Mr, Thompson provided a brief overview of the history of the A. B, Hammond petition.
He stated the petitioner wants the property for agricultural land use,

Public Hearing
I , The petition of South Peak Residences LL C, et al to rezone 11.41 t acres from
R-3, Me&um Density Multi-Family Residential District, and C- 2C, General
Commercial District, with conditions, to R- 4C, High Density MUlti-Farnfly
Residential District, with conditions, identified as Area "A" on the Concept
Development Plain for 176 multi-family residential units", and to rezone 11.940
acres frorn R-3, Medium Density Multi-Family Residential District, to R,-
Medium Density Multi-Famlly Residential District, with condition ' s, identified as
Area B" on the Concept Development Plan with a proffered density limit of 2
single family residential units, involving several properties (07'7.20-01-48-01-000
and 077.20-01-50.00-0000; and portions of 077.20-01-52.00-0000 and 087,08-
01 - 11.00 - 0000) located at 4240 Elm View Road, 4,252 Elm View Road, and 4486
Summit Street, Cave Spring Magisterial District.
Mr. Murphy presented' the staff report,, including a review of the proposed
proffered conditions and a brief history of the petition. He reviewed the proposed
concept pion, including density, access, and stoirmwater concerns which were
expressed by citizens at the ccimirnUrrity meeting. He discussed buffering plans,
noting the petitioner plans to minimally disturb the surrounding wooded area. He
also stated the proposed pedestdan access to Area A is consistent with the
Comprehensive Plan,
Ms. Hooker noted sidewalks end trails are riot defined on the concept plan, Mr,
Murphy stated although sidewalks were not initially included in the concept plan
for Area A, the plan was later modified to include there, He stated that Area B
will include sidewalks or walking trails along one side of the streets,
Mr. Marrano inquired about the location of 'the trails,, Mr. Murphy discussed this
issue, noting the importance of connectivity of the development areas. He
discussed the area which is not included as part of the current petition,
Mr, Jarrell inquired about the higher density request. Mr, Murphy discussed this
issue, in , 0111.4ing the by-right density and height restriction of the proposed
building.
Ms. Maryel'Ien Gooclatte, Esquire, stated the petition applies to the resident , ially
zoned area only,, She discussed the acreage of the valriOLIS, parcels included in
the petition, noting some of the parcels adjoin commercial properties. She stated
the petitioner believes South Peak should be less dense and similar in style to
the Hunting Hills area, She reviewed the proposed concept plan, noting the
reducboni of density , from Area B to Area A, is needed by South Peak in order to
enhance the area. She discussed the amenities such as undergrOUnd parking
and an observation area, . She stated better placement of the condominiums

would create no impact to the previous traffic impact analysis. She stated the
facades of the buildings will be built in the arts and crafts design style. She
stated Area B is mostly wooded and they plan to disturb as few trees as possible.
Ms. Goodlatte then discussed drainage issues, noting the proposed development
should improve existing Quail Ridge stormwater runoff issues. She introduced
Mr. Tom Austin, Civil Engineer, who concurred with Ms. Goodlatte. She stated
the petitioner will develop the roadway network to enhance connectivity. She
introduced Mr. Gene Whitesell and Mr. Will Holmes who are also working on the
project.
Mr. Gene Marrano inquired about height restrictions of the structures. Ms.
Goodlatte explained this issue, noting the final range will be approximately 1362
feet at the same grade with the finished floor grade. She reiterated the
proposed proffered conditions of this petition do not apply to Area B. She
reviewed the topographical issues of the site. Mr. Marrano inquired about the
observation area. Mr. Whitesell and Mr. Holmes discussed this issue. Ms.
Goodlatte stated there is a 60 foot limit on the structure height. Mr. Marrano
inquired about exterior colors of the development. Ms. Goodlatte reviewed the
proffers and discussed this issue. Ms. Hooker was agreeable with shifting the
density and the additional buffering. She stated that she appreciates the
consideration being given to pedestrian traffic. Mr. Marrano inquired about
stormwater management. Ms. Goodlatte noted Quail Ridge should benefit from
the proposed development regarding their current stormwater issues. Mr. Peters
inquired about the finished floor height. Ms. Goodlatte discussed this issue. Mr.
Jarrell inquired about installation of sprinkler systems. Mr. Holmes stated the
development will have a sprinkling system. Mr. Radford inquired about the
development of a homeowners' association (HOA) or property owners'
association (POA). Mr. Whitesell noted that covenants for the condominiums will
be developed. Ms. Goodlatte stated she is unsure if the development will be
large enough for the organization of a POA at this time. Mr. Radford suggested
constructing sidewalks on both sides of street. Mr. Marrano concurred. Ms.
Goodlatte stated the petitioner is listening to suggestions and also trying to
lessen the impact to the area. Mr. Peters and Mr. Jarrell inquired about the use
of the Roanoke County Design Guideline Standards. Mr. Murphy discussed this
issue, noting that these standards address sidewalks which are required to be on
only one side of the private road. Mr. Radford inquired about preventing
problems with the sidewalk and trails. Mr. Murphy discussed bonding
requirements. Mr. Thompson stated the suggested proffers #5 and #8 refer to
the standards and can be added to the petitioner's proffered conditions.
Mr. Radford opened the public hearing for public comment.
With no citizens requesting to speak, Mr. Radford closed the public hearing.
Mr. Peters and the Commissioners agreed they are pleased to see progress on
the site.

Mr. Marrano made a motion to recommend approval of the rezoning with the
following proffered conditions with proffers 5 and 8 being amended as folllows:

With respect to the property described on the attached Exhibit A (the Area
A tract):
Area A will be developed in substantial conformity with the Concept
Development Plan made by Mattern & Craig dated June 14, 2012,
subject to such changes as may be required by Roanoke County during
comprehensive site plan review.
2. The height of any building in Area A shall not exceed sixty (60) feet (as
measured by the Roanoke County Zoning Ordinance).

3. All facades and finishes of buildings in Area A shall be of similar design

5. All residential buildings in Area A shall be connected by sidewalks.
Sidewalks shall be constructed in accordance with Roanoke County
design standards.
With respect to the property described on the attached Exhibit B (the Area B
tract):
6. Area B shall be developed only for single-family dwellings.
7. Area B shall be subdivided such that no more than twenty-three (23)
single-family dwellings shall be constructed thereon.
8. A sidewalk or walking trail, constructed in accordance with Roanoke
County standards, shall be installed along one side of the streets to be
developed in Area B.
9. A row of evergreen trees shall be installed along the southern boundary
of Area B which adjoins tax map parcels 87.08-06-16.00 through 87.08-
06 -28.00 inclusive, planted twenty (20') feet on center.

Final Orders,
1. The petition Of'BlUe Ridge Bread, Inc. (Panera) to obtain a Special Use Permit iin
a C-2, General Commerciaf District for the operation of a drive-in and fast food
restaurant on 1.02 acres located at 4202 Electric Road, Cave Spring Magisterial
District was approved by the Board of Supervisors at a Plublic Hearing on June
26, 2012.
