PUBLIC HEARING - SEPTEMBER 20, 2000

Mr. Karr called the meeting to order at 7:00 p.m. Mr. Jones moved approval of the agenda.
Mr. Wright seconded the motion which carried unanimously.
PUBLIC HEARING REQUESTS
1. Variance requested by Douglas and Linda Graybill and Patricia Zimmerman of Sections
30-41-3(A)l.a and 30-41-3(A)l.b of the Roanoke County Zoning Ordinance to allow an
existing nonconforming tract to be reduced from 0.58 acre to 0.373 acre and to create a
1.207 acre tract with 25.22 feet of public road frontage from an adjoining nonconforming
1.0 acre parcel, located at 1624 and 1618 Read Mountain Road, respectively, Hollins
Magisterial District. The purpose of this request is to provide public road frontage to
one nonconforming tract.
Mr. Graybill presented the petition stating that he would like to have his and his wife's
existing south boundary adjusted to fit the driveway contour which crosses both subject
parcels in order to"clean up and separate the two properties." Mr. Thomas stated that, to
his knowledge, the 22-foot wide ingress/egress easement contained in the Graybill deed
will be in effect at the time of sale of either of the subject tracts and will carry over in
each subsequent sale. Mr. Jones asked the applicant if he had considered adjusting the
easement location (which can be handled privately)rather than resubdividing property?
Mr. Graybill replied that he had not considered this option. Mr. Karr suggested adding
language to the deed ensuring usage of the driveway for the lot adjoining Read Mountain
Road. Mike Laffoon, immediate neighbor to the west of the subjects tracts, noted survey
work onsite which had crossed his east side line incorrectly and requested that, should a
vote to approve be forthcoming, a corrected survey be required. Mr. Graybill distributed
another version of altering property lines which was reviewed by the Board.
Mr. Jones moved to deny the request based on lack of a legal hardship. Mr. Wright
seconded the motion which carried with the following vote:
AYES: Jones, Wright, Karr, Thomas
NAYS: None
ABSENT: McNeil
Approval of Minutes:
Mr. Wright moved to approve the minutes of August 16, 2000. Mr. Thomas seconded the
motion which carried unanimously.
There being no further business, the meeting was adjourned at 7:45 p.m.
