HomeMy WebLinkAbout3/15/2022 - Minutes "r ROANOKE COUNTY rr PLANNING COMMISSION PUBLIC HEARING MINUTES MARCH 15, 2022 Commissioners Present: Mr. Kelly McMurray, Chairman Mr. Rick James Mr. Wayne Bower Commissioners Absent: Mr. Troy Henderson, Vice-Chairman Mr. Jim Woltz Staff Present: Mr. Philip Thompson, Secretary Ms. Rachel Lower, Senior Assistant County Attorney Ms. Rebecca James Ms. Cecelia Thomas, Recording Secretary Call to Order Mr. McMurray called the meeting to order at 6:10 p.m. Approval of Agenda Mr. James made a motion to approve the agenda, which passed 3-0. Approval of Minutes Mr. Bower made a motion to approve the minutes from the March 1, 2022, meeting, which passed 3-0. Discussion of Zoning Ordinance Amendments Ms. James reviewed the Franklin County code defining and regulating food trucks. She discussed the potential requirement of inspections from the Virginia Department of Health and Fire Safety. Ms. James questioned if the Planning Commissioners recommend restricting food trucks in any zoning districts. Mr. James noted that he did not think it would be wise to immediately exclude any zoning districts due to the variety of uses food trucks provide. Mr. Thompson noted that he agreed that districts should not be restricted, and questioned if the County should regulate where the vehicles are allowed to park. He commented that needing consent from the landowner to be on the property would be essential. He suggested regulating outdoor seating for the food trucks. He discussed process of acquiring a zoning permit, and discussed whether the acquisition of a zoning permit should be before or after acquiring a health department inspection. Mr. McMurray noted the differentiation between food delivery vehicles and food trucks where the food is prepared to clarify the definition of food truck. Mr. Thompson questioned the duration that a food truck would be allowed to be parked at a location due to it being considered a temporary use permit. Ms. Thomas noted a parcel in Forest that has multiple food trucks parked as permanent uses. She noted the importance to differentiate between a food court layout where food trucks are parked for months, if not all year round, compared to a food truck that is parked for an afternoon. Mr. McMurray questioned if there would be a regulation on hours of operation, which would also have to abide by noise and light restrictions. Mr. Bower questioned if the permit would need to be annually or bi-annually renewed, and recommended it be consistent with what is required by the health department. Mr. ROANOKE COUNTY PLANNING COMMISSION MINUTES MARCH 152022 Thompson questioned if businesses with multiple food trucks would need to acquire permits for each vehicle, it was decided they should. Mr. James noted he would want the code to be minimal to allow businesses to operate, but not if it would cause problems for Zoning staff. Mr. Thompson noted that it would be important to ensure that food trucks are not blocking access, sight distance, or hindering handicap accessibility. Ms. James presented a use that does not currently have a definition that was presented by Jill Loope. Mr. Thompson introduced the information regarding having a hatchery in Roanoke County. The Planning Commissioners discussed the possibility of having a hatchery and similar types of agriculture allowed in AG and I-1 or 1-2. Mr. Thompson discussed the problems of creating a new use rather than adjusting an existing use to allow for a hatchery. Hatchery was defined, and it was discussed as to how to address it within the ordinance. Mr. Thompson noted the master plans that are already in place at the industrial parks in the County, and they do not have hatcheries listed as a permitted use in the definition. He noted that if they revise the existing code to allow hatcheries in industrial areas, amendments would still have to be made to the master plan for them to be allowed in the industrial park. Discussion of Upcoming Planning Commission Meetings Mr. Thompson discussed the upcoming schedule for the Roanoke County 200 Comprehensive Plan spring meeting dates. He explained the changes to the schedule compared to the fall schedule. Mr. Thompson recommended canceling the Planning Commission's April 19, 2022 meeting. Mr. James made a motion to cancel the April 19, 2022, meeting, which passed 3-0. Citizen Comments There were none. Comments of Planning Commissioners and Planning Staff Mr. McMurray noted he was excited to see citizen interest in the 419 Town Center Design Guidelines meeting. Mr. Thompson noted that the meeting was well attended, and noted the excitement from the community. Ms. James discussed the upcoming applications that will come before the Planning Commission in May. Mr. Thompson informed the Planning Commissioners of the Community Meeting for ABoone Realty, Inc. on March 16, 2022, at 6:30 p.m. at the Fire and Rescue Training Center on Kessler Mill Road. Mr. Thompson noted that Mr. Condyles will be starting to work on the ordinance for Broadcasting Towers on April, 1, 2022. He informed the Planning Commissioners about the second community meeting for the Route 460 Land Use and Connectivity Study on May 18th. He also noted that Burlington will be moving to Tanglewood in the retail space previously occupied by SteinMart. Adiournment Mr. Bower made a motion to adjourn, which passed 3-0.
