Richard Jones Carlton Wright Rodney McNeil Eric Thomas Timothy Beard, Secretary �I Chairman Karr called the meeting to order at 4:50 p.m. Approval of A enda Mr. Wright moved to approve the agenda. Mr.McNeil seconded the motion which carried. unanimously. Approval.of Minutes Mr. McNeil moved to.approve the minutes of June 20, 2001. Mr. Wright seconded the motion which carried unanimously. j Janua - June 2001 Case Summa All board members commented on the hardship level involved with virtually all cases heard this year with the exception of Craw-Mart, Ine.'s request to exceed the maximum building area of its proposed new convenience store. The issue of corner lot construction, the related ordinance and the inequities involved as opposed to interior lots was again discussed. Vehicle parking on such j lots was also discussed in general. I Adjournment for Site Viewing The afternoon session was adjourned at 5:18 p.m. for site viewing. ' I 3 3. jt y 1 ROANOYE COUNTY BOARD OF ZONING APPEALS-MEETING MINUTES PUBLIC HEARING-•JULY 18, 2001 PRESENT: Mr. Eldon Karr, Chairman Mr. Rodney McNeil Mr. Eric Thomas Mr. Richard Jones i Mr. Carlton Wright Mr. Timothy Beard, Secretary Ms. Tammi Wood,Recording Secretary i ( Mr. Eldon Karr called the meeting to order at 7:00pm. j APPROVAL OF AGENDA i Mr. Carlton Wright moved to approve the agenda. Mr. Rodney McNeil seconded the motion, which carried unanimously. I PUBLIC REARING PETITION 1. ` Variance requested by Donald E. and Cheri A. Johnson of Section 3091-2(A)1, of the Roanoke County Zoning Ordinance to allow the parking of a boat in front of the front building j line located at 2239 Pommel Drive , Windsor Hills Magisterial District. The purpose of this request is to permit boat-parking in a corner lot side yard facing the side street.(Stoneybrook Drive). Mr. Donald E. Johnson, 2239 Pommel Drive, owner of the property presented the petition. Mr. a, Johnson stated that the Planning Commission passed the original ordinance after he was already living in the property. He stated that his yard is presently fenced in with extensive landscaping throughout and includes a dog fence. He added that it would be a hardship on himself to tear up the existing landscaping and fencing to park his boat by the corner lot ordinance standards. In the past he was told by Roanoke County that he could park the boat behind the back building line, then was told that it was not permissible. He then parked the boat where it is now. Mr. Johnson cannot park his boat in the garage because the garage is 4 inches too narrow for the width of the boat. Mr. Johnson uses the boat three to four time per week. } Mr. Rodney McNeil questioned if the driveway could be extended into the backyard under the tree. Mr. Johnson stated that he doesn't know how to do that because he may have to remove all or part of a tree and parking would then be very difficult. Mrs. Cheri A. Johnson, 2239 Pommel Drive, co-owner of the property then stated that backing a car out of the driveway onto Stoneybrook Drive was very dangerous. She stated that it would be even more dangerous to try to maneuver a truck and boat with trailer into the suggested tight parking space from Stoneybrook Drive. Two citizens spoke. Mr. Joe Piccard, 5460 Stoneybrook Drive, owner of property across from the petitioner addressed the board. He stated that he had no problem with parking the boat on Mr. Johnson's property for a temporary basis, but was against parking the boat there permanently due to the i 2 3 � possible"domino effect" of granted variances. He was also concerned that permitting the variance would affect the appearance and property value of the neighborhood. Mr. Paul Fleming, 5733 Castlerock Road, 'a resident since 1966 stated that he thought that the ordinance was a good one but that he was also concerned about debris,branches, etc, in the area. Mr. Carlton Wright stated that he was concerned that not all possibilities have been considered such as removing some landscaping to move the parking space to the required area. Mr. Wright stated that the ordinance specifies that a hardship due to financial reasons is prohibited. Mr. Carlton Wright motioned to deny the requested variance. Mr. Richard Jones seconded the motion with the following vote: AYES: Jones, Wright, McNeil,Karr, Thomas NAYS: None ABSENT: None { 1 COMMENTS Mr. Scott Johnson, son of Mr. Donald Johnson stated that backing the boat into the parking space q was not a feasible request nor was the amount of money($10,000)that is estimated would be required to make the renovations to the back yard-area for the parking. He also stated that backing the boat into the parking space from the street was a safety issue for the neighborhood. Mr. Eldon Karr thanked Mr. Scott Johnson for his comments. Mr. Karr then proceeded to explain that ordinances are in place to be fair to everyone and he also explained the procedures of granting variances.
