Consent Agenda
Mr. Thompson provided a brief overview of the petition of' Larry and Rhonda Conner,
including a brief history of the property and surrounding zoning designabon. Mr.
Thompson and the Commissioners discussed, the construction history and site plan of
the property,

and conditions for the proposed use. Ms. Cronise stated the petitioner will provide a
traffic impact analysis for review prior to the public hearing. Mr. Thompson discussed
the site plan review process.
Ms. Pattisall provided a brief overview of the petition regarding Pelewoo Properties LLC,
including surrounding zoning and future land use designations. She stated the
proposed use of the property will include the sale of used vehicles.
Mr. Patriarca discussed the Charles S. Wells petition, including a brief history of the
property, surrounding zoning, future land use, and proposed proffered conditions. He
discussed the current use of the property.
Mr. Marrano made a motion to approve the consent agenda, which passed 4 -0.
Commissioners' and Staff Comments
Mr. Thompson and the Commissioners discussed which site they planned on visiting.
With no further comments, Mr. Peters adjourned the work session at 4:31 p.m. for site
viewing.
EVENING SESSION
Mr. Peters called the Public Hearing to order at 7:00 p.m. Mr. Woltz gave the invocation
and led the pledge of allegiance.
1. The petition of Wendy's of Western Virginia, Inc. to obtain a Special Use Permit
in a C -2S, General Commercial, District with Special Use Permit to increase a
drive -in or fast food restaurant by more than ten percent (10 %) on
approximately 1.296 acres, located at 4369 and 4377 Electric Road, Cave
Spring Magisterial District. Mr. Thompson presented the staff report, including a
brief history of the property, future land use, surrounding zoning, and suggested
condition. He stated property access, traffic signaling, and fire and rescue
issues would be addressed during the site plan review process.
Mr. Marrano inquired about the conceptual building plans. Mr. Thompson
discussed this issue, noting the conceptual plans have not been finalized. Mr.
Marrano inquired about traffic circulation. Mr. Thompson discussed this issue.
Mr. Peters inquired about signage. Mr. Thompson discussed this issue, noting
that since it is an - existing - building the petitioner is permitted to reface the
current sign.
Mr. Scott Quesinberry, Wendy's of Western Virginia, Inc., discussed the flow of
traffic and stacking of vehicles. He stated the franchise would like a more
modern facility for the community. He stated the building plans will be value
engineered for 2014.
Mr. Marrano inquired about outdoor seating. Mr. Quesinberry discussed this
issue, stating consumers have requested outdoor facilities. Mr. Marrano

inquired about plans regarding parking and entrances. Mr. Quesinberry
discussed this issue. Mr. Peters inquired about the construction timeline. Mr.
Quesinberry discussed this issue, noting they plan to engage a local engineer
by January, 2014. Mr. Peters inquired if the current facility would remain open
during the construction. Mr. Quesinberry discussed this issue, noting public
safety will be a primary factor. Mr. Woltz expressed appreciation to the
petitioner for the company's continued investment in the community. Mr. Jarrell
discussed the current signage, noting it is sufficient since it is an existing
business.
Mr. Peters opened the public hearing for public comment. With no citizens to
speak, he closed the public hearing.
Mr. Woltz made a motion to recommend approval of the rezoning with the
following condition:
1. The site shall be developed in general conformity with the Wendy's
Preliminary Site Plan dated December 14, 2012.
Mr. Thompson called the roll and the motion passed (4 -0) with the following vote:
AYES: Jarrell, Marrano, Peters, Woltz

2. The petition of Seventh Day Adventist Reform Movement to obtain a Special Use
Permit in a C -2, General Commercial, District for the operation of a religious
assembly on approximately 11.685 acres, located at 5248 Hollins Road, Hollins
Magisterial District. Ms. Pattisall presented the staff report, including a brief
history of the church, future land use, surrounding zoning, and property access.
Mr. Marrano inquired about citizen concerns regarding the request. Ms. Pattisall
stated she has not received any adverse calls regarding the petition. She
discussed Type C buffering requirements.
Mr. Peters opened the public hearing for public comment. With no citizens to
speak, he closed the public hearing.
Mr. Jarrell made a motion to recommend approval of the special use permit with
one condition:
1. General conformance with the concept plan prepared by Jerome Henschel
Architecture and dated February 26, 2013.

3. The petition of Mount Union Church of the Brethren Trustees to obtain a Special
Use Permit in an AR, Agricultural /Residential, District for the operation of a
religious assembly on approximately 5.45 acres, located at 9240 Bent Mountain
Road (near its intersection with Airpoint Road and Tinsley Lane), Windsor Hills
Magisterial District. Ms. Pattisall presented the staff report, including a brief
history of the church, future land use designation, surrounding zoning, and
proposed site plan.
Mr. Peters opened the public hearing for public comment. With no citizens to
speak, he closed the public hearing.
Mr. Woltz discussed the importance of helping the church because it is a
positive anchor in the community.
Mr. Woltz made a motion to recommend approval of the special use permit with
the following condition:
1. General conformance with the concept plan prepared by Hughes
Associates, Architects & Engineers, dated February 27, 2013.
Mr. Thompson called the roll and the motion passed (4 -0) with the following
vote:

4. The petition of Seaside Heights, LLC, to amend the proffered conditions and
proffered Master Plan and to obtain a Special Use Permit in a C -2S, General
Commercial, District with Special Use Permit for the operation of a drive -in or
fast food restaurant on approximately 2.088 acres, located at 4510 Brambleton
Avenue, Cave Spring Magisterial District. Mr. Patriarca presented the staff
report, including a brief history, surrounding zoning, and future land use. He
reviewed the proffered conditions and the concept plan, including property
access and parking analysis.
Mr. Marrano inquired about the traffic impact analysis (TIA) and the level of
service rating for the intersection located at Brambleton Avenue and Colonial
Avenue. Mr. Patriarca discussed this issue.
Mr. Ben Crew, Balzer and Associates, Inc., discussed the TIA and the method
used for calculating the level of service rating. He stated the petitioner's intent
for the property has always been retail and fast food. He stated the petitioner
does not want to lease to competing business. He stated currently a business
which would not require the special use permit is considering leasing the
property. He discussed the reasons for the level of service rating.
Mr. Stan Seymour, Seaside Heights, LLC, discussed previous traffic concerns
of citizens on Springlawn Avenue, noting these issues no longer exist. Mr.
Marrano stated the intersection remains an issue. Mr. Seymour discussed this

issue. Mr. Marrano inquired about the design of the proposed business. Mr.
Seymour discussed this issue. Mr. Marrano inquired about loading and
unloading of supply trucks. Mr. Seymour stated the trucks will be unloaded
behind the building and supplies taken into the building by hand - trucks.
Mr. Peters expressed concern regarding tractor - trailers being on the roadway.
Mr. Jarrell noted they are currently widening Route 220 which should ease
some of the burden at the intersection. Mr. Woltz noted property could
potentially have three separate storefronts. Mr. Seymour discussed the status
of a potential tenant. Mr. Woltz asked if it would help retain the potential tenant
if the request is approved. Mr. Seymour affirmed it would help.
Mr. Marrano inquired about adherence to conditions regarding the appearance
of the building. Mr. Seymour discussed this issue.
Mr. Peters opened the public hearing for public comment. With no citizens to
speak, he closed the public hearing.
Mr. Marrano made a motion to recommend approval to amend the proffered
conditions and proffered Master Plan and to obtain a special use permit for a
drive -in or fast food restaurant. The amended proffers are:
1. The development of the property shall substantially conform with the site
plan entitled "Bojangles — Master Plan" dated February 27, 2013, last
revised April 12, 2013, attached as Exhibit A, with driveway access only
from Brambleton Avenue and Merriman Road, subject to those changes
required by Roanoke County during comprehensive site plan review.
2. The exterior of the fast food restaurant to be constructed on the Property
shall substantially conform to the photographs attached as Exhibit B.
3. All building exterior walls shall be brick from grade to eave.
4. The Merriman Road driveway shall be designed to prohibit right turns
onto Merriman Road.
5. Signage placed on each building shall occupy less than 5% of the
building fagade area for each building.
6. Any freestanding sign shall be a monument style not to exceed 5 feet in
- height or 7- feet in width, and shah have brick construction to match the
buildings.
7. The top of any light fixture shall not exceed 15 feet.
8. The sides and rear of the dumpster enclosure shall be brick construction
to match the buildings.
9. Dumpsters shall not be emptied between the hours of 10:00 pm and 7:00
am.

10. Portions of the front yards along Colonial Avenue and Merriman Road
rights -of -way designated on the masterplan for landscaping shall remain
as open green spaces, and landscaped with a combination of flowers,
shrubs, ground cover or trees. These subject frontages shall be
professionally landscaped per Roanoke County right -of -way and street
side planting requirements.

Final Orders
1. The petition of April Caudle to obtain a Special Use Permit in a R -2, Medium
Density Residential, District for the operation of a family day care home on
approximately 2.00 acres, located at 5629 Cove Road near the Glen Haven,
Montclair Estates and Glen Cove subdivisions, Catawba Magisterial District, was
approved by the Board of Supervisors at a Public Hearing on April 23, 2013.
Citizen Comments
With no citizens requesting to speak, Mr. Peters closed the citizen comment period.
Commissioners' and Staff Comments
Mr. Marrano discussed the regional surface transportation funding program, noting
greenways should be the first priority. He discussed the importance of the completion
of the Roanoke River Greenway. He stated citizens are using the newly constructed
walkway through the wetlands at the South Roanoke County Library. He stated funding
for improvements to Plantation Road should be the second priority and Park and Ride
should be the third priority. Mr. Thompson discussed the status of the Metropolitan
Planning Organization (MPO) applications for additional funding, noting the Roanoke
River Greenway is a multi -phase project.
With no further business or comments, Mr. Peters adjourned the meeting at 7:57 p.m.
