PUBLIC HEARING—FEBRUARY 19, 2003

Mr. Richard Jones called the meeting to order at 7:00pm.
APPROVAL OF AGENDA
Mr. Wright moved to approve the agenda. Mr. Thomas seconded the motion, which carried
unanimously.
PUBLIC HEARING PETITION
1. Variance requested by John W. Bircichead of Section 30-41-3(B)4 of the Roanoke
County Zoning Ordinance to reduce the minimum front yard(coiner) setback from 30
feet to 15 feet. The purpose of this request is to construct a residence located northwest
of the intersection of Andrew Avenue and McDaniel Drive, Catawba Magisterial District.
Mr. John W. Birckhead introduced the owner of the property,Virginia Farrow, and his
business partner,Rob Rigatti. Mr. Birckhead gave a history of the property stating when
Mrs. Farrow and her husband purchased the property,it did not have the current setback
restrictions. He explained area photos illustrating other houses built in the area in the
1950's which are very close to the property lines. He stated an attractive house on this
corner would enhance the neighborhood. Mr. Wright asked Mr. Birckhead for
confirmation of his purchase of the property from Mrs. Farrow. Mr. Birckhead stated he
and Mr. Rigatti have a contract on the property subject to the approval of the variance
and septic approval. Mr. Wright asked if Mr. Birckhead if he had a design plan of the
house he plans to build. Mr. Birckhead stated they do not have a design plan. Mr.
Rigatti then stated they plan to build a one-story brick home keeping with the current
style of homes in the neighborhood.
Mr. Neil Conner, 1124 Fisher Avenue, Salem,VA, who is employed by MKB Realtors,
stated he may have come to the meeting under misunderstood terms. He stated it was his
understanding the setback variance was to reduce the minimal building line from 30 feet
to 15 feet. He requested clarification of the proposed variance. Mr. Jones explained the
setback reduction would be 15 feet on McDaniel Drive, After a brief discussion,he
stated the setback would not be detrimental to his clients,Mr. James Collins and Ms.

Cynthia Wheeler Collins,provided the setback between his clients'home and the
petitioner's property remains the same. Mr. Collins stated he had no additional
comments.
Mr. Wright made the motion to grant the variance due to the shallowness and unusual
shape of the corner lots and the restrictive nature of having to abide by two setbacks. He
stated a strict ordinance application would unreasonably restrict use of the property. He
made this motion with one condition:
1. The driveway entrance will be on the west side of the lot facing Andrew Avenue
pending concurrence from VDOT.
Mr. Beard stated he would speak with VDOT regarding their concurrence with the
condition.
Mr. Thomas seconded the motion with the following vote:
AYES: Wright, Jones, Thomas

Mr. Wright moved to approve the BZA Calendar,
Mr. Thomas seconded the motion.

Mr. Thomas moved to appoint Mr. Karr as 2003 BZA Chairman.
Mr. Wright seconded the motion.
AYES: Wright, Jones, Thomas
NAYS: None
ABSENT: Karr,McNeil
Mr. Wright moved to appoint Mr. McNeil as 2003 BZA Vice Chairman.
Mr. Thomas seconded the motion.
AYES: Wright, Jones, Thomas

Mr. Wright moved to appoint Mr. Tim Beard as 2003 BZA Secretary.

Mr. Wright moved to appoint Ms. Janet Scheid and Mr. David Holladay as 2003 BZA Alternate
Secretaries.

Mr. Thomas moved to approve minutes of October 16 , 2002.
Mr. Wright seconded the motion.

BZA 2002 ANNUAL REPORT
Mr. Beard gave an overview of the report.
COMMENTS
Mr. Wright remarked 2002 had been a very good year.
There being no farther business, the meeting was adjourned at 7:17 p.m.
