door on the same side of the house. Mr. Thomas asked if any neighbors had offered negative responses to the request. Mr. Creasy stated he has not received any negative comments from neighbors. Mr. Thomas noted many of the surrounding homes have carports. Mr. Karr and Mr. Jones discussed the plot plan. Mr. Karr inquired about the requested size of the carport. Mr. Creasy explained the carport has been designed so residents can exit on either side of the vehicle. Mr. Thomas made a motion to approve the variance request based on the on the findings that the property is narrow and an unusual shape, such hardship is not shared generally by other properties in the same zoning district and the same vicinity, the authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting the variance. Mr. Karr seconded the motion with the following vote: AYES: Thomas, Jones, Karr NAYS: Wright ABSTAIN: Barnes Mr. Jones excused himself as Chairman and Mr. Barnes reassumed the position of Chairman. APPROVAL OF MINUTES Mr. Jones moved to approve the September 20, 2006 minutes as amended. Mr. Thomas seconded the motion, which carried with the following vote: AYES: Thomas, Karr, Barnes, Jones, Wright NAYS: None ABSENT: None COMMENTS There were none.
