SLIsan Carter, Recording Secretary Work Session: Mr. Radford called the work ses,sion to order at 4 p,m. Agproval of Agenda Mr. Marrano made a motion to approve the agenda, which passed 3-0, Approval of Minutes Mr., Peters made a motion to approve the min utes of JWy 3, 20 12, which passed 4-0. Approval of GonsenjAgenda Thiere were no petitions for the consent agenda. Commissioner and Staff Comm2nts Mr. Thompson informed the comrni Iion Ms, Hooker was absent due to a, death in her family Mr. Marriano inquired about the invocation regulations. Ms, Kulhnel discussed the status of this issue. Mr. Thompson discussed the change in which payrcIl receipts, will be rece[ved beginning in September. Wth no further comments, Mir. Radford adjourned the wo session at 4:09 p.m. for site viewing. Page 11 of 6 ROANOKE COUNTY PLANNING COMMISSION MINUTES AUGUST 7, 2012 EVENING SESSION Mr. Radford called the Public Hearing to order at 7:02 p.m. Mr. Peters gave the invocation and led the pledge of allegiance. 1. The petition of A. B. Hammond to rezone approximately 47.7 acres from EP, Explore Park, District to AG-3, Agricultural/Rural Preserve, District, located off Hammond Drive, Vinton Magisterial District, Mr. Thompson presented a brief history of the property, noting the property is being purchased by the petitioner from the Virginia Recreational Facilities Authority (VRFA), He discussed the zoning, the current land use, and the previous development intent of the property. Mr. Jarrell inquired about the change of land use. Mr. A. B. Hammond discussed his plans to put a conservation easement over the entire farm involving this property and several other properties totaling approximately 300 acres, Mr. Marrano inquired about public use. Mr. Hammond stated they may have weddings, picnics, and, allow community use of river. Mr. Radford opened the public hearing for public comment. With no citizens requesting to speak, Mr. Radford closed the public hearing. Mr. Peters made a motion to recommend approval of the rezoning, Mr. Thompson called the roll and the motion passed (4-0) with the following vote: AYES: Jarrell, Marrano, Peters, Radford NAYES: None ABSTAIN: None 2. The petition of Christ the King Presbyterian Church to amend the proffered conditions on approximately 4.70 acres zoned C -1 C, Commercial, District with conditions, and to obtain a special use permit for religious assembly, located in the 2400 block of Electric Road (Route 419) and near the intersection of Stoneybrook Drive and Bridle Lane, Windsor Hills Magisterial District. Ms. Pattisall presented the staff report, providing a brief history of the proffers made by previous petitioner Cherney Enterprises. She explained the existing house would be used as a church office. She discussed the current land use and zoning, including the zoning of the surrounding properties. Ms. Goodlatte explained that since Cherney Enterprises never matured, the church was allowed to purchase the property. She reviewed the concept plan, noting that no exterior modifications will be made to the house which will accommodate two to three church employees. She stated during Phase 1 access to the property will be made via Bridle Lane. She stated during Phase 2 and Phase 3 the main building, playground, and parking area will be constructed Page 2 of 6 ROANOKE COUNTY PLANNING COMMISSION MINUTES AUGUST 7, 2012 at which time access will be established from Electric Road. She stated after Phase 4 approximately 450 people will be able to be accommodated for services. Ms. Goodlatte discussed citizen concerns expressed at the Community Meeting, which included using Bridle Lane to access property. She stated Bridle Lane will be used only as a secondary access. She stated the Fire & Rescue Department was not comfortable placing a gate restricting access to and from the property. She introduced church representative, Mr. Justin Davies and Mr. Rodney Pierson, Pierson Engineering and Surveying. Mr. Radford inquired about the timetable for development of the property. Ms. Goodlatte stated Phase 1 would begin immediately with interior changes being made to the house in order to create the church office. She stated Phase 2, which would include parking and playground, will begin in approximately 1-2 years as funding is available. She stated Phases 3 and 4, which would include the dedication of the sanctuary, are difficult to give a timeline at this time. Mr. Jarrell inquired about lighting possibly disturbing neighbors, Ms. Pattisall stated a photometric plan will be required during the site plan review process, Mr. Marrano inquired about buffering of the property. Ms. Goodlatte noted a 30- foot buffer would be established where the property adjoins the homeowners on Bridle Lane, Mr. Radford noted the Roanoke County Design Handbook establishes requirements for buffering. Mr. Radford opened the public hearing for public comment, Ms. Audra Whitlow, 5116 Stoneybrook Drive, stated she owns the property on the corner of Bridle Lane. She expressed concern regarding major construction and the safety of the residents in the area. She stated this area previously was used as the main thoroughfare especially during construction by the Western Virginia Water Authority (WVWA). She expressed concern about traffic and safety issues in the neighborhood. Ms. Joy Taylor, 5206 Stoneybrook Drive, stated she lives on the opposite side of the street from the proposed development. She stated Bridle Lane is not a road but an access which was used when WVWA replace pipes in the area. She stated roads were damaged by construction equipment during the process. She stated she has no issue with the development of the church, only the long term traffic and safety issues. She suggested providing fencing near her property to prevent parishioners from parking on her property. With no other citizens requesting to speak, Mr. Radford closed the public hearing. Ms. Goodlatte discussed the traffic concerns, noting a traffic impact analysis would be required for submission by the petitioner and approved by VDOT prior to access construction. She noted impacts to traffic would be minimal due to the peak hours of operation of the church. She stated during Phase 2 the site plan notes the parking would be in the back of the property where the 30-foot buffer would be placed. Ms. Goodlatte discussed this issue, noting difficulty of emergency vehicles accessing property. She stated gating the property could possibly be considered later. She discussed a possible traffic plan from Electric Road. Mr. Radford inquired about Bridle Lane. Ms. Goodlatte stated Bridle Lane is a state road but not currently state maintained. She stated the church would be required to pave Bridle Lane. The Commissioners discussed safety issues of the entrances and property access during various phases of the construction process. Ms. Goodlatte discussed the difficulty of a large truck being required to make "U" turn from Route 419. Mr. Marrano inquired when Bridle Lane would be paved. Ms. Goodlatte stated it would be paved after Phase 2. Mr. Marrano inquired about VDOT's current assessment. Ms. Goodlatte discussed this issue. The Commissioners discussed noise issues. Mr. Radford made a motion to recommend approval of the special use permit and to amend the proffer conditions as listed below: The properties will be developed in substantial conformity with the concept plan dated May 31, 2012 titled "Master Site Plan Christ the King Presbyterian Church, Roanoke, Virginia", prepared by WKWW Architects, subject to those changes which may be required by Roanoke County during comprehensive site plan review. 2. Exterior finish materials for all buildings constructed on the properties shall be limited to the following: brick; wood, vinyl or composite wood substitute lap siding and trim; glass; stucco or exterior insulated finish system (EIFS); stone face colored concrete block; stone or cast stone; standing seam metal, copper, composite slate tile or asphalt shingle roof. 3. All parking lot lighting shall be shielded "cut-off' types no more than eighteen (18) feet high and arranged so glare is not cast onto adjoining properties. Mr. Thompson called the roll and the motion passed (4-0) with the following vote: AYES: Jarrell, Marrano, Peters, Radford NAYES: None ABSTAIN: None 3. An ordinance amending Chapter 5 "Animals and Fowl" and Sections 30-29 and 30-88-2 of the Roanoke County Code to provide for definitions and to establish standards for Residential Chicken Keeping. Mr. Thompson discussed the proposed changes to the County Code and Zoning Ordinance, including definitions. He reviewed various requirements including that the property owners are required to reside on the property and the chickens cannot run at large. He stated chickens are currently allowed only in the agricultural zoning and that these proposed regulations will not apply to the agricultural areas. He reviewed the proposed ordinance. Mr. Radford inquired if residential covenants would supersede the ordinance regulations of having Page 4 of 6 ROANOKE COUNTY PLANNING COMMISSION MINUTES AUGUST 7, 2012 chickens. Mr. Thompson affirmed this issue. Mr. Marrano inquired if a permit would be required. Mr. Thompson discussed the permitting system and noted that Roanoke County Animal Control would also have access to the information. Mr. Jarrell inquired about lot size. Mr. Thompson affirmed that no minimum lot size would be included in the Zoning Ordinance since most restrictions can be located in the Animal and Fowl portion of the County Code. Mr. Marrano noted that the wild birds were louder than the chickens during the site visits. He stated it is a growing movement and life concept. Mr. Radford concurred it is becoming a mainstream trend. Mr. Radford opened the public hearing for public comment. With no citizens requesting to speak, Mr. Radford closed the public hearing. Mr. Peters made a motion to recommend approval of the ordinance amendment, Mr. Jarrell discussed the necessity of creating this ordinance due to the increasing interest of citizens to have chickens in residential areas. Mr. Thompson called the roll and the motion passed (4-0) with the following vote: AYES: Jarrell, Marrano, Peters, Radford NAYES: None ABSTAIN: None Final Orders 1. The petition of South Peak Residences LLC, et al to rezone 11.411 acres from R-3, Medium Density Multi-Family Residential District, and C-2C, General Commercial District, with conditions, to R-4C, High Density Multi-Family Residential District, with conditions, identified as Area "A" on the Concept Development Plan for 176 multi-family residential units; and to rezone 11.940 acres from R-3, Medium Density Multi-Family Residential District, to R-3C, Medium Density Multi-Family Residential District, with conditions, identified as Area "B" on the Concept Development Plan with a proffered density limit of 23 single family residential units, involving several properties (077.20-01-48.01-0000 and 077.20-01-50.00-0000; and portions of 077.20-01-52.00-0000 and 087.08- 03- 11.00 -0000) located at 4240 Elm View Road, 4252 Elm View Road, and 4486 Summit Street, Cave Spring Magisterial District was approved by the Board of Supervisors at a Public Hearing on July 24, 2012. Citizen Comments With no citizens requesting to speak, Mr. Radford closed the citizen comment period. Commissioners' and Staff Comments Mr. Radford requested an update on the petition of Old Heritage Corporation. Mr. Thompson discussed this issue, noting VDOT is currently reviewing the traffic impact analysis submitted by the petitioner. Mr. Peters made a motion to cancel the Planning Commission Work Session and Planning Commission Public Hearing on September 4, 2012, which passed 4-0.
