HomeMy WebLinkAbout3/21/2001 - Minutes ROANOKE COUNTY BOARD OF ZONING APPEALS -MEETING MINUTES PUBLIC HEARING -MARCH 21, 2001 Present: Mr. Eldon Karr, Chairman Mr. Rodney McNeil Mr. Eric Thomas Mr. Richard Jones Mr. Timothy Beard, Secretary Absent: Mr. Carlton Wright Mr. Karr called the meeting to order at 7:00 p.m. Mr. Jones moved approval of the agenda. Mr. McNeil seconded the motion which carried unanimously. PUBLIC HEARING PETITION 1. Variance requested by Keith & Marjorie Wright of Section 30-32-3(A)l.c. of the Roanoke County Zoning Ordinance to increase the maximum width-to-depth ratio from 1 to 5 to 1 to 15 on property located adjacent to 8981 Newport Road and of Section 30- 100-4(B) of the Roanoke County Zoning Ordinance of the Roanoke County Zoning Ordinance to create an irregular lot 500 feet east of 8981 Newport Road, Catawba Magisterial District. The purposes of these requests are to create two lots from an existing 101.543 acre tract and to create one irregular lot from the two proposed parcels, respectively. Mr. Wright presented the petition beginning with the history of the All (Mrs. Wright's family)property inheritance intended for 11 children originally. After much negotiating amongst heirs, three separate interests remained. The applicant then brought the proposed plat attached to this petition to county staff for review. The subdivision agent could not approve the resubdivision under family exemption provisions since the County Attorney's office had ruled that the three parties with remaining undivided shares in the property transfer did not meet state code requirements. Responding to Mr. McNeil, the petitioner stated that all remaining heirs are in agreement with the proposed plat as presented. Mr. Karr asked Mr. Wright to clarify the interior property line shown on the plat northwest of the "frame dwelling". That boundary could not remain without creating a landlocked parcel immediately above it("remaining 45.084 acres"). Mr. Wright explained that this line should not be on the plat and is not part of the request. Reginald All (one of the other two interests along with his wife) and John Brozofsky, a neighboring property owner, voiced their support for the petition. Mr. Jones moved to approve the petition noting the site's topography with the following conditions: 1) that this subdivision be created according to the proposed plat submitted with this request prepared by John D. Abbott dated 4/3/2000 with the removal of property line bearing South 47 degrees, 12 minutes, 33 seconds West currently shown 500 feet northwest of the existing frame dwelling; and 2) that no additional subdivision of these properties shall occur. Mr. McNeil seconded the motion which carried with the following vote: AYES:McNeil, Karr, Thomas, Jones NAYS: None ABSENT: Wright Approval of Minutes: Mr. McNeil moved to approve the minutes of February 21, 2001. Mr. Jones seconded the motion which carried unanimously.
